A Study on the Vicarious Liability of Employers in China - Focus on Article 35 of Tort Liability Law - (중국의 사용자책임에 관한 연구 - 불법행위책임법 제35조를 중심으로 -)

  • With the development of market economy, it has been a legislative trend to establish a system for vicarious liability of employers. China also established Tort Liability Law of People's Republic of China in 2009 and ruled responsibility of the employers for the acts for their employees through Art. 35. First, the employer's right to indemnity to an employee should be recognized, because employer's superintendence is much weak and economic power is similar between them. Second, an employer should take a responsibility for an unpaid employee as vicarious liability, because the Law did not exclude them from employees. Lastly, in case the Law conflicts with Interpretation of the Supreme People's Court on Certain Issues Concerning the Application of Law in Trying Cases Involving Compensation for Personal Damage, the Law should be regarded it has priority based on several related Principles. Regarding these matters, this study guides you to an analysis of vicarious liability of employers in China, benefits with a view to the perfection of the vicarious liability regime.

  • File sharing through P2P was decided as illegal according to Supreme Court of the U.S. and the Highest Court of Korea in 2005. Metro-Goldwyn-Mayer Studios Inc. et al. v. Grokster, LTD., et al. and Soribada v. Korea Association for Music Providers have the same ground for decision. P2P service company has vicarious liability for illegal file sharing of its customers. Balance between copyright protection and development of technology was considered in that decision. Programmer who will develop new program for free download and copyright holders who will exploit every measures to protect their right may compromise for their mutual benefits.

  • Internet users and copyright holder have been at the center of a severe legal dispute because file-sharing soft (P2P) through Napster aggravates the violation of copyright as well as takes on the world. Though it is natural that we should hold users a criminal penalty for the illegal use of various computer programs, I think that if the supply of a computer program is generally within a circle of development act, program developer ought not to hold users criminally liable for the unintended illegal act of users. Two main issues are addressed in this work: (i) the basis and validity of legal responsibility and condemnation that appear in the precedent set as to P2P in America, Japan, and Korea. (ii) the necessity of both scientific technology development and efficient legal regulation of copyright holder. For this purpose, software development and legal regulation are reviewed analyzed from viewpoint of the criminal law.
