The Harmony and Moderation of Between Defect Liability and Default Liability in the Construction Contract (도급계약에서 하자담보책임과 채무불이행책임의 조화와 중용 - 대법원 2020.6.11. 선고 2020다201156판결에 대한 고찰 -)

  • On 11 June 2021, the Supreme Court ruled that the judgment of the lower court was justified for the subject case, that the plaintiff could assert the defendant's liability for default due to incomplete performance even though the warranty period for defects which stipulated in the particular condition of the contract has expired. In Korean civil law, the concurrent between the exclusion period for defect warranty and the extinctive prescription for default liability is conceded, since the exclusion period and the extinctive prescription have their respective purposes in law, therefore these two should be judged by harmonizing them based on that they are mutually related. If the subject judgment is generalized, there is no reason to exist for the provisions of defect liability in the construction contract any longer. This study examines the subject judgments through the general theory and precedent case studies on the defect liability and default liability, then derived any problems that may arise if the subject judgment is generalized. In addition, based on a realistic model, it was suggested for a practical improvement method that both the provisions of the warranty period shall be changed realistic and to stipulate the character of its nature as written provisions in the contract.

Validation of the Korean Version of the Posttraumatic Growth Inventory-Expanded (외상 후 성장 척도 확장판(The Posttraumatic Growth Inventory-Expanded: PTGI-X)의 한국판 타당화 연구)

  • The purpose of this study was to validate the Korean version of the post-traumatic growth inventory-expanded(K-PTGI-X), which has been widely used to assess posttraumatic growth. The PTGI-X is a measure of the addition of the items to measure the existential growth as the need for modification to the factors of the 'increase of spiritual interest' in the existing PTGI is suggested. We examined the factor structure, reliability, and validity of a Korean version of the PTGI-X among 625 Korean adults who have experienced trauma events. First, EFA confirmed the appropriate PTGI-X factor structure and found that the 4-factor structure was the most appropriate. Next, as a result of CFA, it was found that the model to which correlation between items was added to the 4-factor model was good. Next, testing internal consistency, CR, and AVE of the K-PTGI-X showed that PTGI-X's items are reliable. Also, we tested the concurrent validity and discriminative validity. All of the K-PTGI-X scales significantly correlated with measures of deliberate rumination and core-belief except for the intrusive rumination. Finally, to add an understanding of K-PTGI-X, t-test according to demographic variables was conducted. Recommendations for future research and implications were discussed.

Development of Community Resources Linkage Capability Scale of Counselors (심리상담사의 지역사회자원연계 능력 척도 개발)

  • This study was intended to develop and investigate reliability and validity of a scale that can measure linkage capability of community resources of counselors. This study prepared a preliminary question consisting of a total of 42 questions in 5 areas. Then, the content validity and facial validity were verified by the counseling experts with a first-degree qualification as a counselor in Korean Counselling Psychological Association, and a total of 20 final questions of 4 areas. The final questions were conducted on psychological counselors(N=306) to investigate reliability and validity. As a result of conducting an exploratory factor analysis, validity of the two-factor structure have been verified. And In the confirmatory factor analysis, two factors were shown to be appropriate. The two-factors were named 'The collection and utilization of information' and 'Association with the Organization of Information'. Also, the scale of final selection of questions were found to have a good degree of concurrent validity, interitem consistency and test-retest reliability. The implications of the present study is significant in that it is a measure of community resources linkage capability scale of counselors. In addition, this scale is expected to be useful in Wee Class, Wee Center, Youth Counseling Welfare Center, and other counseling sites.

Evaluation of Clinical Outcomes by Therapeutic Dosing Interval of Denosumab (Prolia®) and Calcium-Vitamin D Prescriptions (Denosumab (Prolia®)의 투여 간격 및 칼슘·비타민 D 복합제제 처방 여부에 따른 임상적 결과 평가)

  • Background: Denosumab (Prolia®) is administered every 6 months for osteoporosis treatment. Co-administration of calcium and vitamin D is required to minimize hypocalcemia risk. We evaluated clinical outcomes based on the administration interval of denosumab and co-prescription with calcium-vitamin D combination products. Methods: A retrospective study was conducted using electronic medical records from 668 patients who started denosumab therapy between January 1 and December 31, 2018, at Seoul National University Bundang Hospital. Clinical outcomes, as measured by changes in T-score, were evaluated by the intervals and concurrent prescriptions with calcium-vitamin D combination products. Results: Of the 668 patients, 333 patients met the eligibility criteria. These patients were divided into two groups based on appropriateness of the administration interval: "Appropriate" (304 patients, 91.3%) and "Inappropriate" (29 patients, 8.3%). T-score changes were significantly higher in the "Appropriate" than in the "Inappropriate" group (0.30±0.44 vs. 0.13±0.37, p=0.048). At the beginning of the treatment, 221 patients (66.4%) were prescribed calcium-vitamin D combination products, but the changes in T-scores were not significantly different by the prescription status of the product (0.29±0.46 vs. 0.28±0.38, p=0.919). Conclusion: T-scores were significantly improved in patients with appropriate administration intervals. No significant changes in T-scores were observed by the prescription status with calcium-vitamin D combination products. For optimal treatment outcomes, prescribers should encourage adherence to the approved prescription information on dosage and administration, and pharmacists should provide medication counseling for patients.

