A Study of Competence-Competence in the United States (미국에서의 중재인의 권한판단권한(Competence-Competence)에 관한 고찰)

  • Competence-competence refers to an arbitratorpower to determine whether he or she has jurisdiction to decide a controversy. Although arbitrators power to rule on their own jurisdiction is generally recognized throughout the world, in the United States, neither the courts nor legislative bodies have recognized its significance or the reasoning behind its widespread adoption. Section 3 of the Federal Arbitration Act (FAA) is notorious among arbitration statues for its failure to incorporate competence-competence. When courts rule on an issue of competence-competence, it is referred to as a question of who decides the arbitrability of the case. In the United States, the use of competence-competence as a term of art is still limited to scholarly writings. The answer to the competence-competence inquiry is found in an interpretation of section 3 of the FAA which empowers the courts to decide arbitrability issues. The cases of the Supreme Court and most commentators interpreted sections 2 and 3 of the FAA as conferring issues of arbitrability on the federal courts, including the ability to rule on the validity and scope of the arbitral agreement. Traditionally, United States courts have denied the competence-competence to arbitral tribunal. Recently, however, they have confounded the rules by placing primary importance on the arbitration agreement between the parties. The Supreme Court, in a series of cases, has underscored the necessity of giving full effect to the intentions of the parties as expressed in their agreement to arbitrate. The result of the Supreme Court's emphasis on contractualism in determining the issue of arbitrability is most evident in the Courtdecision in the First Options case. Under First Options, courts are to decide arbitrability issues unless there is a clear and unmistakable contractual assignment of these issues to the tribunal itself. The Court is appraised that it has attempted to compromise between contractual freedom in the arbitration setting and the rule of law that is necessary in a society that depends on the concept of ordered liberty. In the decision in Howsam, the Court clarified the definition of arbitrability by attempting to draw a clear line between questions of arbitrability that are to be decided by courts and those matters that bear on the allocation of decisions between courts and arbitrators but are not questions of arbitrability.

A Study on the Activation Plan for the Participation in Citizen Participation Education by Types of Lifelong Education Participation : Focusing on Chungcheongnam-do (평생교육 참여유형별 시민참여교육 참여 활성화 방안에 관한 연구: 충청남도를 중심으로)

  • This study used data from '2016 Chungnam Citizens' Lifelong Education Needs Survey'. This analyzed the basic situation of Citizen Participation Education. It also typifies the interest and participation intention of lifelong education by region, and compared the interest and participation intention of Citizen Participation Education. Through this, we intend to provide concrete basic data for activating the Citizen Participation Education in Chungnam. We analyzed data of 4,108 people in 2016 lifelong education needs survey. This was named enjoy learning type, bias earning type, and elderly learning type. Second, the enjoy learning type group is a group that enjoys participating throughout lifelong education area. bias earning type group is a group that perceives that lifelong education is limited to vocational ability education, culture art education, and liberal arts education. These are groups that are interested and participating only in three areas. The elderly learning type group is a group that shows typical characteristics of the elderly learners and is a group that is concentrated on participation in culture arts education. Third, enjoy learning type group is the second most experienced participant. They are the group with the highest participation interest and participation intention. bias earning type group is the group with the highest participation experience. They are also the second highest group of participating interests and willingness to participate. elderly learning type group is the group with lowest participation experience, participation interest, and participation intention. Finally, we suggest the ways to revitalize Citizen Participation Education in lifelong education.

Antioxidant Activity of the Ethanol Extract from Cooking Drips of Thunnus thynnus by Gamma Irradiation (참치 자숙액의 항산화 활성에 감마선 조사가 미치는 영향)

  • This study was conducted to examine the effect of a gamma irradiation on the antioxidant activity of ethanol extract from cooking drips of Thunnus thynnus (ECT). The electron donating ability against 1,1-diphenyl- 2-picryl-hydrazyl (DPPH), authentic hydroxyl radical scavenging activity by Ultra Weak Luminescence Analyzer, oxidative protection factors by Racimat method, ferric reducing antioxidant power (FRAP), and ${\beta}$-carotene bleaching activity were measured as indices of antioxidant activity. All of the results shown that irradiation increased the antioxidant activity of ECT. These results suggested that ECT could be used as an antioxidative component in food and gamma irradiation could enhance these antioxidative properties.

