Technology-oriented national R&D programs produce intellectual property as their final result. Patents, as typical industrial intellectual property, are therefore considered an important factor when evaluating the outcome of R&D programs. Among the main components of patent evaluation, in particular, the patent right quality is a key component constituting patent value, together with marketability and usability. Current approaches for patent right quality evaluation rely mostly on intrinsic knowledge of patent attorneys, and the recent rapid increase of national R&D patents is making expert-based evaluation costly and time-consuming. Therefore, this study defines a hierarchy of patent right quality and then proposes how to quantify the evaluation process of patent right quality by combining text mining and regression analysis. This study will contribute to understanding of the systemic view of the patent right quality evaluation, as well as be an efficient aid for evaluating patents in R&D program assessment processes.

본 연구는 특허의 질적 특성을 관측 가능한 특허의 인용지표로 설명함으로써 특허가치 추정모형에 기여하는 것을 목표로 한다. 본 연구는 기업, 대학, 연구소가 한국특허청에 출원한 특허를 대상으로 전후방 인용자료를 구축하였다. 특허의 원천측면을 반영하는 후방인용 지표들이 후속특허에 의한 활용측면을 반영하는 전방인용 특성들을 잘 설명하는 것으로 나타났다. 전방인방 지표와 후방인용 지표 간에 존재하는 함수관계는 특허가치에 대한 추정, 예측모형을 더 정교화하는데 기여할 것이다. 후방인용 지표들은 특허 자체가 갖는 기술범위를 잘 설명하는 것으로 나타났다. 기술협력의 일방에게 기술협력의 상대방이 누구인지도 중요하였다.

기업들의 경쟁 환경이 세계시장으로 급속히 확대되고 있다. 이에 글로벌 자동차 기업을 대상으로 한 실증분석을 통해, 기업들의 국제적인 기술수준을 비교할 수 있는 특허포트폴리오 분석 방법을 제시하고자 하였다. 1991년부터 2010년까지 20년간의 삼극특허를 이용하여 국제적 수준의 특허활동을 측정하였으며, 권리적, 기술적, 경제적 측면에서 특허품질을 측정하였다. 그 결과, 미국의 자동차기업인 Ford와 GM은 특허품질이 우수하고, 특허품질의 변화도 크게 증가한 잠재적 리더로 분석되었다. 본 연구는 삼극특허를 기준으로 국적이 다른 글로벌 기업들 간의 국제적인 특허활동을 측정하고, 권리적, 기술적, 경제적 측면에서의 종합적인 특허품질을 삼극특허에 기반하여 일관성 있게 분석하는 방법을 제시한 점에서 연구의 의의가 있다.

본 연구에서는 인용 정보를 활용하여, 특허 인용색인의 기법을 분석하고, 이를 바탕으로 새로운 특허지수를 제시하였다. 이를 위해 문헌정보 및 특허정보 관련 인용색인데이터베이스에서 제공하는 인용색인지수를 비교 분석하였다. 특히 JCR의 영향력 지수와 CHI의 기술영향력 지수가 갖고 있는 정보적 가치와 의미를 재해석하였다. 전자는 상대적 인용빈도를 사용하여, 연속간행물과 같은 매체의 가치를 중시하고 있다. 후자의 경우는 특허고유의 가치를 평가하기 때문에, 자체정보만을 중시하고 있다. 이러한 차이점을 극복하기 위해 후자의 경우 해당 특허를 보유하고 있는 기관의 기술영향력 지수를 이용하여 상대적 가치를 재부여하였다. 이를 보완하기 위해 인용정보에 기반하여 다음 특정 특허의 피인용지수를 비롯하여 상대적 반감기 평가지수, 특허기술활용 통합지수 등 세가지의 새로운 지수를 제안하였다. 단 비교분석대상은 출원특허사항에 인용정보를 제시하고 있는 미국 특허정보로 제한하여 국내 특허정보에 대한 비교 분석은 수행하지 못하였다.

Although patents have mainly been considered as the results of the invention process, of late their value as strategic assets have increasingly been emphasized. Consequently, the competition for patents among firms has intensified, and the number of patent disputes have been steadily increasing. Patent disputes, which cause enormous expense and resource utilization, increase uncertainty and have been considered as a threat or problem for the firms involved. Patent disputes are expected to have a significant impact on the decision making about subsequent innovation activities. This study attempts to analyze the effect of patent disputes on the subsequent innovative activities of the firms that are sued. After experiencing litigation as defendants, we examine their subsequent patenting strategies. According to the results of the study, firms who are experiencing patent litigation are more likely to achieve high-quality patents and cite recent technology when they apply for patents. Meanwhile, patent litigation experience has been shown to negatively affect the amount of subsequent patents applied. This study increases understanding by examining whether patent disputes, which have been mainly recognized negatively as obstacles, can be an opportunity that comes during a crisis.

