Taking of Evidence in International Arbitration Procedure - focusing on 2010 IBA Rules on the Taking of Evidence in International Arbitration (국제중재 절차내에서 증거조사 : 국제변호사협회(IBA)의 2010 증거규칙을 중심으로)

  • International commercial arbitration has established itself as the primary dispute resolution mechanism for international business transactions. Certainly, there are commonly-accepted standards that have evolved to reflect an internationally-harmonized approach to issues relating to the taking of evidence. This is reflected in International Bar Association("IBA") Rules for Taking of Evidence in International Evidence("IBA Rules"). This IBA Rules were revised in 2010. Designed to assist parties in determining what procedures to use in their particular case, IBA Rules present some of the methods for conducting international arbitration proceedings. Parties and arbitral tribunals may adopt IBA Rules in whole or in part - at the time of drafting the arbitration clause in a contract or once an arbitration commences - or they may use them as guidelines. They supplement applicable national laws and institutional or ad hoc rules. The IBA Rules were an ambitious undertaking, designed to overcome fundamental cultural differences relating to the taking of evidence under different national court systems. While it is difficult to assess how frequently the IBA Rules are actually adopted by parties, it is fair to say that they have had a considerable influence on the practice of taking evidence in international arbitration. This article mainly describes the essential provisions of IBA Rules, as revised in 2010, including but not limited to production of document, witnesses of fact, party-appointed experts, and tribunal-appointed experts. It also provides a comparison of relevant procedural rules of civil law and common law systems to each of the above mentioned provisions. It is important for arbitration practitioners to understand the differences in the taking of evidence under civil law and common law systems, respectively. This article will be helpful for practitioners and academics not only to understand the revised IBA Rules themselves but also to prepare for, and adequately deal with, the frictions that may arise as a result of the differences in approach for taking evidences. Indeed, so prepared, the arbitration practitioner will be able to anticipate the expectations, perceptions and the conduct of the parties, their counsel and the tribunal members.

Mechanical Properties of Friction Welded SM 45C-SF 45 Joints for Automobile Reverse Idle Gear Shaft Applications (자동차 후진기어용 축재(SM 45C-SF 45)의 이종마찰용접 특성)

  • Friction welding is a common practice to join axially symmetrical parts for automobile industry applications. The shaft for automobile reverse idle gear is generally produced by forging steel, SF 45. This method is not so good because of high cost of material and production. In this study, in order to investigate the possibility of application of SM 45C to SF 45 dissimilar friction welding, the dissimilar friction welded joints were performed using 20 mm diameter solid bar in forging steel(SF 45) to carbon steel(SM 45C). The optimal friction welding parameters were selected to ensure reliable quality welds on the basis of visual examination, tensile test, micro-Virkers hardness surveys of the bond of area and optical microstructure investigations for welded joint parts. Finally, post weld heat treatment(PWHT) of the high-frequency induction hardening was performed for the friction welded specimens under the optimal welding conditions. And then, the mechanical properties were compared for as-welded and PWHT in SM 45C to SF 45.

Vitis amurensis Ruprecht root inhibited ${\alpha}$-melanocyte stimulating hormone-induced melanogenesis in B16F10 cells

  • BACKGROUND/OBJECTIVES: The root of Vitis amurensis Ruprecht, a sort of wild-growing grape, has been used in oriental medicine for treatment of skin ailments; however, its dermatological activity is not sufficiently understood. The aim of this study was to investigate tyrosinase inhibitory and anti-melanogenic activities of V. amurensis Ruprecht root methanol extract (VARM) in B16F10 mouse melanoma cells and to attempt to isolate and identify the active compound issued from VARM. MATERIALS/METHODS: Anti-melanogenic activity of VARM was analyzed in ${\alpha}$-melanocyte stimulating hormone (MSH)-stimulated B16F10 cells through evaluation of antioxidative activity as well as inhibited tyrosinase activity and melanin contents compared with those of kojic acid and arbutin. After anti-melanogenic analysis of VARM, serial fractionation, nuclear magnetic resonance (NMR), and thin layer chromatorgraphy (TLC) were applied for identification of active compounds contained in VARM. RESULTS: VARM significantly inhibited oxidative stress and tyrosinase activity and attenuated ${\alpha}$-MSH-induced melanin production in B16F10 cells. For isolation of active compounds, VARM was fractionated using a series of organic solvents, including dichloromethane ($CH_2Cl_2$), ethyl acetate (EtOAc), and n-butanol (n-BuOH). Among fractions showing anti-melanogenic activity, the CH2Cl2 fraction induced the most potent attenuation of melanogenesis without cytotoxicity and the major compound in the $CH_2Cl_2$ fraction was identified as betulinic acid. Betulinic acid isolated from the $CH_2Cl_2$ fraction of VARM significantly attenuated ${\alpha}$-MSH-induced melanogenesis in a dose dependent manner, which was stronger than that of arbutin used as a positive control. CONCLUSIONS: These results indicate that VARM inhibits oxidative stress, tyrosinase activity, and ${\alpha}$-MSH-induced melanogenesis in B16F10 cells, due primarily to the active compound, betulinic acid, in the $CH_2Cl_2$ fraction.

