임의비급여 진료행위에 관한 민사법적 검토 (Civil Law Study on the Arbitrary Uninsured Medical Benefits)

  • 국민건강보험법상 급여에는 요양급여와 법정비급여가 있지만, 그 이외에도 임의비급여가 있다. 임의비급여는 법정 비급여가 아님에도 불구하고 의료기관이 비급여로 처리하고 환자로부터 진료비를 받는 것을 말하지만, 이러한 임의비급여에 대해서는 국민건강보험법령에서는 아무런 규정을 두지 않고 있다. 대법원 2012. 6. 18. 선고 2010두 27639, 27646 전원합의체 판결은 종전의 부정적인 법리를 폐기하면서, 민법상 기본원칙인 사적자치의 원칙에 기초한 민사법적 쟁점이 임의비급여에 기본적 전제로 포함되어 있음을 확인하였다. 대법원에서 제시한 (1) 편입 또는 조정절차 부존재, 존재하면 회피 불가피성, (2) 의학적 안전성과 유효성 및 필요성, (3) 충분한 설명과 동의 요건은 예외적 요건으로서 그 해석에 있어서 매우 신중을 기해야 할 것이다. (1)의 요건은 임의비급여에 해당하는 질병 중 치명적이거나 이환속도가 매우 빠른 질환에 해당하는 경우에는 그 해석을 엄격하게 하는 것은 매우 부적절하다고 생각된다. (2)의 요건은 그 적용의 구체적 판단을 의료계의 전문가적 감정에 일임하는 것이 합리적이고, 법원은 그 의료계의 감정이 적절하였는지 여부를 판단하는 것에 그칠 수밖에 없다. (3)의 요건은 의사의 충분한 설명과 그에 따른 환자의 동의이지만, 그 중에서 가장 중요한 것은 의사의 충분한 설명에 있다. 2010두27639, 27646 판결 이후에 선고된 대부분의 판결에서는 위 3개 요건의 불비를 이유로 기각하는 사례가 많았다.

정신질환자에 대한 비대면진료 및 비고지투약 -치료적 대화의 복원을 위한 모색적 고찰- (Non Face-to-Face Treatment and Not-informed Medication to Persons with Mental Disorders)

  • 정신질환자는 대체로 병식이 전혀 없거나 자발적 치료의지가 없는데, 그에 따라 치료가 어렵고 그 고통은 주로 가족에게 전가된다. 그에 따라 환자를 직접 대면하여 진료하지 않고 가족과의 면담을 통해 예후를 관찰하여 진단하는 비대면진료 및 가족을 통해 몰래 투약이 이루어지는 비고지투약이 이루어질 수 있고, 이는 필요악으로 여겨지기도 했다. 이러한 정신건강의학과 진료의 특수성이나 가족들이 받는 고통 등 현실적인 측면을 고려하더라도 환자 몰래 약을 투약하는 등 동의 없는 치료는 의료법 위반은 물론 강제입원처럼 정신질환자에 대한 인권침해의 소지가 크다. 무엇보다도 이를 뒤늦게 환자가 알게 되는 경우에는 환자와 가족, 의사 사이의 신뢰가 완전히 깨지고 치료를 절대적으로 거부하는 상황이 발생한다. 여러 사정을 고려하여 그 예외적 허용요건을 제시한 일본의 치바(千葉)판결은 구체적 타당성을 도모하는 하나의 해결책이 될 수도 있다. 그러나 비고지투약을 예외적으로 허용하고 이를 일시적인 조치로서 허용하려는 의도와 달리 이는 현실적으로 장기적인 비고지투약으로 이어지고 치료적 대화를 통한 치료 및 투약은 완전히 단절될 수 있다는 점을 감안할 때 올바른 해결책이 아니다. 결국, 치료적 대화의 복원을 통해 이 문제를 근본적으로 접근하고 대안을 모색할 필요가 있다.

