The problem of the cases of Soribada and Winny is their duplexity that they could be used legally and illegally. The issue called 'The crime of aiding through the neutral behavior' is about whether the program developer who shared the file sharing program letting unspecified public infringe the copyright could be punished or not. Many theories about limiting the traditional scope of punishment of aider have been maintained. However, it is questionable whether it is possible to limit the scope of punishment following the former cases and theories even for the action that is causal and facilitates the principal's criminal conduct, like the aid through the neutral action which is hard to perceive as illegal aid because of its characteristics. Therefore, using the case of Soribada in Korea and the case of Winny in Japan as the examples of illegal aid through neutral behavior case, this paper examines the characteristics and problems of aid through existing theories and cases, and suggests new scope of punishment limitation standard through the elaboration of the action of aid and judgment of degree.

Along with the spread of digital music and recent growth in the digital music industry, the demands for music recommender are increasing. These days, listeners have increasingly preferred to digital real-time streamlining and downloading to listen to music because it is convenient and affordable for the listeners to do that. We use Bayesian learning through weight of listener's prefered music site such as Melon, Billboard, Bugs Music, Soribada, and Gini. We reflect most popular current songs across all genres and styles for music recommender system using user profile. It is necessary for us to make the task of preprocessing of clustering the preference with weight of listener's preferred music site with popular music charts. We evaluated the proposed system on the data set of music sites to measure its performance. We reported some of the experimental result, which is better performance than the previous system.

국내 디지털 음악 시장은 소비자 이용 패러다임의 변화, 국내 디지털음악 서비스 사업자간의 양극화, 글로벌 사업자의 국내진출 이슈 등의 환경변화로 인해 경쟁력 제고를 위한 미래사업 전략 수립이 필요한 상황이다. 디지털 음악 서비스의 경쟁력 향상을 위해 디지털 음악 서비스 수용요인, 만족, 충성도 간의 인과관계에 대한 연구는 필수적이나 현재까지 제한적인 연구만 수행되어 왔다. 따라서 본 연구에서는 '디지털 음악 수용 요인' 모델을 기초로 소비자의 '지각된 가치', '고객 만족' 및 '충성도'간의 인과관계를 규명하고자 하였다. 분석결과 '디지털 음악 서비스 요인' 중 '상품의 다양성'과 '시스템 품질'은 '지각된 가치'와 '고객 만족'에 영향을 미쳤으나 '서비스 용이성'은 '고객 만족'에만 영향을 미치는 것으로 나타났다. 또한 '지각된 가치'는 '고객 만족'과 '충성도' 모두에 영향을 미치는 것으로 나타났다.

File sharing through P2P was decided as illegal according to Supreme Court of the U.S. and the Highest Court of Korea in 2005. Metro-Goldwyn-Mayer Studios Inc. et al. v. Grokster, LTD., et al. and Soribada v. Korea Association for Music Providers have the same ground for decision. P2P service company has vicarious liability for illegal file sharing of its customers. Balance between copyright protection and development of technology was considered in that decision. Programmer who will develop new program for free download and copyright holders who will exploit every measures to protect their right may compromise for their mutual benefits.
