Electro-Cleen 선박평형수 처리장치의 실선 설치 및 선상시험 (Installation and Shipboard Tests of the Ballast Water Treatment System Electro-Cleen)

  • 선박평형수를 통한 수중생물의 이동을 막기 위해, IMO에서는 2004년 2월 선박 평형수와 침전물 관리 국제협약을 제정하였다. 이 협약을 위해, 각국은 협약 비준과 법제화를 준비하고 협약의 성능기준을 만족시킬 수 있는 처리장치 개발을 촉진시키고 있다. Electro-$Cleen^{TM}$ 처리장치는 2006년 3월 IMO 기본승인을 받았고, 2008년 10월 최종승인을 받았다. 형식승인은 한국 정부로부터 2008년 12월에 발급되었다. 본 논문은 Electro-$Cleen^{TM}$ 처리장치의 기본 원리, 구성 요소, 실선 설치 및 선상 시험 내용을 검토하였다. 선상 시험은 8300 GT M/V Yokohama와 27,000 DWT M/V Greenwing으로 수행하였다. 이들 선상 시험을 통해 Electro-$Cleen^{TM}$ 처리장치가 IMO 기준을 만족시키며 신조선 및 현존선에 설치하기가 적합함을 확인하였다.

ICSID의 투자분쟁 해결구조에 관한 고찰 (A Study on Settlement of Investment Disputes under ICSID Mechanism)

  • Settlement of investment disputes is quite different from that of commercial disputes arising from ordinary commercial transactions in view of disputing parties, applicable laws and rules, etc.. Therefore, it is very important to consider the Convention on the Settlement of Investment Disputes between States and Nationals of Other States(Washington Convention) of 1965. The creation of the International Centre for Settlement of Investment Disputes(ICSID), which was established under the Washington Convention, was the belief that an institution specially designed to facilitate the settlement of investment disputes between governments and foreign investors could help to promote increased flows of international investment. Pursuant to the Washington Convention, ICSID provides facilities for the conciliation and arbitration of disputes between member countries and investors who qualify as nationals of other member countries. Recourse to ICSID conciliation and arbitration is entirely voluntary. However, once the parties have consented to arbitration under the Washington Convention, neither can unilaterally withdraw its consent. Moreover, all Contracting States of the Washington Convention are required by the Convention to recognize and enforce ICSID arbitral awards. Provisions on ICSID arbitration are commonly found in investment contracts between governments of member countries and investors from other member countries. Advance consents by governments to submit investment disputes to ICSID arbitration can also be found in many bilateral investment treaties including the Korea-China Agreement on the Encouragement and Reciprocal Protection of Investments(1992), the Korea-Japan Agreement for the Liberalization, Promotion and Protection of Investment(2003) and the Korea-Chile FTA, the latter was signed as of February 15, 2003 and is still pending in the National Assembly for its ratification. Arbitration under the auspices of ICSID is similarly one of the main mechanism for the settlement of investment disputes under the bilateral treaties on investment. Therefore, it is a problem of vital importance that Korean parties interested in investment to foreign countries should understand and cope with the settlement mechanism of investment disputes under the Washington Convention and bilateral investment treaties.

현존선에 선박 평형수 처리장치를 설치를 위한 위험도 평가 분석 (Risk Assessment for Retrofitting a Ballast Water Treatment System on an Exising Vessel)

  • Since Ballast Water Management Convention has been adopted, Ballast Water Management Convention is not effected yet. This convention will only enter into force 12 months after its ratification by 30 states, collectively representing 35% of world merchant shipping tonnnage. Morocco, Indonesia and Ghana have ratified this convention during last 29th IMO Assembly meeting which was held in November 2015. In 2016, Belgium, Fiji, Saint Lucia and Peru have become the latest countries to ratify the convention. As of now, 51 states and 34.87% combined merchant fleets are being calculated. BWM convention will be applied to not only new ships but also, existing ships after it is effected. Thus, existing vessel will be retrofitted a Ballast Water Treatment System according to D-2 Requirement until first IOPP nenewal survey after date of entry into force of the convention. Currently, about 65 BWTSs certified by Administration will be reported to IMO, even type of BWTSs is very various. Thus, a risk of each BWTS can be existed, and this existed risk can be also effected to ship's crew safety and protection of ship's own property. Therefore, we have evaluated a risk assessment for an existing vessel retrofitting an ultra violet type Ballast Water Treatment System which is mostly developed in the world. And we described the procedure of selecting a sample vessel, consequently, bulk carrier is selected because this vessel kind is mostly charged in the world. Especially, DWT 175K size is selected. Risk Assessment is using a HAZID and HAZOP method, evaluation method is referred to IMO Document "Considerated test of the Guidelines for Formal Safety Assessment (FSA) for use in the IMO rule-marking process(MSC/Circ.1203-MEPC/Circ.392)". The Risk Assessment Section is decided to 3 Nodes, Consequently, total risks have evaluated 51 items.

