우주(宇宙) 상업활동(商業活動) 규율(規律)에 있어서의 우주법(宇宙法)의 발전적(發展的) 위상(位相) (Developments in Space Law in regulating commercial space activities)

  • This paper examines current developing status of space law as defined in terms of its unique principle that "the utilization of outer space for all mankind's interest". As commercialization of space activities has brought about heated debate on its legitimacy with respect to that principle, space law has come to witness a dual situation. One is the realization of that principle in establishing commercial space activities system where all mankind's interest is respected through the non-discriminatory distribution mode of space benefit. In satellite telecommunication system, the INTELSAT Organization assures its public service policy while protecting itself against a competition from separate systems. For remote sensing, commercialization of LANDSAT Systems promoted since 1984 seems not to affect present non-discriminatory distribution of data and information obtained. On the other hand, active participation of private entity aiming at commercial profit enables national government to manage more effective control and supervision of those activities with a view to promoting national interests. Also, newly developed private rules and regulations are emerging in business relations about commercial space activities. Extended capacity of national government assuring its national interest in production and distribution of international resources that is outer space, and regulation of space activities by newly developed rules and customs provoke a concern about a identity problem of space law. The best way to summarize this perspective might consist in saying that non space law regulations, which are not assumed as aiming at the promotion of all mankind's interest, are confirming their role about space related activities. For those reasous, we are now facing a developing status of space law as developments of commercial space activities continues.

게임 법률의 제·개정을 통해 본 게임정책이 지향하는 의미 탐구 (A study on the meaning of game policy through the amendment of game law)

  • 문화산업 중에서도 게임산업은 경제적 가치가 가장 높은 산업이다. 게임정책이 추진되고, 정책이 반영된 게임 관련 법률이 제정된 지도 약 20년이 되었다. 법률이 정책의 실현에 대한 의지적 표현이라고 한다면 게임 관련 법률의 제 개정을 통해 게임정책의 지향하는 의미를 파악할 수 있다. 1999년 제정된 <음반 비디오물 및 게임물에 관한 법률>과 이어서 2006년에 제정된 <게임산업진흥에 관한 법률>은 많은 개정 과정을 거치면서 게임에 대해 규율하고 있다. 본 논문은 근 20년 간의 게임정책의 핵심 아젠다(등급분류, 게임역기능, 사행성, 산업성장)가 게임 법률의 제 개정에서 구체화되는 내용을 분석하고, 이를 통해 한국 게임정책이 지향하는 방향과 그 의미를 파악하고자 한다. 게임 법률의 개정을 통해 보여지는 게임정책이 지향하는 의미는 게임물의 사행화를 규제함으로써 게임물을 보호하고, 사행성 근절과 게임역기능 예방으로 게임이용자를 보호하는 것이다. 또한 법정등급제라는 한계가 있지만 자율등급제로의 전환으로 이용자의 선택권과 생산자의 자율권을 확대하고, 이를 기반으로 지속적인 산업성장의 환경을 조성하는 것이다. 향후 게임정책은 게임만의 영역을 넘어 사회 제영역과의 협력을 고려해야 한다. 한편 산업구조의 양극화, 공정한 환경, 고용환경 등 새로운 아젠다에 대한 대응을 필요로 한다.

우리 나라 전산화단층촬영기(CT)의 도입에 영향을 미치는 요인에 관한 연구 (Adoption and Its Determining Factors of Computerized Tomography in Korea)

