영국 역사정원 보전정책과 관리현황에 대한 연구 - 내셔널 트러스트를 중심으로 - (A Study of the Conservation Policy and Management Status of Historic Gardens in England - Focused on the National Trust -)

  • 본 연구는 영국 내셔널 트러스트에 대한 개요와 함께 중요한 보전 대상의 하나로 관리되고 있는 역사정원에 대한 보전 정책과 관리현황에 대한 조사와 이를 통하여 한국 역사정원 보전을 위한 시사점을 도출하고자 한다. 연구의 방법은 크게 3단계로 나누어 진행하였다. 첫 번째 단계는 본 연구의 기본 개념인 내셔널 트러스트 및 영국의 역사정원 보전을 이해하는 단계로써, 문헌고찰을 통하여 이루어졌다. 두 번째 단계로 1996년 만들어진 정책서에 담겨진 내용을 분석하여 정책을 8개 부분으로 분류하여 각 부분에 대한 주요 정책을 요약하고, 내셔널 트러스트 소유의 정원 216개소의 성격을 문헌을 통하여 분석하였다. 또한, 관리 시스템 및 현황은 216개 정원의 관리 책임자와 이메일 인터뷰를 통해서 분석하였다. 마지막으로 두 단계의 결과들을 종합하여 영국 내셔널 트러스트 의 역사정원 보전 정책을 파악하고, 현황을 종합 분석하여 시사점을 도출하였다. 영국 내셔널 트러스트의 역사정원 보전에 대한 중요 특징으로는 취득을 기본으로 직접관리, 유지, 감독으로 이루어지는 일련의 보전 시스템을 구축하여 그 효과를 극대화 하고 있다는 점이다. 또한, 이에 대한 보전 원리가 간결하며 이해하기 쉽게 정립이 되었다는 점을 들 수 있다. 이에 따른 내셔널 트러스트의 활동에 대한 본 연구의 결과는 조직적 관리를 통한 역사정원에 대한 중요성 인식 및 책임, 취득하여 관리를 통한 자연과 문화적 요소의 통합, 변화에 대한 관리, 정원공개와 시민의 참여, 그리고 정원사 양성과 관련분야와의 연계로 나타났다. 이러한 내셔널 트러스트의 보전 활동의 결과를 통하여 역사정원의 보전 목적과 정원의 의미가 어느 국가에서나 크게 다르지 않는 전제조건을 반영한 시사점은 다음과 같다. 우선 변화에 대한 유연한 접근이 관리되고 있다는 점이다. 필연적이거나 요구되는 변화에 대응하여 첨가되거나 변형되는 어떠한 것도 가능한 많은 부분을 미래세대를 위해 기록하고 있다. 따라서 모든 것이 반드시 기록되고 관리되는 것이 보전을 위한 중요한 사항이다. 다음으로 국민을 위하여 지속가능한 공개가 이루어지고 있다는 점이다. 정원 보전의 목적은 사람을 위한 것이며, 다음 세대에게 전승하기 전 현세대가 다만 잠시 빌려 쓰는 것이다. 교육적, 심미적, 신체적으로 현세대가 정원을 향유하고 미래세대인 어린이들이 지속적으로 관심을 가지도록 교육하는 것은 우리에게 좋은 시사점이다. 마지막으로 도제식 정원사를 양성하고 지속적인 현 직원에 대한 연수 등을 통하여 훈련시키고 있다는 점이다. 이는 아직도 직접적인 관리는 거의 일용직 근로를 쓰고 있는 국내의 전통정원과는 대조적인 부분이다. 실제로 역사정원의 유지 관리는 단순한 과정이 아니다. 정원사는 과거를 이해하고 현재를 담으며, 미래를 준비하는 세대간 문화를 전달하는 사람이라고 할 수 있다.

