Legal Problems and Improvement Measures Concerning the Monopoly of Housing Construction Sales Guarantee Business by Housing and Urban Guarantee Corporation (주택도시보증공사의 주택건설 분양보증업무 독점에 관한 법적문제점과 개선방안)

  • Issues have arisen over the monopoly of housing sales guarantees by the Housing and Urban Guarantee Corporation. If the Ministry of Land, Infrastructure and Transport appoints an additional guarantee institution, there is concern that the property protection between the two parties is insufficient due to excessive competition and the weakening of urban regeneration resources. It argues that housing supply policies for stabilization of the housing market can be smoothly implemented through monopoly projects. This is judged to be an abuse of market dominant position under the Fair Trade Act, and excessive restrictions on pre-sale guarantee requirements may cause delays in business and infringement of property rights of members. First, the establishment of a designation system for market dominant operators of the Fair Trade Commission enables new entry of private guarantee institutions. Second, it is necessary to improve regulations under Article 63 of the Fair Trade Act (consultation on the establishment of laws restricting competition, etc.). Third, through the establishment of the 「Rules on Housing Supply」 under Article 15 (2), the Minister of Land, Infrastructure and Transport can additionally designate a guarantee institution, thereby guaranteeing the right to select a pre-sale guarantee for the business entity. In addition, it is expected that at least one of a number of guarantee insurance companies can be designated to improve the efficiency of the distribution of social benefits, thereby lowering the volatility of housing prices.   • This study examined the apartment sale in lots system from 1960s to 1970s in Seoul from a historical perspective, with the focus on the concept and changes of pre-sale in lots system. By tracing back historical context and application of the system in that period through the analysis of the advertisements for apartment sale, we found out the hidden side of the apartment pre-sale in lots system from the public's point of view, and its impact and meaning on the formation of our current residential culture. In the 1960s and 1970s, the apartment sale in lots system based on the pre-sale in lots system formed strong seller's market and it has been the main reason for imposing the wrong residential awareness that led the public to recognize housing as a means of property growth. Even now, the current apartment sale in lots system remains to be a supplier-oriented one, and lots of people tend to regard housing as investment method. That is, this mechanism is not only still working but one of the fundamental causes of impoverishing our residential culture. It is necessary to reconsider the pre-sale in lots system and the apartment sale in lots system in relation to the public of housing.

Trust to Share: Investigating the Key Factors to Influence Tenants' Participation in Online Short-Term Rent

  • The concept of sharing economy has received rich attention in recent years. As a typical type of business model in the sharing economy, online short rent has been paid attention by both industry and academia. In this study, we find trust to be a critical determinant to the success of online short rent platforms. Based on three dimensions of trust theory, i.e., ability, benevolence and integrity, we investigate the factors influencing tenant' willingness to participate in online short rent. We further examine the extent to which trust can influence the number of sales and comments of rooms listed at online short-term rent platforms, which can represent tenant' willingness to participate in the sharing economy. The results show that the trust dimensions represented by a landlord's personal characteristics have significant positive correlations with the number of sales and comments. For example, the real name authentication and the sesame score can represent the trust integrity; online replay ratio and the average confirmation time representing the trust sincerity, and the order acceptance ratio representing the trust ability. On this basis, we proposed some recommendations for both platforms and landlords. For example, the landlords can improve the tenants' trust by authenticating his/her real name, replying actively and timely. For platforms, when they make housing list ranking rules, they can take the landlord's personal attributes that may affect trust into consideration. Moreover, platforms can also allow landlords to supply value-added services to improve service quality and ultimately promote the virtuous circle of the platform ecosphere. Through conducting the empirical research on a particular application of the sharing economy, we aim to fill the research gap of this field in China and provide theoretical and practical contributions to the future development of online short rent.