  • 한미 FTA의 협상 과정에서부터 비준을 걸쳐 발효된 이후까지 끊이지 않는 논쟁의 중심에는 바로 투자자-국가 소송제도인 ISD가 있다. ISD의 본 취지인 외국인 투자자에 대한 보호기능은 국제통상환경에서 없어서는 안 될 보호장치이며 지금까지 수많은 양자투자협정(BIT)에도 적용되어온 제도임에도 ISD에 대한 부정적인 시각은 여전히 존재한다. 그중에서도 가장 큰 우려는 정부의 공공정책이 ISD 때문에 제한될 수 있다는 것이다. 실제로 한미 FTA의 당사국인 미국이 맺은 NAFTA의 경우를 보면 ISD로 인하여 캐나다와 멕시코 정부가 ISD 제소를 당해왔으며, 그로 인하여 공공정책을 추진하면서 제약을 느껴온 것은 사실이다. 그러나 일부의 ISD 사건에서는 일국 정부의 공공정책이 투자자의 이익을 우선한다는 판정부의 결정도 있었다. 그렇다면 한미 FTA가 막 발효된 이 시점에서 우리가 앞으로 일어날 수 있는 우리 정부에 대한 미국기업이나 미국인 투자자의 ISD 제소에 어떻게 대비해야 하며, 정부의 공공정책이 어떻게 해야 ISD 제소의 표적이 되지 아니할지에 대한 분석이 필요하다. 이러한 분석에 가장 효과적인 자료가 미국이 당사국으로 있는 NAFTA의 ISD 사건들이다. NAFTA의 ISD 사건 분석은 판정부가 판정을 함에 있어 어떠한 법리적 해석을 하는지를 알 수 있는 근거자료이며 나아가 우리의 상황에 적용하여 대비하는데 필수적인 도구이기도 하다.

The Provisions on the Enforcement of Foreign Arbitration Awards in Indonesia (under the New York Convention of 1958?)

  • This article tried to describe the laws concerning the enforcement of foreign arbitration awards in Indonesia. This issue is relevant in the light of frequent curiosity of foreign commentators, business communities, practicing lawyers, concerning the arbitration in Indonesia, in particular its enforcement of foreign arbitration awards. The main laws on arbitration analyzed were, firstly, the Indonesian law on arbitration, namely Law No 30 of 1999 on Arbitration and Alternative Dispute Resolution and the Presidential Regulation No 34 of 1981 concerning the Ratification of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958. The provisions of Law of 1999 analyzed were confined to its international provisions on arbitration, in particular the requirements for the enforcement of foreign arbitration awards and also the requirement that the awards do not violate Indonesian public policy. The problem with the Indonesian arbitration law (and the courts' practice) were that no provisions which provided guidance or meaning with regard to public policy. The absence or lack of guidance or definition on public policy had some times confused lawyers or the parties in dispute fearing that their arbitration awards would not be enforced due to the violation of public policy. Secondly was the different opinion of two Indonesian arbitration experts, Prof. Sudargo Gautama and Prof. Priyatna Abdurrasyid. Both scholars had rather different opinions with regard to the meaning of public policy in Indonesia. Thirdly was a recent case law, Astro Nusantara Bv et.al., vs PT Ayunda Primamitra Case (2010) decided by the Indonesian Supreme Court with regard to the enforcement of foreign arbitration awards. This article concluded that the Indonesian court, in particular the Central of Jakarta Court, so far have given its support that the execution of foreign awards was duly enforced.

3D Digital Design 기법을 이용한 BWTS 설치 설계 연구 (A Study on Retrofitting BWTS using 3D Digital Design)

  • Over the past few years, as maritime trade and traffic were highly expanding, problem of invasive species via ballast water have been raised. In 1988, Canada and Australia had firstly experience that unexpected and hazardous species were observed on their own sea, they have issued the problem to MEPC under the IMO. At the end of many years of discussion, on the diplomatic conference in 13 Feb. 2004, "International Convention for the Control and Management of Ballast Water and Sediments of the Ship" was adopted. Requirements for entering into force of this Convention is that 30 countries ratify and world merchant marine fleet is more than 35% and BWM Convention will be effected after 12months from date satisfying conditions. With Finland ratifying the BWM Convention on 8 Sep. 2016, the fleet amounted to 35.1441% and ratification country became 52 countries. Therefore, after 12month, BWM Convention will be formally effected on 8 Sep. 2017. Ballast Water Treatment System is to be fitted in new ships as well as existing ships. Thus, there are concerns of ship owners to be suitably installed a variety typed BWTS in many kinds of vessels. As approaching for resolving these problems, engineering analysis was carried out research studies and detailed design to analyze to optimal installation space for retrofitting a BWTS using 3D Scanning method, targeting representative DWT 180K Bulk carrier of dry cargo vessels charged more 40% on worldwide vessel and mainly two type BWTS as electrolysis treatment type and ultra violet treatment type. Optimal design of 3D Scanning technology was applied to analyze four step process and the overall conclusion was described in this paper.