A Hybrid Tendency of Contemporary Landscape Design (현대조경설계의 하이브리드적 경향)

  • This study originated from following questions. What can we understand the conception of deconstruction, which has been the core idea of new discourses developed in various ways since modernism? How can this question be interpreted in landscape design? What is the conceptional frame of integration the prominent hybrid post-genre movements and phenomena? The frame can be epitomized with the deconstruction phenomenon. 'Deconstruction' is the core conception appeared in late or post-modern ages in the embodiment of modernity and can be viewed as an integrating or a hybrid phenomenon between areas or genres in formative arts. Therefore, the author regards the hybrid movements widely witnessed in the post contemporary formative arts as one of the most important indicators of de-constructive signs. It is safe to say that the phenomenon of this integration or hybridism, of course, does not threaten the identity of landscape design but serves as an opportunity to extend the areas of landscape design. One of the consequences of this integration or hybridism is the voluntary participation of users who have been alienated in the production of the meanings of design works and hybrid landscape design with the hybridization of genres that is characterized with transformation in forms. This view is based on the distinction between hybridization of interactions between the designer (the subject) and the user (the object), and hybridization of synesthesia. Generally speaking, this is an act of destroying boundaries of the daily life and arts. At the same time, it corresponds to vanishing of modern aesthetics and emerging of post-contemporary aesthetics which is a new aesthetic category like sublimeness. This types of landscape design tries to restore humans' sensibility and perceptions restrained by rationality and recognition in previous approach and to express non-materialistic characteristics with precaution against excessive materialism in the modern era. In light of these backgrounds, the study aims to suggest the hybrid concept and to explorer a new landscape design approach with this concept, in order to change the design structure from 'completed' or 'closed' toward 'opened' and to understand the characteristics of interactions between users and designs. This new approach is expected to create an open-space integrating complexity and dynamics of users. At the same time, it emphasizes senses of user' body with synesthesia and non-determination. The focus is placed on user participation and sublimity rather than on aesthetic beauty, which kind of experience is called simulacre. By attaching importance to user participation, the work got free from the material characteristics, and acceptance from the old practice of simple perception and contemplation. The boundaries between the subject and object and the beautiful and ordinary, from the perspective of this approach, are vanished. Now everything ordinary can become an artistic work. Western dichotomy and discrimination is not effective any more. And there is 'de-construction' where there is perfect equality between ordinary daily life and beautiful arts. Thus today's landscape design pays attention to the user and uses newly perceived sensitivity by pursing obscure and unfamiliar things rather than aesthetic beauty. Space is accordingly defined to take place accidentally as happening and event, not as volume of shape. It's the true way to express spatiality of landscape design. That's an attempt to reject conventional concepts about forms and space, which served as the basis for landscape design, and to search for new things.

Evaluation of Drying Properties and Yields of Domestic Quercus Species for Enhancing Utilization (국산 참나무류의 이용활성화를 위한 건조특성 및 가공수율 평가)

  • In order to develop value-added utilization technology of domestic oaks the processing yield rate from the standing tree to the flooring material for the Quercus variabilis and Quercus mongolica were investigated. Also, to reduce drying time, improved drying schedule was applied and the physical properties were measured. The drying time was 173 hours in total, and the final moisture content was 5.39% (Quercus variabilis) and 4.17% (Quercus mongolica). The color difference of oak lumber before and after drying showed a significant change as ${\Delta}E$ value from 7 to 11. The shrinkage rates of Quercus variabilis and Quercus mongolica during drying were 8.1% and 8.5% in the tangential direction and 5.0% and 6.2% in the radial direction, respectively. The lumber manufacturing yield rate of sawn lumber was 30 to 40% and that of the final product was 8 to 15%. It is expected that the processing characteristics of the Quercus species investigated in this research could contribute to formulate an efficient production plan of domestic hardwoods that are still under utilization.

