The Korea's Consumer electronics industry has exhibited a spectacular growth in the last three decades, expanding into one of the most important industries in Korea in many respects. One interesting aspect of the industry is the dominant role played by the Big Three of the industry, Gumsung, Samsung, and Daewoo. Since 1984, the three companies have accounted for about 90% of the sales in key items such as color TV, VTRs, refrigerators, and washers. The Big Three not only dominated the manufacturing stage, but also the distribution stage of the industry through their networks of exclusive dealers that constitute the major part of the distribution market. In this study, we analyzed the effects of the exclusive dealing by the Big Three on the efficiency of the Korean economy. We find that exclusive dealing by the Big Three could seriously constrain competition in both the manufacturing and distribution stages of the industry. Exclusive dealing by the Big Three effectively forcecloses the market for most other manufacturers as well as deterring entry into the manufacturing stage by potential entrants. Further, it impedes the growth of distributors that achieve the economies of scale and scope and restricts competition by the Big Three. In contrast, we could find little evidence that exclusive dealing by the Big Three is pro-competitive or enhances welfare. As a remedy to this problem, we suggest that the Fair Trade Commission of Korea should regulate the exclusive dealing by the Big Three, thus opening the door for the growth of distributors that are not bound by an exclusive dealing relationship with any of the Big Three. Put differently, we urge the Korean Fair Trade Commission to apply the Article 23 (5) to the exclusive dealing by the Big Three. Article 23 (5) that states that unfair restrictive dealing is illegal has never been clarified by the FTC. We believe that our analysis could also serve as a basic for the clarification of the article in general.
At the outset of import liberalization, most economists expected a significant drop in the prices of domestic goods that faced foreign competition. However, it is now generally acknowledge that a significant drop in prices of those goods has not occurred. A common claim is that the prices did not drop significantly because the major importers of many imported goods were also the domestic producers of competing goods. The objective of this paper is to analyze the welfare effect of importation by domestic firms that produce competing goods, to identify the factors that facilitate such business practices, and to formulate a policy that could improve the welfare. We proved that importation by competing domestic firms definitely raises the prices of both imported and domestic goods compared to the situation where foreign goods are imported by non-producers, ceteris paribus. The intuition behind this result is that since a producer-importer is essentially a cartel, its overall profit maximization requires reduced competition between the products that it sells. On the other hand, if a producer-importer is more efficient at distrinbution than a simple importer, the comparison between the two cases is a priori indeterminate. We also find that the industries in which domestic producers are actively involved in importing competing goods are the ones in which the distribution channels are tightly controlled by importer-producers. This finding suggests that exclusive dealing contracts, which work as an entry barrier, may be the source of importing by domestic producers. We argue that in a country such as Korea, where financial market is highly incomplete, tight control of the distribution channels by oligopolistic manufacturers is likely to be an effective entry barrier that leads to importing by domestic producers of similar goods. We further argue that seemingly superior distribution costs of importer-producers is likely to be a result of market foreclosure which would disappear once the entry barrier of exclusive dealing contracts is removed. Above findings suggest that market imperfections are the source of importation by domestic competitors, which in turn constitutes a market imperfection in itself and reduces consumer welfare. As potential remedies, we considered three alternatives; direct price control by the government over the imported goods sold by major domestic producers, regulation of trade itself between major producers, and regulation of exclusive dealing contracts. For reasons both theoretical and pratical, we find that the last alternative is the most attrative. Prohibiting exclusive contracts between manufacturers and dealers in industries where exclusive dealing contracts are a significant entry barrier is expected to break up the importer-producer cartel and improve the welfare.
Recently, the Korean government has announced a stream of countermeasures for stabilizing petroleum product prices. Especially, the Fair Trade Commission proposed a transaction guideline focusing on the petroleum-product blending. The main purpose of this study is to suggest the policy options to induce and promote petroleum-product blending. For this purpose, this paper describes the changes in domestic systems related to petroleum-product blending. In addition, it discusses the major topics for inducing and promoting petroleum-product blending. It would be prerequisites to alleviate or demolish the requirements of separate storage by supplier and exclusive dealing. These options would result in the price decreases at the stages of refinery and gas station. Due to the legal constraint of law revision, it should be also considered to increase more gas stations in wholesale marts and self or franchised independent gas stations.
This study conducted a survey on 290 employees in 6 theme western restaurants, proposing differences in the menu planning of western food enterprises based on the factors that influence on the inside and outside of western restaurants as well as the theme industries in order to clear up the characteristics peculiar to and factors related to the menu planning of western food enterprises. The results are as follows. According to the results, even with same foodservice industries, they have to search for their own exclusive menu from a marketing aspect because of the full of ups and downs based on the dealing items: for six western restaurants by theme, it showed that there is a significant difference in marketing factors. Particularly, they have to plan these points- considered menu, given that general flavor is the most important point, followed by environment or atmosphere and service. In the result, it should not only apply the developed menu according to industries and dealing items differently, but also arrange a comfortable atmosphere and kind services, centering on health food in the select menu of mid and low prices verified above, through a sufficient location survey in advance and a firm preparation accompanied by consumers.
It has been subject to question whether a conventional traffic signal controller can support efficient operation at grade intersections in which vehicles and tram lines cross concurrently. This study proposes a list of functional requirements for a traffic signal controller to support effective operation of trams at such an intersection. The considered details includes the combinations of geometric conditions at which vehicle, bus, and tram lines are aligned, the types of exclusive tram signals, and the combinations of various signal phases, including exclusive tram phases, which are currently undefined in the nation. The results suggest that the controller should be capable of dealing with the NEMA standard overlap relays and a quadruple-ring phase representation scheme.
