  • Due to easy access to information in our digital society, there are many cases of illegal counterfeiting and usage of personal information. Producing information with investment and effort is important indeed, but managing and protecting information is becoming a furthermore important issue. This is to promote a new detecting theory and solution for cases of intellectual property violations and plagiarizing digital contents.

  • The information of world is most likely to be created as digital data. These digital productions need some legal protection mechanisms or techniques because users can illegally use them. Thus many researchers are developing various techniques. Currently most techniques are focusing on the physical and chemical methods like disk inspection for taking legal evidence about production infringement. This paper has developed a computer forensics-based copyrights protection system capable of detecting and notifying disobedience facts when user uses illegally a production. Furthermore if the user infringes continually the production the system stores the infringement facts to take the legal evidence by mapping to law for intellectual property right. The technique can protect data from digital evidence manipulation or destruction.

  • Korea continues to invest in the IT industry and is currently regarded as one of the five major powerhouses in the field of intellectual property. However, it is evaluated that this status is only limited, and the level of intellectual property protection and dispute resolution does not reach a level commensurate with the status of one of the five major intellectual property powers. To address these problems, the Korean government has enacted the Arbitration Industry Promotion Act in 2017, which aims to strengthen national competitiveness by fostering the arbitration system as an industry and provide systematic support so that the arbitration industry can become a future growth engine. In addition, in accordance with Article 3 of the 「Arbitration Industry Promotion Act」, the Minister of Justice must establish "the Basic Plan for Arbitration Industry Promotion" every 5 years. Great efforts must be put into establishing an Online Dispute Resolution (ODR) system at the KCAB for five years from 2024 to 2028, the Second Basic Plan for the Promotion of the Arbitration Industry period. Under these circumstances, this study presents implications and improvement measures for the development of the intellectual property-related arbitration system to protect Korea's intellectual property rights and contribute to more active intellectual property creation. In particular, this study proposes a plan to build an one-stop digital platform for KCAB to implement an efficient ODR system.

Protecting Copyright Owners in Nigeria: A Panacea for Intellectual Development

  • The paper looks at protecting copyright owners in Nigeria: a panacea for intellectual development. A descriptive survey design was adopted in carrying out the study. The sample size for the study was 112. Three research objectives guided the study. The study utilized a self-developed questionnaire for data collection. A total of 112 copies of the questionnaire were distributed to librarian and lecturers, out of which 108 copies were duly filled and returned, representing 96.4%. The collected data was arranged in frequency and analyzed using percentage and mean score. The findings revealed that protection of copyright will encourage creators of intellectual works, and that if authors are well remunerated there is likelihood of adequate availability of various publications to meet information needs of Nigerians. The result showed that the right to intellectual properties is one of the ways to encourage intellectual development. The finding revealed that copyright protection provides security for intellectual product and does not negatively affect the availability of intellectual materials. Based on the research findings, it was recommended that owners of intellectual property deserve good earnings for their intellectual works in order to promote Knowledge proliferation and availability so as to meet the reading needs of the citizens at the various levels. The study also recommended that all cases relating to copyright violation in our courts should be summarily dealt with. The study advocated that the provision on the punishment should be reviewed such that it could deter people from infringing on authors rights.

  • In contemporary society, though convenience and efficiency of work using information system is growing high, adverse effect problems of malignant code, system hacking, information leak by insiders due to the development of the network are raising their head daily. Because of this, enormous work forces and expenses for the recovery and management of system is needed. The existing system can be divided into two aspects: security solution which surveils and treats virus and malignant codes, and network management solution which observes the system of computer, and practices maintenance and repair such as management, recovery, backup. This treatise applied Active Write Filter mechanism and the technology based on NFS and complemented the maintenance problems of user data of the existing system and designed the system which enables solving problems of intellectual property right such as information protection and illegal work.

  • Digital copyright protection is important in the protective side of effort to have leaned to in property right and it which are intelligent of an author and is very important for development of digital contents industry. It is the misgovernment that a reproduction is easy as for the digital contents. and the original and a copy have the same characteristic, and it is so, and is experiencing what is hard for protection of copyright and large quantity illegal copy and illegal distribution prevention. CDN needs a copyright protective plan about the digital contents that digital contents providers were written jointly. The paper used a non-repudiation multi-technique for copyright protection about the digital contents which were written jointly. The Non-repudiation multi-technique proved efficiency about this.

  • The web-based technology allows anybody who has access to the Internet to get all kinds of information from the World Wide Web. It brings about issues regarding intellectual property and copyright threats. After content is downloaded, no further protection is provided on the content that has been accessed. DRM (Digital Right Management) technologies came out to ensure the protection of copyrighted content and information. In this paper, we propose architecture of license-based digital rights management system for protection of contents and principles' rights such as contents creators, providers, distributors, and uses in contents distribution value-chain over Internet. This system makes on-line processing of all value-chain from creator to purchaser possible, compared with existing DRM products only supporting only limited distribution between distributor and purchaser.

