Recently, users of bicycles as a green mode are rising sharply, but there are few efforts to increase bicycle safety and to decrease the number of accidents between vehicles and bicycle users. Therefore, this research seeks to improve bicycle safety at intersections by analysing causation factors of bicycle accidents pattern and providing optimal intersection design guidelines. For this study, real bicycle accident data of fifty six occurred in the Incheon metropolitan area in the year of 2005 were collected and field surveys were conducted. In addition, this research developed a bicycle accident pattern model with using multinomial logit model. The model results showed that presence of fatality, presence of traffic islands on the minor road, highway_type, weather, presence of traffic bus_stop on the major road, minor road lane width, victim induce factor are significant for bicycle safety.
National Health Insurance Act has been enforced all over the People as part of the effort to assure the minimum constitutional human worth and dignity in the aspect of the right to pursue health for preventing misfortune that comes to death without even a chance to be received treatment for illness or injury. Meanwhile auto insurance is compulsory in certain parts in order to promote benefits of everyday life and the rapid recovery of the damage caused by traffic accident when one have negligently driven a car which has become the necessities in daily life. Any injured driver in a traffic accident can be treated by National Health Insurance without getting an auto insurance in various circumstances, but Article 3 paragraph 2 of Traffic Accident Act don't allow exception of criminal punishment when he has driven a car without license, drunken, or tresspassing the centerline, etc. When the injury occured by his own certain negligence is judged to 'when he has intentionally or through gross negligence caused a criminal conduct or intentionally contributed to the occurrence of an accident' of National Health Insurance Act, insurance benefits can be restricted. Such a restriction could harm the right to pursue happiness and health of People by depriving the poor, who cannot afford to pay, of chances to get treatment. Here we will see benefit restriction by 'gross negligence' of National Health Insurance Act Article 48 paragraph 1, which has largest portion of such restriction. It is desirable to delete 'gross negligence' clause from above paragraph and to interpret 'when' clause restrictively for diminishing confusion of interpreting and guaranteeing the right of health.
Incident investigation is one of the most important processes among various other safety management methods to prevent industrial accidents. Finding the root causes of accidents, eliminating hazards, and improving safety are the most important purposes of investigating accidents. During the investigation process, root cause analysis (RCA) techniques are used to effectively identify RCA. Over the past few decades, over 30 RCA methods have been developed. These techniques are being widely used in some industries, such as the nuclear and aircraft industries; however, most of the RCA techniques require professional knowledge and special training, making it difficult for safety managers in their respective fields to understand and apply them. Therefore, managers of general industrial sites are rarely present at the scene of actual accident investigations, and they cannot contribute much to the purpose and effectiveness of these investigations. In this study, to address these issues, we developed an RCA technique to facilitate root cause investigation of accidents in real-world industrial sites. To develop new techniques, Systematic Cause Analysis Technique (SCAT), one of the RCA techniques, was used to investigate incidents in the enterprise over three years. We also utilized feature analysis and other papers from existing RCA techniques. To verify its effectiveness, the technique proposed was also applied to the accident case. The technique developed can easily identify and analyze the root cause of an accident and help industrial managers. It can also identify the root cause category where accidents are concentrated and use this data to establish guidelines for preventing future accidents and, thus, focus on prioritizing improvement initiatives.

The key features of maritime accidents are the change of their attributes by new risks from time to time. To prevent maritime accidents in Korea, the impacts by new risks on domestic safety environments should be identified or predicted. The purpose of this paper is to find the hazard factors by new risks on maritime safety in Korea. The meaning of new risks is the elements of accident hazard which is compiled from new or rare or unprecedented events in the worldwide maritime transportations. The problems of new risks are the lacks of optimum countermeasures to mitigate accident risks. Using the questionnaires with 152 event scenarios classified by 20 accident causes, the hazard identification and risk analysis of new risks was performed based on the Formal Safety Assessment (FSA) by IMO. A total of 22 Influence Diagrams, which is to depict the transit flows between accident causes to consequences, is used in the construction of 152 event scenarios. A total of 20 accidents causes is the same contents as the causation factors represented in Statistical Year Book for Maritime Accidents of Korean Maritime Safety Tribunals. After defining the evaluation equations to the response results of questionnaires by 46 experts, the work for risk analysis is carried out. As results from the analysis of 152 scenarios, it is known that the root cause to affect on maritime safety in Korea is the pressure of business competition and it led to the lacks of well experienced crews, the overload of vessel operations and crew's fatigue. In addition, as results from the analysis of 20 accident causes, the three accident causes are to be candidate as main issues in Korea such as the inadequate preparedness of departure, the neglecting of watch keeping in bridge and the inadequate management of ship operations. All of the results are thought to be as basic hazard factors to safety impediments. It is thus found that the optimum Risk Control Options to remove the hazard factors and to mitigate consequences required are the following two factors: business competition and crewing problems.
