Electronic Discovery in International Arbitration -Focusing on the Establishment of Rules Regarding Electronic Discovery- (국제중재에서의 전자증거개시 -전자증거개시를 규율하는 규정의 제정을 중심으로-)

  • Electronic discovery refers to the discovery of electronically stored information. The differences between producing paper documents and electronic information can be categorized into seven groups: massive volume, persistence, dynamic and changeable contents, metadata, environment-dependence, dispersion and searchability. Since these differences make the discovery more expensive and less expeditious, it is necessary to limit the scope of discovery. Accordingly, a number of arbitration institutions have already introduced rules, guidelines or protocols on electronic discovery. ICDR guidelines take a minimal approach and address only the proper form of electronic document. CIArb Protocol is intended to act as a checklist for discovery of electronic data. CPR Protocol offers four modes of discovery of electronic documents ranging from minimal to extensive among which the parties may choose the way of electronic discovery. IBA Rules on Evidence and ICC Rules are silent on the issue of electronic discovery, however, working parties of the ICC are considering updates to the rules to deal with electronic discovery. It is disputed whether rules, guidelines or protocols on electronic discovery is necessary or appropriate. Although some have suggested that existing rules can make adequate provision for electronic discovery, it is more desirable to prepare new rules, guidelines or protocols to make arbitrators and counsels be familiar with electronic discovery process, to provide an adequate standard for electronic discovery and to limit the time and cost of electronic discovery. Such rules on electronic discovery should include provisions regarding the form of electronic document production, conference between parties regarding electronic discovery, keyword search, bearing the expenses to reduce disputes over electronic discovery.

  • Currently, developed technologies for semantic web services discovery are based on ontologies. These ontologies are DAML-S(DARPA Agent Markup Language for Services) and Process Handbook Project of MIT. These technologies have some problems for intelligent web services discovery. So, in this paper we analyzed those ontologies and proposed TM-S, Topic Maps for Services. TM-S is the presentation model for semantic web services. And TM-S includes benefits and complements weaknesses of those ontologies. And we proposed TMS-QL, TM-S Query Language. TMS-QL is query language for intelligent web services discovery. At last, we designed and implemented intelligent web service discovery system that deals TM-S ontology and TMS-QL

Causality, causal discovery, causal inference and counterfactuals in Civil Engineering: Causal machine learning and case studies for knowledge discovery

  • Much of our experiments are designed to uncover the cause(s) and effect(s) behind a phenomenon (i.e., data generating mechanism) we happen to be interested in. Uncovering such relationships allows us to identify the true workings of a phenomenon and, most importantly, to realize and articulate a model to explore the phenomenon on hand and/or allow us to predict it accurately. Fundamentally, such models are likely to be derived via a causal approach (as opposed to an observational or empirical mean). In this approach, causal discovery is required to create a causal model, which can then be applied to infer the influence of interventions, and answer any hypothetical questions (i.e., in the form of What ifs? Etc.) that commonly used prediction- and statistical-based models may not be able to address. From this lens, this paper builds a case for causal discovery and causal inference and contrasts that against common machine learning approaches - all from a civil and structural engineering perspective. More specifically, this paper outlines the key principles of causality and the most commonly used algorithms and packages for causal discovery and causal inference. Finally, this paper also presents a series of examples and case studies of how causal concepts can be adopted for our domain.

  • The purpose of this study is to suggest the directions for record and information management (RIM) strategies for Korean companies as preparation for e-Discovery risks. It begins with the articulation key concepts and some RIM issues of e-Discovery, which is governed by the U.S. Federal Rules of Civil Procedures. It analyzes three lawsuit cases for which Korean companies were sued by North American companies in order to determine the main reasons behind the defensible disposition failures. Based on the analyses, it suggests the RIM strategic policies for preparing the e-Discovery, including the development of inventories for documents and ESI in their possession, custody, or control; ensuring legal hold programs in good faith; and making defensible retention policies.

In this paper, e-Discovery system applies to the methods and security of incorrect logistics information and evidential data about illegal products of agriculture & livestock, it is necessary as studies about compensation and liability.

  • As the domestic companies which have made inroads into foreign markets have more lawsuits, these companies' demands for responding to E-Discovery are also increasing. E-Discovery, derived from Anglo-American law, is the system to find electronic evidences related to lawsuits among scattered electronic data within limited time, to review them as evidences, and to submit them. It is not difficult to find, select, review, and submit evidences within limited time given the reality that the domestic companies do not manage their records even though lots of electronic records are produced everyday. To reduce items to be reviewed and proceed the process efficiently is one of the most important tasks to win a lawsuit. The Predictive Coding is a computer assisted review instrument used in reviewing process of E-Discovery, which is to help companies review their own electronic data using mechanical learning. Predictive Coding is more efficient than the previous computer assister review tools and has a merit to select electronic data related to lawsuit. Through companies' selection of efficient computer assisted review instrument and continuous records management, it is expected that time and cost for reviewing will be saved. Therefore, in for companies to respond to E-Discovery, it is required to seek the most effective method through introduction of the professional Predictive Coding solution and Business records management with consideration of time and cost.

