Comparative Study on the Aviation Monetary Penalty in Korea and the United States (한·미 항공 과징금 제도의 비교)

  • The monetary penalties system inherently has efficiency as DNA. In the event that administrative measures to recover unfair profits from businesses that violate the law, deprive business licenses, or order to suspend business, infringe the interests of ordinary consumers, a system that can achieve the same effect through financial sanctions. It is a monetary penalties. In addition, it is convenient for the government because it takes effect only by the administrative agency's unilateral imposition order compared to the trial process, which takes a long time and huge cost to prove the illegality. However, it is questionable whether procedural legitimacy is well established in Korea's aviation monetary penalties. Compared to foreign legislation, Korea's aviation monetary penalties system need to be improved. This paper was for the purpose of studying the improvement direction of the monetary penalties system disposed of in the Korean aviation field. This study suggests the direction by examining the US system, which is an aviation advanced country, in the aviation safety area. The research was conducted with the intention of exploring the direction as follows: First, the characteristics of the Federal Aviation Administration (FAA) aviation administrative sanctions and the US aviation penalty system will be outlined. Furthermore, with the recent paradigm shift in aviation safety management, this paper tried to look at new trends that focus on autonomous reporting of aviation safety as a proactive and preventive measure in conventional post-airline accident management administration, focusing on various systems including ASAP. This article also reviewed the formal process for imposing monetary penalties adopted by the FAA. Based on the above review, this paper also looked at ways to improve the reporting system for aviation safety in Korea.

Study on Improvement of Family Assistance System for Victim's Family of Air Traffic Accident (항공사고 피해자 가족지원 제도개선 연구)

  • In the event of an air accident, the media and members of the general public pay attention to the victim of the accident and are deeply concerned about their actions and rewards. However, through the accident of Air China(CCA) Flight 129, which occurred in 2002, we were able to confirm that it is a real problem that the victims of the air accident as well as the victims suffer much suffering and serious aftermath. Nevertheless, Korea's system for assistance the families of victims of air accident is very poor. On the other hand, when Trans-World Airlines(TWA) Flight 800 exploded and crashed over the Atlantic Ocean in 1996, the United States enacted a law to assistance the families of the victims of the accident. According to this law, systematic assistance and management of not only the victims of the accident but also their families, minimize the additional damage of victims and victims' families and help them to get rid of the accident after the accident. In particular, the measures taken by the US authorities in response to an accident in which an Asiana Airlines flight(AAR) 214 crashed during a landing at San Francisco International Airport in 2013, made a lot of suggestions for us to assistance the victims and their families in an air accident. The purpose of this paper is to suggest the necessity of improving the system for victims and victim's family assistance in air accident. In this paper, we analyze the domestic and foreign legal systems and related cases in past accidents, identify the deficiencies of the Korean system, and derive the necessity to improve the related system. It is also important to make sure that victims' families are relieved from early psychological and economic shocks and that the results of accident investigations are reliable. Relevant ministries, airlines, and related agencies should recognize that prompt and systematic assistance and cooperation is needed to ensure that victims and families are relieved of the impact and confidence in the investigation, as is the case in the United States. In addition, efforts should be made to supplement the related laws for the assistance of aircraft victims and victims' families, to establish manuals for implementation, to plan and to implement them promptly in the event of an accident. To achieve this, it is necessary to establish regulations for the legal institutionalization of the roles and responsibilities of national and state agencies on victims of aviation accidents and family assistance. And the victim and family assistance plan that the airline has to submit to it, as specified in the current law, need to specify that item. In addition, new and supplemented contents should be integrated into a single clause or proposed as a separate special law for the purpose of applying a clear law.

A Study on the Implications of Korea Through the Policy Analysis of AI Start-up Companies in Major Countries (주요국 AI 창업기업 정책 분석을 통한 국내 시사점 연구)

