Introduction to the Montreal Convention 1999 (New Warsaw Convention : Montreal Convention 1999 소개)

  • The Warsaw Convention of 1929 and the amendments thereto including the Hague Protocol, Montreal Protocols Nos. 1,2,3 and 4, the Guadalajara Convention and the IATA Intercarrier Agreements, which are the rules (as called "War saw System") have played as a major rule in the international air transportation for more than 70 years, will be replaced by the Montreal Convention of 1999 for its effectiveness on November 4, 2003. While a major portion of the Montreal Convention follows the language of the Warsaw System, the Montreal Convention makes significant changes to the scope and extent of the carrier's liability, expands the jurisdictions where the carrier can be sued, and recognizes the effect of code sharing on air carrier liability. The Montreal Convention heralds the single biggest change in the international aviation since the diplomatic efforts in the mid-1920's which resulted in the enactment of the Warsaw Convention. Until now, the legal liability of almost all the international air carriers has been governed by the Warsaw System. The Montreal Convention incorporates provisions of these instruments to create a single document and to set a uniform regime for carrier liability in international transportation. At the same time the issue of the low liability limits of the Warsaw has been resolved to a more satisfactory level in the Montreal Convention. The Convention has been hailed as consumer friendly and progressive in nature. If this Convention is ratified by Korea, the virtual elimination of the liability limits between the passengers and the airlines will become law by treaty. The airlines in Korea as well as Korean consumers of international air carriage will immensely benefit from the ratification. As opposed to the Warsaw Convention, the Montreal Convention has been described to be the one that is no longer a Convention for airlines, but it would serve the interests of both the consumers and the air carriers.

A Study on the Application of the New York Convention in the Recognition and Enforcement of ISDS Arbitral Awards (투자협정중재에 의한 중재판정의 승인·집행에 대한 뉴욕협약 적용에 관한 고찰)

  • As international transactions have grown more numerous, situations of disputes related to the transactions are getting more complicated and more diverse. Cost-effective remedies to settle the disputes through traditional methods such as adjudications of a court will be insufficient. There fore, nations are attempting to more efficiently solve investor-state disputes through arbitration under organizations such as the ICSID Convention, the ICSID Additionary Facility Rules, and the UNCITRAL Arbitration Rules by including the provisions on investor-state dispute settlement at the conclusion of an investment agreement. In case of an arbitration under the ICSID Convention, ICSID directly exercises the supervisorial function on arbitral proceedings, and there is no room for the intervention of national courts. In time of the arbitration where the ICSID Convention does not apply, however, the courts have to facilitate the arbitral proceedings. When the recognition and enforcement of an arbitral award under the ICSID Convention are guaranteed by the Convention, it should be considered that the New York Convention does not apply to them under the Convention Article 7 (1) fore-end. In exceptional cases in which an arbitral award under the ICSID Convention cannot be recognized or enforced by the Convention, the New York Convention applies to the recognition and enforcement because the award is not a domestic award of the country in which the recognition or enforcement is sought. It is up to an interpretation of the New York Convention whether the New York Convention applies to ISDS arbitral awards not based on the ICSID Convention or not. Although an act of the host country is about sovereign activities, a host country and the country an investor is in concurring to the investment agreement with the ISDS provisions is considered a surrender of sovereignty immunity, and it will not suffice to exclude the investment disputes from the scope of application of the New York Convention. If the party to the investment agreement has declared commercial reservation at its accession into the New York Convention, it should be viewed that the Convention applies to the recognition and enforcement of the ISDS awards to settle the disputes over an investitive act, inasmuch as the act will be considered as a commercial transaction. When the recognition and enforcement of an arbitral award on investment disputes about a nation's sovereign act have been sought in Korea and Korea has been designated the place of the investment agreement arbitration as a third country, it should be reviewed whether the disputes receive arbitrability under the Korean Arbitration Act or not.

  • This study is about the marketing mix of convention destination, aims to examine convention destination image and loyalty. In order to study the marketing mix more scientifically, this paper select those indexes which can promote the destination image but also can guide the access loyalty of exhibition participants. In addition, in order to understand the influence of marketing mix of convention destination which includes products, place, price, promotion, people, on destination image and loyalty, this research analyses the beneficial effect among variables. Based on previous research, the marketing mix of convention destination export products, place, price, promotion, people, convention image exports Cognitive images and Emotional images. The results show that, assuming that the beneficial effect of convention marketing mix on cognitive images was established partly, the beneficial effect of convention marketing mix on emotional images was established partly, the beneficial effect of marketing mix of convention destination on loyalty was established partly, the beneficial effect of cognitive images of convention destination on loyalty was established, he beneficial effect of emotional images of convention destination on loyalty was established. Based on the results of the study, a comprehensive strategic management on arketing mix of convention destination, played a profound impact on forming the image of the participants and enlivening the convention destination.

  • This study was to explore the relationships between convention mobile applications, and convention participants' satisfaction and loyalty. Recently mobile applications by using smart-phone have been utilized to provide relevant information and contents, Similarly, convention industry utilize mobile application to provide convention program, speakers, and other information and contents, However, only few research has been conducted to investigate convention mobile application characteristics and benefits. This study provides the results of convention mobile application characteristics and its impacts on participants' satisfaction and loyalty. Among convention mobile application characteristics, conveniency and information are important factors to enhance convention participants' satisfaction and loyalty. More discussion and implication is provided in the conclusion section.