  • A study on Bang-Yak-Hap-Py$\breve{u}$n, one of the most widely-known Korean medicine books, has been conducted and the findings are as follows:the political and social background at the end of Yi-dynasty amidst the inflow of western civilization and the aggression of foreign forces can be seen as a historical period of trial, when civilization and independence had to be preserved at the same time, during the period, the social trend was to pursue a rapid practical solution rather than a profound theory. Responding to this trend, simple and easy medical science became to prevailand the representative medicine book of this kind was Bang-Yak-Hap-Py$\breve{u}$n. 1. Bang-Yak-Hap-Py$\breve{u}$n was written comprising the characteristics of simple and easy medical science with a view to popularizing-collection of logics, easy readability, medical science in time, etc. 2. Bang Yak-Hap-Py$\breve{u}$n, rich and grand in content, came out of Dong-$\breve{U}$i-Bo-Gam at the right moment as a pragmatic guide book of Korea medical practice symbolizing Korean spirit. 3. Do-yun Whang whose pen name was Hye-Am was born in Changwon, Kyungnam-do as the 18th descendant of Changwon Whang family. He engaged in medical practice in Seoul and wrote and edited Boo-Bang-Py$\breve{u}$n-Ram. $\breve{U}$i-Jong-Son-Ik, $\breve{U}$i-J$\breve{u}$ng-Son-Ik-Bu-Yeo, $\breve{U}$i-Bang-Whan-Tu, ect. and made his son, Pil-Su follow him and let him edit Bang-Yak-Hap-Py$\breve{u}$n, which put $\breve{U}$i-Bang-Whal-Tu and Son-Ik-Bon-Cho together. 4. The construct of Bang-Yak-Hap-Py$\breve{u}$n can be subdivied into three parts: herbs of 34 classes and 514 kinds were arranged on the upper part and $\breve{U}$i-Bang-Whal-Tu was arranged on the middle end lower part. Such arrangement can be very effective in clinics. 5. Bang-Yak-Hap-Py$\breve{u}$n as a curative book of Korean medical science has been a necessary another ego for many Korean medical practioners. It also played a great role of enhancing Korean oriental medical science to be widely used by Koreans. On the other hand, it produced a side effect of emergence of employed medical practioner who lacked in scholastic aptitude. 6. Tens or newly edited Bang-Yak-Hap-Py$\breve{u}$n have been issued. Among them, Jung-Jeong, Bang-Yak-Hap-py$\breve{u}$n, J$\breve{u}$ng-Mak-Bang-Yak-Hap-Py$\breve{u}$n. By$\breve{u}$n-J$\breve{u}$ng-Bang-Yak-Hap-Py$\breve{u}$n, and By$\breve{u}$n-J$\breve{u}$ng-Bang-Yak-Jung-Jeon have been widely known. Lately, Bang-Yak-Hap-Py$\breve{u}$n which includes more symptoms and remedies or is translated into Korean came out in several kinds. 7. The number of korea classical medicinal books quoted in Bang-Yak-Hap-Py$\breve{u}$n is 68, among which Dong-$\breve{U}$i-Bo-Gam Occupies the top in the list enlisting 69 medicinal treatment. This Shows that Dong-$\breve{U}$i-Bo-Gam gave birth to Bang-Yak-Hap-Py$\breve{u}$n.

사고로 남편을 잃은 여성의 경험 (A Study on Woman's Experience of Being Bereaved of Her Husband by an Accident)