  • As artificial intelligence (AI) technology is recognized as a key technology that will determine future national competitiveness, competition for AI technology and industry promotion policies in major countries is intensifying. This study aims to present implications for domestic policy making by analyzing the policies of major countries on the start-up of AI companies, which are the basis of the AI industry ecosystem. The top four countries and the EU for the number of new investment attraction companies in the 2023 AI Index announced by the HAI Research Institute at Stanford University in the United States were selected, The United States enacted the National AI Initiative Act (NAIIA) in 2021. Through this law, The US Government is promoting continued leadership in the United States in AI R&D, developing reliable AI systems in the public and private sectors, building an AI system ecosystem across society, and strengthening DB management and access to AI policies conducted by all federal agencies. In the 14th Five-Year (2021-2025) Plan and 2035 Long-term Goals held in 2021, China has specified AI as the first of the seven strategic high-tech technologies, and is developing policies aimed at becoming the No. 1 AI global powerhouse by 2030. The UK is investing in innovative R&D companies through the 'Future Fund Breakthrough' in 2021, and is expanding related investments by preparing national strategies to leap forward as AI leaders, such as the implementation plan of the national AI strategy in 2022. Israel is supporting technology investment in start-up companies centered on the Innovation Agency, and the Innovation Agency is leading mid- to long-term investments of 2 to 15 years and regulatory reforms for new technologies. The EU is strengthening its digital innovation hub network and creating the InvestEU (European Strategic Investment Fund) and AI investment fund to support the use of AI by SMEs. This study aims to contribute to analyzing the policies of major foreign countries in making AI company start-up policies and providing a basis for Korea's strategy search. The limitations of the study are the limitations of the countries to be analyzed and the failure to attempt comparative analysis of the policy environments of the countries under the same conditions.

  • The domestic ESCO project was introduced in 1992 as one of the energy efficiency improvement programs. In recent energy market, the changes in the market conditions such as smart grid, renewable energy, and the importance of demand response became important issues. As the diversified business models are required, examples of overseas exercises are examined. Business areas in Europe or the US where the ESCO industry has been active include measures to improve the efficiency of energy facilities in all areas, ranging from energy supply facilities and energy services to end users. This type of ESCO overseas business model can be classified into various types such as project execution method, supplier demand management, financing method, climate change and emission rights, new and renewable energy, and other criteria. In this study, we propose to adopt IEC (Integrated Energy Contracting) contract method in domestic ESCO market for additional business models. Current convention of listing the specific individual business types being allowed by regulation turned out to be obstacles to the revitalization of the related market. In order to achieve the goal of energy conservation, it is recommended, instead, to revise the current funding guidelines to be a negative system.

Research on Measures to Enhance Railroad Security Checks of Railroad Police Officers to Prevent Terrorist Attacks (철도테러 예방을 위한 철도경찰 보안검색 강화 방안 연구)

  • Countries across the globe, including those in Europe, are waging a "war against terrorism" as international terrorist groups such as ISIS and lone-wolf terrorists have unleashed various large-scale attacks on rail infrastructure. Anti-South Korean sentiment exists in Muslim-majority countries because the nation has cooperated with the US for its military interventions in the Middle East, and ISIS has threatened to target South Korea four times since September 9, 2015. In addition, North Korea has been left isolated in the international community with its missile and nuclear tests, while further escalating inter-Korean tension and threatening to strike major facilities and attack important figures in the South. These situations imply that South Korea is no longer immune to terrorist attacks. If the nation fails to prevent or deter such terrorist attacks against rail networks, massive casualties, property damage and social confusion would be unavoidable, deteriorating national and international trust in its counter-terrorism policies. This may lead to a national crisis involving decreases in the number of tourists, dampened interest of foreign investors, and capital flight. This study aims to propose policy measures to enhance railroad security checks, based on the work of railroad police officers, for the sake of protecting citizens and public safety. The suggestions include an incremental expansion of railroad security checks; growth of the railroad police force and adjustment of their policing distribution with other police officers; enhancement of security systems across important rail networks; improvement of the Railroad Safety Act; Southeast Asia, including the corresponding strengthening of the national crackdown illegal immigrants, and plans for pre-emptive and regular cooperation among organizations related to the promotion of security checks and the prevention of terrorist attacks.

  • NLP means the technology that mechanically analyzes a language spoken by a human and makes it into a form that can be understood by a computer. This is important because it is a core technology for communication between humans and devices, which is the basis of artificial intelligence. In this paper, I analyzed patent information of US and Korea in order to identify technical trends related to NLP, especially semantic analysis. and the purpose of this study is to provide meaningful information for future research on NLP. In conclusion, the number of Korea patents is 7.9% compared to the USA and the different frequencies of the major keywords were found to differ from country to country in technical direction. In addition, the upward or downward keywords are twice as many in the U.S. as in Korea, and reflect the trend of the times relatively more. Based on these results, in future study, I will analysis how upward trending keywords are described in actual patents for concrete technology prediction.

