This study examines the seller's liability to transfer the property to the buyer. Even though contracting parties choose CISG as the governing law regulating their obligations and rights by means of their contract, CISG does not concern with the effect generated by the transfer of property. Thus, the issues of the property is settled in conformity with the domestic law applicable by virtue of the rules of private international law. By considering the general rules of the transfer of property in goods under SGA and KCC as the lex rei sitae, the difference of requirements to pass the property between them is analyzed and then the reasons why the transfer of property is importantly considered are discussed. In addition, as CISG does not exclude completely the matters concerning the property and provides the provision like Art 41, the seller's liability to deliver goods free from the third party right or claim is examined under Art 41. Lastly, the practical advice is suggested.

Recently, computer hardware is evolving toward increasing the number of computing cores, not increasing the clock speed. In order to use the performance of parallelized hardware to the maximum, the running program must also be parallelized. However, software developers are accustomed to sequential programs, and in most cases, write programs that operate sequentially. They also have a lot of difficulty designing and developing software in parallel. We propose a method to automatically convert a sequential C/C++ program into a parallelized program, and develop a parallelization tool that supports it. It supports open multiprocessing (OpenMP) and parallel patterns library (PPL) as a parallel framework. Perfect automatic parallelization is difficult due to dynamic features such as pointer operation and polymorphism in C/C++ language. This study focuses on verifying the conditions of parallelization rather than focusing on fully automatic parallelization, and providing advice to developers in detail if parallelization is not possible.

Despite the number of developed theories, it still remains a difficult task for some established and emerging scholars in various academic fields to clearly articulate new theories from research studies. This paper reviews and collates the views of scholars on what a theory is and how a good theory can be developed. It explains the concept of a theory, and the different components that make up a theory. The paper discusses the different processes of theory development by emphasizing what theory is and what theory is not. This review found that scholars differ in their definition of a theory, which leads to using terms such as model, paradigm, framework, and theory interchangeably. It found the lack of theoretical constructs in a study to be one of the factors which explains why articles are rejected for publication. This paper may be of benefit to established researchers who may be struggling with theory development, and especially younger academics who are the future of scholarship in various academic fields, particularly in information science.

This paper proposes a design of a citizen advisory model under the consideration of the unique characteristics of the government, namely complex structure of goals, predominance by laws, knowledge driven organization, and the good governance objectives. The legal knowledge-based technology is explored with the aims to facilitate citizens in accessing e-government services in five phases: search, intake, decision-making, explanations, and objection and appeal phases. The design of the citizen advisory model consists of four components: specific service advice, customized form fill-in service, decision-making services, and a statement of reasons service. The prototype of the citizen advisory model is illustrated using the Thai Anti Dumping and Countervailing Act 1999 as a legal domain and e-government services example.

Manufacturing environs constantly change, and any efficient software system to be used in manufacturing must be able to adapt to the varying situations. In a CAPP (Computer-Aided Process Planning) system, a learning capability is necessary for the CAPP system to do change along with the manufacturing system. Unfortunately only a few CAPP systems currently possess learning capabilities. This research aims at the development of a learning system which can increase the knowledge in a CAPP system. A part in the system is represented by frames and described interactively. The process information and process planning logic is represented using a decision tree. The knowledge expansion is carried out through an interactive expansion of the decision tree according to human advice. Algorithms for decision tree modification are developed. A path can be recommended for an unknown part of limited scope. The processes are selected according to the criterion such as minimum time or minimum cost. The decision tree, and the process planning and learning procedures are formally defined.

Simulation is one of the most widely used techniques in operations research and management science, but there are several impediments to even wider acceptance and use of simulation. One of the more significant limitations is the dependence of simulation on statistical methodology. This research identifies eighteen different statistical issues in simulation methodology and develops an expert system which could through interactive dialog with simulation analysts offer advice on statistical approaches which might be used to deal with particular issues and to accomplish required statistical computations. This research revises the previous study published in Simulation by incorporating additional statistical issues in the expert system to enhance its performance in analyzing a given simulation problem with statistical methodologies. An overview of the revised system is given and illustrations of the capabilities of the system are presented.

At the choice of aviation company, safety appears as biggest variable than expenses, speed and comfort so these are concerned not only aviation companies but also countries and customers. Until now, ICAO has been making effort to reduce the flight accident through the safety advice of aviation part, establishment of standard, education, training and develop of navigation aids. Especially in 2008, they emphasize that the flight accident is reduced through researches and applications about SMS as safety regulation. Important primary factor to give influence about promotion of SMS is practice of organization and for this, to investigate recognition about safety management and culture of members. At point of this, this research analyze the recognition degree about how to manage safety and SMS for pilots an mechanics of Korea.

The purpose of this study is explored the determinant of job satisfaction focused on work convenience and self-efficacy, physical culinary environment. And we have studied the structural relations among physical culinary environment work convenience and self-efficacy to job satisfaction. We find that self-efficacy and work convenience has highly effected job satisfaction compared to physical culinary environment. We conclude that the study of hotel culinary employees has provided new and important insights into the way in which people in hotel culinary behave, and we offer advice for managers to enable them to develop and to maintain a positive job satisfaction of hotel culinary employees.

There have not been many studies which considered both quantitative and qualitative location factors on the issues of site selection problems for a fish farm. This study develops AHP(analytic hierarchy process) model to resolve site selection problem for a fish raising farm by using quantitative and qualitative factors. In order to evaluate the validity of the location factors found in the literature review, the study used advice from fish raising farmers and related academic experts. Four major factors have been selected as economic factors, social factors, natural environmental factors and infrastructures. An AHP structural diagram has developed by considering the factors and potential sites proposed for fish farming. Through the survey on the preference of factors and potential sites, pairwise comparison matrices have been estimated and used to calculated the relative weights of each potential site. The AHP model process shown in the study can be applied to resolve site selection problems for fish raising farmers.

The article specified in aviation legislation, 'The captain has the final authority and responsibility in flight safety' could be one reason running counter to applying "Vertrauensgrundsatz". In practice, however, captains do not have professional skills in every task and they should distribute duties and responsibilities to flight attendents and other staffs to operate the flight as safely and efficiently as possible. Therefore, in aviation, fair criterion, namely, "Vertrauensgrundsatz" is necessary to balance between efficiency and legal interest for participants. In addition, when it comes to mutual trust of duty which was the starting point of this study, the standard in mutual advice or interference must be based on the duty specified in air law and flight regulations. Also, pervasive trust will not only be attributed to joint responsibility but an act that cannot be trusted.