중대재해법 시행에 따른 항만노동자의 안전인식 변화 (A Study on Changes in the Safety Perception of Port Workers in accordance with the Enforcement of the Serious Disasters Act)

  • 항만물류는 국가와 기업에 경쟁력 강화의 중추적인 산업으로 우리나라 수출입 물동량의 대다수를 차지할 만큼 중요한 역할을 하고 있어 우리나라의 산업중에서도 그 중요성은 실로 엄청나다. 이처럼 중요한 역할을 하고 있는 항만은 하역작업, 부두내 이송작업과 보관이 동시에 이루어지며 굉장히 복잡한 흐름으로 구성이 되어 있다고 할 수 있다. 특히 항만하역작업은 대형선박, 컨테이너이송을 위한 크레인작업등 대형 하역기계들과 운반장비들이 이동하며 수많은 재해의 위험이 도사리고 있고 재해 발생시 중대재해로 이어지는 경우가 많아 항만하역근로자들은 항상 재해의 위험에서 벗어날 수 없는 환경이다. 본 연구는 중대재해처벌법에 대한 문헌연구들을 통해 중대재해처벌법이 항만하역근로자들에게 어떠한 영향을 미쳤는지에 대해 파악하고, 항만근로자와, 항만관리감독자의 중대재해처벌법 시행에 따라 안전교육에 대한 만족도 변화가있는지 알아봤다. 본 연구를 통해 항만하역근로자는 인지,태도,경험 요인에서 관리자보다 안전에 대한 인식을 더 많이 하고있는 것으로 나타났다. 이는 항만하역 관리자는 하역작업에 투입되지 않기 때문에 근로자보다 안전에 대한 인식이 근로자보다는 낮게 분석되었다. 이는 근로자에게 안전한 작업을 교육하고 안전에 대해 경각심을 가져야되는 관리자들이기에 항만하역 관리자에게도 안전에 대한 인식에 대한 변화가 필요할 것으로 보여진다. 중대재해처벌법이 22년 1월 27일 시행되어 법 시행초기 단계로 법이 정착까지 실무업무를 일선에서 수행하고 있는 담당자들은 많이 혼동되고 애매한 부분들이 많이 발견되고 있다. 업무에 혼선이 생기지 않도록 법에 대한 명확한 기준과 현업에서 안전재해가 발생되지 않는 목적으로 중대재해처벌법이 개정이 필요해 보인다. 또한 향후 보다 의미 있는 연구 결과를 도출하기 위해서는 문헌연구를 심화하여 여러 요인들을 찾아보고 인터뷰등의 조사방법을 사용하여 근로자와 관리자의 재해 인식에 대한 연구가 지속적으로 필요할 것으로 보인다.

정신응급상황에서 119구급대원 대응사례와 법적쟁점 (Cases and Legal Issues For 119paramedics in Mental Emergency Situations)

  • 우리나라는 급격한 발전과 더불어 많은 성장을 이루는 과정에서 스트레스에 노출이 정신적 고통을 수반하게 되었고 다양한 사회문제로 나타나며, 응급입원의 빈도가 높아지고 있다. 정신질환자의 경우 '비자의 입원'이 문제가 되며, 경찰, 119구급대원이 정신질환자의 신체억제를 시도하며, 많은 문제점이 노출되고 있다. 이는 정신건강복지법 상 응급입원의 조항의 구성요건이 현실을 반영하지 못해 하나의 정신질환자를 두고 각 기관이 다른 입장을 내며, 응급입원이 원활하게 진행되지 않거나, 관계기관의 마찰로 이어지며 정신질환자의 안전이나, 타인의 안전이 확보되지 못하는 경우가 발생하고 있다. 응급입원은 주체가 '정신질환자로 추정되는 사람으로 자신의 건강 또는 안전이나 다른 사람에게 해를 끼칠 위험이 큰 사람을 발견한 사람'으로 정하고 있으며, 그 상황이 매우 급박하여 스스로 입원을 결정하는 입원절차를 거칠 시간적 여유가 없는 경우 의사와 경찰관의 동의를 얻어 응급입원을 의뢰할 수 있다고 규정하고, 이 경우 119구급대원이 정신의료기관까지의 호송하도록 하고 있다. 이러한 응급입원의 조항은 정신의료기관까지 이송하는 과정에 많은 문제를 내포하고 있다. 실무를 담당하는 경찰관이나 119구급대원이 응급입원과정 중 '물리력'을 사용하게 되면, 필연적으로 부작용이 발생하게 되는데, 업무상과실이 문제가 될 수 있으며, 구체적으로는 물리력을 행사할 때 법령에 근거하고 비례원칙에 따른 필요최소한도의 신체억제가 필요하게 되는데, 법령상 119구급대원이나 경찰관의 주의의무의 부재가 결국 다른 법령을 적용하여 해결하게 된다는 것이다. 이에 정신건강복지법 상 응급입원 조항의 주체를 경찰, 소방기관의 장점을 살려 주체를 변경하고, 정신보건법의 시행규칙으로 신체보호대 사용을 정의하고, 규정함으로써 119구급대원과 경찰관의 주의의무를 설정하고 정신질환자가 안전하게 치료받을 수 있도록 이송에 대한 환경을 조성함으로써 자기 또는 타인의 위험을 내포하고 있는 정신질환자 또한 안전한 환경에서 정신의료기관으로 이송될 수 있는 계기가 될 것이다.