A Study on Legal Protection, Inspection and Delivery of the Copies of Health & Medical Data (보건의료정보의 법적 보호와 열람.교부)

  • In a broad term, health and medical data means all patient information that has been generated or circulated in government health and medical policies, such as medical research and public health, and all sorts of health and medical fields as well as patients' personal data, referred as medical data (filled out as medical record forms) by medical institutions. The kinds of health and medical data in medical records are prescribed by Articles on required medical data and the terms of recordkeeping in the Enforcement Decree of the Medical Service Act. As EMR, OCS, LIS, telemedicine and u-health emerges, sharing and protecting digital health and medical data is at issue in these days. At medical institutions, health and medical data, such as medical records, is classified as "sensitive information" and thus is protected strictly. However, due to the circulative property of information, health and medical data can be public as well as being private. The legal grounds of health and medical data as such are based on the right to informational self-determination, which is one of the fundamental rights derived from the Constitution. In there, patients' rights to refuse the collection of information, to control recordkeeping (to demand access, correction or deletion) and to control using and sharing of information are rooted. In any processing of health and medical data, such as generating, recording, storing, using or disposing, privacy can be violated in many ways, including the leakage, forgery, falsification or abuse of information. That is why laws, such as the Medical Service Act and the Personal Data Protection Law, and the Guideline for Protection of Personal Data at Medical Institutions (by the Ministry of Health and Welfare) provide for technical, physical, administrative and legal safeguards on those who handle personal data (health and medical information-processing personnel and medical institutions). The Personal Data Protection Law provides for the collection, use and sharing of personal data, and the regulation thereon, the disposal of information, the means of receiving consent, and the regulation of processing of personal data. On the contrary, health and medical data can be inspected or delivered of the copies, based on the principle of restriction on fundamental rights prescribed by the Constitution. For instance, Article 21(Access to Record) of the Medical Service Act, and the Personal Data Protection Law prescribe self-disclosure, the release of information by family members or by laws, the exchange of medical data due to patient transfer, the secondary use of medical data, such as medical research, and the release of information and the release of information required by the Personal Data Protection Law.

Effective Patent Strategies for the Protection of Research Results

  • Objective: This study provides strategies of how to effectively convert an invention, created at universities or government-funded research institutes, into a strong patent with the clear understanding of its unique technological characteristics. Background: Regardless of the amount of research funds available in our country and the decent number of intellectual property rights created using the funds, there was a deficit of more than KRW 6 trillion in the technology trade balance related with intellectual property rights in the year of 2014. One of the reasons was that the vast number of patents that were being produced by universities or by government-funded research institutes were merely performance-based patents, namely, so called "patents for patents". Another reason is that developed technology from research and development could not be transformed into a strong patent right properly due to the lack of related knowledge. Method: After reviewing various references mentioned on the patent strategies, the definition of a strong patent and the strategies of producing a strong patent for an invention drawn out from research performance will be supplied. Results: To produce a strong patent right at universities or government funded research institutes, one should use strategies for strong specifications, strategies of product patents and method patents, strategies of patent portfolios, strategies of know-how, strategies of inventions defined by numerical limitation and strategies of parameter inventions for a more strategic approach. Conclusion: Strong patent rights will be produced with the use of effective patent strategies provided in this study. Application: It is estimated that the results of this study will aid the establishment of strong patents for inventions developed by research performance at universities or government-funded research institutions.

Analysis on the Constitutional Judicial Precedents concerning the Social Welfare Law (사회복지법 관련 헌법재판소 판례 분석 : $1987{\sim}2004$년 헌법판례 현황과 내용을 중심으로)

  • The purpose of this study was to investigate the various contents of legal life's conflicts and constitutional applications by analysing on the constitutional judicial precedents regarding to social welfare law. The total cases of constitutional precedents are 62 totally, and 22 precedents among 62 are analysed through content analysis. These 22 constitutional precedents consist of nine cases of concerning Social Insurance Act, six cases in National Pension Act, two cases in National Basic Livelihood Protection Act and one cases in Social Welfare and Service Act. The major contents of these precedents are regarding to operational principles of social insurance system, rule of entitlements, benefits, social welfare organizations and the constitutional right such as property right, equal right, right of happiness. And also there are precedents to review how the rule of Act is interpreted or how the process of right protection is. Findings in this study show that Korean Constitutional Law has characteristics of welfare nationalism and social capital economics orientations, and sanctions legislation and administration discretion.
