  • The Code of Ethics for Newspaper Advertising in Korea, first implemented in 1976 and subsequently revised in 1976, 1996, and 2021, is a critical regulatory instrument for the country's advertising sector. However, the specialized domain of "advertising ethics," particularly the "code of advertising ethics," remains under-explored. This research addresses this scholarly gap, providing an empirical analysis of the 2021 amendment's revision trajectory. This study employs a robust methodological approach, integrating expert interviews and small-group AHP-based surveys. This approach allows for a comprehensive understanding of the revision needs, referencing existing ethical codes studies, and comparing similar ethics codes nationally and internationally. The research further investigates key challenges such as personal data protection and copyright issues in the rapidly evolving digital media landscape, while preserving the existing code's inherent value. The findings are expected to significantly contribute to the emerging field of advertising ethics in Korea, offering practical implications for future code revisions.

  • The medical advertising review system which was revised and implemented on September 28, 2018, was revived. In this paper, we examine the implications of social ethics and public value of advertising under 4 perspectives of advertising, present the direction of future medical advertising, and suggest the meaning and expected effect of the preliminary medical advertising review system.

  • Price skimming practices, false claim on products, false information/communication, marketing overseas, and deception on products in marketing have received significant attention by the researchers of ethics in marketing studies. This research considers these phenomena as marketing instruments that grossly violate the practice of ethics in this domain. The two most crucial parts in marketing that have received greater attention are product safety and advertising. The paper also examines Ethical Marketing as the ability to make marketing decisions that are morally right and acceptable to all. In order words, ethics in marketing explains how moral standards can be applied in marketing decisions. It seeks to answer the research question by looking at some fundamental business ethics theories, namely, Virtue ethics, Utilitarian, and Deontological approaches to business ethics. Nevertheless, ethics in business is very controversial as many hold different view about what makes up the standard morals that corporations should take and so it is necessary for any organization to formulate its ethical codes to follow.

  • The purpose of this study is to investigate the characteristics of advertising section of the daily newspaper through content analysis. From April 2015 to March 2017, a total of 1,927 advertisements were analyzed by the newspaper ethics committee, and the following results were obtained. Firstly, most types of features (advertising) received more attention than warnings. Secondly, we can confirm that the amount of advertisement in section (featured) of major daily newspapers is gradually increasing, and section advertisement is appeared in major business districts. Third, there were many violations in the practice guidelines of the newspaper code of ethics as the media's responsibility and press coverage. Finally, in the case of certain companies and products, if you do not follow the principles of publication for profit and publicity, you may need to make your own efforts to protect the credibility and fairness of newspapers, and more autonomous guidelines.

  • This study were investigated in Korean and Chinese consumers' awareness about the controversial ads expressions. Any ethical evaluation and consumers about the issue of the type of ad that is examined, and also the difference between Korea and China, the consumer perception of advertising ethics evaluation is confirmed. Korean and Chinese consumers consumerism to promote awareness and relevance is analyzed. Firstly, the negative role of advertising in terms of positive perceptions of Chinese consumers significantly higher. The other hand, recognize the positive role in the Korean consumer awareness was high. Second, the Korean consumer advertising that targets children positive response compared to Chinese consumers higher. Third, Sexual Appeal for Chinese consumers think that is very generous compared to Korean consumers were Fourth, Korea and China consumers about tobacco advertising for all tobacco advertising was negative ethical perception. Fifth, obnoxious ad, ads, such as racial discrimination and acts for all bilateral consumers very negative comments were, for the spread of AIDS, bilateral consumers allow condom ads for all the positive responses demonstrated. The results of this study advance into China and the Korean company's executives and advertising agency advertising practitioners to formulate a strategy to accommodate an effective message.