  • Relatively young widows, who are left with young children by a sudden death of their husbands, will be faced with not only psychological troubles such as individual anxiety and frustration but also the dual burden of playing both father and mother roles in a family, Also, family members have difficulty in adapting themselves to new circumstances of the family system, the training and raising of family members, and management of the family economy. In this study, the realistic resources on the experience of middle-aged women who are bereaved of their husbands by accidents were explored. The purpose of this study is to help widows adapt to life in society and live a more positive life by setting a new goals and recovering from a lost and twisted life. 11 women, who have experienced the loss their husbands and live in the Seoul metropolitan area were studied. The research took 116 days from December 15, 1995 to April 8, 1996. The method of research was direct interviews. While having interviews with them, the contents were recorded with their consent. The ground theory was that used by Strauss & Corbin(1990) in the analysis of the data. 81 concepts were analyzed and they were subdirided into 22 subordinate categories through the course of the analysis. These were then classified into 9 general categories. In the course of being categorized, 'absurdity' was showed as a core category. The subordinate categories 'surprise', 'gloom', 'grudge', 'helplessness', 'emptiness', and 'loss' were united in the core category 'absurdity'. Ominous presentiment, belated notice, death, surprise, gloom, grudge, helplessness, emptiness, loss, the situation of the children, lack of support from neighbors, support from neighbors, mulling over ways to live, choosing a job, strengthening, reinforcement, burden, sadness, smoldering, yearning, overcoming these 22 subordinate categories were re-composed into 9 general ones the husband's death, absurdity, presence of children, existence of support, self-support ability, preparation of countermeasures, self-reinforcement, toilsomeness, and overcoming. 'Absurdity' widows experience was shown in the results of 'toilsomeness' and 'overcoming' through reaction, confrontation, and adaptation. According to the analysis the central phenomenon was absurdity, the causal condition of the death of a husband, the presence of children and the existence of support, and the meditated situation of self-support. To solve absurdity, the preparation of countermeasures and self-reinforcements were shown resulting in toilsomeness and overcoming. Through the contrast in the data, the following statements were deduced: (1) If the death of the husband is expected, the more a widow will feel absurdity. (2) The more children she has and the younger she is, the more a widow will feel absurdity. (3) The lower support she is given, the more a widow will feel absurdity. (4) The larger self-ability she has, the more actively she will prepare countermeasures. (5) The smaller self-ability she has, the more passively she will prepare countermeasures. (6) The larger self-ability she has, the weaker self-reinforcement she will preform. (7) The smaller self-ability she has, the stronger self-reinforcement she will perform. (8) The more actively she prepares countermeasures for absurdity, the better she will overcome. (9) The more passively she prepares counter measure for absurdity, the worse she will overcome. (10) The stronger self-reinforcement for absurdity she performs, the better she will overcome. (11) The weaker self-reinforcement for absurdity she performs, the worse she will overcome. Through the results in this study, the following suggested: 1) A study whose object is all family members, and a comparative study on the case of a husband who has lost his wife should be done. These studies can be expected to develop a more refined theory. 2) Because of the collapse of the extended family system and the changes of family culture in Korea, a widow's status and position are apt to be ambiguous between her husband's home and her parent's. Therefore a new study on family culture should be made. 3) A continuous study on growing social Self Help Groups should be requested for the widows of this study to re-establish and recover from their twisted and scattered lives.

