소리바다와 위니(Winny)사건에 있어서와 같이 적법 또는 불법 그 어느 쪽으로도 사용이 가능한 파일공유프로그램을 개발하여 웹사이트에 이를 공개한 후, 불특정다수인이 인터넷상에서 이를 통해 저작권 침해행위를 하였다면, 이러한 도구를 제공한 자에게 방조범의 죄책을 물을 수 있는지 하는 문제가 이른바 "중립행위에 의한 방조"의 문제이다. 방조범은 종래 처벌범위의 한정방법으로 다양한 학설들이 주장되어 왔다. 그러나 인과적이고 정범의 실행행위를 용이하게 한 행위라고 하더라도 중립행위에 의한 방조처럼 그 행위의 특성상 방조라고 보기 어려운 행위에 대해서는 기존의 판례와 학설들로 처벌범위를 한정할 수 있는지 의문이 아닐 수 없다. 따라서 본 논문은 중립행위에 의한 방조의 사례로서 논의된 한국의 소리바다사건과 일본의 위니사건을 소재로 그 방조의 특성과 문제점을 종래 제기된 학설과 판례에 따라 고찰하여 방조행위의 구체화 및 양적판단을 통한 새로운 처벌범위의 한정기준을 제시하였다.

Along with the spread of digital music and recent growth in the digital music industry, the demands for music recommender are increasing. These days, listeners have increasingly preferred to digital real-time streamlining and downloading to listen to music because it is convenient and affordable for the listeners to do that. We use Bayesian learning through weight of listener's prefered music site such as Melon, Billboard, Bugs Music, Soribada, and Gini. We reflect most popular current songs across all genres and styles for music recommender system using user profile. It is necessary for us to make the task of preprocessing of clustering the preference with weight of listener's preferred music site with popular music charts. We evaluated the proposed system on the data set of music sites to measure its performance. We reported some of the experimental result, which is better performance than the previous system.

국내 디지털 음악 시장은 소비자 이용 패러다임의 변화, 국내 디지털음악 서비스 사업자간의 양극화, 글로벌 사업자의 국내진출 이슈 등의 환경변화로 인해 경쟁력 제고를 위한 미래사업 전략 수립이 필요한 상황이다. 디지털 음악 서비스의 경쟁력 향상을 위해 디지털 음악 서비스 수용요인, 만족, 충성도 간의 인과관계에 대한 연구는 필수적이나 현재까지 제한적인 연구만 수행되어 왔다. 따라서 본 연구에서는 '디지털 음악 수용 요인' 모델을 기초로 소비자의 '지각된 가치', '고객 만족' 및 '충성도'간의 인과관계를 규명하고자 하였다. 분석결과 '디지털 음악 서비스 요인' 중 '상품의 다양성'과 '시스템 품질'은 '지각된 가치'와 '고객 만족'에 영향을 미쳤으나 '서비스 용이성'은 '고객 만족'에만 영향을 미치는 것으로 나타났다. 또한 '지각된 가치'는 '고객 만족'과 '충성도' 모두에 영향을 미치는 것으로 나타났다.

File sharing through P2P was decided as illegal according to Supreme Court of the U.S. and the Highest Court of Korea in 2005. Metro-Goldwyn-Mayer Studios Inc. et al. v. Grokster, LTD., et al. and Soribada v. Korea Association for Music Providers have the same ground for decision. P2P service company has vicarious liability for illegal file sharing of its customers. Balance between copyright protection and development of technology was considered in that decision. Programmer who will develop new program for free download and copyright holders who will exploit every measures to protect their right may compromise for their mutual benefits.