A Study on Perception and Task of Lifelong Education for Individuals with Disabilities (장애인 평생교육의 인식 및 과제에 관한 연구)

  • The purpose of this study is to explore the perceptions and tasks of lifelong education for individuals with disabilities, including the necessity of lifelong education and the range and content of it for the disabled. The research method is a focus group interview with 4 managers of lifelong education institutions for the disabled, and the data were analyzed according to the process of thematic analysis method proposed by Braun and Clarke(2006), which is one of qualitative data analysis methods. The results of the analysis are as follows: First, the lifelong education for the disabled is needed, because, unlike the non-disabled, the disabled are less able to recognize and respond to social changes, which requires equipment or convenience facilities to improve it. Second, the range of lifelong education for the disabled was suggested as social life including daily life, vocational ability development education, culture·art·physical training, and those required by individuals with disabilities. Third, the lifelong education institutions for the disabled are lack of experts and have difficulty in communicating between practitioners and the disabled. In conclusion, it is required to provide lifelong education by self-determination of the disabled in the community by priority.

Antioxidant activity and anti-inflammatory effects of ethanol extract from Allium schoenoprasum (향부추 에탄올 추출물의 항산화 활성 및 항염증 효과)

  • This study evaluated the antioxidant and anti-inflammatory activity of ethanol extracts using three parts of the chives plant: the bulb, the leaf, and the flower. As a result of DPPH and ABTS radical scavenging ability, the scavenging activity of the flower extract was higher than that of the bulb and leaf. In addition, as a result of FRAP analysis, antioxidant activity increased in all extracts depending on the extract concentration. The total polyphenol content was high in the following order: flower (11.29±0.37 mgGAE/g) > leaf (6.61±0.14 mgGAE/g) > bulb (5.7±0.67 mgGAE/g) extract. The cytotoxicity of the three extracts against rat macrophage RAW264.7 cells and HaCaT cells, both of which are human cutaneous keratinocyte cell lines, was minimal. NO by LPS was generated as a result of examining the anti-inflammatory activity of each extract through the NO colorimetric analysis method and ELISA. TNF-α secretion was decreased to a significant level in the flower ethanol extract. Therefore, these results indicate that there is a high possibility that the ethanol extract of chives, a natural plant resource, can be used as a cosmetic raw material.

Study of Antioxidation Action of Lenonuri herba Extract (익모초 추출물의 항산화 작용에 관한 연구)

  • Motherwort (Leonurus sibiricus L), a hemp nettle (Labiatae) plant, grows about 1.5${\~}$2 m high spontaneously to wildness in Korea, China, Japan, and other Asian place. Its medical applications includes women's uterine disease, urination, bloody stool, bloody urine, and hemorrhoids. It's also effective for high blood pressure, heart stimulation, and anti-cancer activity. We first prepared chlroform and methanol extracts of motherwort and then they were fractionated using water, $30\%$ methanol, $60\%$ methanol, and $100\%$ methanol, respectively. Each fractionates is assayed for free radical scavenging activities against DPPH and anti-oxidant activity by TBARS assay measuring lipid peroxidation using LDL. The $30\%$ and $60\%$ methanol fractionates of methanol extracts showed strong anti-oxidant activity compared to vitamin C. They also had more Potent SOD activity using pyrogallol at 250 ppm than that of vitamin C. These results suggest that anti-oxidant activities of motherwort may be applicable to development of natural anti-oxidant cosmetics. Possibility of nature anti-oxidation ability cosmetics is seen possibility low official.

