The Use of the UNIDROIT Principles as Neutral Law in Arbitration

  • This article discusses the use of the UNIDROIT Principles of International Commercial Contracts in international commercial arbitration. Because the Principles are designed specifically for cross-border commercial transactions, the use of the Principles avoids many of the legal rules that would govern from otherwise applicable domestic law that do not reflect the expectations of parties in international trade.

A Study on Neutral Atom Heating in Inductively Coupled Plasma

  • Neutral atom temperature was measured by Laser Rayleigh scattering method using neutral depletion by neutral heating with ideal gas law in Inductively coupled plasma. We observed sudden pressure change when plasma is turned on and off. We analyzed mechanism of neutral heating by employing zero-dimensional neutral and ion energy balance model simultaneously. The results showed that neutral atom temperature increase with ion density. The mechanism of neutral atom heating and cooling is mainly dominated by ion-neutral collision including elastic and charge-exchange collision and by wall cooling respectively.

Properties of the Poisson-power Function Distribution

  • When a neutral particle beam(NPB) aimed at the object and receive a small number of neutron signals at the detector without any errors, it obeys Poisson law. Under the two assumptions that neutral particle scattering distribution and aiming errors have a circular Gaussian distributions that neutral particle scattering distribution and aiming errors have a circular Gaussian distribution respectively, an exact probability distribution of neutral particles vecomes a Poisson-power function distribution. We study and prove some properties, such as limiting distribution, unimodality, stochastical ordering, computational recursion fornula, of this distribution. We also prove monotone likelihood ratio(MLR) property of this distribution. Its MLR property can be used to find a criteria for the hypothesis testing problem.

A novel higher order shear deformation theory based on the neutral surface concept of FGM plate under transverse load

  • The static analysis of the simply supported functionally graded plate under transverse load by using a new sinusoidal shear deformation theory based on the neutral surface concept is investigated analytically in the present paper. No transversal shear correction factors are needed because a correct representation of the transversal shearing strain is given. The mechanical properties of the FGM plate are assumed to vary continuously through the thickness according to a power law formulation except Poisson's ratio, which is kept constant. The equilibrium and stability equations are derived by employing the principle of virtual work. Results are provided for thick to thin plates and for different values of the gradient index k, which subjected to sinusoidal or uniformly distributed lateral loads. The accuracy of the present results is verified by comparing it with finite element solution. From the obtained results, it can be concluded that the proposed theory is accurate and efficient in predicting the displacements and stresses of functionally graded plates.

  • Human material is considered as an independent object after departing from human body. But unlike other materials, that is not allowed for the trading because of the nature of personality. According to the present legal system, the human material is only permitted to donate to the researcher or biobank for scientific study. Bur after the collection, the human materials are regarded as a valuable assets and the collectors want to get more economic gains. If the neutral modulators serve for the justifiable circulation. The economic motivations could be prevented within material transfer processes. In real life, the neutral modulator is hard to find and most of partipants are involved in the economic interests. In this situation, it may be justifiable to permit the person who donate his body material to pursue reach through right on his material. The problem is how to measure the value of human material and how to treat the informed consent. If the essential portion of human personality is contributed to the value of human material and if only his material can be served for the invention, the tissue donator can get economic interests on his body material as his property. That is based on the rule of processing of human efforts on civil law.

Neutral surface-based static and free vibration analysis of functionally graded porous plates

  • The functionally graded (FG) porous plates are usually characterized by the non-symmetric elastic modulus distribution through the thickness so that the plate neutral surface does not coincide with the mid-surface. Nevertheless, the conventional analysis models were mostly based on the plate mid-surface so that the accuracy of resulting numerical results is questionable. In this context, this paper presents the neutral surface-based static and free vibration analysis of FG porous plates and investigates the differences between the mid- and neutral surface-based analysis models. The neutral surface-based numerical method is formulated using the (3,3,2) hierarchical model and approximated by the last introduced natural element method (NEM). The volume fractions of metal and ceramic are expressed by the power-law function and the cosine-type porosity distributions are considered. The proposed numerical method is demonstrated through the benchmark experiment, and the differences between two analysis models are parametrically investigated with respect to the thickness-wise material and porosity distributions. It is found from the numerical results that the difference cannot be negligible when the material and porosity distributions are remarkably biased in the thickness direction.