외국인투자기업의 국제이전가격 결정에 영향을 미치는 환경 및 기업요인 (Factors Affecting International Transfer Pricing of Multinational Enterprises in Korea)

  • 기업환경의 국제화 및 세계화에 따라 국내에 진출하는 다국적기업의 수는 증가할 것으로 보이는데, 그들을 효율적으로 관리할 수 있는 적절한 수단은 별로 연구되고 있지 않은 것 같다. 다국적기업의 국제이전가격은 정교하게 설정되어 조세부담을 회피할 수 있기 때문에, 이를 관리하기 위해서는 다국적기업의 행태를 이해할 필요가 있다. 본 연구는 우리나라에 진출한 외국인 기업의 특성 및 환경적 요인이 국제이전가격의 설정방식에 미치는 영향을 확인하고자 하는데 그 목표를 두고 있다. 2004년 현재 우리나라에 미화 100만불 이상의 직접투자를 수행하고 있는 외국인 투자기업 861개 기업을 대상으로 설문조사를 시행한 결과 121개 기업이 응답하여 이를 본 연구의 분석자료로 사용하였다. 종속변수로는 국제이전가격설정방법이 시장기준 혹은 원가기준에 의거하였는지의 여부를 묻는 2원적변수를 채택하였다. 시장기준방법의 경우 객관성이 높아 세무당국이 선호하는 방법임에 비해 원가기준은 경영자의 주관적인 판단이 개입될 소지가 많아 객관성이 떨어진다는 점에서 구분되기 때문이다. 독립변수로는 법인세, 관세, 세무당국과의 관계, 세무조사가능성, 현지투자자의 지분율, 내부거래비중, 매출액 및 제품수명주기가 채택되었고, 통제변수로는 중소기업여부 및 투자자의 국적이 더미변수의 형태로 포함되었다. 분석 결과를 살펴보면 세무변수로는 법인세와 관세가 유의하게 나타났는데, 그 중요도가 높을수록 경영자에게 재량권이 있는 원가기준이전가격방식을 선호하는 것으로 나타났다. 또 세무당국과의 관계를 중요하게 평가할수록 시장기준이전가격방식을 선호하는 것으로 나타났는데, 현지 정부는 객관성이 높은 시장기준을 가장 선호하기 때문에 기업의 입장에서 이 점을 고려한 것이라 생각할 수 있다. 제품 수명주기의 성숙도가 높을수록 원가기준을 선호하는 것으로 나타났는데, 이는 제품의 성숙도가 높을수록 경쟁 때문에 현지자회사가 시장을 확보하는데 어려움을 느끼게 되므로 이를 지원하는 수단으로 원가기준을 선호하는 것으로 보인다.

