중국 중재법에 관한 연구 (A Study on the Chinese Arbitration Act)

  • The legislative body of The People's Republic of China, the National People's Congress, enacted the first arbitration act in China's history on August 31st, 1994, which took effect on September 1, 1995. The problems revealed through a comparison of China's Arbitration Act with the UNCITRAL model arbitration law were studied as well as the enacting process, background, status and system, important contents, problems of Chaina's Arbitration Act, and the differences between the old arbitration regulations and the new arbitration act. These are all discussed in this paper. The Arbitration Act is the basic act ruling over china's arbitration system: it unified the previously confusing laws and regulations relevant to the arbitration system, and the act brings out fundamental changes in China's domestic arbitration to the level of international arbitration standards. It is possible to view this act as a cornerstone in China's arbitration system. But, as discussed in this paper, there are still a lot of problems with the new act and only a few of the merits which the UNCITRAL model arbitration law has. First, under China's Arbitration Act, parties enjoy autonomy to some degree, but the range of party autonomy, compared to that of the UNCITRAL model arbitration law, is too narrow. Second, because China's Arbitration Act didn't explicitly provide issues which can give rise to debate, a degree of confusion in its interpretation still remains. Third, China's Arbitration Act's treatment of some important principles was careless. Fourth, in some sections, China's Arbitration Act is less reasonable than the UNCITRAL model arbitration law. These problems must be resolved in order to develop China's arbitration system. The best way of resolving these problems for China is to adopt the UNCITRAL model arbitration law. But it is difficult to expect that China will accept this approach, because of the present arbitration circumstances in China. Although it is difficult to accept all the contents of the UNCITRAL model arbitration law, China's legislators and practitioners must consider the problems mentioned in this paper.

  • The purpose of this study was to provide for the useful fundamental data by developing an appearl sizing system according to body types for Chinese Adult Female. Thus, it was to improve of fittness and coverage rate of exporting domestic clothing to China. For study, It was measured 1360 female women aged between 19 and 50 who resident in Beijing and Shanghai in China. as a sample, 1381 female women was seleted for development of apparel sizing system. Thus, this study was to characterize body types of Chinese adult female by classifying them into groups and set coverage rate of ready-made clothes by developing an apparel sizing system according to the Women's Wear Specifications(GB/T 1335.2-1997), National Standards of People's Republic of China. As for the method of this study was done during Jun. 23 $\sim$ Aug. 7, 2004. Data analysis were processed by SPSS WIN 10.0 Program was used to for technical statistical analysis. The result was as follows: The clothes dimension for upper and lower body and the coverage rate of body size that had the highest appearance ratio from the entire group was Y-type 160-84$\cdot$160-64(4.6%) and the section 160cm 32.4%, A-type 160-88$\cdot$160-72(3.3%) and the section 160cm 28.1%, B-type 155-88$\cdot$155-78(3.8%) and the section 155cm 27.8%, C-type 150-96$\cdot$150-88(2.5%). The result By setting of representative size number and production coverage rate for Chinese adult female. The representative size number of the entire group was set for 150-80A$\cdot$150-64A(1.0%), 155-84A$\cdot$155-68A(2.6%), 160-88A$\cdot$160-72A(3.3%), 165-84A$\cdot$165-68A (2.8%), 170-96A$\cdot$170-80A(0%). The production coverage rate for each representative size number was SS size the section 150cm 2.8%, size the section 155cm 17.0%, M size the section 160cm 31.6%, L size the section 165cm 25.0%, XL size the section 170cm 12.6% that covered 85.0%.

A Study on Development of Chinese Men's Apparel Sizing System II

  • The purpose of this study is to provide for some basic data useful to production of the apparels fit and measured well for the Chinese men. For this purpose, Chinese men's apparel measurements and specifications were determined per area group(Beijing and Shanghai) according to the Men's Wear Specifications (GB/T 1335.1-1997), National Standards of People's Republic of China. The results of this study can be summarized as follows; 1. As a result of dividing the Chinese men into Beijing and Shanghai men and thereby, setting stature and upper chest circumference for upper garments and stature and waist for lower garments. 2. As a result of analyzing the correlational distributions of stature and upper chest circumference measurements by region (Beijing and Shanghai) and type of physique, it was found that the coverage rate of the selected sizes was higher in Shanghai sample than Beijing sample in case of the sample with thicker waist circumferences. 3. As a results of analyzing the correlations according to the three-fold classifications of stature /upper chest circumference/waist for garment specifications by region (Beijing and Shanghai) and type of physique, "A" type was most covered, followed by "B", "C" and "Y" types.

