Arbitrator's Duty to Disclose in the Context of U.S. Law: Focusing on Case Law's Evident Partiality (미국법 상의 중재인의 고지 의무: 판례법상 명백한 편파성을 중심으로)

  • The FAA provides that a district court may make an order vacating an arbitration award upon the application of any party to the arbitration where there was evident partiality on the arbitrator's behalf. The U.S. Supreme Court in the case of Commonwealth Coatings Corp. held that arbitrators must disclose to the parties "any dealing that might create an impression of possible bias." Justice White attempted to limit the scope of evident partiality to instances where an arbitrator has a "substantial interest" in the dispute before disclosure is required. The Second Circuit held that if an arbitrator thinks that a nontrivial conflict of interest might exist, the arbitrator must either (i) conduct an investigation into the potential conflict, or (ii) disclose to the parties why he or she thinks there could be a conflict. Further, the arbitrator must disclose his or her intent not to investigate the matter. By utilizing a reasonable impression of partiality standard, the Ninth Circuit held that evident partiality can exist despite an arbitrator's actual acknowledgement of a conflict, and if an arbitrator fails to discharge his or her duty to investigate potential conflicts of interest, his or her constructive knowledge of the conflicts can give rise to evident partiality.

  • Focused on developing form of Western architecture, invisible elements covering actual human life has been dealt with separately and the time was turned away and disparaged. But now the phenomenology, arranging such a meeting of space and time, gives opportunity to look at the actual life in architecture. Recently, Guille Deleuze and Merleau-Ponty tried to recover the sense of touch segregated in skin from body keeping eyes for distance. And the activity can be happened by being connected to the body rather than to eye in the space. From the phase of recognition where the human body tries to identify the object in the space considering a time, it will be changed for the subject to the phase of space-time structure. If the tactility is to erase the distance different from the visuality in dichotomy, it will be occurred to having a tension and makes new relationship to work trying to move the subjective point of view in object. Like this evidence in analysis of architecture, it can be found these in the Korean traditional architecture rather than Western architecture in terms of emphasizing the time and space. And this study will be intensive to the side of the Phenomenology how it is being connected to the movement in the space and time for the subject and object.

Burnout Process Model of Social Workers: Analysis of the Paths from the Job-related Stressors, Job-stress and Professional Self-efficacy to Burnout (사회복지사의 소진과정(Burnout Process) 모델 - 직업관련 스트레스 요인, 직무스트레스와 전문직효능성에 의한 소진 경로분석 -)

  • This study aims to find out the determinants of burnout in order to better understand the burnout process among social workers. For this purpose, a hypothetical model which explains the relationships among 8 job-related stressors (role ambiguity, role overload, difficulties in solving problems of clients, conflict with the clients, lack of support from the supervisor, closed communication pattern, bureaucracy, and lack of accountability), 4 mediators (job-stress, professional role performance, abiding by the agency policy and partiality in service delivery), and 4 dimensions of burnout (physical exhaustion, psychological exhaustion, depersonalization and personal accomplishment) was developed. Using the data collected from 207 social workers, the hypothetical model was tested. For data analysis, a path analysis was used, and the best-fitting model was found(df=66, $x^2$=63.250, GFI=0.962, CFI=1.00). As a result of this study, the following results were found. Burnout among social workers was increased by the 6 job-related stressors(role ambiguity, role overload, difficulties in solving problems of clients, conflict with the clients, lack of support from the supervisor, closed communication pattern). Job-stress, the mediating variable of the emotional path to burnout, increased professional role performance and the abiding by agency policy, and finally increased burnout. On the other hand, professional self-efficacy (which consists of professional role performance, abiding by agency policy and partiality in service delivery), the mediationg variable of the cognitive path to burnout, reduced burnout when the professional role performance was high, and abiding by agency policy and partiality in service delivery were low.

  • This study discribes result of comparision of two other numerical method, method of characteristics (MOC) and Lax-Wendroff method(LWM) applied at wave action analysis of Intake and exhaust pipe. Partiality FCT(Flux Correct Transport) scheme is appeneded to LWM to protest unacceptable overshoots, occuring near discontinuity. The final conclusion of this study is that MOC should be replaced by a second order finite difference approach(such as the LW method). Clear benefits we can get by change are faster calculation, higher accuracy, conservation of mass and consistent calculation method.