  • In this thesis, I intend to study the translational and clinical interpretation through the syndrom of "Pyong-Yeol-Byong", and reached the following conclusions. 1. Eum-Yang-Kyo (陰陽交)' 1) Meaning: "Eum" means "Essential and vital energy" "Yang" means "Evil factor affecting health" and "Kyo" means "cross-struggle." 2) Location of disease: Heat evil enter Hyeol-Bun (血分) 3) Pathogenesis: Heat evil invade Eum-Bun (陰分) and struggles with Health energy, therefore Eum-Chung (陰精) is exhausted and Heat-evil doesn't disapper, it damage Eum and exhaust fluid. Reach fever, rapid pulse raving and unable to take meal, not controled by sweating and sceach death. 4) Particularity of Syndrome: Heat enter Hyol-Bun, and Evil factor is enough and Health energy is insufficient, so that reveal the symptoms of high fever, delirium with coma, unable to take meals. 5) Therapy: It clears Gi-Bun heat evil (氣分熱邪) by Gypsum, Rhizoma Anemarrhenae, Flos Lonicerae, Fructus Forsythiae, Fructus Gardeniae, Radix Scutellanae Rhizoma Coptidis, and cools Blood by Cornu Rhinoceri Asiatici, Radix Rehmanniae, Cortex Moutan Radicis, Dae-Chung-Yob (大靑葉) Radix Arnebiae Seu Lithospermi. 2. Poong Gweol (風厥) 1) Meaning: Poong means wind-evil, Gweol means reversing up. 2) Location of disease: Disease complexes with TaeYang (太陽) in outer part, and with So-Eum (少陰) in inner part. 3) Pathogenesis: Tae-Yang-Gyeong (太陽經) accept wind-evil and So-Eum-Gyeong (少陽經) Kidney Energy reverse up so that fidgetiness not resolves by sweating. 4) Particularity of Syndrome: There are outer symptoms of fever, hydrosis with inner symptoms of fidgetinessis. 5) Therapy: Reduce Jok-Tae-Yang (足太陽) and Supply Jok-So-Eum (足少陰) by accupuncture, so cure Poong Gweol and make balance between Yeong (營) and Wi (衛). 3. Scrofula coused by wind-evil (勞風) 1) Meaning: It means accepting wind evil rest less. 2) Location of Disease: It locates lung 3) Pathogenesis: Because of accepting wind-evil restless, he take scrofula with damaging lung. 4) Particularity of disease: It is lung disease of aversion to wind and shiver, nape-stiffiness, dim eyesight, cough, disphea, vomitting sputum, if one camnot vomit sputum, he died by damage of lung. 5) Therapy: The period of therapy is different by age or strength of health energy, so I think must prevent Eum deficiency and clear fever no reduced in lung. 4. Shin-Poong (腎風) 1) Meaning: It means taking edema by accepting wind-evil, because the kidney controls water. 2) Location of Disease: It is that wind-evil envade kidney. 3) Pathogenesis : Water evil of kidney with wind-heat rises up to face, reach edema, puffines s of the lower eyelid, floating pulse, bombus, yellowish urine, hydrosis and hand-heating, drymouth and excessive thirsty, walkless by heaviness, menstrual disfunction, restless and unable to take meals, unable to lie flat, heavy cough if lie flat, and accepting wind-evil by deficiency of kidney function, so the function of dredging the water passage is not smooth, symptom of water and symptom of wind reveal together. 4) Therapy: Remove wind-heat, promote diuresis to eliminate tile wetness-evil, supplement the dificiency of kidney's Eum. Finally, we can know that later Fever Disease Medicime (溫病學) is affected to the theory of "Pyong Yeol Byong" in 33th Chapter of SoMoon (素問).

신장이식 수혜자의 경험 (A Study on the Experience of Patients with Chronic Renal Failure who have Received a Kidney Transplant)

  • The grafting of a kidney has been found to be the best medical treatment for patients who have renal insufficiency failure, but the patients still have experienced much trouble and apprehension. This study was done to further nursing theory developing for patients who have has a kidney graft from another person. The research method followed grounded theory methodology of Strauss and Corbin. The subjects were three female and four male patients. This study done befween Oct. 1997 and Mar. 1998. All of the subjects were interviewed by the author. Interview were done by the long interview technique and observation. In the process of data analysis, 'heart-boiling' was found to be the core phenomenon. The results were composed to 101 concepts. These concepts were grouped into nineteen categories, and then to twelve categories. There were 12 super-class categories as follows ; 'pain', 'heart-boiling', 'experience of dialysis', 'term of admission to a hospital', 'support of other person', 'dependence on God', 'direction', 'negative reaction', 'positive reaction', 'comfortable', 'lacking', 'acceptance'. In this process, 14 hypotheses were derived from the categories as follows ; (1) The more experience with dialysis that the patients have, the stronger the heart-boiling will tend to be. (2) The less experience with dialysis the patients have, the weaker the heart-boiling will tend to be. (3) The longer admission to hospital the patients have, the stronger the heart-boiling will be. (4) The shorter the admission to hospital the patients have, the weaker the heart-boiling will be. (5) The weaker the intense-grief is, the more positive the reaction to heart-boiling the patients wll have. (6) The stronger the intense-grief is, the more negative the reaction to heart-boiling the patients will have. (7) The stronger the support of other persons that the patients have, the more positive the reaction to heart-boiling the patients will have. (8) The weaker the support of other person that the patients have, the more negative the reaction to heart-boiling the patients will have. (9) The stronger the dependence on God that the patients have, the mure positive reaction to heart-boiling the patients will have. (10) The weaker the dependence on God that the patients have, the more negative reaction to heart-boiling the patients will have. (11) The more positive thoughts that the patients have, the more positive reaction to heart-boiling the patinets will have. (12) The more negative thoughts that the patients have, the more negative reaction to heart-boiling the patients will have. (13) The more positive reaction the patients have, the more free from heart-boiling the patients tend to be. (14) The more negative reaction the patients have, the less free from heart-boiling the patients tend to be. From the analysis of observed data and comparing each class, I concluded that there are four formula relation types between reaction of patients and heart-boiling. (1) If patients have the experience of dialysis, have a long term admission to hospital, are strong in heart-boiling, depend on God, have positive thoughts and another's strong support, they experience release by positive reaction to the intense-grief. (2) If patients have the experience of dialysis, have a short term admission to hospital, are weak in heart-boiling, do not depend on God, have negative thoughts, and have few supports from others, they experience attachment to heart-boiling though a negative reaction. (3) If patients have the experience of dialysis, have a long term admission to hospital, are strong in heart-boiling, do not depend on God, and have negative thoughts, they experience attachment to heart-boiling through negative reaction in spite of support from another. (4) If patients have the experience of dialysis, have a long term admission into hospital, are strong in heart-boiling and satisfaction is low, but they have positive thoughts, then they experience acceptance and harmony through the positive reaction to heart-boiling. The results of this study are expected to help the way nurses care for patients who have had a kidney graft from another.