A Study on New Appreciation of Cultural Industry and the Role of Design Policies (문화산업에 대한 재인식과 디자인 정책의 역할 연구)

  • Design, to all of us living in the 21st century, is not just an action that revs up the production and consumption as an added value of an industry, but it is recognized as a broader social and cultural action in practice. The purpose of this study is to broaden the role of design as a principal body producing culture, and to proclaim that design itself has to have self-sufficiency as culture. The study starts from a hypothesis that the action of design should be at the core of cultural industry. The study includes studying the documents on and analyzing the current status and case studies of cultural industry and design policies for macro view. Comparative research and analysis of how designers from three countries, Korea, United States and England, perceive policies is a microscopic part of this study. The methods for this study include survey for quantitative research in Korea, United States and England, and intensive interviews for qualitative research to explain past facts and the current situation of design policies. The survey compares design professionals of three countries, and the intensive interviews are done with manager level design professionals who are both decision makers and policy makers. On order to prove the appropriateness of the survey structure, three pilot studies and a pre-test were carried out. As shown in the verification of the subject of study, if, in the cultural industry which was considered to be the blossom of 20th century, the blind running without intervention of reason still keeps its former state and is unable to go beyond history, we will not be able to enter the age of mentality and fall behind. The value of design that we shall judge depends on the dialectic of 'past' and 'present' regarding the principle of enlightenment, and it will open up a new philosophy, a new civilization and a new world.

Analysis and description of the Visual Image Structure of Lemon Juice Squeezer, designed for Italy ALESSI company by Philippe Starck (필립 스탁의 디자인작 '레몬즙 짜개(Lemon Juice Squeezer)'에 대한 시각형상 구조 분석과 기술)

  • The modeling analysis for objects placed in a given space can be described objectively when their visual image structure is grasped. It can't be answered without first analyzing the basic program, visual expression. And when the whole aspect of the visual image of the desired interior utensils is presented, the mindset of its designer can be deduced from that. Therefore, the study was based on the lemon juice squeezer, one of the interior kitchen utensils that Philippe Starck designed for Italy ALESSI company. For the study method, putting'The Elements of Dynamic Symmetry' by Prof. Jay Hambidge into practice, 'paradigm' analysis containing the whole'lemon juice squeezer'image was attempted. And to describe it, the visual mark description method by Prof. Bok-Young Kim was used. In conclusion, henceforth, the relationship between interior space and articles, the relationship between object and user, the modeling critique or analysis of the production itself shoud not be intended to be emotional. On the contrary, the study presented an art analyic methodology that can analyze and describe the visual image structure numerically, and confirm the relationship between form and content.

Effect of Water Stress at Different Growth Stages on the Growth and Yield of the Transplanted Rice Plants (벼의 생육기별 수분결핍장애가 생육 및 수량에 미치는 영향)

  • Knowledge of the degree of yield reduction due to water stress at different crop growth stages in rice production is important for rational scheduling of irrigation during periods of insufficient water supply. Previous studies to determine the degree of yield reduction duo to water stress suffered from interruptions by rain during experiment. Also the findings did rot relate the degree of water stress to the soil water potential and water deficit status of rice plants. In this study, two years experiments were conducted using the high yielding rice varieties, an Indica x Japonica (Nampoong) and a Japonica variety(Choochung). These were grown in 1/200$^{\circ}$ plastic pots placed under a rainfall autosensing, sliding clear plastic roof facility to control rainfall interruptions. The results obtained were as follows. 1.The two varieties differed in the growth stage most sensitive to water stress as well as the degree of yield reductions. When rice plants were stressed to the leaf rolling score 4 and soil water potential of about - 20 bar at major crop growth stages which included heading, booting, non-effective tillering, panicle initiation and early tillering stages, the yield reductions in the Indica x Japonica variety were 58%, 34%, 27%, 22%, and 21%, respectively, whereas in the Japonica vairety they were 23%, 36%, 1%, 13% and 22%, respectively. This result show that the recommended drainage during non-effective tillering is valid only for the Japonica variety. Sufficient irrigation at booting, heading and early tillering stages are necessary for both varieties. 2.The two varieties showed visible wilting symptoms when the soil water potential dropped to about - 3.0 bar. The Japonica variety showed more leaf rolling than the Indica X Japonica. However, it had a higher retention of leaf water content and greater stomatal diffusive resistance. When the soil water potential dropped, the Japonica variety showed leaf rolling score (LRS) 1 at 0 soil-5. 0 bar and LRS 2 at 0 soil -6.0 bar while the Indica X Japonica showed LRS 1 at 0 soil - 5.5 bar and LRS 2at 0 Soil - 9.0 bar. The stomatal diffusive resistance was maximum at the second top leaf blade in both varieties at intermediate water stress of 0 soil - 4.5 bar. 3.The number of days that was required for the soil water potential to drop to-3. 0 bar and to - 20.0 bar after drainage of irrigation water from the 20cm deep silty clay loam soil in the pots were 6 and 13 days, respectively for booting stage, and 7 and 11 days, respectively for heading stage, 9 and 12 days, respectively for panicle initiation stage, and 12 and 19 days, respectively for early tillering stage. 4.Water stress during the early tillering stage recorded the longest delay in beading time, the largest reduction in panicle numbers and a substantial yield decrease of 20%. This calls for better water management to ensure the availability of water at this stage, particularly during drought periods. In addition, a reexamination of the conventional inter-drainage practice during the non-effective tillering stage is necessary for the high yielding Indica X Japonica varieties.