  • Background: Complementary and alternative medicine (CAM) has been used frequently, and its use continues to increase in lung cancer patients, despite insufficient scientific of its efficacy. To investigate this situation, we analyzed the current awareness and use of CAM in Korean lung-cancer patients. Methods: This prospective survey-based study was performed at seven medical centers in South Korea between August and October 2019. The survey assessed general patient characteristics and the awareness and use of CAM. We analyzed differences in the clinical parameters of patients aware and not aware of CAM and of CAM non-users and users. Results: Of the 434 patients included in this study, 68.8% responded that they were aware of CAM and 30.9% said they had experienced it. In univariate analysis, the patients aware of CAM were younger with poor performance status, had advanced-stage lung cancer, received more systemic therapy, and received concurrent chemoradiation therapy (CCRT). By multiple logistic regression, younger age, poor performance status, advanced stage, and prior CCRT were identified as independent risk factors for CAM awareness. There were no significant differences in the general characteristics and cancer-associated clinical parameters of CAM non-users and users. Conclusion: Specific clinical parameters were associated with patients' awareness of CAM, although there were no significantly different characteristics between CAM users and non-users.

Impact of Climate Change on Yield and Canopy Photosynthesis of Soybean (RCP 8.5 기후변화 조건에서 콩의 군락 광합성 및 수량 반응 평가)

  • Changes in air temperature, CO2 concentration and precipitation due to climate change are expected to have a significant impact on soybean productivity. This study was conducted to evaluate the climate change impact on growth and development of determinate soybean cultivar in the southern parts of Korea. The high temperature during vegetative period, which does not accompany the increase of CO2 concentration, increased the canopy photosynthetic rate in soybean, but after flowering, the high temperature above the optimal ranges interrupts the photosynthetic metabolism. In yield and yield components, high temperature reduced both the pod and seed number and single seed weight, resulting in a reduction of total seed yield. On the other hand, the increase in CO2 concentration dramatically increased the canopy photosynthetic rate over the whole growth period. In addition, high CO2 concentration increased the number of pods and seeds, which had a positive effect on total seed yield. Under concurrent elevation of air temperature and CO2 concentration, canopy photosynthesis increased significantly, but enhanced canopy photosynthesis did not lead to an increase in soybean seed yield. The increase in biomass and branch by enhanced canopy photosynthesis seems to be attributed to an increase in the total number of pods and seeds per plant, which compensates for the negative effects of high temperature on pod development. However, Single seed weight tended to decrease rapidly by high temperature, regardless of CO2 concentration level. Elevated CO2 concentration did not compensate for the poor distribution of assimilations from source to sink caused by high temperature. These results show that the damage of future soybean yield and quality is closely related to high temperature stress during seed filling period.

  • The association between heavy metals in the blood and obesity has been examined in many studies. However, inconsistencies have been observed in the results from these studies. The present study was conducted using data from 119,181 participants of the Korea National Health and Nutrition Examination Survey (KNHANES) for 11 years in 2005 and between 2008 and 2017. The subjects with missing heavy metal blood tests, health interview data, and health examination data were excluded from the study. The study population comprised 1,844 individuals (972 men, 872 women) who were eligible for inclusion. It was found that obesity and abdominal obesity were associated with an increase in both blood mercury (P<0.001) and alanine aminotransferase (ALT) (P<0.001). After adjusting the confounding factors, those with concurrent high levels of ALT and the highest tertile of mercury showed an increased risk of obesity (odds ratio 4.46, 95%, confidence interval 2.23~8.90, P<0.001) as well as abdominal obesity (odds ratio 5.36, 95%, confidence interval 2.57~11.17, P<0.001). The interrelationship of mercury and ALT with the parameters of body mass index (P for interaction=0.009) and waist circumference (P for interaction=0.012), respectively, have been observed to be significant, suggesting that the reciprocal relationship could contribute to obesity and abdominal obesity.

