미국중재법과 중재합의 (Arbitration Law of The United States and The Arbitration Agreement)

  • The Federal Arbitration Act and the States Arbitration acts of the United States approve that the an arbitration clause should be construed broadly and the Courts interpreted it broadly without being curbed by the written meaning of clause itself. The Courts also divided the interpretation of arbitration clause from the interpretation of other clauses of contract to approve the validity of arbitration clause and further expanded the scope of arbitration. However, the Arbitration Act of Korea does not specify a general principle about how an arbitration clause should be interpreted. The Supreme Court did not have a case yet but the lower courts kept their posture that an arbitration clause should be clear by resulting narrow interpretation and should be written to the extent that it excludes the power of courts from jurisdiction. As a result, there would be cases that arbitration is not permitted although an arbitration clause exists. The parties intending arbitration are frustrated about how to draft an arbitration clause into their agreement. There were the cases that the parties which took the prevailing position attempted to delay dispute resolutions by dragging disputes into litigation even if they agreed to resolve through arbitration, on the basis that an arbitration clause was incomplete. Although the arbitration statutes of the United States cannot apply in Korea, the way of their approaches to the interpretation of arbitration clause can be taken into consideration in view of the globalization of arbitration.

Hamaticyclops ahni, a New Genus and Species of the Family Clausidiidae (Crustacea, Copepoda, Poecilostomatoida) from California, United States

  • Hamaticyclops ahni is described as a new genus and species from the Californian shore of the United States. It was discovered as a victim of the sea anemone Anthopleura elegantissima (Brandt). The new genus is closely related to the genus Hemicyclops but possesses, as significant autapomorphies, three strong claws on the second endopodal segment of antenna and a markedly elongate exopod of leg 5 with its protopod fused to somite.

  • Marketing information systems become a competitive weapon that supports firms in making decisions on the operation of marketing-related activities. However, little research regarding the operating strategy of marketing information systems has been conducted in Korea. Considering that this issue has been studied in the United States, this paper conducted a global benchmarking on the operating strategy of marketing information systems between Korean and the United States firms. The result of this global benchmarking suggests recommendations on supports from three management levels, the mix of 4P, the management of marketing, data from environment, and information sources.

'Nobody helps the family.' South Korean Cultural Identity in Bong Joon-ho's The Host (2006)

  • This article examines Bong Joon-ho's science fiction/horror film, The Host (2006) and interrogates its depiction of a contemporary South Korean family in crisis. The writer considers the film as a resonant cultural artefact and a manifestation of particularly new-millennial anxieties concerned with the continued involvement of the United States in South Korean affairs, fears of an erosion of traditional family values and mistrust of officious, state endorsed bureaucracy. The Host emerges as a profoundly visceral depiction of an ordinary family set against everyone with no one to turn to except each other.

미국과 한국의 홈스쿨링 법제화 비교연구 (A Comparative Study on the Legislation of Homeschooling in the United States and South Korea)

  • 본 연구의 목적은 미국과 한국의 홈스쿨링 법제화를 비교 분석하여 향후 한국의 홈스쿨링 법제화 방안을 모색하는 데 있다. 이를 위해 선행연구와 관련 자료를 검토하여 분석준거를 도출하고, 그에 대한 하위범주로 분석내용을 도입하여 미국의 홈스쿨링 주 법률과 한국의 홈스쿨링 법률안을 비교 분석하였다. 주요 분석결과는 다음과 같다. 첫째, 홈스쿨링 허용절차 중 의향 신고에 대해서는 양자 모두에 관련 규정이 대체로 포함되어 있다. 둘째, 홈스쿨링 요구조항에 대해서는 미국 주 법률에는 관련 규정이 대체로 포함되어 있는 데 반해 한국 법률안에는 관련 규정이 거의 포함되어 있지 않다. 셋째, 공립학교 접근 정책에 대해서는 양자 모두에 관련 규정이 포함되어 있지 않다. 넷째, 교육지원서비스에 대해서는 미국 주 법률에는 관련 규정이 대체로 포함되어 있지 않으나 한국 법률안에는 관련 규정이 모두 포함되어 있다. 다섯째, 미국 홈스쿨링에 대한 주 법률의 규제 정도 측면에서 보면, 한국 홈스쿨링 법률안은 약한 규제 정도에 해당한다. 이상의 분석 결과를 토대로 결론 및 논의를 하였다.