The Limiting Sequence and Proper Ratio of Lysine, Methionine and Threonine for Calves Fed Milk Replacers Containing Soy Protein

  • The limiting sequence and relative ratio of lysine (Lys), methionine (Met), and threonine (Thr) for calves about 2 mo of age fed milk replacers (MR) containing soy protein are not clearly defined. The objective of the study was to investigate the effect of supplementing MR containing 22% CP, half from soy protein concentrate (SPC, 40.56% CP, flour) and half from whey proteins, with Lys, Met, and Thr to estimate amino acid (AA) sequence and their relative ratio for calves about 2 mo of age. A method of partial deduction of AA was adopted. Twenty-four newborn calves (half males and half females, $40.7{\pm}0.9$ kg of BW) were fed 1 of 4 MR diets for 56 d (n = 6/diet). The diets were supplemented with all (positive control) or with 2 of the 3 AAs: Lys, Met and Thr, (i.e., PC (22% CP, 2.34% Lys, 0.72% Met and 1.80% Thr), PC-Lys (22% CP, 1.64% Lys, 0.72% Met and 1.80% Thr), PC-Met (22% CP, 2.34% Lys, 0.50% Met and 1.80% Thr), and PC-Thr (22% CP, 2.34% Lys, 0.72% Met and 1.26% Thr)). Calves were fed thrice daily; starter (20% CP, 1.03% Lys, 0.30% Met and 0.69% Thr), hay (3.23% CP, 0.29% Lys, 0.12% Met and 0.23% Thr) and water were offered free choice. Starter and hay were only offered beginning on d 36 (after 5 wk) and d 43 (after 6 wk), respectively. BW, body size and blood samples measures were taken every two weeks. Three-day total collection of feed refusals, feces, and urine were recorded starting at d 33 and d 54 of age, respectively. From the results, the limiting sequence and relative ratio between the 3 AAs in calves with different diet structures were calculated. The limiting sequence of the 3 AAs were ranked as Lys, Met and Thr; the proper ratio was 100:29:70 for MR-only diet and 100:30:60 for diets consisted of MR, starter and hay. Nitrogen digestion and utilization and nutrient digestibility were negatively affected by AA deletion treatments. From the evidence of this experiment, it did not appear that the AA limiting sequence was selectively altered by differences in diet structures such as would be encountered in practice. The relative ratio between the 3 AAs varied with the offer of starter and hay to calves, and the average ratio was 100:29.5:65 for calves during 2 to 10 wk of age.

Combination of an Enzymatically Hydrolyzed Yeast and Yeast Culture with a Direct-fed Microbial in the Feeds of Broiler Chickens

  • A balance trial experiment was carried out to evaluate the potential relationship between an enzymatically hydrolyzed yeast (EHY) and yeast culture combined with a live Bacillus subtilis (Bs) on the productive parameters, ileal digestibility, retention of nutrient and energy and villus morphology in broilers. Seventy two 28 d old, Ross B308 male broilers were assigned to a factorial combination of 2 levels of EHY (0 and 1 kg/ton of feed) and 2 levels of Bs (0 and 125 g/ton of feed). The experiment lasted 2 weeks. Several treatment interactions were observed. EHY-fed broilers showed the lowest feed intake and feed conversion ratio whereas Bs-fed broilers showed the highest feed intake and intermediate feed conversion ratio (EHY and BS interaction, p<0.05). Also, EHY-fed broilers had greater ileal digestibility of dry matter (EHY and BS interaction, p<0.01) and energy (EHY and BS interaction, p<0.05) but these responses were counterbalanced by the combination of EHY and Bs. The thickness of the mucosa was similar between the control and EHY-fed broilers, but was lowest when Bs was added alone (EHY and BS interaction, p<0.01). The thickness of the villus was greater in EHY plus Bs-fed broilers, intermediate for the control and lower for Bs or EHY-fed broilers (EHY and BS interaction, p<0.05). The area of the villus was greater in the control and EHY plus Bs-fed broilers (EHY and BS interaction, p<0.05). In addition, EHY-fed broilers showed greater breast yield and nitrogen retention (p<0.01) and ashes digestibility (p<0.05). On the other hand, Bs-fed broilers had greater carcass and breast weight, nitrogen retention, energy excretion and villus height (p<0.05). In summary, EHY and Bs enhanced some growth, carcass and nutrient retention responses, but did not show any synergic relationship in these responses. Opposite to this, the results suggest that the positive effect of EHY on the feed conversion and digestibility of nutrients were counterbalanced by the addition of Bs.