Investigating the effects of non-persistent cracks' parameters on the rock fragmentation mechanism underneath the U shape cutters using experimental tests and numerical simulations with PFC2D

  • This paper aims to study the fracture mechanism of rocks under the 'u'shape cutters considering the effects of crack (pre-existing crack) distances, crack spacing and crack inclination angles. The effects of loading rates on the rock fragmentation underneath these cutters have been also studied. For this purpose, nine experimental samples with dimensions of 5 cm×10 cm×10 cm consisting of the non-persistent cracks were prepared. The first three specimens' sets had one non-persistent crack (pre-existing crack) with a length of 2 cm and angularity of 0°, 45°, and 90°. The spacing between the crack and the "u" shape cutter was 2 cm. The second three specimens" set had one non-persistent crack with a length of 2 cm and angularity of 0°, 45°, and 90° but the spacing between pre-existing crack and the "u" shape cutter was 4 cm. The third three specimens'set has two non-persistent cracks with lengths of 2 cm and angularity of 0°, 45° and 90°. The spacing between the upper crack and the "u" shape cutter was 2 cm and the spacing between the lower crack and the upper crack was 2 cm. The samples were tested under a loading rate of 0.005 mm/s. concurrent with the experimental investigation. The numerical simulations were performed on the modeled samples with non-persistent cracks using PFC2D. These models were tested under three different loading rates of 0.005 mm/s, 0.01 mm/sec and 0.02 mm/sec. These results show that the crack number, crack spacing, crack angularity, and loading rate has important effects on the crack growth mechanism in the rocks underneath the "u" shape cutters. In addition, the failure modes and the fracture patterns in the experimental tests and numerical simulations are similar to one another showing the validity and accuracy of the current study.

Effects of Cognitive Load on the Division of Labor: Working Memory and the Joint Simon Effect (인지 부하가 분업에 미치는 영향: 작업기억과 결합 사이먼 효과)

  • As social beings, we need to understand others' actions as quickly and accurately as possible. Action understanding can occur at many levels. We sometimes grasp others' intentions unintentionally. Other times, however, we have to expend effort to draw inferences about their goals. In the context of joint action, the joint Simon effect demonstrates that actors are influenced by the unintended representation of a co-actor's actions. This effect has been described as quasi-automatic, but it is unclear if the effect is automatic enough to be immune to cognitive load. Thus, we asked participants to complete a joint Simon task with or without a concurrent working memory task. One group of participants maintained a single digit in their mind during working memory load blocks (low-load group), while the other group maintained five digits (high-load group). As a result, the low-load group showed a joint Simon effect both during no-load and low-load blocks. In contrast, the high-load group had no joint Simon effect during either no-load or high-load blocks. These results suggest that the joint Simon effect is not an automatic phenomenon given that it requires cognitive resources. Actors in a joint task may represent a co-actor's actions in their task set, but only when cognitive resources are available.

Investigation of the tensile behavior of joint filling under experimental test and numerical simulation

  • In this paper, tensile behavior of joint filling has been investigated under experimental test and numerical simulation (particle flow code). Two concrete slabs containing semi cylinder hole were prepared. These slabs were attached to each other by glue and one cubic specimen with dimension of 19 cm×15 cm×6 cm was prepared. This sample placed in the universal testing machine where the direct tensile stress can be applied to this specimen by implementing a special type of load transferring device which converts the applied compressive load to that of the tensile during the test. In the present work, two different joint filling thickness i.e., 3 mm and 6 mm were prepared and tested in the laboratory to measure their direct tensile strengths. Concurrent with experimental test, numerical simulation was performed to investigate the effect of hole diameter, length of edge notch, filling thickness and filling length on the tensile behavior of joint filling. Model dimension was 19 cm×15 cm. hole diameter was change in four different values of 2.5 cm, 5 cm, 7.5 cm and 10 cm. glue lengths were different based on the hole diameter, i.e., 12.5 cm for hole diameter of 2.5 cm, 10 cm for hole diameter of 5 cm, 7.5 cm for hole diameter of 7.5 cm and 5 cm for hole diameter of 10 cm. length of edge notch were changed in three different value i.e., 10%, 30% and 50% of glue length. Filling thickness were changed in three different value of 3 mm, 6 mm and 9 mm. Tensile strengths of glue and concrete were 2.37 MPa and 6.4 MPa, respectively. The load was applied at a constant rate of 1 kg/s. Results shows that hole diameter, length of edge notch, filling thickness and filling length have important effect on the tensile behavior of joint filling. In fixed glue thinks and fixed joint length, the tensile strength was decreased by increasing the hole diameter. Comparing the results showed that the strength, failure mechanism and fracture patterns obtained numerically and experimentally were similar for both cases.
