The New York Convention(formally called "United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards") done in New York on June 10, 1958 has been adhered to by more than 140 States at the time of this writing, including almost all important trading nations from the Capitalist and Socialist World as well as many developing countries. The Convention can be considered as the most important Convention in the field of arbitration and as the cornerstone of current international commercial arbitration. Korea has acceded to the New York Convention since 1973. When acceding to the Convention, Korea declared that it will apply the Convention to the recognition and enforcement of awards made only in the territory of another Contracting State on the basis of reciprocity. Also, Korea declared that it will apply the Convention only to differences arising out of legal relationships, whether contractual or not, which are considered as commercial under the national law of Korea. The provisions relating to the enforcement of arbitral awards falling under the New York Convention begin at Article III. The Article III contains the general obligation for the Contracting States to recognize Convention awards as binding and to enforce them in accordance with their rules of procedure. The Convention requires a minimum of conditions to be fulfilled by the party seeking enforcement. According to Article IV(1), that party has only to supply (1) the duly authenticated original award or a duly certified copy thereof, and (2) the original arbitration agreement or a duly certified copy thereof. In fulfilling these conditions, the party seeking enforcement produces prima facie evidence entitling it to obtain enforcement of the award. It is then up to the other party to prove that enforcement should not be granted on the basis of the grounds for refusal of enforcement enumerated in the subsequent Article V(1). Grounds for refusal of enforcement are stipulated in Article V is divided into two parts. Firstly, listed in the first Para. of Article V are the grounds for refusal of enforcement which are to be asserted and proven by the respondent. Secondly, listed in Para. 2 of Article V, are the grounds on which a court may refuse enforcement on its own motion. These grounds are non-arbitrability of the subject matter and violation of the public policy of the enforcement country. The three main features of the grounds for refusal of enforcement of an award under Article V, which are almost unanimously affirmed by the courts, are the following. Firstly, The grounds for refusal of enforcement mentioned in Article V are exhaustive. No other grounds can be invoked. Secondly, and this feature follows from the first one, the court before which enforcement of the award is sought may not review the merits of the award because a mistake in fact or law by the arbitrators is not included in the list of grounds for refusal of enforcement set forth in Article V. Thirdly, the party against whom enforcement is sought has the burden of proving the existence of one or more of the grounds for refusal of enforcement. The grounds for refusal of enforcement by a court on its own motion, listed in the second Para. of Article V, are non-arbitrability of the subject matter and public policy of the enforcement country. From the court decisions reported so far at home and abroad, it appears that courts accept a violation of public policy in extreme cases only, and frequently justify their decision by distinguishing between domestic and international public policy. The Dec. 31, 1999 amendment to the Arbitration Act of Korea admits the basis for enforcement of foreign arbitral awards rendered under the New York Convention. In Korea, a holder of a foreign arbitral award is obliged to request from the court a judgment ordering enforcement of the award.
급변하는 환경 속에서 지속적인 경쟁우위와 혁신을 위한 지식의 중요성이 증대되면서, 그 동안 지식공유에 관한 많은 연구들이 있었다. 그런데, 이러한 연구들의 대부분이 응답자의 인지오차가 내재된 서베이에 의존해왔다. 본 연구는 대표적인 온라인 지식협업 커뮤니티인 위키피디아 유저들의 온라인 행위만을 토대로 지식공유 참여정도에 대한 행위 특성들간의 관계를 도출하였다. 그런데, 유저들의 편집 참여 패턴이 서로 다르기 때문에 편집횟수는 같아도 재방문기간은 달라질 수 있고 이에 따라 지식공유 결과가 달라질 수 있으므로, 지식공유 참여정도를 아티클 편집 참여횟수와 재방문기간의 두 가지 관점에서 접근하였다. 지식공유 참여정도에 영향을 미치는 행위특성으로는 위키 플랫폼에서 관찰이 가능한, 공적인 토론툴인 아티클 톡과 사적인 메시징 툴인 유저 톡 참여여부 및 정도, 그리고 커뮤니티 등록여부를 사용하였다. 행위 분석은 먼저, 행위특성 차원에 의한 유저 카테고리별 참여정도를 비교하였고, 행위 특성의 정도를 반영하는 독립변수들과 참여정도를 나타내는 종속변수간의 관계에 대한 로버스트 회귀분석을 수행하였다. 특히, 연구가설을 설정하는 단계에서 온라인 환경에 적합한 모티베이션 이론을 도입함으로써, 온라인 지식공유 참여정도에 관한 이론적인 설명 모델을 제시하였다. 결론적으로, 본 연구는 이론적인 시사점 외에 다음과 같은 실제적인 행위 결과를 얻었다. 첫째, 공적인 토론 및 사적인 메시징 참여와 지식공유 참여정도간에는 양의 관계가 성립한다. 둘째, 공적인 토론이 사적인 메시징 보다 지식공유 참여정도에 더 큰 영향력을 미친다. 셋째, 아티클 편집 참여횟수에 대해서는 공적인 토론과 사적인 메시징의 시너지 효과가 존재하는 반면에, 재방문기간에 대해서는 아주 약한 음의 상호작용효과를 나타낸다. 넷째, 커뮤니티 등록 여부는 재방문기간에 대해서는 절대적인 양의 영향력을 미치지만, 실질적인 편집 참여횟수에 대해서는 유의한 영향력을 나타내지 않는다. 다섯째, 사적인 메시징에 의한 관계성을 고려할 때, 관계의 범위보다는 빈도 또는 깊이가 더 중요한 것으로 보인다.
