콘텐츠 관련 공모전의 저작권 소유와 저작권 침해 분석 (An analysis on the possession and infringement of copyright on the contents-related contest exhibit)

  • 공모전이 활성화되어 다양한 단체에서 다양한 목적을 가지고 공모전을 주최하고 있다. 공공기관부터 개인 사업자까지 다양한 주최의 공모전 요강을 분석해보면 저작권을 주최 측이 가지려는 경향이 매우 크다. 공모전 요강 중 일부는 일종의 계약서이다. 주최 측은 요강을 통해 저작권에 대한 견해를 분명히 밝히고 있는 데 반해, 개인은 계약서로 보기보다는 공모전에 출품하기 위한 형식이라고 단순하게 생각하는 경향이 있다. 이제는 공모전의 저작권에 대한 문제 제기가 필요한 시점이다. 기업의 콘텐츠 저작권만 보호하는 것이 중요한 것이 아니라 개인의 콘텐츠 저작권 또한 보호받고 존중받아야 한다는 점이다. 본 연구는 공모전 요강에서 드러나는 저작권 소유와 저작권 침해 항목을 분석함으로써 저작권에 대한 문제 제기를 하는 데 목적이 있다. 공모전의 저작권 조항은 계약서 역할을 한다. 공모전의 저작권 항목은 갑과 을의 관계인 주최 측과 수상자 모두가 이해하고 수용할 수 있는 내용이 바람직한 공모전의 방향이다. 이를 위해서 공공기관부터 개인 사업자까지 우월적인 지위를 가진 주최 측의 인식변화가 필요하다. 그러기 위해서는 첫 번째, 저작권의 표기: 분명하고 구체적인 용어를 사용해야 한다. 두 번째, 해석의 범위: 포괄적인 해석이 가능한 표기가 아닌 구체적인 표기를 해야 한다. 세 번째, 저작재산권의 대가: 주최 측이 수상작의 저작재산권 소유나 이용이 필요할 경우, 저작재산권의 권리 소유나 이용에 맞는 대가의 상금액을 고려한 적정한 재산적 사용의 권리를 표기해야 한다. 네 번째, 사용기간: 저작재산권의 사용기간을 표기해야 한다. 다섯 번째, 권리의 범위: 주최 측이 필요로 하는 저작재산권의 범위를 한정 표기해야 한다. 여섯 번째, 상호존중: 일방적 계약이 아닌 상호 배려와 존중에 입각한 쌍방계약의 개념으로 저작권 관련 항목을 표기해야 한다.

항공기 집행에 관한 법리 (The Legal Theory on the Civil Execution against Aircraft)