히스테리아(전환장애)의 소실과 진화적 뇌신경 부조화 반응 가설 (Disappearance of Hysteria(Conversion Disorder) and the Evolutionary Brain Discord Reaction Theory)

  • 연구목적 19세기말부터 근래까지 정신과 및 응급실에서 많이 볼 수 있었던 히스테리아(전환장애)환자를 이제는 더 이상 보기 어려워졌다. 이러한 현상의 원인을 규명해보고자 하였다. 방 법 정신과 외래 및 입원환자의 수가 지난 12년 동안 과연 얼마나 되는지 병록지를 조사하고 증상의 변화, 증상지속기간을 조사하였으며, 지난 2년간 응급실에서 정신과진료에서 본 전환장애 환자수를 조사하였다. 이 결과를 과거의 연구 결과와 비교해보았다. 이를 토대로 히스테리아(전환장애)의 소실 및 증상 변화의 원인을 찾아보았다. 결 과 히스테리아(전환장애)의 환자수가 현저히 줄어들었으며 그 증상도 변화된 것을 확인하였다. 그리고 이러한 변화는 불과 수십 년 사이에 일어났다. 그 간의 연구결과를 통하여 신경질환 진단법의 발달, 진단명과 증상기재 용어의 변화, 감정자극에 따른 뇌기능의 변환, 그리고 진화론적 관점 등이 이 병의 감소 내지는 증상의 변화를 설명할 수 있다. 결 론 히스테리아(전환장애)의 소실 및 증상의 변화가 불과 수십 년 동안에 일어날 수 있는 것은 진화적으로 변화하는 뇌와 환경 사이의 부조화에 따른 충격이 반응으로 나타난다는 가설을 통하여 이유의 많은 부분이 설명된다. 그리고 비록 과거의 히스테리아(전환장애) 환자수는 줄었으나 그 모습이 변화된 환자수는 결코 적지 않다. 정신과의사는 이들 환자에게 적절한 치료를 제공해 주기 위해서 일차 진료의사와 신경과의사와 협동해야 하며 주도적인 역할이 필요하다. 현재 사용하는 진단명이나 증상 기재 용어는 그 기본 내용이나 개념이 일부 변화했을 뿐, 뇌기능의 장애와 연관된 원인 불명의 신체증상이라는 점에서 달라진 바가 없다고 생각한다. 이에 저자는 과거의 용어인 히스테리아(전환장애)를 부활시키는 것이 타당하다는 점을 설명하였다.