  • For Singapore, 2017 was an uneasy year. The presidential election was fraught with controversy since the revised Presidential Election Act allowed only one candidate to be eligible for the election. The bitter feud between Prime Minister Lee Hsien Loong and his siblings shocked many Singaporeans. Succession planning for the next top leadership is still veiled in obscurity. The anti-globalization trend and the increasing pressure to raise the tax have become major challenges for Singapore's economy to overcome. China's continuous diplomatic pressure has called into the question Singapore's pragmatic foreign policy. Although its relations with China were back to normal, Singapore, the ASEAN chair in 2018, is still facing intractable problems in safeguarding ASEAN centrality in the growing US-China rivalry. In the meantime, Singapore has pursued its diversity and equality, heading toward a more matured multi-racial and multi-cultural society in 2017. The first female president, Halimah Yacob, served as a symbolic epitome of Singapore's emphasis on diversity and harmony among different ethnic groups and minorities. This great milestone, however, has largely been questioned by Singaporeans, as it seemed to be a political gesture that only utilized Halimah's double minority in the level of ideologies. The election of the Malay president has led Singaporeans to think about the real equity and equality among minorities, while strongly motivated to move toward a more inclusive society. In 2018, Singaporean leaders will try to resolve many challenging problems by reaffirming leadership succession planning, which is expected to lead Singapore to pursue a more integrated society.

  • Through specific cases, this article examines the causes and measures to overcome cultural divergences most frequently encountered by Koreans living in Vietnam and Korean-contacting Vietnamese in terms of mode of communication, mode of living and mode of doing business. Historical reality proves that Vietnam and Korea have a lot in common in history, culture and society, due to the influence from the Chinese culture on both countries. However, each country has its own acculturation, hence, there exist, apart from the normal dissimilarities, differences between the two countries especially in natural environment andpolitical systems. As a result, in Vietnam, Koreans and Vietnamese have met with quite a lot of divergences in communication, business and living activities. In order to overcome these cultural divergences, in addition to the ceaseless efforts made by Koreans in Vietnam and Korean-contacting Vietnamese, there should be concern, assistance as well as cooperation between the people and the authorities of the two countries. We should draw lessons from the groundless or trivial affairs which, springing from the Chinese people's dislike for Koreans, have been blown up and disseminated on the internet; where by we are to reconsider the relationship between Koreans and Vietnamese. What is more, Korea still feels historically ashamed to have sent nearly 350,000 soldiers to the wa rin Vietnam for economic purposes in the past. As our predecessors brought about that historic shame to get bread for our fatherland in exchange, our generation today should approach Vietnam out of a sense of responsibility towards history. Having experienced a period of economic difficulties, Vietnam innovated and started its open-door policy in 1987. However, this event should not be regarded as the reason for us to approach Vietnam with only one rigid economic principle.

A Dilemma of Kyrgyzstan Goes Through the Process of Nation-Building: National Security Problems and Independent National Defense Capability (국가건설과정에서 키르기스스탄의 국가안보와 자주국방의 딜레마)

  • The regions of Central Asia have each acquired an elevated strategic importance in the new security paradigm of post-September 1lth. Comprised of five states, Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan and Uzbekistan, Central Asia's newly enhanced strategic importance stems from several other factors, ranging from trans-national threats posed by Islamic extremism, drug production and trafficking, to the geopolitical threats inherent in the region's location as a crossroads between Russia, Southwest Asia and China. Although the U.S. military presence in the region began before September 11th, the region became an important platform for the projection of U.S. military power against the Taliban in neighboring Afghanistan. The analysis goes on to warn that 'with US troops already in place to varying extents in Central Asian states, it becomes particularly important to understand the faultlines, geography, and other challenges this part of the world presents'. The Kyrgyz military remains an embryonic force with a weak chain of command, the ground force built to Cold War standards, and an almost total lack of air capabilities. Training, discipline and desertion - at over 10 per cent, the highest among the Central Asian republics - continue to present major problems for the creation of combat-effective armed forces. Kyrgyzstan has a declared policy of national defence and independence without the use of non-conventional weapons. Kyrgyzstan participates in the regional security structures, such as the Collective Security Treaty Organisation (CSTO) and the Shanghai Co-operation Organisation (SCO) but, in security matters at least, it is dependent upon Russian support. The armed forces are poorly trained and ill-equipped to fulfil an effective counter-insurgency or counter-terrorist role. The task of rebuilding is much bigger, and so are the stakes - the integrity and sovereignty of the Kyrgyz state. Only democratization, the fight against corruption, reforms in the military and educational sectors and strategic initiatives promoting internal economic integration and national cohesion hold the key to Kyrgyzstan's lasting future

The lesson From Korean War (한국전쟁의 교훈과 대비 -병력수(兵力數) 및 부대수(部隊數)를 중심으로-)