  • 우리나라의 경제가 더욱 성장하고, 항공기의 수가 점차 증가하면, 항공기 집행사건은 앞으로 늘어날 수 있다. 이 글은 다수의 사례가 축적되어 있는 선박집행에 관한 법리를 차용하여 항공기 집행에 관한 법리를 제시하기 위한 것이다. 항공기, 경량항공기에 대한 집행은 기본적으로 부동산 선박 집행을 준용하고, 초경량비행장치, 외국항공기에 대한 집행은 동산집행방법에 의한다. 항공기 집행에는 강제경매, 임의경매, 유치권에 기한 경매 등이 있다. 항공기에 대한 강제경매는 채권자가 금전의 지급을 목적으로 하는 청구권의 만족을 얻기 위하여 채무자 소유의 항공기에 대하여 행하는 강제집행을 말한다. 항공기에 대한 강제경매는 압류 당시에 그 항공기가 있는 곳을 관할하는 지방법원을 집행법원으로 하고, 이는 전속관할이다. 법원은 경매개시결정을 한때에는 집행관에게 항공기등록증명서 그 밖에 항공기운항에 필요한 문서를 받아 법원에 제출하도록 명하여야 한다. 강제경매개시결정이 있은 날부터 2월이 지나기까지 집행관이 항공기등록증명서등을 넘겨받지 못하고 항공기가 있는 곳이 분명하지 아니한 때에는 집행법원이 강제경매절차를 취소할 수 있다. 채권자 최고가매수신고인 차순위매수신고인 매수인의 동의가 있으면, 법원은 영업상의 필요 그 밖에 상당한 이유가 있다고 인정한 때에는 채무자의 신청에 따라 항공기의 운항을 허가할 수 있다. 법원은 채권자의 신청에 따라 항공기를 감수하거나 보존에 필요한 처분을 할 수 있다. 채무자가 민사집행법 49조 2호 4호의 서류를 제출하고 압류채권자 및 배당요구채권자의 채권과 집행비용에 해당하는 보증을 매수신고 전에 제공한 때에는 법원은 신청에 따라 배당절차 외의 절차를 취소하여야 한다. 항공기를 목적으로 하는 담보권 실행을 위한 경매(임의경매) 절차에는 선박 항공기 강제경매에 관한 규정과 담보권 실행을 위한 부동산 선박 경매에 관한 규정이 준용된다. 임의경매에서는 집행권원이 필요하지 않고, 신청에도 집행력 있는 정본은 요구하지 않는다. 또한, 집행법원이 담보권 및 피담보채권의 존부를 심사하여 담보권의 부존재 무효, 피담보채권의 불발생 소멸 등과 같은 실체상의 하자가 있으면 경매개시결정을 할 수 없다. 나아가 이러한 사유는 매각불허가 사유에 해당하고, 또 이를 간과하여 매각허가결정이 확정되고 매수인이 매각대금을 완납하여 소유권이전등록을 마쳤다 하더라도 매수인은 매각항공기의 소유권을 취득하지 못한다. 집행법원은 여러 대의 항공기 상호간의 이용관계에서 견련성이 있는 경우에 한하여 여러 대의 항공기에 대한 일괄경매를 할 수 있다(대법원 2001. 8. 22.자 2001마3688 결정). 항공기에 대한 유치권자도 경매를 신청할 수 있다. 형식적 경매의 절차는 담보권 실행을 위한 경매의 예에 따라 실시한다. 그러나 공항시설 사용료와 항공기 사이의 견련관계를 인정할 수 없으므로, 공항공사의 항공기에 대한 유치권은 성립하지 않는다(대법원 2014. 4. 10. 선고 2011다29291 판결). 유치권에 의한 경매도 항공기 위의 부담을 소멸시키는 것을 법정매각조건으로 하여 실시되고, 우선채권자뿐만 아니라 일반채권자의 배당요구도 허용되며, 유치권자는 일반채권자와 동일한 순위로 배당을 받을 수 있다.

Detection of transgene in early developmental stage by GFP monitoring enhances the efficiency of genetic transformation of pepper

  • In order to establish a reliable and highly efficient method for genetic transformation of pepper, a monitoring system featuring GFP (green fluorescent protein) as a report marker was applied to Agrobacteriummediated transformation. A callus-induced transformation (CIT) system was used to transform the GFP gene. GFP expression was observed in all tissues of $T_0$, $T_1$ and $T_2$ peppers, constituting the first instance in which the whole pepper plant has exhibited GFP fluorescence. A total of 38 T0 peppers were obtained from 4,200 explants. The transformation rate ranged from 0.47 to 1.83% depending on the genotype, which was higher than that obtained by CIT without the GFP monitoring system. This technique could enhance selection power by monitoring GFP expression at the early stage of callus in vitro. The detection of GFP expression in the callus led to successful identification of the shoot that contained the transgene. Thus, this technique saved lots of time and money for conducting the genetic transformation process of pepper. In addition, a co-transformation technique was applied to the target transgene, CaCS (encoding capsaicinoid synthetase of Capsicum) along with GFP. Paprika varieties were transformed by the CaCS::GFP construct, and GFP expression in callus tissues of paprika was monitored to select the right transformant.