시장지배적 의료기기 사업자의 경쟁제한적 차별행위 - 지멘스 사건을 중심으로 - (A Review on the Dominant Undertaking's Abuse in the Medical Device Market)

  • 대상판결은 시장지배적 지위 남용에 관한 다양한 쟁점을 다루었을 뿐만 아니라, 경쟁제한효과가 문제된 시장이 의료기기 시장이라는 측면에서도 여러 시사점을 제시하고 있다. 첫째, 관련상품 시장의 측면에서 대상판결이 주상품(CT, MRI 등 의료기기) 시장과 부상품(유지보수서비스) 시장이 밀접하게 관련되어 있다고 하더라도 이를 하나의 시장으로 보기 어렵다고 판단한 것은 수긍할 수 있다. 둘째, 대상판결은 고착효과에 관하여 명시적인 판시를 하지 않았으나, 관련시장에 대한 판단에서 높은 주상품 가격, 주상품의 사용연한이 장기인 점 등을 고려하는 등 실질적으로 고착효과를 반영한 것으로 보인다. 셋째, 객관적 행위 요건으로 '정상적인 거래관행에 반하는 타당성 없는 조건'에 대하여 대상판결은 저작권자가 실시료를 받고 저작권을 실시하는 행위는 정당한 권리행사이며, 원고가 유상의 라이선스 정책을 가지고 이를 실행하며, 예외적인 경우에만 무상으로 실시를 하였으므로 공정위가 주장하는 무상실시 관행을 증거로 인정할 수 없음을 지적하였다. 넷째, 이 사건에서 경쟁자의 비용 상승은 원고가 서비스 소프트웨어 사용에 필요한 서비스키를 유상으로 제공한 행위를 통하여 이루어졌고, 원고의 행위가 지식재산권의 행사로 정당하다면 설령 그러한 행위로 경쟁이 제한된다고 하여 이를 남용행위로 보기는 어렵다고 판단하였다. 대상판결이 다룬 관련시장의 획정, 시장지배력의 존부, 객관적 행위 요건, 경쟁제한효과 등 주요 쟁점에 대하여 대법원이 시장지배적 지위 남용행위의 증명기준과 증명도의 방향을 제시할 기준을 판시할 것으로 기대한다.

("황제내경소문(黃帝內經素問)" 중(中) 사혈(瀉血)에 관한 연구(硏究) (A Study on the Blood-Letting Therapy in Elementary Questions)

  • Blood-Letting Therapy is a rational and ecological medical treatment by which we can heal most of the diseases by removing the static blood which precipitates in the blood vessel and blocks the flowing of blood. And the static blood is the generic term for the injurious, bad, dead and precipitated blood which is blocked the capillary vessel. The Yellow Emperor's Canon of Internal Medicine says that "the patient is treated with drugs internally and stone acupuncture externally. "In the old texts, the blood-letting therapy is mentioned as blood-letting, network vessel pricking, bloodletting, pricking, and arousing pulses etc and it is noted down as the method of network vessel pricking in 'On the Application of Needles' of Spiritual Pivot. Nine-pricking therapy, twelve-pricking therapy and five-pricking therapy are recorded in the methods of network vessel pricking and among them, the method of squeezing blood after pricking the affected part is explained as the network vessel pricking. There are four methods of network vessel pricking, pricking, picking, cluster needling and scatter-pricking and they are fluidly applied to the various symptoms of diseases. In 'On Discriminative Treating for Patients of Different Regions' in Elementary Questions, Ki-baek emphasizes "most of the local people, there are black in skin and loose in striate, and their diseases are mostly of carbuncle kind. But by the change of social customs and the confucianism of confucius - it is widely spread on the period of North and South Dynasties, 'Wi' and 'Jin' in china and the period of the Three States in korea - The blood-letting therapy which was regarded as the most important medicinal treatment withered rapidly. And Confucius accentuated the importance of our body and all its members, loyalty and filial piety and banned any damage of our body under no circumstances. As a result of it, the therapy of blood-letting had a rapid decrease and barely kept itself in existence in both countries. What is worse, at the period of Japanese colonial rule of korea and our nation's founding of early stage, it has been withered by the high-handed policy to change Oriental Medicine into modern medical science. So the therapy of blood-letting barely kept itself in existence in some Buddhist temples. Another case, it has handed down as a old-fashioned quick fix in folk remedies. But all kinds of the contamination of heavy metals and the misuses of antibiotics are widely spread nowadays, which increased diseases of adult people and incurable diseases as modern society unavoidably made its way into a highly industrial society. To make us more miserable, the western medical science - the antibiotics and surgical operation medical science - already reveals itself into a limit. The necessity of a new medical science which can give a security to the patients who are suffering from the diseases of adult people and the incurable diseases is especially come into the force nowadays. In view of the results after bibliographically studying on the blood-letting Therapy in Elementary Questions of the Yellow Emperor's Canon of Internal Medicine, the blood-letting therapy has acted for the important Oriental medicinal science and has been clarified the prominent effects on the diseases of adult people and the incurable diseases. So it is regarded as an appropriate thing that we lay out a determined theory of the blood-letting therapy and of course prevent the unwanted side effects from inappropriate medicinal treatments, and make full use of clinic by elevating the curative value and that we win back our self-respect of medical treatment which is dominated from the western medical science and ultimately contribute to national medical welfare.