  • Just before the Korean War, the total number of the North Korean troops was 198,380, while that of the ROK(Republic of Korea) army troops 105,752. That is, the total number of the ROK army troops at that time was 53.3% of the total number of the North Korean army. As of December 2008, the total number of the North Korean troops is estimated to be 1,190,000, while that of the ROK troops is 655,000, so the ROK army maintains 55.04% of the total number of the North Korean troops. If the ROK army continues to reduce its troops according to [Military Reform Plan 2020], the total number of its troops will be 517,000 m 2020. If North Korea maintains the current status(l,190,000 troops), the number of the ROK troops will be 43.4% of the North Korean army. In terms of units, just before the Korean War, the number of the ROK army divisions and regiments was 80% and 44.8% of North Korean army. As of December 2008, North Korea maintains 86 divisions and 69 regiments. Compared to the North Korean army, the ROK army maintains 46 Divisions (53.4% of North Korean army) and 15 regiments (21.3% of North Korean army). If the ROK army continue to reduce the military units according to [Military Reform Plan 2020], the number of ROK army divisions will be 28(13 Active Division, 4 Mobilization Divisions and 11 Local Reserve Divisions), while that of the North Korean army will be 86 in 2020. In that case, the number of divisions of the ROK army will be 32.5% of North Korean army. During the Korean war, North Korea suddenly invaded the Republic of Korea and occupied its capital 3 days after the war began. At that time, the ROK army maintained 80% of army divisions, compared to the North Korean army. The lesson to be learned from this is that, if the ROK army is forced to disperse its divisions because of the simultaneous invasion of North Korea and attack of guerrillas in home front areas, the Republic of Korea can be in a serious military danger, even though it maintains 80% of military divisions of North Korea. If the ROK army promotes the plans in [Military Reform Plan 2020], the number of military units of the ROK army will be 32.5% of that of the North Korean army. This ratio is 2.4 times lower than that of the time when the Korean war began, and in this case, 90% of total military power should be placed in the DMZ area. If 90% of military power is placed in the DMZ area, few troops will be left for the defense of home front. In addition, if the ROK army continues to reduce the troops, it can allow North Korea to have asymmetrical superiority in military force and it will eventually exert negative influence on the stability and peace of the Korean peninsular. On the other hand, it should be reminded that, during the Korean War, the Republic of Korea was attacked by North Korea, though it kept 53.3% of troops, compared to North Korea. It should also be reminded that, as of 2008, the ROK army is defending its territory with the troops 55.04% of North Korea. Moreover, the national defense is assisted by 25,120 troops of the US Forces in Korea. In case the total number of the ROK troops falls below 43.4% of the North Korean army, it may cause social unrest about the national security and may lead North Korea's misjudgement. Besides, according to Lanchester strategy, the party with weaker military power (60% compared to the party with stronger military power) has the 4.1% of winning possibility. Therefore, if we consider the fact that the total number of the ROK army troops is 55.04% of that of the North Korean army, the winning possibility of the ROK army is not higher than 4.1%. If the total number of ROK troops is reduced to 43.4% of that of North Korea, the winning possibility will be lower and the military operations will be in critically difficult situation. [Military Reform Plan 2020] rums at the reduction of troops and units of the ground forces under the policy of 'select few'. However, the problem is that the financial support to achieve this goal is not secured. Therefore, the promotion of [Military Reform Plan 2020] may cause the weakening of military defence power in 2020. Some advanced countries such as Japan, UK, Germany, and France have promoted the policy of 'select few'. However, what is to be noted is that the national security situation of those countries is much different from that of Korea. With the collapse of the Soviet Unions and European communist countries, the military threat of those European advanced countries has almost disappeared. In addition, the threats those advanced countries are facing are not wars in national level, but terrorism in international level. To cope with the threats like terrorism, large scaled army trops would not be necessary. So those advanced European countries can promote the policy of 'select few'. In line with this, those European countries put their focuses on the development of military sections that deal with non-military operations and protection from unspecified enemies. That is, those countries are promoting the policy of 'select few', because they found that the policy is suitable for their national security environment. Moreover, since they are pursuing common interest under the European Union(EU) and they can form an allied force under NATO, it is natural that they are pursing the 'select few' policy. At present, NATO maintains the larger number of troops(2,446,000) than Russia(l,027,000) to prepare for the potential threat of Russia. The situation of japan is also much different from that of Korea. As a country composed of islands, its prime military focus is put on the maritime defense. Accordingly, the development of ground force is given secondary focus. The japanese government promotes the policy to develop technology-concentrated small size navy and air-forces, instead of maintaining large-scaled ground force. In addition, because of the 'Peace Constitution' that was enacted just after the end of World War II, japan cannot maintain troops more than 240,000. With