Study on the Improvement Plans of Condensation Defect Examples in Apartment Building (공동주택 결로 하자 사례를 통한 개선방안 도출)

  • There are main issues of defect type that condensation, concrete crack and noise in apartment buildings. Especially, according to the Apartment Defect Dispute Mediation Committee in Korea (ADDMC) at Ministry of Land Infrastructure and Transport in Korea (MLIT), condensation defects are great importance (14 percent) on whole number of reported cases of faults from 2015 in Korea. Most condensation defects have many different causes that take a toll on the resident's life and space. So it is very important to early detection and repair. For preventing the condensation in apartment buildings, there are building codes in Korea such as 'Standard of Method and Judgment for Apartment defect of investigation, Repair cost Estimate'. This research aims to study on the improvement of preventing the condensation aforementioned korea standard. Types and characteristics (opaque wall, windows, doors) of cause of occurrence and existing state condensation defect is analyzed from evaluation of real application 100 case in 2015 ADDMC data.

Improvement of Defect Checklists for the Quality Inspection of Apartment Houses (공동주택 품질점검 하자 체크리스트 개선방안)

  • The Apartment Defect Dispute Mediation Committee of the Ministry of Land, Infrastructure, and Transport received as many as 7,686 complaints regarding defects in 2021, and the conflict caused by these disputes on the defects is worsening. A quality inspection team system was established in January 2021 to address the deepening conflict, and this system prevented the emergence of defects in apartment houses before the residents moved in. Quality inspections were conducted based on the Housing Act standards, but the reality is that the standards for the ordinances are not systematic. Based on the analysis of the ordinances by the apartment quality inspection team, 23 out of 226 local governments utilized the quality inspection teams, and they had different standards for the quality inspection subjects and inspection periods. In addition, the inspection standards for the defect checklists used by the apartment quality inspection teams operated by local governments varied. A survey was conducted by apartment quality experts to tackle this problem and proposed improvement plans for the defect checklists used for the quality inspection of apartment houses.

Korean Style System Model of Financial ADR (한국형 금융ADR의 제도모델)

  • "Financial ADR" system in South Korea can be represented by so-called "Financial Dispute Resolution System", in which Financial Supervisory Service (FSS) and Financial Dispute Resolution Committee are the principal actors in operation of the system, and this is discussed as an "Administrative Financial ADR System". The system has over 10-year history since it was introduced in around 1999. Nonetheless, it was not until when financial consumer protection began to be highlighted after the 2008 financial crisis that Financial ADR system actually started to draw attention in Korea. This was because interest has been rising in "Alternative Dispute Resolution (ADR)" as an institutional measure to protect financial consumers damaged via financial transactions. However, the current discussion on the domestic Financial ADR system shows an aspect that it is confined to who is to be a principal actor for the operation of Financial ADR institution with main regards to reorganization of supervisory system. This article aims to embody these facts in an institutional model by recognizing them as a problem and analyzing the features of the Financial ADR system, thereby clarifying problems of the system and presenting the direction of improvement. The Korean Financial ADR system can be judged as "administrative model integrated model consensual model quasi-judicial model non-prepositive Internal Dispute Resolution (IDR) model". However, at the same time, it is confronted with a task to overcome the two problems; the system is not equipped with institutional basis for securing its validity in spite of the adopted quasi-judicial effect model; and a burden of operating an integrated ADR system is considerable. From this perspective, the article suggests improvement plans for security of validity in the current system and for expansion of industry-control ADR system, in particular, a system of prepositive IDR model. Amongst them, it suggests further plans for securing the validity of the system as follows; promotion to expand the number of internal persons and to differentiate mediation procedures and effect; a plan to keep a financial institution from filing a lawsuit before an agreement recommendation or a mediation proposal is advised; and a plan to grant suspension of extinctive prescription as well as that of procedures of the lawsuit.

Study on the Defects of Finishing Works of Apartment Houses during Warranty Liability Period and its Correlation (공동주택 마감공사의 하자보수기간 현황 및 연관성 연구)

  • The warranty liability period for defects in apartment buildings by work type is not based on scientific analysis, making the appropriateness of the term a culprit behind the lawsuits. Therefore, this research aims to evaluate the appropriateness of the warranty liability term of apartment buildings by identifying the current status of defects, in particular, caused by finishing works. That is because the number of defects, caused during the finishing works, accounted for the largest portion of the total defect cases of apartment buildings reported to the Apartment Defect Dispute Mediation Committee under the Ministry of Land, Infrastructure, and Transport of Korea between 2010 and 2011. The result from analyzing claims for defect repairs of the finishing works showed that most cases by work type continued to be made after two years, and only about 60% were charged within the warranty period. And, defects by work type have correlation, which needs to be considered for a better construction technique. Considering a low correlation between the possibility of defects and the construction performance rankings, which are highly relevant to the apartment preference. It is believed that there needs to be a qualification process for agencies that actually performs finishing works.