  • High price equipment is one of the major factors that increases national health expenditure in developed countries. Computerized Tomography(CT), one of the important high price equipment, has been concerns of health service researchers and policy makers in many countries. In Korea, CT, first introduced in 1984, have spreaded nationwide with rapid speed. Though the Committee for Approving Import of High Price Medical Equipment, founded in 1981, tried to regulate the introduction of high price medical equipment including CT, the effort resulted in failure. The exact situation of diffusion of the high price equipment, however, was not yet investigated. We aimed at the description of the diffusion of CT in Korea and analysis of influencing factors on hospitals for the adoption of CT. We mainly used the database of CT, made in 1996 by the National Federation of Medical Insurance for the purpose of insurance payment for CT. Also characteristics of hospitals were gathered from yearbooks published by the central and local governments and by the Korean Hospital Association. We calculated the cumulative number of the CT per one million population year by year. In turn, multiple linear logistic regression was done to find out the contributing factors for the adoption of CT by each hospital. In the logistic regression model, it is regarded as dependent factor whether a hospital retained CT or not in 1988 and 1993. The major categories of the independent factors were hospital characteristics, environmental factors and competitive conditions of hospitals at the period of the adoption. The results are as follows: Number of CT scanners per one million persons in Korea marked more higher level compared with those of most OECD countries. Major influencing factors on the adoption of CT scanners were hospital characteristics, such as hospital referral level, and competitive condition of hospitals, such as number of CT scanners per 10,000 persons in each district where the hospital was located. In Korea, CT diffused with rather rapid speed, comparable with those of the United States and Japan. The major factors contributing on the adoption of CT for hospitals were competitive condition and hospital characteristics rather than regional health care need for CT. In conclusion, a kind of regulating mechanism would be necessary for the prevention of the indiscreet adoption and inefficient use of high price equipment including CT.

생태계서비스 기반 국립공원 생태복지 개념정립 및 정책방향 설정 (Concept and Policy Developments on Eco-welfare of National Parks based on Ecosystem Service)

  • 생태복지는 인간의 복지와 건강한 생태계의 상호관계성에 대한 국제적 담론에서 시작되었다. 본 연구는 국립공원이 생태복지의 최대 실현가능 지역이라는 점에서 국립공원에 적합한 '국립공원 생태복지' 개념을 정립하고 정책방향을 설정함으로써 향후 국립공원에서의 생태복지 실현을 도모하기 위한 기초자료를 제공하는데 그 목적이 있다. 이를 위해 사전워크숍과 총 2회에 걸친 델파이 조사를 수행하였다. 본 연구를 통해 '국립공원 생태복지'는 국립공원에서 생태계의 지속가능성과 생물다양성을 유지하며, '국립공원 인간복지'와 '국립공원 생태계복지'의 조화를 지향하는 복지로 정의되었다. 2차 델파이 결과 모든 항목에서 평균 4.00 이상, 내용 타당도(CVR) 0.37 이상, 변이계수(CV) 0.5 미만으로 타당한 내용으로 확인되었다. 국립공원 생태복지의 정책방향을 설정하기 위해 생태복지의 바탕이 되는 생태계서비스의 요소들 중 국립공원에 적합한 주요 요소를 도출한 결과 공급서비스에서 먹이 식량, 물, 유전자원 3항목, 조절서비스와 기반(서식지)서비스의 모든 항목, 문화서비스에서 미적정보, 휴양관광, 심신치유, 지식체계 교육적 가치 4항목이 최종 도출되었다. 또한 본 연구에서는 국립공원 생태복지의 개념과 향후 국립공원 생태복지 정책이 어떻게 나아가야할지 방향성을 제시하였다. 그러나 이를 실현하기 위해서는 향후 이에 대한 구체적인 단위사업에 대한 실행계획이 수반되어야 하며 이를 위한 추가적인 연구가 필요할 것이다.