the limited number of troops (240,000), japan has no choice but to promote the policy of 'select few'. However, the situation of Korea is much different from the situations of those countries. The Republic of Korea is facing the threat of the North Korean Army that aims at keeping a large-scale military force. In addition, the countries surrounding Korea are also super powers containing strong military forces. Therefore, to cope with the actual threat of present and unspecified threat of future, the importance of maintaining a carefully calculated large-scale military force cannot be denied. Furthermore, when considering the fact that Korea is in a peninsular, the Republic of Korea must take it into consideration the tradition of continental countries' to maintain large-scale military powers. Since the Korean War, the ROK army has developed the technology-force combined military system, maintaining proper number of troops and units and pursuing 'select few' policy at the same time. This has been promoted with the consideration of military situation in the Koran peninsular and the cooperation of ROK-US combined forces. This kind of unique military system that cannot be found in other countries can be said to be an insightful one for the preparation for the actual threat of North Korea and the conflicts between continental countries and maritime countries. In addition, this kind of technology-force combined military system has enabled us to keep peace in Korea. Therefore, it would be desirable to maintain this technology-force combined military system until the reunification of the Korean peninsular. Furthermore, it is to be pointed out that blindly following the 'select few' policy of advanced countries is not a good option, because it is ignoring the military strategic situation of the Korean peninsular. If the Republic of Korea pursues the reduction of troops and units radically without consideration of the threat of North Korea and surrounding countries, it could be a significant strategic mistake. In addition, the ROK army should keep an eye on the fact the European advanced countries and Japan that are not facing direct military threats are spending more defense expenditures than Korea. If the ROK army reduces military power without proper alternatives, it would exert a negative effect on the stable economic development of Korea and peaceful reunification of the Korean peninsular. Therefore, the desirable option would be to focus on the development of quality of forces, maintaining proper size and number of troops and units under the technology-force combined military system. The tableau above shows that the advanced countries like the UK, Germany, Italy, and Austria spend more defense expenditure per person than the Republic of Korea, although they do not face actual military threats, and that they keep achieving better economic progress than the countries that spend less defense expenditure. Therefore, it would be necessary to adopt the merits of the defense systems of those advanced countries. As we have examined, it would be desirable to maintain the current size and number of troops and units, to promote 'select few' policy with increased defense expenditure, and to strengthen the technology-force combined military system. On the basis of firm national security, the Republic of Korea can develop efficient policies for reunification and prosperity, and jump into the status of advanced countries. Therefore, the plans to reduce troops and units in [Military Reform Plan 2020] should be reexamined. If it is difficult for the ROK army to maintain its size of 655,000 troops because of low birth rate, the plans to establish the prompt mobilization force or to adopt drafting system should be considered for the maintenance of proper number of troops and units. From now on, the Republic of Korean government should develop plans to keep peace as well as to prepare unexpected changes in the Korean peninsular. For the achievement of these missions, some options can be considered. The first one is to maintain the same size of military troops and units as North Korea. The second one is to maintain the same level of military power as North Korea in terms of military force index. The third one is to maintain the same level of military power as North Korea, with the combination of the prompt mobilization force and the troops in active service under the system of technology-force combined military system. At present, it would be not possible for the ROK army to maintain such a large-size military force as North Korea (1,190,000 troops and 86 units). So it would be rational to maintain almost the same level of military force as North Korea with the combination of the troops on the active list and the prompt mobilization forces. In other words, with the combination of the troops in active service (60%) and the prompt mobilization force (40%), the ROK army should develop the strategies to harmonize technology and forces. The Korean government should also be prepared for the strategic flexibility of USFK, the possibility of American policy change about the location of foreign army, radical unexpected changes in North Korea, the emergence of potential threat, surrounding countries' demand for Korean force for the maintenance of regional stability, and demand for international cooperation against terrorism. For this, it is necessary to develop new approaches toward the proper number and size of troops and units. For instance, to prepare for radical unexpected political or military changes in North Korea, the Republic of Korea should have plans to protect a large number of refugees, to control arms and people, to maintain social security, and to keep orders in North Korea. From the experiences of other countries, it is estimated that 115,000 to 230,000 troops, plus ten thousands of police are required to stabilize the North Korean society, in the case radical unexpected military or political change happens in North Korea.
