인터넷 콘텐츠서비스 이용약관의 불공정성 검토에 관한 연구 (A Study on the Unfairness of Adhesion Contracts for Internet Contents Service)

  • The purpose of this study was to explore the unfairness of adhesion contracts for internet contents service. The internet contents were classified into six types of avatar, learning, download, e-book and movie internet sites. The adhesion contracts of internet contents service were collected in 60 internet sites. The unfairness of the adhesion contract was reviewed under the adhesion contract regulation act. The major results were as follows. First, the obligation of clear statement, explanation, and delivery was not observed completely. Second, many articles of adhesion contract were unfair and they especially violated articles 7 and 9. Therefore, the standard adhesion contract system for internet content service should be enforced and self-regulation of information service providers is needed.

엔터테인먼트분쟁 해결을 위한 중재제도의 활성화 방안 (A Study on the Activation of Arbitration System for Entertainment Disputes Resolution)

  • The entertainment industry has developed along with current Korean wave fever, and so entertainment-related disputes are increasing rapidly. Litigation is a poor fit for entertainment disputes because of characteristics such as temporal sensitivity. Thus, in the US, the entertainment industry resolves these disputes through ADR mechanisms like arbitration, but cases of settling such disputes through arbitrations are very rare in Korea. This study examined the characteristics and types of entertainment disputes and considered the compatibility of arbitration as a method for settling disputes, and then suggested tasks for revitalizing arbitration systems as entertainment dispute resolution procedures. Arbitrations have many merits, such as the rapid pace of procedures, confidentiality, satisfying the long-term desires of business relationships, the low cost of settling disputes, judgments rendered by experts, etc.; thus, it is a very suitable mechanism to settle entertainment-related disputes. The study proposes necessary steps for revitalizing arbitration systems for entertainment disputes. First, awareness of entertainment industry workers about the arbitration system should be raised. Second, special educational programs for members the of Korean Commercial Arbitration Board related to entertainment should be set up and operated together with encouraging positive attitudes toward actions like establishing a dedicated arbitration unit on entertainment disputes. Third, neutral, professional arbitrators should be secured and aggressive disclosures made. Fourth, a professional ADR organization such as an "Entertainment Arbitration Committee" should be established.

가구디자인에 있어서의 네오-아방가르드적 특성 연구 -1960년대 전후 사조를 중심으로- (A Study on Characteristics of Neo-Avant-Garde in Furniture Design -Focusing on the Thought before and after the 1960s-)

  • The historian called Peter Burger divided it into historical avant-garde before and after the first World War (Dadaism, Futurist, Geometric Abstract, etc.) and Neo- avant-garde during the period of forming social foundation that would be ready to accept new forms of art in the USA, the center of capitalism, after the 2nd World War such as pop art and conceptual art including the then emerging avant-garde minimal art. Meanwhile, he interpreted that Neo- avant-garde succeeded the spirit of historical avant-garde. For modem furniture, the avant-garde terminologies are discussed from the aspect of epistemology or symbolism. On the other hand, they would be exclusively used for advertising slogans, however, it is considered as difficult due to vague terms or their characteristics. This study relates the points of historians such as Peter Burger for theoretical proposal and Richard Kostelanetz's point for formal issues, and contracts and arranges the avant-garde terminologies and its characteristics to the meaning of "getting out of the present decadent trend - aiming for future", "transcending the present aesthetic custom - renovation" and "violating the rules already established in the process of entering new areas - freshness of unfairness". The study was meaningful in providing fundamental clues based on the historical discussion and artists for Neo- avant-garde in the 1960s, that is, the mainstream of design at the end of the 20th century in the period when an avant-garde oriented alternative in the 21st century design has been sincerely required overflowed with the fin de siecle phenomenon.

심리적 자본이 이직의도에 미치는 영향과 조직몰입의 매개효과에 대한 연구 : 건설업 종사자를 중심으로 (A Study on Effect of Psychological Capital on Turnover Intention & Mediating Effect of Organizational Commitment: Focusing on Construction Industry Workers)

  • 본 연구는 건설업체 종사자들을 대상으로 심리적자본과 조직몰입 그리고 이직의도와의 관계를 실증적으로 검증하고자 하며 이직의도를 낮추거나 완화시키기 위한 방안을 도출하는 것을 목적으로 한다. 주어진 환경에서 조직 구성원들의 태도나 행동이 어떠한 영향을 주는지 확인하기 위해 심리적 자본을 희망, 복원력(탄력성), 자기효능감, 낙관성의 4개 요인으로 구분하였다. 이를 위해 수도권 지역의 건설업 종사자를 대상으로 310부를 분석에 활용하였으며 심리적자본이 조직몰입과 이직의도에 영향을 미치는지, 조직몰입이 이직의도에 어떠한 영향이 있는지, 조직몰입이 심리적자본과 이직의도의 관계에서 매개효과를 나타내는지 검증하고자 하였다. 심리적자본과 이직의도의 관계를 분석한 결과, 희망과 자기효능감은 이직의도에 부(-)의 영향을 미치며, 복원력과 낙관성은 유의한 영향을 미치지 못하는 것으로 나타났다. 심리적자본과 조직몰입의 관계를 분석한 결과, 희망, 복원력, 낙관성은 조직몰입에 정(+)의 영향을 미치며, 자기효능감은 유의한 영향을 미치지 못하는 것으로 나타났다. 조직몰입 매개효과를 검증한 결과, 심리적 자본의 하위요인 중 희망과의 관계에서 이직의도에 유의한 매개효과를 나타내는 것으로 확인되었다. 기존 선행연구들은 건설업 종사자들의 이직의도에 대한 외부적인 측면을 주로 고려하였다면, 연구를 통해 심리적인 측면에 접근하여 조직몰입을 더 높이고, 이직의도를 완화시키고자 했다는 점에서 학문적 시사점이 있다. 실무적 시사점으로는 건설업 종사자들의 심리적 요인 중 자기효능감과 조직에서의 직무에 대한 희망이 높을수록 심리적 안정 속에서 직무를 이행하기 때문에 이직의도가 낮아진다는 것을 확인하였다. 따라서, 자기효능감과 희망을 향상 시킬 수 있도록 직무 자율성 부여, 유연한 근무 등과 같은 다양한 제도 정비가 마련되어야 할 필요가 있다.
