선화주 균형발전을 위한 해운법 및 독점규제법의 개정방향에 관한 연구 (A Study on the Direction for Revision of Korea Shipping Act and Monopoly Regulation and Fair Trade Act)

  • Korea Shipping Act admits shipping conferences' joint actions like rate agreement, sailing agreement in some degree for development of shipping transport industries for decades. Meanwhile, EU has prohibited all kinds of shipping conferences' joint actions since October 2008, and many advanced countries also have similar position on shipping conference. The balance development between shippers and ship owners is very important in terms of national economic growth. So it is appropriate time to revise related laws such as Shipping Act and Monopoly Regulation and Fair Trade Act. First, It is direction for revision of Korean Shipping Act. The act has to define precisely the criteria of "unfairness" in case of admitting of shipping conferences' joint actions. Shipping conferences have a conference with shipper or shipper's delegation substantially on freight and transport conditions and so on. Second, It is direction for revision of Monopoly Regulation and Fair Trade Act. The fair trade commission has to perform fair roles between shippers and ship owners. The judgement of fairness has to confirm according to the spirit of not Korea Shipping Act but Korea Monopoly Regulation and Fair Trade Act itself.

개항의 항계 안에서의 선박충돌에 따른 법률상의 쟁점 -해양안전심판원의 재결사례에 대한 분석을 중심으로- (A Study about Legal Issues of Ship Crash in Open Ports Act)

  • Open port has the designated course and traffic jam of ships happens often. This fact may connect to ship crash easily. And the accident happens due to violation of navigation mainly. In ship crash between Neoblue and Shinkwang 7 at incheon open port, the Korean incheon maritime safety tribunal shows that the violation of navigation and duty of attention at the open port would produce ship crash directly. Wherefore, the interpretation and application of navigation are important to protect future ship crash accident. The points of navigation as objects of study are divided into two categories, interpretation and application of navigation on crashing between the ship which navigate the designated course and the ship which enter into the designated course from the another course or outside the course, interpretation and application of navigation on crashing between two or more ships, which navigate violating the navigation every ships and violating agreement rule each other. And as conclusion, I refer the legal responsibility both Neoblue and Shinkwang 7 in detail. The results of this study as follows : First, in case of crashing between the ship which navigate the designated course and the ship which enter into the designated course from the another course or outside the course, public order in open port act can be applied by priority. However, in applying the public order the principle of trust and reasons of crew, cause and effect, the time of navigation application are mandatory considerations. Second, in case of crashing between two or more ships, which navigate violating the navigation every ships and violating agreement rule each other, we should focus on the reasons of crew. Also, the reasons of crew need strict conditions. These means that the awareness of crash danger and recognition of special circumstance including limit state of ships, existence of emergency danger, non escaping crash danger by only observance of navigation. And in case of this state the public order the principle of trust and reasons of crew, cause and effect, the time of navigation application should be considered by priority, too.

선박급유업의 법제도적 개선방안에 관한 연구 (A Study on Improving the Legislation and Institution of Bunkering Business)

  • 선박급유업은 국제물류흐름의 허브인 항만의 부가가치 창출을 위한 핵심적인 사업 중의 하나이다. 선박급유업의 법 제도적인 개선을 통하여 급유산업의 안정화를 도모하여 항만이 실질적으로 부가가치를 창출하는 기능을 수행할 수 있도록 해야 한다. 이 논문에서는 항만운송법과 해운법의 개정, 안전관리체계의 일원화, 선박유 품질관리를 위한 지침제정, 선박급유업자의 불법행위에 대한 관리 및 법 개정에 대한 대책을 제시하고 한다. 결론적으로 선박급유업의 경영 안정화 및 중장기 발전을 위하여 정부, 정유사, 급유선 선주 등이 주체별로 역할을 분담하여 할 것이며, 선진화를 위해서 단계적으로 계약체계 및 법 제도의 개선을 추진해야 할 것이다.

위탁승선실습생의 법적지위 -목포해양전문대학생을 중심으로- (A Study on the Legal Status of Apprentice Officers on the Merchant ship)

  • Students of the Mogpo Merchant Marine College must complete one year's shipboard training course according to IMO(International Maritime Organization) regulations as an obtaining matter of Certificate of Competency. The purpose of this shipboard training course lies int he student's acquiring practical knowledge and sill as a part of a course of study and, in the future, fostering essential adaptability and leadership, especially in bad circumstances on the sea. The shipboard training course has two kind that the students can be trained either on the training ship or on a merchant ship of the shipping company. In this paper, I only thought over the legal status of apprentice officers on the merchant ship and analyzed the problems practicably during shipboard training. This paper is made up of five chapters. The first chapter contains the purpose contents and method of this study, in the second, the meaning of shipboard practice education and training, in the third, the legal status of apprentice officers on merchant ship, in the fourth, the analysis of the provisions of the seamen act applied to apprentice officers on a merchant ship. And in the last chapter 5, the contents mentioned is summarized and directions are presented to amend the provisions of the seamen act applied to apprentice officers. The conclusions are as follows. 1.In case of shipboard training on overseas employment ship, the seamen act applied to the manning agent employing the apprentice officers should be reinforced. 2. The provisions of disembarkation in mid course by discipline of the seamen acts Article 24 should be relaxed. And the provisions in relations to seamen's duty to be a reason of discipline applied to apprentice officer among the provisions for ship's public order maintenance should be abolished. 3. The provision of repartriation completely should be applied to apprentice officers and the provisions of a journey expenditure during their embarkation or disembarkation have to be established. 4. The apprentice officers in shipboard training also need securing a basic wages provision to be criterion of an accident compensation. 5. The apprentice officers in shipboard training should not be in charge of third officer's or third engineer' study.