  • The wall shear stress in the vicinity of end-to end anastomoses under steady flow conditions was measured using a flush-mounted hot-film anemometer(FMHFA) probe. The experimental measurements were in good agreement with numerical results except in flow with low Reynolds numbers. The wall shear stress increased proximal to the anastomosis in flow from the Penrose tubing (simulating an artery) to the PTFE: graft. In flow from the PTFE graft to the Penrose tubing, low wall shear stress was observed distal to the anastomosis. Abnormal distributions of wall shear stress in the vicinity of the anastomosis, resulting from the compliance mismatch between the graft and the host artery, might be an important factor of ANFH formation and the graft failure. The present study suggests a correlation between regions of the low wall shear stress and the development of anastomotic neointimal fibrous hyperplasia(ANPH) in end-to-end anastomoses. 30523 T00401030523 ^x Air pressure decay(APD) rate and ultrafiltration rate(UFR) tests were performed on new and saline rinsed dialyzers as well as those roused in patients several times. C-DAK 4000 (Cordis Dow) and CF IS-11 (Baxter Travenol) reused dialyzers obtained from the dialysis clinic were used in the present study. The new dialyzers exhibited a relatively flat APD, whereas saline rinsed and reused dialyzers showed considerable amount of decay. C-DAH dialyzers had a larger APD(11.70$\pm$1.32mmHg/min)compared to CF dialyzers(4.32$\pm$0.55mmHg/min)(p<0.05). However, there was no observable difference in the UFR between the two dialyzers. Neither APD nor UFR showed any significant increase with an increasing number of reuses for up to more than 20reuses. A substantial number of failures observed in APD(larger than 20mmHe/min)on the reused dialyzers(2 out of 40 CP and S out 26 C-DAK) were attributed to the Possible damage on the fibers. The CF 15-11 HFDs which failed APD test did not show changes in the UFR compared to normal dialyzers indicating that APD is a more sensitive test than UFR test to evaluate the integrity of the fibers. 30527 T00401030527 ^x For quantitative measurement of reflected light from a clinical diagnostic strip, a prototype old reflectance photometer was designed. The strip loader and cassette were made to obtain more accurate reflectance parameters. The strip was illuminated at 45˚c through optical fiber and the intensity of reflected light was determined at rectanguLat angle using a photodiode. The kubelka-munk coefficient and reflection optical density were determined ar four different wavelengths(500, 550, 570 and 610nm) for blood glucose strip. For higher concentration than 300mg/41 about glucose, a saturation state of abforbance was observed at 500, 550 and 570nm. The mice were divided into two groups. One group was injected with Photofrin II, intravenously (2.5mg/kg body weight). The other group received no Photofrin II. Mice from both groups were irradialed for approximately 15 minutes at 100, 300, or 500 mW/cm2 with the argon (488nm/514.5 nm), dye(628nm) and gold vapor (pulsed 628 nm) laser light. A photosensitizer behaved as an added absorber. Under our experimental conditions, the presence of Photolfrin II increased surface temperature by at least 40% and the temperature rise due to 300 mW/cm2 irradiation exceeded values for hyperthermia. Light and temperature distributions with depth were estimated by a computer model. The model demonstrated the influence of wavelength on the thermal process and proved to be a valuable tool to investigate internal temperature rise. 30536 T00401030536 ^x We investigated the structural geometry of thirty-eight Korean femurs. The purpose of this study is to identify major geometrical differences between Korean femurs 3nd others that we believe belong to Caucasians so that we would be able to get insights into the femoral component design that fits Asians including Koreans. We utilized computerized tomography (CT) images of femurs extracted from cadavers. The CT images were transformed into bitmap data by using a film scanner, and then analyzed by using a commercially available software called Image v.1.0 and a Macintosh IIci computer.The resulting data were compared with already published data. The major results show that the geometry of the Korean femurs is significantly different from that of Caucasians: (1) the anteversion angle and the canal flare index are greater by the amount of approximately 8˚ and 0.5, respectively, (2) the shape of the isthmus cross section is more round, and (3) the distance between the teaser trochanter and the proximal border of the isthmus is shelter by about 15 mm. The results suggested that the femoral component suitable for Asians should be different from the currently-used components designed and manufactured mostly by European or American companies. 