In general, seafarer's human error is considered to be the preponderant muse for the majority of maritime transportation accidents in a merchant ship. The implementation techniques for Human Error Model (HEM) to assess possible accident risk by deck officers including captain, chief officer, second mate and third mate are described in this study. The scope of this work is focused to 642 deck officers in the ship management company with 130 vessels. At first, HEM can be constructed through the statistical analysis and expert's brainstorming process with human data to 642 deck officers. Then the variables $\upsilon$ for the human factors, the evaluation level EP($\upsilon$) for $\upsilon$, the weight $\alpha$ of $\upsilon$, and the title weight $\beta$ of each deck officers can be decided. In addition, through the analysis of ship's accident history, the accident causation ratios by human error ${\gamma}_H$ and by external error ${\gamma}_B$ can be found as 0.517(51.7%) and 0.483(48.3%), respectively. The correlation coefficients to $\upsilon$ are also shown significant for a 95% confidence interval (p < 0.05) for each coefficient. And the validity of HEM is also surveyed by the analysis of normal probability distribution of risk level RL to each deck officer.
It is well known that weather conditions are closely related with the number and severity of traffic accidents. At present, installation of safety countermeasures including systems is common approach to reduce the damage of traffic accidents at expressways. In this study, the differences of causation factors to influence traffic accidents considering road alignment characteristics and weather conditions. In order to identify the relationship between road and weather conditions, discriminant analysis has been performed with 500 traffic accident data at expressways. Weather conditions are divided into several categories such as snow, sunny, rain, fog, and cloud. Also, road conditions such as types of pavements, grades are analyzed. As the results, major impacting road conditions to traffic accidents are concrete pavement and 3% or more down grades. In these road conditions, visible distance will be reduced and actual braking distances will be increased. This study shows that the expressway sections under concrete pavement and down grades should be more cautious than other sections. It also shows that fog condition is the mose dangerous situation in terms of traffic accidents.
This is the first Korea study to evaluate the effects od the safety of ambulance driving and the occurrence of ambulance traffic accidents and to provide basic informaion for the description of various factors to reduce the ambulance traffic accidents. The major insturment of this study were Krean Self-Analysis Driver Opinionnaire. Questionnaire contains 8 items which measure driver's opinions or attitudes : driving courtesy, emotion, traffic law, speed, vehicle conditions, the use of drugs, high-risk behaviors, and human factors. To take the analysis of data, the total of 350 divers were investigated ambulance divers and others in Taejon City and others (6 City) from 1996. 1. July to 1996. 31. July. The data were analyzed by the descriptive statistics and the logistic regression - path analysis - with SPSS and SAS package program. The result are as follows : 1. There was desirable attitude group(16.2%) and undesirable attitude group(17.6%) on safety ambulance driving. 2. It have suggested that risk factors of ambulance traffic accidents much affected with emotion and speed control on safety ambulance driving < Y(Accdient) = -2.64 + 0.57 $X_1$ (Emotion Control) + 0.30 $X_2$(Seed control) + E > and motor traffic acident much affected with emotion control and high-risk behavior on safety driving < Y(Accident) = -1.11 + 0.33 $X_1$(Emotion Control) + 0.29 $X_2$(High-risk Behvior) + E > 4. The primary emphassis of ambulance drivers was make us realized that improthatnt factors on safety ambulance driving were 1)making way for emergent ambulance, 2)driver's career, 3)The ability of emergency medical technics, and the knowledge or under standing of ambulance way difficut(or easy) of accdess. 5. Almost 96.6% of respondents have agreed to necessity of emergency medical technics for ambulance drivers. 6. It have suggested that the proportion of traffic accident proportion by desitable attitude group(16.7%) was much less than that of undesirable attitude group(30.8%) on safety ambulance driving(P < 0.05)/Ps) Accidents are unplanned, unforesen incidents which can lead to harmful or unfortunate outcomes, Collisons are not accidents, since the basic cause of the majority of collisons invovles high-risk human behavior. Although there are many factors which contribute to accident causation, four basic factors seem to predominate in most traffic related situations. These four factors include: the human factor, the vehicle factor, the environmental factors and destination factor(Peto G. et al. 1995).