본 연구는 연구개발스톡과 6개의 지식스톡(특허의 질적 가치)이 기업의 시장가치에 미치는 영향을 포함하는 연구모형을 설정하여 기업의 시장가치와의 상관관계를 분석하였다. 구체적으로 토빈Q 모형을 사용하여 우리나라 402개 기업의 미국특허등록 108,851건(연도관측치 2,795건)의 특허를 분석하였다. Hall모형의 확장 모형 분석결과, 연구개발스톡/자산, 청구항스톡/특허스톡, 인용스톡/특허스톡 등이 기업의 시장가치에 긍정적인 영향을 미치는 것으로 나타났으며, 유의수준이 높진 않지만 피인용스톡/특허스톡, 발명자스톡/특허스톡 등도 기업의 시장가치에 긍정적인 영향을 미칠 수 있는 것으로 분석되었다. 이러한 결과에 따라 특허경영시대에 특허의 질적 수준 고도화와 특허의 가치 제고를 위한 정책 방안이 마련되어야 할 것으로 보인다.

특허 소송은 혁신 혹은 지적 재산권의 보호 수단으로서 알려져 있다. 그러나 특허 시장이 증대됨에 따라 경쟁사의 진입을 방해하기 위한 전략적 수단으로 특허 소송의 활용 범위가 증대되었다. 특허 소송에 연루될 가능성은 기업이 가지고 있는 특허의 양질이 증대할수록 높아진다고 밝혀져 왔다. 그러므로 혁신을 추구하는 기업의 입장에서는 특허 소송에 연루될 가능성을 최대한 낮출 수 있는 방안이 필요하다. 이에 본 연구는 인쇄 전자 산업 내 기업의 과거 제휴 활동이 특허품질과 특허 소송의 관계에 미칠 수 있는 영향력에 대해 분석하였다. 특허 품질과 특허 소송의 관계에 대한 기존 연구결과를 재 입증함과 더불어 피고인 관점의 특허 소송에 대한 연구를 진행하여 기업의 제휴 활동이 특허 소송을 낮춘다는 결과를 도출하였다. 예컨대, 평균치의 특허를 지닌 기업에 대해 과거 제휴 활동의 유무가 연간 특허 소송률을 약 33% 낮추는 것을 실증적으로 입증하였다. 본 연구가 특허 소송과 전략적 제휴에 관한 기존 문헌에 기여하는 바는 다음과 같다. 기업의 과거 전략적 제휴가 평판으로서의 역할을 하여 특허 소송을 감소시킴을 확인함으로써 기존 전략적 제휴 관련 문헌에 기여한다. 또한, 특허 품질이 특허 소송에 미치는 영향력에 대한 새로운 조절 변수를 밝혀냄으로써 기존 특허 소송 관련 문헌에 기여한다. 더불어, 본 연구는 특허 소송을 피고인 관점에서 분석한 최초의 연구라는 점에서 매우 의미가 있다.

본 논문에서는 특허자료의 분석을 통해 무인 항공기 관련기술의 기술력을 살펴보고자 한다. 이를 위해 국가별 출원인수, 기술별 출원인수, 연도별 출원인수, 피인용 건수를 활용한다. 기술력을 분석하기 위해 현시기술비교우위지수를 변형한 현시특허우위지수(RPA)와 특허분석에서 사용하는 특허영향력지수(PII)를 활용하기로 한다. 현시특허우위지수는 특허의 양적인 비교지수로써 0을 기준으로 "+"일때는 경쟁력이 비교 우위에 있으며, "-"일때는 경쟁력이 비교 열위에 있다. 특허영향력지수는 다른 특허가 해당 특허를 얼마나 인용하였는가를 나타내는 비율로 1 이상 일때는 질적 수준이 높고 1이하 일때는 질적 수준이 낮다. 이러한 두 가지 지표를 활용하여 국가별, 기술별 경쟁력을 비교하였다.

R&D(Research and Development) efficiency analysis is a very important issue in academia and industry. Although many studies have been conducted to analyze R&D(Research and Development) efficiency since the past, studies that analyzed R&D(Research and Development) efficiency considering both patentability and patent quality efficiency according to the financial performance of a company do not seem to have been actively conducted. In this study, measuring the patent application and patent quality efficiency according to financial performance, patent quality efficiency according to patent application were applied to corporate groups related to artificial intelligence hardware technology defined as GPU(Graphics Processing Unit), FPGA(Field Programmable Gate Array), ASIC(Application Specific Integrated Circuit) and Neuromorphic. We analyze the efficiency empirically and use Data Envelopment Analysis as a measure of efficiency. This study examines which companies group has high R&D(Research and Development) efficiency about artificial intelligence hardware technology.

This paper explores the determinants of the economic value of patents using a survival time analysis. The analysis is based on renewal information of about 250,000 patents filed from 1984 to 2005 in the Korea Intellectual Property Office. A patent right is valid only when its owner pays yearly maintenance fees. Failure to pay causes patent rights to be lapsed. We use the fact that more valued patents live longer and the lengths of their renewals can be closely related to their value. The value can be affected not only by its own technological aspects such as quality and breadth, but also by characteristics of its owners such as innovativeness and age. This paper presents patent-specific and firm-specific characteristics which influence patent value. The result of analysis implies that patent value depends on both the technological contents of the patent and general capabilities of a firm.