30537 T00401030537 ^x It is well known that nonlinear propagation characteristics of the wave in the tissue may give very useful information for the medical diagnoisis. In this paper, a new method to detect nonlinear propagation characteristics of the internal vibration in the tissue for the low frequency mechanical vibration by using bispectral analysis is proposed. In the method, low frequency vibration of f0( = 100Hz) is applied on the surface of the object, and the waveform of the internal vibration x (t) is measured from Doppler frequency modulation of silmultaneously transmitted probing ultrasonic waves. Then, the bispectra of the signal x (t) at the frequencies (f0, f0) and (f0, 2f0) are calculated to estimate the nonlinear propagation characteristics as their magnitude ratio, w here since bispectrum is free from the gaussian additive noise we can get the value with high S/N. Basic experimental system is constructed by using 3.0 MHz probing ultrasonic waves and the several experiments are carried out for some phantoms. Our department has developed an information system for routine hematology using down-sized computer system. We have used an IBM 486 compatible PC with 16MB main memory, 210 MB hard disk drive, 9 RS-232C port and 24 pin dot printer. The operating system and database management system were SCO UNIX and SCO foxbase, respectively. For program development, we used Xbase language provided by SCO foxbase. The C language was used for interface purpose. To make the system use friendly, pull-down menu was used. The system connected to our hospital information system via application program interface (API), so the information related to patient and request details is automatically transmitted to our computer. Our system interfaced with fwd complete blood count analyzers(Sysmex NE-8000 and Coulter STKS) for unidirectional data tansmission from analyzer to computer. The frame and leaflet of the polymer valve were made from polyurethane, To evaluate the hemodynamic performance of the polymer valve a comparative study of flow dynamics past a polymer valve and a St. Jude Medical prosthetic valve under physiological pulsatile flow conditions in vitro was made.   • The wall shear stress in the vicinity of end-to end anastomoses under steady flow conditions was measured using a flush-mounted hot-film anemometer(FMHFA) probe. The experimental measurements were in good agreement with numerical results except in flow with low Reynolds numbers. The wall shear stress increased proximal to the anastomosis in flow from the Penrose tubing (simulating an artery) to the PTFE: graft. In flow from the PTFE graft to the Penrose tubing, low wall shear stress was observed distal to the anastomosis. Abnormal distributions of wall shear stress in the vicinity of the anastomosis, resulting from the compliance mismatch between the graft and the host artery, might be an important factor of ANFH formation and the graft failure. The present study suggests a correlation between regions of the low wall shear stress and the development of anastomotic neointimal fibrous hyperplasia(ANPH) in end-to-end anastomoses. 30523 T00401030523 ^x Air pressure decay(APD) rate and ultrafiltration rate(UFR) tests were performed on new and saline rinsed dialyzers as well as those roused in patients several times. C-DAK 4000 (Cordis Dow) and CF IS-11 (Baxter Travenol) reused dialyzers obtained from the dialysis clinic were used in the present study. The new dialyzers exhibited a relatively flat APD, whereas saline rinsed and reused dialyzers showed considerable amount of decay. C-DAH dialyzers had a larger APD(11.70${\pm}$1.32mmHg/min)compared to CF dialyzers(4.32${\pm}$0.55mmHg/min)(p<0.05). However, there was no observable difference in the UFR between the two dialyzers. Neither APD nor UFR showed any significant increase with an increasing number of reuses for up to more than 20reuses. A substantial number of failures observed in APD(larger than 20mmHe/min)on the reused dialyzers(2 out of 40 CP and S out 26 C-DAK) were attributed to the Possible damage on the fibers. The CT images were transformed into bitmap data by using a film scanner, and then analyzed by using a commercially available software called Image v.1.0 and a Macintosh IIci computer.The resulting data were compared with already published data. The major results show that the geometry of the Korean femurs is significantly different from that of Caucasians: (1) the anteversion angle and the canal flare index are greater by the amount of approximately 8˚ and 0.5, respectively, (2) the shape of the isthmus cross section is more round, and (3) the distance between the teaser trochanter and the proximal border of the isthmus is shelter by about 15 mm. Then, the bispectra of the signal x (t) at the frequencies (f0, f0) and (f0, 2f0) are calculated to estimate the nonlinear propagation characteristics as their magnitude ratio, w here since bispectrum is free from the gaussian additive noise we can get the value with high S/N. The proposed network is composed of multi-layers and the nerve cells in each layer are connected by spatial filters which approximate receptive fields in optic nerve fields. By using a switching mode power supply rather than a conventional linear power supply for charging high voltage capacitors, the weight and size of the magnetic nerve stimulator can be considerably reduced. The bedside monitor consists of a main unit and module cases with various parameter modules. The main unit includes a 12.1" TFT color LCD, a main CPU board, and peripherals such as a module controller, Ethernet LAN card, video card, rotate/push button controller, etc. The main unit can connect at maximum three module cases each of which can accommodate up to 7 parameter modules. They include the modules for electrocardiograph, respiration, invasive blood pressure, noninvasive blood pressure, temperature, and SpO2 with Plethysmograph.