The Relations between Children's Sibling Relationships and Self-Esteem. (아동의 형제관계와 자존감과의 관계 연구)

  • The purpose of this study was to examine how children's sibling relationships were related to their self-esteem. 440 children and their only siblings were asked to respond to two questionnaires concerning the two research variables. The questionnaires used were the SRQ (Furman & Buhrmester, 1985) and the SPPC (Harter, 1985). Ther data were analyzed through correlation analyses, stepwise multiple regression analyses, and canonical correlation analyses. The results were as follows : Warmth·Intimacy and Rivalry (parental partiality toward the child himself/herself) had positive correlations with the child's self-esteem, while sibling Conflict had negative correlations and Relative Status·Power had little correlation. The best predictor of children's self-esteem was sibling Warmth·Intimacy. The next powerful determinants were Conflict and Rivalry. Among the six self-esteem measures, the one predicted best by sibling relationships was Global Self-Worth. The next ones were Behavior·Conduct and Scholastic Competence. The findings revealed that the predictive power of the sibling relationships factors varied considerably according to such status variables as sex and birth order of children and to whether each of the two research variables was analyzed as a whole or at a factor level.

Experimental Validation of Two Simulation Models for Two-Phase Loop Thermosyphons

  • Five two-phase closed loop thermosyphons (TLTs) specially designed and constructed for the present study are one small scale loop, two medium scale loops (MSLI and MSLII) and two large scale loops (LSLI and LSLII). Two simulation models based on thermal resistance network, lumped and sectorial, are presented. In the Lumped model, the evaporator section is dealt as one lumped boiling section. Whereas, in the Sectorial model, all possible phenomena which would occur in the evaporator section due to the two-phase boiling process are considered in detail. Flow regimes, the flow transitions between flow regimes and other two-phase parameters involved in two-phase flows are carefully analyzed. In the present study, the results of two different simulation models are compared with experimental results. The comparisons showed that the simulation results by the Lumped model and by the Sectorial model did not show any partiality for the model used for the simulation. The simulation results according to the correlations show the various results in the large different range.

  • In this paper, electric fields in electromagnetic reverberation chambers, which are used as a substitute facility for EM-free anechoic chambers, are analyzed. This paper focused on the 4-5 GHz band, which is expected to adversely affect equipment. To analyze the field uniformity inside the electromagnetic reverberation chamber, electric field strengths are sampled and finite-difference time-domain method was used for numerical analysis. Moreover, Quadratic residue diffuser was used to improve the characteristics of the electromagnetic reverberation chamber and the uniformity of the internal field strength. Standard deviation, tolerance characteristics, and partiality characteristics were compared while varying the aiming point of transmission antenna.

  • In order to understand Changeologically on the meaning of FCST's TMJ (temporo-mandibular joint) treatment procedure, Yi, Shike, Bi, Gen trigrams concerning the jaw and change by treatment were analyzed from the viewpoint of semiotic context of hexagon and holistic interpretation on disease. Yi is meant by jaw but actually indicates mouth made by maxilla and mandible, and it's characters are related with nourishing by aliment and words. But when we eat and speak in the daily life, jaw does not nourish properly it's own body by bad habit or postures. For the treatment of this ill state, there needs punishment and correction symbolized with Shike. Shike has fourth nine meaning obstacles between the two strong lines in the upper and lower end, and so it has the function of mastication and get rid of the fourth nine metaphorically indicating subluxation of axis using CBA and auxiliary measures of four movement or laughing methods. Bi expresses the achievement and effects of consecutive mastication process implicating normalized manifestation of jaw and its linked spinal function. Gen symbolizes removing selfish motive or partiality in advance and reaches the best state of the saint righteously self-nourishable human being.

  • A systematic and multi-dimensional analysis in evaluation results may play a role of providing both learners and instructors with essential information. Conventional types of evaluation research have a tendency of partiality for developing evaluation tools, and analyzing the evaluation results has mostly been fragmentary and a one-dimensional analysis. In this study, through analyzing evaluation results in a multi-dimensional way, a multi-dimensional evaluation result analyzing system was developed for the purpose of providing various information for both learners and instructors to accomplish quality learning teaching. Dimensions are classified into four dimensions including period, student, difficulty degree, and evaluation domain. Analysis results are presented in various types of Dcube, graphs, and spreadsheets.