Vibroacoustic response of thin power law indexed functionally graded plates

  • The main objective of this paper is to compute the far-field acoustic radiation (sound radiation) of functionally graded plates (FGM) loaded by sinusoidally varying point load subjected to the arbitrary boundary condition is carried out. The governing differential equations for thin functionally graded plates (FGM) are derived using classical plate theory (CPT) and Rayleigh integral using the elemental radiator approach. Four cases, segregated on power-law index k=0,1,5,10, are studied. A novel approach is illustrated to compute sound fields of vibrating FGM plates using the physical neutral surface with an elemental radiator approach. The material properties of the FGM plate for all cases are calculated considering the power law indexes. An in-house MATLAB code is written to compute the natural frequencies, normal surface velocities, and sound radiation fields are analytically calculated using semi-analytical formulation. Ansys is used to validate the computed sound power level. The parametric effects of the power law index, modulus ratios, different constituent of FGM plates, boundary conditions, damping loss factor on the sound power level, and radiation efficiency is illustrated. This work is the benchmark approach that clearly explains how to calculate acoustic fields using a solid layered FGM model in ANSYS ACT. It shows that it is possible to asymptotically stabilize the structure by controlling the intermittent layers' stiffness. It is found that sound fields radiated by the elemental radiators approach in MATLAB, ANSYS and literatures are in good agreement. The main novelty of this research is that the FGM plate is analyzed in the low-frequency range, where the stiffness-controlled region governs the whole analysis. It is concluded that a clamped mono-ceramic FGM plate radiates a lesser sound power level and higher radiation efficiency than a mono-metallic or metal-rich FGM plate due to higher stiffness. It is found that change in damping loss factor does not affect the same constituents of FGM plates but has significant effects on the different constituents of FGM plates.

  • In this paper, a new hyperbolic shear deformation plate theory based on neutral surface position is developed for the static analysis of functionally graded plates (FGPs). The theory accounts for hyperbolic distribution of the transverse shear strains and satisfies the zero traction boundary conditions on the surfaces of the beam without using shear correction factors. The neutral surface position for a functionally graded plate which its material properties vary in the thickness direction is determined. The mechanical properties of the plate are assumed to vary continuously in the thickness direction by a simple power-law distribution in terms of the volume fractions of the constituents. Based on the present new hyperbolic shear deformation plate theory and the neutral surface concept, the governing equations of equilibrium are derived from the principle of virtual displacements. Numerical illustrations concern flexural behavior of FG plates with Metal-Ceramic composition. Parametric studies are performed for varying ceramic volume fraction, volume fraction profiles, aspect ratios and length to thickness ratios. The accuracy of the present solutions is verified by comparing the obtained results with the existing solutions.

  • In this paper, a new first shear deformation plate theory based on neutral surface position is developed for the static and the free vibration analysis of functionally graded plates (FGPs). Moreover, the number of unknowns of this theory is the least one comparing with the traditional first-order and the other higher order shear deformation theories. The neutral surface position for a functionally graded plate which its material properties vary in the thickness direction is determined. The mechanical properties of the plate are assumed to vary continuously in the thickness direction by a simple power-law distribution in terms of the volume fractions of the constituents. Based on the present shear deformation plate theory and the neutral surface concept, the governing equations are derived from the principle of Hamilton. There is no stretching-bending coupling effect in the neutral surface based formulation. Numerical illustrations concern flexural and dynamic behavior of FG plates with Metal-Ceramic composition. Parametric studies are performed for varying ceramic volume fraction, length to thickness ratios. The accuracy of the present solutions is verified by comparing the obtained results with the existing solutions.

  • Arbitration is a consensual process in which a dispute is resolved by an impartial arbitrator outside the courts. Arbitration is flexible, neutral, time- and cost-efficient, and confidential. In 1985, the United Nations Commission on International Trade Law(UNCITRAL) enacted the UNCITRAL Model Law on International Commercial Arbitration to help countries reform and modernize their arbitration laws. In 1999, South Korea adopted the model law. Later in 2006, UNCITRAL amended the model law to promote international arbitration. The amended model law includes, among other things, specific provisions regarding interim measures. In 2016, in order to adopt the newly amended version of the model law, South Korea revised its Arbitration Act. The revised act includes a more comprehensive legal regime regarding interim measures, including definitions, types, processes, requirements, the court's recognition and enforcement, and liability. This paper examines the revision of the Arbitration Act of Korea and its legislative intent, presents the problems, and offers recommendations for resolving the problems.
