Legal Status of Medical Personnel on Medical Records (환자의 의무기록 관련 의료인의 법적 지위)

  • This study is a paper reviewed legal status of medical personnel and issues of law on recently discovered medical records. As the increase of medical personnel who have gone through the administrative disposal in regards to the medical records, it is needed to examine the legal issue or dispute on the medical records under the current law. Medical records are the statement on patient's medical conditions made by the medical personnel. This records are used as important source for patient's further treatment. This becomes the communication route between the patients and the other medical personnel, and it provides the patients a right to find out their medical information. According to the Medical Service Act (Article 21), a medical personnel shall prepare respectively a record book of medical examination and treatment. And medical personnel shall make a signature. Furthermore, the medical personnel or the opener of the medical institutions must preserve the record book (including an electronic medical record). Meanwhile, the issues of a ban on false entry, additional record, revision or manipulation on the medical record have been recently on the rise. This paper briefly examined the major issues in regards to the medical records. It especially clarified the legal duty on medical records and its major-contentious-issues. At the same time, it pointed out the problems of the unreasonable over interpretation of the law. Furthermore, this suggested the guidelines for the further discussion and review.

  • Under the changes of administrative systems and office automation, 'the national record management system' had been reformed until 'Record Management Act' was enacted in 1999. Between 1984 and 1992, the national record management system was reformed in process of overcoming national crises and carrying out office automation. As a result, the system was absorbed into 'Governmental Document Regulations', 'Official Document Management Regulations' and 'Governmental Document Regulations'. In addition, 'government document classification scheme' and 'Record schedule' were unified into 'Official Document Classification and Record schedule'.

  • Administrative information datasets are a kind of record produced based on an organization's work performance. A dataset is evidence of the act of recording and contains a lot of information that can be used for work. Datasets have been neglected in Korea's records management system. However, as the law was revised in 2020, the management of administrative information datasets was legislated. Organizations that require management of administrative information datasets have already gradually begun record management. The core of managing administrative information datasets is the preparation of the Management Reference Table for the dataset. Regardless, there is confusion with the Records Management Reference Table for Dataset in institutions that work on records management, and it is difficult to work because the Management Reference Table for Dataset has a new concept. This study looked into the problems in the records management of datasets that appeared at the beginning of work. It isuggests a method to effectively settle records management for datasets. In that way, the Management Reference Table was selected as the research subject, and the problems discussed so far were summarized. In addition, the items of the current Management Reference Table were analyzed. As a result of the study, we have proposed the simplification of items in the Management Reference Table, the reorganization of areas in the Management Reference Table, the introduction of the concept of retention periods, and the preparation process of the Management Reference Table.

  • In this study, the improvement plan for the appropriate archives opening system in this country was proposed, by searching for the optimal operating method of opening system of archival institutions through the foreign instances related to the integrated type operation and the separate type operation. The opening system in the archival institutions shall be operated in consideration of the characteristics of the preserved archives and the various values and contexts rather than riding on the administrative logics.   • Due to the trend toward computerization of business services in public sector and the push for e-government, the volume of records that are produced in electronic system and the types of records vary as well. Of those types, dataset is attracting everyone's attention because it is rapidly being supplied. Even though the administrative information system stipulated as an electronic record production system is increasing in number, as it is in blind spot for records management, the system can be superannuated or the records can be lost in case new system is developed. In addition, the system was designed not considering records management, it is managed in an unsatisfactory state because of not meeting the features and quality requirements as records management system. In the advanced countries, they recognized the importance of dataset and then managed the archives for dataset and carried out the project on management systems and a preservation formats for keeping data. Korea also is carrying out the researches on an dataset and individual administrative information systems, but the official scheme has not been established yet. In this study the items for managing archives which should be reflected when the administrative information system is designed was offered in two respects - an identification method and a quality requirement. The major directions for this system are as follows. First, as the dataset is a kind of an electronic record, it is necessary to reflect this factor from the design step prior to production. Second, the system should be established integrating the strategy for records management to the information strategy for the whole organization. In this study, based on such two directions the strategies to establish the identification for dataset in a frame to push e-government were suggested. The problem on the archiving steps including preservation format and the management procedures in dataset archive does not included in the research contents. In line with this, more researches on those contents as well as a variety of researches on dataset are expected to be more actively conducted.