Relevant perceptual features on advertising and indirect advertising effectiveness factors of Chinese viewers (중국시청자의 간접광고 효과요인과 광고기능 관련성 지각)

  • The purpose of this study was targeting Chinese viewers. Awareness of factors affecting indirect advertising effects were investigated. What is the awareness of advertising features for Chinese viewers also examined. Advertising and indirect advertising effectiveness factors examined relationships recognized. Chinese viewers were collected through surveys. Firstly, factors affecting indirect advertising effects was seven. Sponsor, celebrity involvement, and blatantly portrayed, reliability, brand differentiation, ethics and information provided is a factor. Second, the advertising capabilities of the Chinese viewers were relatively positive perception. Indirect advertising effects of Chinese viewers, features and advertising on the relevance factors, there was a significant relationship. Celebrity involvement and brand differentiation, blatantly portrayed, and ethical factors had an impact on the function of advertising. These results provide indirect advertising of China and South Korea produced implications for practitioners. Korea also interested in entering the Chinese enterprises will provide the basic material in the production of indirect advertising.

A study of Problems with False Exaggerating Advertisements and Consumer's Protection. (허위, 과장광고와 소비자보호문제에 관한 고찰)

  • As the economic society develops very exceedingly, the gap of production and consumption elarges gradually. So the current function to connect them and the function to communicate are needed. I think the advertisement take the charge of this role. This advertisement is so essential to today's economic society that its power influences variably both the economic society and the consumers. The enterprisers, advertising owners stick to the maximization of profits and neglect the principle of true advertisements. They but tise not the information for the consumers to choose reasonably but the false, exaggerating advertisement and unfair manifestation very frequently, which is the main trouble in the current problems of consumption. Therefore, on the one hand, in this study from protecting the consumers not to be involved in the false, exaggerating advertisements, the establishment of advertising ethics as advertising owner's self-control is discussed. On the other hand, the legal control regulation in Korea, involving Japan and U.S.A. are analyzed. The cases of false, exaggerating advertisements and unfair manifestation in Korea are also demonstrated. Finally, the proposals to improve the advertisements are made from the Point of government, enterprisers, and consumers.

Regulation of Professional Advertising: Focusing on Physician Advertising (전문직 표시·광고규제의 몇 가지 쟁점: 의료광고를 중심으로)

  • A commercial advertisement is not only a way of competition but also a medium of communication. Thus, it is under the constitutional protection of the freedom of business (article 15 of the Constitution) as well as the freedom of press [article 21 (1) of the Constitution]. In terms of the freedom of business or competition, it should be noted that an unfair advertising (false or misleading advertisement) can be regulated as an unfair competition, while any restraint on advertising other than unfair one might be doubted as an unjustifiable restraint of trade. In terms of the freedom of press or communication, it is important that article 21 (2) of the Constitution forbids any kind of (prior) censorship, and the Constitutional Court applies this restriction even to commercial advertising. In this article, the applicability of these schemes to advertising of the so-called learned professions, especially physician, are to be examined, and some proposals for the reformation of the current regulatory regime are to be made. Main arguments of this article can be summarized as follows: First, the current regime which requires advance review of physician advertising as prescribed in article 56 (2) no. 9 of Medical Act should be reformed. It does not mean that the current interpretation of article 21 of the Constitution is agreeable. Though a commercial advertising is a way of communication and can be protected by article 21 (1) of the Constitution, it should not be under the prohibition of censorship prescribed by article 21 (2) of the Constitution. The Constitutional Court adopts the opposite view, however. It is doubtful that physician advertising needs some prior restraint, also. Of course, there exists severe informational asymmetry between physicians and patients and medical treatment might harm the life and health of patients irrevocably, so that medical treatment can be discerned from other services. It is civil and criminal liability for medical malpractice and duty to inform and not regulation on physician advertising, to address these differences or problems. Advance review should be abandoned and repelled, or substituted by more unproblematic way of regulation such as an accreditation of reviewed advertising or a self-regulation preformed by physician association independently from the Ministry of Health and Welfare or any other governmental agencies. Second, the substantive criteria for unfair physician advertising also should correspond that of unfair advertising in general. Some might argue that a learned profession, especially medical practice, is totally different from other businesses. It is performed under the professional ethics and should not persue commercial interest; medical practice in Korea is governed by the National Health Insurance system, the stability of which might be endangered when commercial competition in medical practice be allowed. Medical Act as well as the condition of medical practice market do not exclude competition between physicians. The fact is quite the opposite. Physicians are competing even though under the professional ethics and obligations and all the restrictions provided by the National Health Insurance system. In this situation, regulation on physician advertising might constitute unjustifiable restraint of competition, especially a kind of entry barrier for 'new physicians.'