국내 주류광고에 대한 탐색적 연구: 동영상 맥주광고 내용분석 (An Exploratory Content Analysis of Beer Advertisements in Korea)

  • Objectives: The purpose of this study is to analyze contents of beer advertisements in Korea. Research has suggested the influence of alcohol advertisements on viewer's drinking behavior, attitude, and expectancies. Korea's policy on alcohol advertising relies on limited government regulation and self regulation among alcohol industries. This study is expected to lay a foundation for further discussion on regulating alcohol advertising in Korea. Methods: A total of 81 beer advertisements broadcasted between 2008 and 2011 were analyzed. The contents were categorized into themes (22 themes were used), models, and presentation techniques. Results: The themes most frequently appeared in beer advertisements were quality (66.7%), relaxation (44%), camaraderie (41%), and individuality (39.5%), respectively. Analysis of models revealed that most advertisements had more than three models (64.2%), and most of them were in their 20s (68%). As much as 82% of advertisements used celebrity models. Analysis on presentation techniques showed that 91.4% displayed drinking scenes, and 27% displayed gulping down the whole bottle or the glass. Finally, about 10% of ads showed drinking in hazardous situations such as during water sports. Conclusion: The results of the study reflect the minimal regulation of alcohol advertising in Korea. The need for joint effort by legislators, researchers, alcohol industries, and advertising agencies is discussed in order to establish healthier drinking environment.

불량식품 사범의 단속방안 개선에 관한 연구 (Research the Improvement for Cracking Down on Substandard Food Violations)

  • 현 정부에서는 국민의 쾌적한 삶을 영위하는 데 방해가 되는 4대악을 척결함으로써 사회적 약자를 보호하고 국민생활의 안전을 보장하기 위한 정책을 추진하고 있다. 4대악에는 성폭력, 학교폭력, 가정폭력, 불량식품이 포함된다. 반추해 보면 4대 사회악은 한국사회의 급속한 환경변화에서 발생하는 다양한 범죄의 한 유형으로 볼 수도 있다. 그런데 4대악으로 인한 피해는 그 파장이 본인에게만 국한되지 않고 나아가 가정 및 사회전반에 주는 해악의 중대성과 지속성으로 인해 국민생활을 현저히 불안하게 하는 범죄이다. 특히 4대악 피해자에게 사회적 침묵이 부당하게 강요되어 피해자 스스로 해결하기 어려운 범죄이기도 하다. 따라서 문제의 심각성을 경시하지 말고 해결의 방안을 모색하여야 함은 당연하다고 하겠다. 뿐만 아니라 이는 사전 예방 국가의 과제이기도 하다. 본 글에서는 4대악 중에서 인간이 생존하기 위한 기본적 요소이며, 국민건강권을 보장하는 차원에서 식품범죄의 개념 및 특징과 유형을 살펴보고, 단속의 문제점 지적과 함께 법제적 개선방안 즉, 식품위생법에서도 결과범에 대한 가중처벌의 조항 신설 등과 같은 개선방안을 제시하고자 하였다.

스마트폰에서 제공되는 실시간 방송서비스 규제방안에 관한 연구 - CJ 티빙서비스를 중심으로 (Studying a Regulation for Real-time Broadcasting Services in Smartphone - the Case of CJ's Tving Service)

  • 스마트폰에서 제공되는 방송서비스에 대해 지상파 혹은 케이블 수준의 규제를 적용해야 한다는 입장과 별도의 규제가 필요하지 않다는 입장이 대립하고 있다. 본 연구는 CJ 티빙서비스를 중심으로 스마트폰에서 제공되는 방송서비스에 대해 규제 방안을 제안하는 것이 목적이다. 연구를 위해 방송 및 콘텐츠 기업, 규제기관, 정책연구소, 컨설팅기업 간부급 14명으로 구성된 전문가 인터뷰를 실시했다. 인터뷰 분석 결과 스마트폰 방송서비스는 콘텐츠 형식으로 보면 방송의 형태를 띠고 있지만 당분간 규제가 필요 없다는 것이 공통적인 의견이다. 근거로 규제의 실효성이 낮고, 대부분의 콘텐츠가 이미 다른 플랫폼에서 검증 받았으며, 서비스의 사회적 영향력이 아직 미약하기 때문이다. 따라서 당분간 스마트폰 방송서비스는 인터넷과 같이 자율규제가 적합하며, 현행법에서 전기통신사업법의 부가통신사업으로 분류하는 것이 타당하다고 결론 내렸다.