To assess the possible collision risk between Mokpo Harbour Bridge, which is under construction, and passing vessels, we proposed Real-Time Bridge-Vessel Collision Model (RT-BVCM) in this paper. The mathematical model of RT-BVCM consists of the causation probability by the vessel aberrancy due to navigation environments, the geometric probability by the structural feature of a bridge relative to a ship size and, the failure probability by the ship collision track and the stopping distance which is not to come to a stop before hitting the obstacles. Then, the probabilistic mathematical model represented as risk index with the risk level from 1 to 5. The merit of the proposed model to the collision model proposed by AASHTO (American Association of State Highway and Transportation Officials) is that it can provide enough time to take adequate collision avoiding action. Through the simulation tests to the two kinds of test ships, 3,000 GT and 10,000 GT, it is cleary found that the proposed model can be used as a collision evaluation model to the passing vessel and Mokpo Harbour Bridge.
Reduced crew performance is frequently cited as a major causal factor in maritime accident causation. Although considerable research has been conducted on the hours of work undertaken by seafarers through interviews and the analysis of records, experimental studies to observe the effects of factors such as high workload, shift patterns, stress, sleep deprivation and disturbance on the cognitive performance of mariners have been limited. Other safety-critical transport industries, such as aviation and rail, have developed fatigue management tools to help manage the work patterns of their operators. Such a tool for mariners would assist shipboard crew, marine pilots and shore management in planning and improving work schedules. The overall aim of this paper is to determine a fatigue factor, which can be applied to human performance data, as part of a software program that calculates total cognitive performance. This program enables us to establish the levels of cognitive performance of a group of marine pilots to test a decision-making task based on radar information. This paper addresses one of the factors that may contribute to the determination of various fatigue factors: the effect of different work patterns on the cognitive performance of a marine pilot.
The main issue in medical malpractice civil litigation is medical negligence and the causal relationship between medical negligence and damages. Regarding the presumption of causality in cases where medical negligence is proven, there is a previous Supreme Court decision 93da52402 on February 10, 1995, but it is difficult to find a case that satisfies the textual requirements of the above decision, and yet, in practice, the above decision is cited. In many cases, causal relationships were assumed, and criticism was consistently raised that it was inconsistent with the text of the above judgment. In its ruling, the Supreme Court reorganized and presented a new legal principle regarding the presumption of causality when medical negligence is proven in a civil lawsuit. According to this, If the patient proves ① the existence of an act that is assessed as a medical negligence, that is, a violation of the duty of care required of an ordinary medical professional at the level of medical care practiced in the field of clinical medicine at the time of medical practice, and ② that the negligence is likely to cause damages to the patient, the burden of proving the causal relationship is alleviated by presuming a causal relationship between medical negligence and damage. Here, the probability of occurrence of damage does not need to be proven beyond doubt from a natural scientific or medical perspective, but if recognizing the causal relationship between the negligence and the damage does not comply with medical principles or if there is a vague possibility that the negligence will cause damage, causality cannot be considered proven. Meanwhile, even if a causal relationship between medical negligence and damage is presumed, the party that performed the medical treatment can overturn the presumption by proving that the patient's damage was not caused by medical negligence. Meanwhile, unlike civil cases, the standard is 'proof beyond reasonable doubt' in criminal cases, and the legal principle of presuming causality does not apply. Accordingly, in a criminal case of professional negligence manslaughter that was decided on the same day regarding the same medical accident, the case was overturned and remanded for not guilty due to lack of proof of a causal relationship between medical negligence and death. The above criminal ruling is a ruling that states that even if 'professional negligence' is recognized in a criminal case related to medical malpractice, the person should not be judged guilty if there is a lack of clear proof of 'causal relationship'.