In this article, we deal with Zariski topology on graded comultiplication modules. The purpose of this article is obtaining some connections between algebraic properties of graded comultiplication modules and topological properties of dual Zariski topology on graded comultiplication modules.
In connection with international commercial arbitration the need to seek interim relief is generally recognized. Interim reliefs address the requirements of a party for immediate and temporary protection of rights or property pending a decision on the merits by the arbitral tribunal. The most common forms of interim relief are attachments and injunctions. If the arbitral tribunal has not yet been appointed, an application for interim relief must usually be addressed to the local courts at the place of commercial arbitration. If the arbitral tribunal has been appointed, the application for interim relief is first made to the arbitral tribunal. Interim relief by the arbitral tribunal is in the form of a direction to the parties. Since the arbitral tribunal has no enforcement power, it may be necessary to have a arbitral tribunal's direction confirmed by a local court which can enforce its order. The New York Convention does not provide for interim reliefs. The question is whether Article II(3) of the New York Convention that the court "shall, at the request of one of the parties, refer the parties to arbitration" denies jurisdiction to courts to grant interim reliefs in international commercial arbitration. Some cases have indicated that the U. S. court have no power to grant interim relief. Other cases have indicated that the U. S. courts do have the power to grant interim relief. It is unlikely that a U. S. court will order interim relief in relation to an commercial arbitration in a foreign country. Article 26 of the UNCITRAL Arbitration Rules provides with respect to interim measures of protection. Section 1 of Article 26 of UNCITRAL Arbitration Rules provides that the arbitral tribunal may take any interim measures it deems necessary in respect of the subject matter of the dispute, including measures for the conservation of the goods forming the subject matter in dispute. This article gives the arbitral tribunal the broadest authority, not limited to safeguarding property. Article 17 of the UNCITRAL Model Law on International Commercial Arbitration provides that the arbitral tribunal may order any party to take such interim measure of protection as the arbitral tribunal may consider necessary in respect of the subject matter of the dispute. It may be noted that the article does not deal with enforcement of such measures. The International Chamber of Commerce Rules of Conciliation and Arbitration do not expressly empower the arbitral tribunal to grant interim reliefs. However, Article 8.5 of the ICC Rules of Conciliation and Arbitration provides that the parties shall be at liberty to apply to any competent judicial authority for interim measures. In conclusion, the power of the arbitral tribunal to provide interim reliefs is generally recognized in the arbitration rules of arbitral institutions. However, the arbitral tribunal's authority is limited by its lack of enforcement mechanisms. It is generally recognized that the local courts have power to grant interim reliefs in aid of an commercial arbitration. However, local courts are reluctant to grant interim reliefs if that decision requires an adjudication of issues within the special competence of the arbitral tribunal.
오늘날 웹의 발전으로 우리는 각종 언론 매체를 통해 온라인 기사를 쉽게 접하게 된다. 온라인 기사를 쉽게 접할 수 있게 된 만큼 거짓 정보를 진실로 위장한 가짜뉴스 또한 빈번하게 찾아볼 수 있다. 가짜뉴스가 전 세계적으로 대두되면서 국내에서도 가짜뉴스를 탐지하기 위한 팩트 체크 서비스가 제공되고 있으나, 이는 전문가 기반의 수동 탐지 방법을 기반으로 하며 가짜뉴스 탐지를 자동화하는 기술에 대한 연구가 계속해서 활발하게 이루어지고 있다. 기존 연구는 기사 작성에 사용된 문맥의 특성이나, 기사 제목과 기사 본문의 내용 비교를 통한 탐지 방법이 가장 많이 사용되고 있으나, 이러한 시도는 조작의 정밀도가 높아졌을 때 탐지가 어려워질 수 있다는 한계를 가진다. 따라서 본 논문에서는 기사 조작의 발달에 따른 영향을 받지 않기 위하여 기사의 진위 여부를 판단할 수 있는 검증기사를 함께 사용하는 방법을 제안한다. 또한 가짜뉴스 탐지 정확도를 개선시킬 수 있도록 실험에 사용되는 기사와 검증기사를 문서 요약 모델을 통해 요약하는 과정을 추가했다. 본 논문에서는 제안 알고리즘을 검증하기 위해 문서 요약 기법 검증, 검증기사 검색 기법 검증, 그리고 최종적인 제안 알고리즘의 가짜뉴스 탐지 정확도 검증을 진행하였다. 본 연구에서 제안한 알고리즘은 다양한 언론 매체에 적용하여 기사가 온라인으로 확산되기 이전에 진위 여부를 판단하는 방법으로 유용하게 사용될 수 있다.