우리나라 환경문제의 인지 위해도와 정부규제의 필요성에 관한 연구 (Risk Perception and Need to Regulate towards Environmental Problems in Korea)

  • A substantial literatures on environmental risk perception have emerged since the late 1960s. Most these works focus on how people form risk perception, on what people believe, on difficulties in communicating information about health, safety, or environmental risks to non-experts. In this study, questionnaire surveys were conducted to sample from stakeholders(general public, environmental specialist, governmental official, non-government officials, journalist) during March and Aprils, 2000. Total number of responses was 1,803 including 773 persons of general public, 353 experts, 390 governmental officials, 111 journalists and 176 NGO members. Risk perception on 26 environmental issues were statistically analyzed to relate with the need to regulate each issues, interest and knowledge, experience of hazard, satisfaction in environmental situation, etc. This research aims to aid risk analysis and policy-making by providing a basis for understanding and anticipating group responses to environmental issues and improving the communication of risk information among general public, lay-people, technical experts, and decision-makers. This study concludes that those who are in charge of promoting and regulating health and safety of citizens should understand how people perceive about and respond to environmental risk. Without such understanding, well-intended environmental policies of governments would be ineffective.

한국 면세점 산업의 구조, 독과점인가? (Is the Korean Duty Free Shop Industry Monopolistic?)

  • Purpose - This study's purpose is to investigate the market structure of the Korean duty free shop industry that has received recent attention from researchers and practitioners. By raising the question of whether or not the Korean duty free shop industry is unequivocally monopolistic, a wider viewpoint is provided. The study seeks to offer insights and managerial implications for marketers and policy makers who are in charge of regulating major Korean duty free shops. Research design, data, and methodology - The authors use secondary data from various sources, including Korea Customs Service and the Moodie Report, to investigate the structure of the duty free shop industry of Korea. Based on several theories, they present various criteria and statistical evidence such as K-firm concentration ratio, HHI, consumer substitutability, excess profit, and marketing costs. Results - In terms of consumer substitutability, it is difficult to confirm whether or not the Korean duty free shop industry is monopolistic. Notwithstanding monopoly characteristics in terms of market share, neither the company Lotte nor Shilla appear to have market dominating power. It is not easy for either of them to control prices or to achieve a much lower operational profit ratio due to a dominant bargaining power. Moreover, the license is not an economic rent. In this situation, it is not easy for these companies to obtain an excessive profit. Conclusions - Considering that most global duty free shops are trying to go upscale to improve bargaining power, it does not seem likely that rigid regulations are needed in the industry. Even though the Korean duty free industry ostensibly has a monopolistic structure, government and policy-makers should look beyond the surface. They should take global and other reasonable criteria into consideration when they establish or change regulation policies. Thorough understanding and appropriate support are needed for the Korean duty free shop industry. Additionally, duty free shops should position themselves as global companies struggling against unlimited international competition, rather than Korean domestic companies. At the same time, they need to give customers appropriate information about the benefits they provide.

공공사업 경쟁입찰에서 낙찰자 결정방법분석 및 국방획득사업의 합리적인 사업자결정 방안 (Contract Awarding Process and its Reasonable Improvement for Defense Acquisition)

  • The current contract awarding process regulated by laws and ordinances is analyzed and more reasonable processes are suggested. To this end, the principle of economic analysis is described with emphasis on the cost-effectiveness analysis, and the laws and ordinances regulating the process are thoroughly examined. The current contract awarding rule is based on the weighted sum of effectiveness score and cost score. This may not conform to the framework of economic analysis where effectiveness is supposed to be measured as an output and cost measured as an input. An improvement is attempted to the defense acquisition system and it is recognized that the economic analysis and policy consideration should be performed separately. Concept of statistical testing is introduced to see if the results of the cost effectiveness analyses show the significant difference between the alternatives. It is suggested that the contract awarding process can be improved by performing significance test followed by the aggregation of the two analyses. A minor improvement is also suggested on the application of current rules.
