A Study on Legalization of Seperate Contracting System for Fire Facility Constructions (소방시설공사 분리발주제도 법제화 방안연구)

  • The ultimate objective of research thesis is to introduce the 'Separate Contracting' system of fire facility construction, develop fire industries and stabilize citizen lives. And, this thesis is designed to analyze the ongoing situations of the 'Separate Contracting' system in national and international public constructions, and initiate the methods of introducing the 'Separate Contracting system' in fire facility constructions proper for Korean situations. In this regard, the research thesis studied of the property of the introduction of the 'Separate Contracting' system of fire facility constructions, through the comparative analysis on the existing 'Contract Bundling' system. And, the thesis established strategies to legalize this system and considered the revisions on the laws and items pursuant to fire facility constructions.

A Study on the Legislation for Separate Prime Contracting in the Fire Facility Business (소방시설업의 분리발주 법제화에 관한 연구)

  • This study analyzes the present public construction ordering system focussing on the legal framework for the fire facilities construction business and investigates the problem of subcontracting, and further reviews why Separate Prime Contracting should be recommended in policy, social, legislative and regulative terms. This study suggests the amendment of Fire Facilities Construction Business Act, with new bill drafting. The result of this study shows the present public construction ordering system has huge disparities between main building construction business and fire facilities construction business, and recommend Separate Prime Contracting should be adopted in the fields of fire facilities construction business. The system of Separate Prime Contracting may secure business entities' responsibility and higher quality of fire facilities, and also result in reasonable construction practices in reasonable costs. This system may also contribute to improve public safety level in fire facilities construction.

  • Procurement System for Korean construction industry has mainly been controlled by the complicated regulatory system which has been recognized as unflexible and remotely separated from the global standard. This has been identified by many Korean construction experts as one of the main reasons that hamper the Korean construction industry becoming the global leader. One commonly discussed regulatory system is the compulsory multiple contracting system that has been enforced for a long time. According to the Korean governmental contracting law 68-3, all construction projects cannot be divided into separate contracting packages with a few exceptions. Exceptions stated in the law include construction activities related electrical, Information communication, fire-fighting, and cultural assets which all are governed by the separate laws/acts controlled by the different governmental bodies. This research is to closely investigate multiple prime contracting system that has been compulsory in Korean construction industry and to provide policy recommendations to these restrictions. Although, there has been a long history of this compulsory contracting system, this study attempted to provide objective analysis on current status of the system as well as global standard on the issue. This study suggests main considerations when considering different contracting system such as rights of owners, flexibilities of regulatory systems, and efficiencies of conducting a construction project. It is envisioned that recommendations from this study, if accepted by the regulatory bodies, would improve the Korean construction contraction system by making it more compatible with global standard. Moreover, these would help making the Korean industry more effective in terms of regulatory restrictions.

A Study on the Applications of Airspace Design Criterions Affecting on the Flight Safety (비행안전에 영향을 미치는 공역설계기준의 적용에 관한 연구)

  • The airspace has to be designed considering the flight safety and economic efficiency of aircraft operators. The International Civil Aviation Organization(ICAO) published standards and recommended practices for safe design of the airspace. Each contracting country must follow the ICAO standards in designing the airspace for the utilization of civil aviation. Normally each member establishes its own standards and national aviation law for the safe and efficient design of the airspace, regarding the ICAO standards. However, our government has not developed yet clear and detailed standards and regulation system for airspace design. This might lead to aviation accidents and disputes between operators of aviation system This study is to review the characteristics of ICAO standards and a legal problem related to application of international standards for airspace design. Specifically this research analyzed the case of airspace design and operation of a domestic airport. The results of analysis are as follow: (1) per the safety of civil aviation, it is very required to establish national regulation system to follow ICAO standards in designing airspace, (2) It is also necessary to establish separate procedure for civil aircraft in military air base, when the aerodrome is co-used by military and civil aircraft. If the same procedure for military aircraft is applied to civil aircraft, it is necessary to make clear what the design concept is, (3) and the differences from ICAO standards have to be publicly known.