  • The most serious problem company facing in today's business environment is the failure of new product development outcomes. Statistically, almost half of the new products released each year failed. Despite the innovative technological advances, consumers' expectation level become much higher and global competition is intensifying. In addition, the new product life cycle is becoming shorter and shorter. It is difficult for a company to survive without developing long-lived products. The most important issue in a company's success and failure is the successful development and introduction of new products. Previous research has presented many determinants to achieve a successful new product development. This study focuses on dynamic competence as an important determinant, and identifies the constituting elements. Enterprises need to acquire, absorb, integrate and reconfigure their resources to survive and develop continuously. It is necessary to hold a dynamic ability switching resource bases in order to adapt to changing environments. The results of this study are as follows: First, the effect of learning, reconfiguration, and alliance capabilities on the new product development of small and medium-sized manufacturing enterprises seems to be positive. Second, the integrative and reconfiguration capabilities positively affect a new product development under high environmental turbulence.

A study on the Development of Physics Education Program for Foreign Students of Natural Science and Engineering College in Korea (이공계 대학의 유학생을 위한 물리교육 프로그램 개발 연구)

  • This study was carried out to develop a physics education program for foreign students of university in Korea to improve their ability to major in the field and to prevent them from becoming dropout. The subjects of the study are five Chinese students attending a natural science and engineering college. Prior to the development of the physics education program, the researchers developed basic physics textbooks for the foreign students and questionaries for diagnosis and summative evaluation, and utilized them to apply a total of seven classes. After the application of the classes, the results of the student's diagnosis and summative evaluation, the teacher's diaries, the observer's diaries, and the transcripts were analyzed by triangulation method. In addition, Nvivo12 was used for the analysis of the teacher's and observer's diaries to help with qualitative analysis. The results of the study are as follows: First, the oder and contents of physics education program for students of the natural science and engineering college were presented in detail, and basic physics textbooks and tools for diagnosis and summative assessment were developed. Second, as a result of the analysis of the diagnosis and summative assessment results of the program, the students' basic physics achievement improved by an average of 40 points due to the application of the developed program. Third, as a result of the application of the program using Nvivo12, meaningful node and actual cases were extracted. There were 10 types of nodes created such as understanding of the students, teaching method, rate of the participation, level differences, language problems, relevance to majors, curriculum and methods of education in the country of origin, cooperative learning, and interest inducement. The researcher provided suggestions on physics education methods for students of science and engineering colleges in Korea based on the related cases.

  • The purpose of this study to examine the status of Korean language education, and to examine the future direction between with korean and China. The Korean language course organized by the European Union Chamber of Commerce and Industry, which selects and conducts consignment companies through annual competition every year since 2002, In order to these goals and needs, it is imperative to develop a curriculum that enhances job skills. As Korean language education, a point that is necessary to clarify terms more clearly, which 'vocational education purpose' is widely used in the term of 'business education'. With all languages education, Korean language education is not meant to teach Korean to foreigners, but it is a process by which learners can apply Korean language learned in classroom to various situations, while outside the classroom through teaching and learning. Otherwise, the curriculum in the four-year college Korean language department in China, which is lacking in acquiring the ability to achieve the Korean language education goals and social needs. Korean language education in China is one of foreign language education and it is different from foreign language education such as English education as Minor Languages education.

Exploring the Foreign Students' Learning Experiences in Natural Science Basic Course at College of Engineering in Korea (국내 이공계 대학 유학생들의 전공기초 학습 경험 탐색)

  • The main purpose of this study is to explore the foreign students' learning experiences in natural science basic course at college of engineering in Korea. The subjects were 7 but 4 students took part in the semi-structured interview. All of the interviews were recorded, and the recorded material was transferred and kept. The transcripts were analyzed in a qualitative method. The researchers answered the questionnaire to 7 foreign students who voluntarily participated in the study, and 4 in-depth interviews were also conducted. The interview took 30 minutes to 1 hour, and semi - structured interviewing technique was used. The contents of the interviews were all recorded with the consent of the participants, and the recorded materials were transferred and managed with the interview notes. The transferred data were analyzed based on the coding and categorization process according to the step of the continuous comparison method. The results of this study is the following. There are four themes; problems due to lack of Korean language ability when taking basic courses; problems of terms and concept understanding in major courses; supplementary learning methods of basic courses; necessity of natural science basic education program and requirement of support of the university.