국제물품매매계약상 특정이행에 관한 법적 쟁점 - CISG 제28조의 해석과 적용을 중심으로 - (Legal Issues in Specific Performance under International Business Transactions: The scope and application of Article 28 of the CISG)

  • Unlike continental European legal systems (civil law systems), specific performance in common law refers to an equitable remedy requiring exactly the performance that was specified in a contract. It usually granted only when money damages would be an inadequate remedy and the subject matter of the contract is unique. Thus, under common law specific performance was not a remedy, with the rights of a litigant being limited to the collection of damages. Consistent with the practice in civil law jurisdictions, United Nations Convention on Contracts for the International Sale of Goods (CISG) makes specific performance the normal remedy for breach of a contract for the sale of goods. Therefore, the buyer may require a breaching seller to deliver substitute goods or to make any reasonable repair. Likewise, the sellermay require the buyer to taker delivery of goods and pay for them. Despite this, Article 28 of the CISG restricts the availability of specific performance where it would be unavailable under the domestic law of the jurisdiction in which the court is located. Thus, the CISG's more liberal policy toward specific performance is restricted by common law. There are some legal issues in CISG's specific performance availability by Article 28. This paper analyzes these issues as interpreting Article 28 of CISG, by examining various theories of application to actions for specific performance and comparing CLOUT cases involving CISG Article 28.

  • The purpose of this study is to investigate previous data and possibility of the new culture building, insuring substantiality of the education in junior college, increasing of practical carrier, acquiring the money for practical class, and the direction of demand for education in a high level of industrial society. There's two parts to consist of investigation and the model case in wedding business in Junior college. The research groups in one part consist of 277 students in Junior college. The result were as follows: 1) The students would like to get the wedding business in new culture building. (72%) 2) The student shave got a idea to recommend to use the wedding facilities for their for their relative sand friends. (51%) 3) The trend of selecting in wedding facilities is outside than inside of facilities. (75%) 4) They would like to have the buffet service after wedding celemony, not a la carte for choose the meal. The above research data suggest that if the wedding facility's management would be accept, we could have expectation about development of junior college, emphasis of practical education and good wedding culture in this areas. For the most of student, they has a righ hand to manage the wedding facility in their college. First, the culinary students could have an experience of service practies to the customer in wedding celemony, as the result of training will be great. Second, the college could show their vision and hope to customer to interest it. Third, it can be supplied the right wedding culture and the wedding facilities which is low price and good circumstance for wedding. Fourth, it's very resonable to use the culture facilities during no class, Saturday and Sunday. Fifth, income from business can be used only a scholarship and a community development. Sixth, it can be induced the self-participication and motivation to take up a positive attitude for their life.

컴퓨터 영상을 이용한 오염방지 친수성능 측정 시스템 개발 (Development of Hydrophilic Performance Measurement System for Anti-Condensation Using Computer Image)

  • Surface energy is the principal factor of anti-condensation. High surface energy appears hydrophilic itself and low surface energy represents hydrophobic itself. The contact angle is widely being used for measurement of surface energy of materials, evaluation of coating performances, measurement of wettability, and so on. However, the existing contact angle measuring system is so expensive for purchasing and complicated, so it takes a lot of time and money to use. This study was conducted to develop the algorithm for evaluating hydrophilic performance through measuring the contact angle of water droplet automatically, and fabricate relatively simple measuring system using a low-cost monochrome camera and image processing. A constant amount of water was firstly allocated on a slide by a micropipette, and then the image of water droplet was captured by monochrome digital camera and sent to a computer. The image was binarized and then reduced noises by labeling. Finally, the contact angle of water droplet was computed by using three points (left, right, and top coordinates), simple linear mathematics, and trigonometric function. The experimental results demonstrated the accuracy and reproducibility of the developed system showing less deviations and deviation ratio.

어머니의 소비자 행동이 유아기 자녀의 소비자 행동에 미치는 영향에 관한 연구 (The Interelationship of the Consumer Behavior between Mother and Their Early Children)

  • In order to adapt to the economic change with the rapid world change, the wise consumers should have positive cognizance of their roles and are requested to fulfil their duties as a consummer. Such capability of the consumer could be acquired from home, mass media and school, and specially the role of mother at home would have a great influence on their early children's consummer activities. The purpose of this study was to investigate the interrelationship of the consumer behavior between mother and their children. As a result of this study, the mother with higher educational background could manage effectively the allowance of the children. The mother with older age had a great influence on the consumer's role of the children and high record of the execution. Employed mother had higher level of execution for the consumer's rights than their count part. Accordingly, the consumer behavior of the mother will have an influence on the children's consumer behavior. Such a result showed the meaningful statistic relations(r=3.6, p<.001) for the economy activity of the children the home management and economy life of the mother, and the purchasing activity of the children including the execution of the consumer's right. In their regard, there was the significant statistic relations(r=19, p<.05) between the children's pocket money and the housekeeping management of the mother. In the meantime, it showed that another changing factor concerned with the consumer behavior of the mother have little influence the children's allowance.