불면증(不眠症)의 병인병리(病因病理)에 관한 문헌고찰 (Literatual Study on Pathology of Insomnia)

  • Though, these days there are increasing many patient of insomnia, there was not considered literatual study on insomnia. So, the result of consideration about cause and process of insomnia from thirty kinds of literatures, are as follows. 1. Early literature like Huangjaenankyung(黃帝內經), Sanghanron(傷寒論) reffered to insomnia as accompanying symptom. on the other hand, Myung(明), Chung(淸)'s literatures reffered to that as chief symptom or distinguished chief symptom from accompanying symptom. 2. There were tendency of deductive expanding of various masters and tendency of induction of simple theory that was based on Huangjaenankyung(黃帝內經). 3. Huangjaenankyung(黃帝內經) showed basic process of the sleep disorder that 'exhausting of Yin and excess of Yang (陰盡陽盛)', protecting energy does not invade Yin portion(陽氣不入於陰). And Huangjaenankyung(黃帝內經) showed cause of insomnia that deficiency of vital energy and blood, imbalanced of spleen and stomach, a fever as a invasion in the outside, lung system's disease. This became a basic cause and process of the sleep disorder in ancient period. 4. Sanghanron(傷寒論) occurred to insomnia as accompanying symptom in progress, remedy of a fever invaded outside, Kumkyeyoriak showed as origination in weakness, fatique, various diseases. Out of that, there is a significance in description of insomnia from some disease like histery or neurosis. 5. Jaebyungwonhuron(諸病源候論), Chunkumbang(千金方), Kukbangseo(局方書.) occured to a fire of heart(心慤) and a deficiency of heart and gall bladder(心膽虛) in defails. Insomnia is caused by agony of seven emotion, delivering of a child, are similar to insomnia is caused by psychologic disorders. Injaesanghanyusu(仁劑傷寒類書) occured to exhausting of Yin and excess of Yang (陰盡陽盛), imbalanced of stomach(胃不和) invasion of coldness(傷寒) are brought a conclusion of assumption of sap(津液耗損) brought about unreturn of yin energy. 6. Manbyunghuechum(萬病回春) in Myung period (明代) made much of portion of phlegm's influence about spiritual function. Kyungakjunsu(景岳全書) valued much of treatment divided according to excess and deficiency. Junginmaekchi(證因脈治) occurred to concept of pyorihesil(表裏虛實), Dongyibokam(東醫寶鑑) synthesised various theories. 7. Hyuljungron(血證論), Byunjungkimun(辨證奇聞), Suksilbirok(石室秘錄) made much of surprisemeni(驚恐) Consideration(思慮), liver's dryness(肝燥) is caused by liver's weakness(肝虛), imbalance of haert -kidney(心腎不交), seven emotion(七情). Especially, ftyujungchijae(類證治載) said that heart, liver, gall-bladder, kidney, surprisment, consideration baought to a conclusion of inbalance of Yang and Yin (陽不交陰). There is a tendency in literature mostly that literature showed separation of insomnia as a chief symptom. 8. These days there are increasing many patient of insomnia. So, it is needed to study about insomnia as a psychologic disease. Saying in conclusion, it is needed that we have to recognize in modern style based on ancient style of cause and process of insomnia. It is regarded to study about insomnia definitely and experimently.