온실가스 배출로 인한 지구온난화에 대응하고 지구의 평균 기온상승을 방지하기 위하여 2015년 12월 파리기후협정(Paris Agreement)이 채택되어 신기후체제가 도래하게 되었다. 해수면상승과 삼림고갈, 미세먼지 등과 같은 기후변화로 인한 환경문제에 대응하기 위하여, 신재생에너지의 중요성이 높아졌다. 신재생 에너지의 성장을 위해서는 현실적으로 정부의 지원이 필요하다. 그러나 신재생에너지 산업에 대한 각국 정부의 과다한 지원은 공정 한 경쟁을 저해하고 비용을 높인다는 점에서 문제가 될 수 있으며, 이미 WTO에서도 신재생에너지 보조금과 관련된 제소사례를 찾아볼 수 있다. 본 연구는 WTO의 보조금 및 상계조치 협정과 GATT를 중심으로 하였다. 신재생에너지 보조금에 관련된 WTO 분쟁사례를 살펴보고, 사례에서 쟁점이 되는 조항인 보조금협정의 제2조 특정성과 제3조 (b)항 수입대체보조금, GATT 제20조 일반적 예외를 분석하였다. 기후변화에 대응하는 환경보호적인 관점에서 현재 각 국의 에너지 정책을 반영하고 신재생에너지 산업의 발전을 위하여 보조금협정의 개정 또는 보완이 필요하다. 본 연구에서는 보조금협정 제8조 허용보조금의 재도입 논의 또는 에너지보조금에 관한 특별규정과 같은 방안과 더불어 보조금협정 제3조의 명확한 해석기준이 필요하다고 보았다. 그러나 과도한 정부 보조금의 지급은 무역분쟁을 야기할 수 있으며 환경보호와 자유무역의 형평성, 지속가능한 개발이라는 WTO의 목적에 맞추어 WTO의 규범을 개선해야 한다.
본 연구는 은평구립도서관의 신문기사 분석사례를 통해 신문기사를 통한 공공도서관의 홍보의 실태를 살펴보고 이해하는데 목적이 있다. 이를 위해 본 논문은 신문기사를 통한 공공도서관의 홍보에 대한 이론적 배경을 살펴 본 후, 은평구립도서관과 관련된 2010년도 신문기사를 기사유형, 기사종류, 기사성격, 기사내용 등으로 나누어 살펴보았다. 또한 본 탐색적 사례연구는 내용분석, 면담, 현장방문 등을 통하여 은평구립도서관과 관련된 2010년도 신문기사를 홍보주체, 홍보대상, 홍보방향, 그리고 홍보방법 등 공공도서관의 홍보에 영향을 미치는 요소들을 중심으로 분석하였다.
This article examines whether parties may agree to contractually waive the right to bring annulment proceedings. Alternately it looks at whether certain grounds of annulment may be waived. The ability for parties to resolve this issue contractually by waiving this element of Article 52(1)(b) ICSID offers a potentially powerful solution. For parties to agree beforehand to the circumstances where tribunals have not 'manifestly exceeded their power' could allow them to remove the unpredictability of annulment on this foundation. Even in the event that an ad hoc committee is against the validity of waiver, it may be possible for a party to frame this restriction as an interpretative agreement by the parties rather than strictly as waiver of a ground of annulment. Ultimately, the wish to enter into such an agreement would likely only be driven by a few exceptional commercial need or prior negative experience with the remedy of annulment. In that cases, and depending on the nature of the specific concern with annulment, a limited waiver or interpretative agreement on certain Article 52(1) ICSID grounds may certainly be appropriate.

The article reviewed both a literature study on the history of fashion exhibition focused on the display technique as well as a case study of domestic and international contemporary fashion exhibitions. The results of the article is as follows. Fashion brand exhibitions are about building competitive business advantage by planning differentiated contents. It gives viewers a brand fantasy and increases brand loyalty. This type mainly displays the latest collections on the commercial purpose as well as uses diverse mediums and high technology to make a spectacular space that provides an immersive experience to the viewer. Second, the museum fashion exhibition focuses on the roles of fashion in terms of social, cultural and artistic aspects that also focus on public education. The presentation technique emphasizes careful collection conservation rather than celebrate fashion business. The article is to encourage a further scholar discourse of fashion curatorial practice and theory.

The article brings the study of nonlocal, surface and the couple stress together to apparent the frequency retaliation of FG nanobeams (Functionally graded). For the examination of frequency retaliation, the article considers the accurate spot of neutral axis. This article aims to enhance the coherence of proposed model to accurately encapsulate the significant effects of the nonlocal stress field, size effects together with material length scale parameters. These considered parameters are assimilated through what are referred to as modified couple stress as well as nonlocal elasticity theories, which encompasses the stiffness-hardening and softening influence on the nanobeams frequency characteristics. Power-law distribution is followed by the functional gradation of the material across the beam width in the considered structure of the article. Following the well-known Hamilton's principle, fundamental basic equations alongside their correlated boundary conditions are solved analytically. Validation of the study is also done with published result. Distinct parameters (such as surface energy, slenderness ratio, as nonlocal material length scale and power-law exponent) influence is depicted graphically following the boundary conditions on non-dimensional FG nanobeams frequency.