  • The important goal of urban renewal is not to reform only Physical environment but to improve people' life quality. people who have been lived in urban renewal area are grouped to owner and tenant. owner of land or house has substituent right but tenant has only house-moving money or rental house by urban renewal. But rental house condition is not good to tenant because tenant has large family, low-income and low grade and it is essential to provide rental house for low-income class and it is worth to analyze tenant house problem The purpose of this study is to analyze the problems of public rental house and to presents solutions. The study was done in following process. First, the literatures on this subject were investigated to seek the problems of public rental house. Second, Survey were done on the staff, who works in the cooperative housing redevelopment and whose jobs are officer, consultant, real estate introducer and designer, to seek problems and solution of public rntal house. survey which is made by three group. one group is made by people who already lived in tenant APT, second group is made by people who are waiting for moving in tenant APT. Third group is made by specialist who has many experience-more than 3years- to urban renewal. Third, the Correlation Analysis was used to analyze the relation between the Area and dwelling satisfaction. Fourth, tenant policy' altenative is presented to solve tenant APT' problem which is analyzed by this study The results are as follows : First, tenant APT' size Which is regulated to 30-$45m^{2}$ is enlarged to more than $45m^{2}$ because tenant family is made up averagely of 4.8 persons. Second, tenant APT' rental cost is reduced to 100 thousand won. Third tenant APT' arrangement is divided from owner because tenant and owner want to live in group by group. Fourth, tenant house type is changed to various house type because tenant is not familiar with APT

임상치과위생사의 직업인식 및 직업윤리 의식정도 (The levels of the vocational awareness and the professional ethics recognition in clinical dental hygienists)

  • Objectives: This study was carried out for the purpose of examining the levels of vocational awareness and the professional ethics recognition in the clinical dental hygienists. Methods: A survey was conducted targeting 500 members who participated in the supplementary education program for dental hygienists in the first half of 2017. Total 328 subjects' materials were analyzed. Results: A reason for working in terms of the occupational identity was very high with 81.4% in 'aiming to earn money'. A goal of working was the highest with 41.5% in 'financial independence'. The professional ethics approach level was indicated to be the highest with 3.33 points in the domain of human relation. It was shown to be in order of the job satisfaction level with 3.21 points, followed by the lifelong working with 3.17 points, the vocational ethics observance with 2.95 points, the workplace satisfaction level with 2.82 points, and the job anxiety level with 2.65 points. The domain in the job anxiety level according to general characteristics was indicated to be significantly high in the higher age and work career in case of the married and in case of Seoul as a workplace. The domain in the professional ethics observance was shown to be significantly high in the higher work career in case of the married and in case of Gyeonggi Province as a workplace. The domain in the lifelong working was indicated to be significantly high in case of the married. Conclusions: For the establishment of the right professional ethics as a dental hygienist and for the securement of its practice starting from the education for the dental hygiene department, the development of educational program will be needed aiming at the approach to the professional ethics and the reinforcement in the vocational ethics recognition.

일본의 GIS 및 수치정보 구축에 대한 연혁적 고찰에 관한 연구 (A Study on the Recent Trends of GIS and Digital Data in JAPAN)

  • 일본에서 공간정보를 최초로 수치화시킨 시도는 1969년의 메쉬데이터의 작성부터이고, 종합화된 GIS의 도입은 1970년대에 초부터 시작된 UIS 사업이다. 최근들어 고베의 대지진시 방재 GIS의 유용성이 실제로 증명되면서 더욱 그 발전속도가 빨라지고 있으며, 최근의 설문에서 지자체의 85% 이상이 GIS를 이미 도입했거나 데이터를 구축중이라는 결과처럼 행정업무에서의 활용도 보편화 되고 있다. 본 연구는 수치지도나 GIS의 분야에서 선행적인 경험이 있고 우리 나라와 제도나 계획체계 및 토지에 대한 개념이 유사한 일본의 경우를 연구하여 우리 나라의 정보산업의 근간이 될 도시정보의 구축과 활용에 관한 정보를 얻고자 한다.