  • This study examined the present condition of convention of convention in Korea and the establishment of strategies for the convention marketing. It is defined as establishing a direction of decision-making for the achievement of efficiency in the convention activities and consists of the following steps; firstly, to set up a target market through the analysis of the convention market and the itemization of the market, and then to draw up a budget and adopt a strategy of convention marketing. Based on this plan of convention marketing, I think the 7P strategy variables such as product, price, passage, and promotion, as well as the participant, physical proof, and process of service assembling should be fixed to attain the target market, for the convention industry is a field of service industry.

  • As conservation of global environment has becoming a major outstanding issue of the world, the International Maritime Organization(IMO) has been legislation a convention for prevention of air pollution from ships. By the new convention, use of air pollutants such SOx, NOx, Freon and Halin Gas shall be restricted. In this regards, analysing these requirements of the convention is required as the cinvention will also be applied in restriction of descharging exhaust gases from ships by estsblishing a requirement of Sox and NOx discharged. The purpose of this study is as follows; 1) Introdcuing of the backgrounds of legislating the convention for prevention of air pollution from ships and major contents of the convention and a countermeasuures in the convention by Korea 2) Reviewing by analyzing the influence in domestic industries concernd by restriction of SOx, NOx in exhaust gases and sulpher content of fuel oil 3) Preparing a countermeasure in the convention properly.

  • A convention is a large meeting to pursue some particular purposes by means of social interactions between participants. Therefore, the key to decide whether a convention is successful or not is that how many active people participate in a meeting. Revenues of this sort of convention depend on a registration fee of participants, so that it is possible to influence badly on a budget operation according to the fact that the number of real participants is smaller than the number of prospective participants. In conclusion, in order to have a large attendance convention organizers and managers should announce benefits by positive attitudes when participants attend a meeting. Representative methods of promotion for providing prospective participants with convention information are advertisements, P.R activities, and personal sales.

A Comparative Study on International Convention and National Legislation Relating to the Liability of the Air Carrier

  • The purpose of this paper is to review the text of national legislation relating to the carrier's liability in respect of the carriage of passengers, baggage and cargo by air in major states such as United Kingdom, Germany, France, Canada, Russia and China, and to compare the air carrier's liability under the national legislations of above states with them under the Warsaw System relating to the international carriage by air. Also this paper reviews the text of the draft legislation relating to the carrier's liability in respect of the carriage by air in Korea. The Warsaw Convention for the Unification of Certain Rules Relating to International Carriage was adopted in 1929. In 1999, the ICAO adopted the Montreal Convention for the Unification of Certain Rules for International Carriage by Air vastly modernizing the unification of private air law. The Montreal Convention replaced the instruments of the “Warsaw System”, and came into force on 4 November 2003. The Montreal Convention is not only an international convention. It has also exercised a considerable influence on national legislation. A the Convention, or certain of its principles, with the object of regulating their national air transport. The main feature of the liability regime of the air carrier under the Montreal Convention is the two-tier liability system for death or injury of the passenger with strict liability up to 100,000 SDR and presumptive liability with a reversed burden of proof without any limit above that threshold. The principles of the liability of the air carrier under the Montreal Convention have been adopted into national legislations by the United Kingdom, Germany, France, Canada, Russia and China. Now the Ministry of Justice of Korea is proceeding to make a new national legislation relating to the liability of the air carrier in respect of the carriage by air. The draft legislation of the Part VI the Carriage by Air of the Commercial Code of Korea has adopted the main principles of the liability of the air carrier under the Montreal Convention. In conclusion, the national legislation relating to the liability of the air carrier in Korea will contribute to settle efficiently the dispute on the carrier's liability in respect of the carriage of passengers, baggage and cargo by air.

  • The purpose of this study is to examine effects of sustainability of convention events on brand equity and customer loyalty. This paper also explores the mediating role of brand equity amid sustainability of convention events and customer loyalty. The four determinants ofsustainability of convention events examined in this study are economic sustainability, environmental sustainability, social sustainability and event sustainability. Brand equity refers to performance, social image, value, trust worthiness, and attachment. The findings are as follows: (1)most sustainability of convention events have a positive effect on each brand equity's elements; (2)all sustainability of convention events have a positive effect on loyalty; (3)brand equity of convention is significantly related to customer loyalty. (4)brand equity plays a mediating role between sustainability of convention and customer loyalty. The findings will not only be useful in improving the structure of sustainability of convention events, but also in enhancing competitiveness in Korea's convention industry.

A Study of Differences of Convention Advertising Satisfaction and Participation Behavior Based on Segmented Groups of Convention Advertising Attributes (컨벤션 광고속성평가에 따른 세분집단별 컨벤션 광고 만족도 및 참가행동의도 연구)

  • The purpose of this study was to investigate if there are any differences of convention advertising and participation behavior based on the segmented groups of convention advertising attributes. The research methods and contents of this study are as follows. From the literature, the measurement of convention advertising attributes, satisfaction, and participation behavior had been developed and utilized to collect the data. The results of factor analysis showed three underlying dimensions of convention advertising attributes. Cluster analysis showed that there were three different segmented groups such as negative, mediative, and positive groups of convention advertising attributes. Lastly, MANOVA showed that there were differences of convention advertising and participation behavior among the segmented groups. More theoretical and practical implication are discussed in the conclusion.