레저선박 관련 사업법상 주요 쟁점사항에 관한 고찰 (A Study on the Main Issues Regarding Business Acts Related to Leisure Boats)

  • 본 연구는 레저선박 이용 사업법을 검토하여 유사사업 간 규제 내용이 상이한 점과 관련 제도의 미비점을 고찰하고 개선방안을 제시하고자 한다. 주요 연구방법은 레저선박 이용 사업에 관한 법률 및 문헌분석이다. 현재 선박법 선박안전법 및 수상레저안전법에 따라 등록된 레저선박(또는 동력수상레저기구)을 이용하는 사업법은 해운법, 유도선법, 수상레저안전법, 마리나항만법이다. 연구결과, 이들 사업법은 선박 총톤수, 선령, 선원, 주류 판매 기준에 차이가 있는 것으로 나타났다. 이로 인해 선박시설의 구조변경 등으로 총톤수를 조정하는 행위, 선령 제한이 없는 사업에 노후 선박이 투입될 가능성, 선원 기준이 명시되지 않은 사업에 안전에 필요한 선원이 승선하지 않을 가능성, 유사 사업에 주류 판매 기준의 형평성이 어긋나는 문제 등이 제기되었다. 이러한 문제는 레저를 목적으로 하는 선박에 대한 이해가 부족하고 관련 사업법이 수요에 따라 하나씩 추가적으로 제정된 데 기인한 것으로 보인다. 비교적 최근에 등장한 레저용 선박의 특성에 대한 이해를 높이고 그 특성에 비추어 다른 목적의 선박과 같은 기준 혹은 다른 기준을 적용해야 하는 부분을 정리해 나가는 일이 필요하다.

  • In order to prepare for the enforcement of the "ransportation Services Improvement Act for the Mobility Handicapped People" which was passed in parliament in Dec. 2004, various equipments and installations need to be developed to ensure appropriate level of safety for the mobility handicapped to use maritime transport. In this paper, we investigated the current status of domestic passenger vessel usage by the mobility handicapped, to analyse the requirements for amenities necessary for the mobility handicapped and developed accessibility guidelines for amenities for the mobility handicapped persons in order to prepare for the enforcement of the "ransportation Services Improvement Act for the Mobility Handicapped People"

예인선의 최저승무기준에 관한 고찰 (A Study on the Tug's Minimum Manning Levels)

  • 부선을 예인하는 예인선은 90.5 %가 총톤수 200톤 미만으로 대부분 선장 혼자 승무하고, 선원법상 근로시간 및 승무정원에 관한 규정을 적용받지 않는다. 따라서 부선을 예인하는 예인선의 선장은 항해당직 중 적절한 휴식을 취하지 못해 피로하게 되고, 부선을 예인하는 예인선은 불가피하게 무자격자인 갑판장과 교대로 항해당직을 수행하며 인적 감항능력을 충족하지 못한다. 또한 예인선의 선장 또는 소유자는 예인선이 부선을 예인할 때 선박직원법상 추가적으로 요구되는 최저승무기준을 준수하지 못하는 사례가 자주 발생하고 있다. 본 연구에서는 먼저 다음 사항에 대해 살펴보았다. (1) 선원법상 근로시간 및 승무정원에 관한 규정, (2) 선박직원법상 예인선의 갑판부 선박직원의 최저승무기준에 관한 규정, (3) 부선을 예인하는 예인선의 해양사고 사례. 그리고 예인선의 실효적인 해양사고 예방을 위해 예인선이 부선을 예인하는 경우에는 항해사 1명이 추가적으로 승무하도록 갑판부 선박직원의 최저승무기준을 개정할 것을 제안하였다. 특히 중대재해 처벌 등에 관한 법률은 2022. 1. 27. 시행되었다. 해양에서 인명사고가 동일한 원인으로 계속 발생하고, 그 원인이 제도적 미비로 인한 항해사의 피로라고 판단된다면 해양항만관청은 처벌을 받게 될 수 있으므로 이에 대해 대비할 필요가 있다고 본다.

소형선박의 복원성기준 연구 (A Study on the Stability Criteria of Small Vessels)

  • In order to ensure safety of small vessels, the amended Ship Safety Act will come into force on 4th. Nov. 2007. This study is performed to suggest the stability criteria of fishing vessels and cargo ships of 12m in length and over but less than 24m in length which will be new object of amended Ship Safety Act. We have analyze the dimensions of domestic small vessels and the casualty reports of capsizing accidents. According to the analyzed result, 58 ships that are in the range of the dimension are modeled and the stability calculation has been carried out. The Stability for the 58 ships has been analyzed by comparing the result that applied the selected standard in the national standard to the stability calculation. Based on the regression analysis of the model ship's allowable transverse metacentric-heights under several stability requirements, stability criteria for small fishing vessels and cargo ships are proposed.