A Study on Data Adjustment and Quality Enhancement Method for Public Administrative Dataset Records in the Transfer Process-Based on the Experiences of Datawarehouses' ETT (행정정보 데이터세트 기록 이관 시 데이터 보정 및 품질 개선 방법 연구 - 데이터웨어하우스 ETT 경험을 기반으로)

  • As it grows more heavily reliant on information system, researchers seek for various ways to manage and utilize of dataset records which is accumulated in public information system. It might be needed to adjust date and enhance the quality of public administrative dataset records during transferring to archive system or sharing server. The purpose of this paper is presenting data adjustment and quality enhancement methods for public administrative dataset records, and it refers to ETT procedure and method of construction of datawarehouses. It suggests seven typical examples and processing method of data adjustment and quality enhancement, which are (1) verification of quantity and data domain (2) code conversion for a consistent code value (3) making component with combinded information (4) making a decision of precision of date data (5) standardization of data (6) comment information about code value (7) capturing of metadata. It should be reviewed during dataset record transfer. This paper made Data adjustment and quality enhancement requirements for dataset record transfer, and it could be used as data quality requirement of administrative information system which produces dataset.

A Study on the Service of the Integrated Administrative Information Dataset Management System (행정정보 데이터세트 종합관리시스템의 서비스 방안 연구)

  • According to the amendment of the Enforcement Decree of the Public Records Management Act in 2020, an administrative information dataset record management plan will be enacted, and the National Archives of Korea plans to establish an integrated administrative information dataset management system to support it. However, there is no specific service plan that considers the characteristics of the datasets and the Management Reference Table. Therefore, this paper compared and analyzed the current status of dataset services at 14 domestic and foreign public data portals and archives websites, derived implications, and proposed 6 service plans applicable to the integrated administrative information dataset management system. This study's results will lead to utilizing the administrative datasets and the activation of services.

Organizations and Records of Local Government Office in the 19th Century Through an Analysis on the Transition Documents in Yeongnam Region (19세기 영남지역 중기(重記)를 통해 본 지방관아의 조직과 기록물 연구)

  • During the Joseon period, space, organization, and personnel were essential in order to perform the administrative work for local governance. For that reason local government records were created, managed, and stored as the results of its administration. Buildings and spaces of local government office can be divided in 3 sections such as 1) administrator's space for governance and living; 2) petty officials' administrative space; 3) granary space for store rations and grains paid as tax. Because of its grand scale, a local government office had considerably complex organizational structure. In order to survey the types and forms of local government records, focusing on six transition documents (junggi, 重記) in the 19th Century Yeongnam Region, this study selected the record type documents in the item lists of the transition documents, then, classified the record type documents which were managed by the organizations in local government offices with several types: program of items (jeolmok, 節目), list of personnel or land (an, 案), register (daejang, 大帳), certified copy (deungnok, 謄錄) and muniment (wanmun, 完文), and examined these documents.

Current Status Analysis of Business Units and Retention Period Estimation related to Administrative Information Systems of Public Institutions (공공기관 행정정보시스템 관련 단위과제 및 보존기간 책정 현황분석)

  • Since the Public Records Management Act was enacted in 2007, the administrative information system has already been included in the electronic records production system, and dataset has been subject to record management as a type of electronic records. With the recent revision of the enforcement decree, dataset records management has been enacted. This study analyzes business units related to administrative information systems of public institutions and examines the current status of retention periods estimation. For this purpose, we collected 36 records classification systems from 49 public institutions among the direct management agencies of the National Archives and disaster management agencies. And we discriminated 824 business units related to administrative information system and divided into large and small groups according to types. We also compared the retention period estimation of records. The problems and improvement plans of this study are expected to be used as basic data in preparing the standard of administrative dataset management in the future.

  • The existing cadastral record cannot meet various and changing demands on land information, improve user convenience, and raise administrative efficiency. In addition, three-dimensional parcels, or spatial objects about three-dimensional space cannot be registered in the conventional cadastral record. The limitation of cadastral information based on two dimensions is quite stressing the necessity of three-dimensional cadastral record. The purpose of this study is to develop new limns of cadastral record model in order. In register three-dimensional positions and right relations of land and buildings. This study examined land cases where space was being three-dimensionally used. As the result, cadastral record models both separated by steps and integrated were developed, which can contain matters of land, buildings, and right registration about three-dimensional land parcels. Also, this study suggested a method where a building can be separately registered according to it's the superficies division.