Ontology describing Process Information for Web Services Discovery (웹 서비스 발견을 위해 프로세스 정보를 기술하는 온톨로지)

  • Until now, most semantic web service discovery research has been carried out using either Web Service Modeling Ontology (WSMO) or a profile of OWL-based Web Service ontology (OWL-S). However, such efforts have focused primarily on service name and input/output ontology. Thus, the internal information of a service has not been utilized, and queries regarding internal information such as 'Find book-selling services allowing payment after delivery' are not addressed. This study outlines the development of TM-S (Topic Maps for Service) ontology and TMS-QL (TM-S Query Language), two novel technologies that address the aforementioned issues in semantic web service discovery research. TM-S ontology describes the behavior of services using process information and consists of three sub-ontologies: process signature ontology, process structure ontology and process concept ontology. TMS-QL allows users to describe service discovery requests.

A Framework for Developing interoperable Knowledge Discovery System

  • The development of web-aware knowledge discovery system has received a great deal of attention in recent years. It plays a key-enabling role for competitive businesses in the E-commerce era. One of the challenges in developing web-aware knowledge discovery systems is to integrate and coordinate and coordinate existing standalone or legacy knowledge discovery applications in a seamless manner, so that cost-effective systems can be developed without the need of costly proprietary products. In this paper, we present an approach for developing a framework of web-aware interoperable knowledge discovery system to achieve this purpose. This approach applies RMI and high-level code wrapper of Java distributed object computing to address the issues of interoperability in heterogeneous environments, which includes programming language, platform, and visual object model. The effectiveness of the proposed framework is demonstrated through the integration and extension of the two well-known standalone knowledge discovery tools, SOM_PAK and Nenet. It confirms that a variety of interoperable knowledge discovery systems can be constructed efficiently on the basis of the framework to meet various requirements of knowledge discovery tasks.

Emodin Inhibits Breast Cancer Cell Proliferation through the ERα-MAPK/Akt-Cyclin D1/Bcl-2 Signaling Pathway

  • Background: The aim of the present study was to investigate the involvement of emodin on the growth of human breast cancer MCF-7 and MDA-MB-231 cells and the estrogen (E2) signal pathway in vitro. Materials and Methods: MTT assays were used to detect the effects of emodin on E2 induced proliferation of MCF-7 and MDA-MB-231 cells. Flow cytometry (FCM) was applied to determine the effect of emodin on E2-induced apoptosis of MCF-7 cells. Western blotting allowed detection of the effects of emodin on the expression of estrogen receptor ${\alpha}$, cyclin D1 and B-cell lymphoma-2 (Bcl-2), mitogen-activated protein kinases (MAPK) and phosphatidylinostiol 3-kinases (PI3K). Luciferase assays were emplyed to assess transcriptional activity of $ER{\alpha}$. Results: Emodin could inhibit E2-induced MCF-7 cell proliferation and anti-apoptosis effects, and arrest the cell cycle in G0/G1 phase, further blocking the effect of E2 on expression and transcriptional activity of $ER{\alpha}$. Moreover, Emodin influenced the ER ${\alpha}$ genomic pathway via downregulation of cyclin D1 and Bcl-2 protein expression, and influenced the non-genomic pathway via decreased PI3K/Akt protein expression. Conclusions: These findings indicate that emodin exerts inhibitory effects on MCF-7 cell proliferation via inhibiting both non-genomic and genomic pathways.

An Efficient Cluster Based Service Discovery Model for Mobile Ad hoc Network

  • The use of web service has been increased rapidly, with an increase in the number of available services, finding the exact service is the challenging task. Service discovery is the most significant job to complete the service discoverers needs. In order to achieve the efficient service discovery, we focus on designing a cluster based service discovery model for service registering and service provisioning among all mobile nodes in a mobile ad hoc network (MANETs). A dynamic backbone of nodes (i.e. cluster heads) that forms a service repository to which MANET nodes can publish their services and/or send their service queries. The designed model is based on storing services with their service description on cluster head nodes that are found in accordance with the proposed cluster head election model. In addition to identifying and analyzing the system parameters for finding the effectiveness of our model, this paper studies the stability analysis of the network, overhead of the cluster, and bandwidth utilization and network traffic is evaluated using analytic derivations and experimental evaluation has been done.