다중회귀분석을 이용한 CO2배출량 추정모형 (Development of CO2 Emission Estimation Model by Multiple Regression Analysis)

  • The Earth's temperature has risen $0.76^{\circ}C$ (degree) during last 100 years which Implies a sudden rise, compare with the 4oC (degrees) rise through out the past 20,000 years. If the volume of GHG (Greenhouse Gas) emission continues at the current level, the average temperature of the Earth will rise by $1^{\circ}C$ (degree) by 2030 with the further implication that the temperature of Earth will rise by $2{\sim}5^{\circ}C$ (degrees) every 100 years. Therefore, as we are aware that the temperature of the glacial epoch was $8{\sim}9^{\circ}C$ (degrees) lower than the present time, we can easily predict that the above temperature rises can be potentially disastrous for human life. Every country in the world recognizes theseriousness of the current climate change and adopted a convention on climate change in June 1992 in Rio. The COP1 was held in March 1995 in Berlin and the COP3 in Dec. 1997 in Kyotowhere the target (2008-2012) was determined and the advanced nations' reduction target (5.2%, average)was also agreed at this conference. Korea participated in the GHG reduction plan which required the world's nations to ratify the Kyoto Protocol. Ratification of the Kyotoprotocol and the followup requirement to introduce an international emissions trading scheme will require severe reductions in GHGs and considerable economic consequences. USA are still refusing to fully ratify the treaty as the emission reductions could severely damage the economies of these countries. In order to estimate the exact $CO_2$ emission, this study statistically analyzed $CO_2$ emission of each country based on the following variables : level of economic power and scientific development, the industrial system, productivity and energy efficiency.

  • 국제노동기구(ILO)는 해상근로자의 근로조건 향상과 양호한 근로환경의 보장 및 근로인격의 향상을 위하여 꾸준한 노력을 기울려 왔으며 1996년까지 채택된 39개의 해사협약과 29개의 권고 채택하였다. 기존 해사협약은 새로운 해상 근로 환경의 변화에 따른 요구를 충족하지 못하며, 중복되는 것이 많고, 복잡한 개정구조로 인한 최신화의 어려움 등, 여러 문제점이 있다는 것이 제기 되어 왔다. 이에 ILO는 2001년부터 해사 노동기준의 기존내용을 최신화하고, 통합하는 작업을 시작하여 2006년 2월 23일 2006년 해사노동협약(Maritime Labour Convention2006)을 채택하였다. 따라서 여기에서는 기존 해사협약에서는 볼 수 없었던 새로운 사항에 관한 특징을 중심으로 그 의의에 관하여 살펴보고, 향후 해운산업에서의 해사노동 문제에 미치는 영향에 관하여 논하고자 한다.

독일민사소송법상 외국중재판정의 승인 및 집행 - 「독일민사소송법」 제1061조를 중심으로 - (Recognition or Enforcement of Arbitral Awards under the German Civil Procedure Act)

  • The arbitration procedure, which is a private trial, does not have a separate enforcement agency. Therefore, unless a party consents to the arbitration award and voluntarily fulfills the award, its execution is accomplished through the implementation of the national court. In particular, the decision in the foreign arbitration procedure will be refused or rejected for the arbitration award in case the proceedings of the law and procedure on which the judgment is based are caused by inconsistency with the domestic law or procedural defect. However, all foreign arbitration awards generally do not have to go through the approval process, and it will come into force with the arbitration award. In the case of Germany in the revision of the German Civil Procedure Act of 1996, the main provisions of the New York Convention concerning the ratification and enforcement of arbitration proceedings are reflected. Germany provides for the arbitration procedures in the arbitration proceedings of Book 10 of the Civil Procedure Act. Particularly, with Article 1061 in Book 10 Section 8 below, the approval and enforcement of foreign arbitrators shall be governed. Article 1061 has been referred to as "The New York Convention on the Recognition and Enforcement of Foreign Jurisdictions," Article 5 (1). The main reasons for approval and enforcement rejection are: (1) Reason for the acceptance or refusal of enforcement by request of the parties: Reason for failure of subjective arbitration ability, invalidation of arbitration agreement, collapse of attack or defense method, dispute not included in arbitration agreement, (2) Reasons for the approval and enforcement of arbitration considered by the competent authority of the arbitrator: violation of objective arbitration ability, violation of public order, but not based on the default of German statute.