Recent Discussions on Third-Party Funding (TPF) in the forums of UNCITRAL, ICSID, and ICC are making different levels of progress towards finalizing the rules. However, they also have similarities in dealing with legal issues related to TPF, such as definitions, disclosure, allocation of costs, and security for costs. International treaty tribunals have dealt with TPF issues, too. When it comes to the standing of funded claimants, the tribunal in Ambiente v. Argentina did not accept the argument that claimants were controlled by the TPF provider. Concerning the scope of the disclosure, the tribunal in Tennant v. Canada ordered the disclosure of the TPF arrangement. As for the allocation of costs, the tribunal in Kardassopoulos v. Georgia noted that there is no reason why a TPF agreement should be treated differently than an insurance contract. Regarding the security for costs, the tribunal in South American Silver v. Bolivia considered the mere existence of a third-party funder as not an exclusive factor to determine costs in the earlier stage of the proceedings. Lastly, relating to TPF as a ground for annulment, the tribunal in Teinver v. Argentina declined the respondent's argument that the TPF agreement was the vehicle of fraud.

The removal of oil spilled by the sinking of a foreign ship in Korea's Exclusive Economic Zone (EEZ) began in May 2019 four years after the ship sunk near Jeju Island. The cleanup was conducted by a foreign company that was contracted to the ship-owner's protection & indemnity (P&I) insurance company. In contrast to the time taken to begin the cleanup, the operation itself was completed in just 22days. Compared to similar cases, the decision to begin the removal was a delayed one. This study analyzes all 93 documents related to the ship's sinking and the eventual cleanup, confirming delays in administrative decision-making on the removal, and identifies factors that influenced this delay. These factors include a neglect of accident-related data verification, and other, legal, technical, environmental, and human aspects. Finally, this study suggests ways to improve decision-making efficiency. As the first study dealing with the cleanup in the EEZ, this research is expected to facilitate decision-making and influence the formulation of policies in the future.
The short animation directed by Sang-Ho Yeon has led the sympathy and reflection of audiences through reveling the violence of the military in the form of the social criticism film. The explores the social value of animation by the content of social criticism, not for entertainment uses but for public interest. This research addresses how the function of social criticism implements in animation film, especially, its narratives and direction. In the light of this, firstly, literature will review the general characteristics of social criticism films, Secondly, based on literature reviews, analysis tools will be drew, thirdly, the case study regarding will be processed by focusing on The function of social criticism, the technique of direction and expression of animation. As a result of this research, shows unique traits because of the hierarchical and exclusive characteristics of military culture, which differs from general characteristics of social criticism films dealing with historic and social issues. In addition to this, the function of social criticism is effectively implemented in animation film, by the creative narratives and technique of direction by a director, Sang-Ho Yeon.
Objectives : This study has been carried out to look into the methods of early treatment of cerebral palsy and the treatment effect by ages. Methods : The fifteen theses dealing with treatment effects by ages were analyzed, which were selected from the 121 theses retrieved out of the wu-ruan(五軟), wu-chi(五遲), wu-ying(五硬), naotan(腦癱), naoxing-tanhuan(腦性癱癱), during the period between the January 2004 to August 2008 by using the China Academic Journal(CAJ) of China National Knowledge Infrastructure(CNKI). Results : 1. Among the study objects in the 15 theses, it was identified that there were 1.97 times more boys with cerebral palsy than that of girls, and it appeared that there was no significant relationship between gender and the treatment. 2. The early treatment referred to the treatment which was carried out based on the early diagnosis within 6 months to one year after the birth. This is the time when the adaptability and plasticity of the brain are high, and it was found out that the treatment effective as babies are young. 3. For the treatment of cerebral palsy, the combination of Traditional Chinese and Western Medicine Therapy was more frequently used than the exclusive Chinese medical treatment method, and it was more effective. Especially in the case, the Chinese medical treatment was focused on the acupuncture and the Tuina Massage. Conclusions : 1. For the treatment of cerebral palsy, when the age between one and two years old was established as the standard. The younger the babies were, the higher treatment effects were obtained. 2. It appeared that the early treatment of oriental medicine had relatively excellent effects on cerebral palsy, but it turned out that we needed more studies for accurate results.
Objective : One of the unique syndromes in Asian traditional medicine named 'heat entering the blood chamber(熱入血室, HEBC)' first appeared in Shanghanlun(傷寒論) and Jinguiyaolue(金匱要略) written by Zhangzhongjing(張仲景) who is the most famous doctor in ancient China. Method : Through comparison between Huangdineijing(黃帝內經), Shanghanlun(傷寒論), Jinguiyaolue(金匱要略) and other medical texts, the correct meaning, causes and mechanisms of HEBC can be analysed and organized to suggest new view of HEBC in modern society. Result : This syndrome is usually occurred in women during catching cold and menstruation, accompanying alternation of chillness and fever, pseudo-malaria, delirium, raveled chest(結胸), uterine hemorrhage, etc. The main sign of this syndrome, delirium belongs to the category of liver disease and fever in Huangdineijing(黃帝內經) which is a document more early published than Shanghanlun. Although there are still many other comprehensions about what blood chamber is, it could be the same as uterus according to Huangdineijing, it is relevant to the control of menstruation and emotions, and the function of liver and thoroughfare vessel(衝脈). Conclusion : HEBC is a syndrome exclusive to women, caused by their unique physical and psychological characteristics. It's beginning can be found in Huangdineijing, and by Shanghanlun and Jinguiyaolue, its concept as a single disease pattern becomes established. In other words, HEBC is a complex disease related to menstruation and its related hormonal dysfunctions, closely related to PMS, menopausal syndrome of today. Physical symptoms accompanied by psychological anxiety and fear is characteristic of this condition. Therefore gynecological approaches as well as socio-cultural issues related to women in modern society must be adopted when dealing with HEBC.