A Study on Classification of Chinese Men's Body Types - Focused in Beijing and Shanghai -

  • The purpose of this study is to provide for some basic data useful to production of the apparels fit and measured well for the Chinese men. For this purpose, 389 men aged between 20 and 49 and living in Beijing and Shanghai, China were sampled to be measured for their constitutions. Then, their constitutions were classified and thereupon, according to the Men's Wear Specifications (GB/T 1335.1-1997), National Standards of People's Republic of China. The collected data were statistically processed using SAS 6.12 for technical statistical analysis, correlation analysis, factor analysis, group-wise analysis. The results of this study can be summarized as follows; 1. As a result of the factor analysis aiming to determine Chinese men's constitutional components, five components could be identified: constitutional obesity, lateral body size, longitudinal body size, shoulder and back width, and shoulder drooping. 2. As a result of classifying Chinese men's constitutions according to drop measurements, four types could be identified. Y type had the lowest obesity and the highest longitudinal body size. A type had a lower obesity and had an average longitudinal body size. B Type had the second highest obesity, the smallest longitudinal body size and shoulders/back width. C Type had the highest obesity, upper body length and shoulders/back width. 3. In terms of distribution, 'B' type (39.10%) of the sample, followed by 'A' type (29.26%), 'C' type (19.95%) and 'Y' type (11.70%). In all, the results of this study suggests that 'B' type represents the Chinese men in contrast with GB specifying that 'A' type represents the Chinese men. On the other hand, Beijing region was dominated most by 'B' type (37.06%), followed by 'A' type (28.82%), 'C' type (22.35%) and 'Y' type (11.76%), while Shanghai region was dominated most by 'B' type (41.13%), followed by 'A' type (31.21%), 'C' type (19.15%) and 'Y' type (8.51%).

For this purpose, Chinese men's apparel measurements and specifications were determined per area group(Beijing/ Shanghai) according to the Men's Wear Specifications (GB/T 1335.1-1997), National Standards of People's Republic of China. The results of this study can be summarized as follows; 1. As a result of dividing the Chinese men into Beijing and Shanghai men and thereby, setting height and upper chest circumference for upper garments and height and waist for lower garments. 2. Analyzing the correlations according to the three-fold classifications of height/upper chest circumference/waist for garment specifications, 17 specifications based on heights and upper chest circumferences for Beijing men's upper garments could be designed within the deviation level of 2%, while 15 specifications based on waist measurements could be designed (between $70{\sim}98cm$) for their lower garments within the deviation level of 4%. Thus, a total of 60 combinations of the specifications could be obtained. 3. 16 specifications based on heights and upper chest circumferences for Shanghai men's upper garments could be designed within the deviation level of 2%, while 16 specifications based on waist measurements could be designed (between $68{\sim}98cm$) for their lower garments within the deviation level of 3%. Thus, a total of 56 combinations of the specifications could be obtained. For other reference measurements, grading measures were set for each type and body part, while the average measures of major body parts were calculated.

중국 성인여성용 의류치수규격 설정 연구 (제II보) - 20대 연령집단을 중심으로 -

  • The purpose of this study was to provide with the useful fundamental data by developing the appearl sizing system according to body types for the Women's Wear Specifications(GB/T 1335.2-1997), National Standards of People's Republic of China. Thus, it was to improve of the garment fit and coverage rate for the apparel production assortment and stock of exporting domestic clothing to China. For this study, 581 female women aged in their twenties who lived in Beijing and Shanghai were selected for the development of the apparel sizing system who resident in Beijing and Shanghai in China. As for the method of this study was made three primary items(length, bust girth, waist girth) and seven secondary items. Data analysis were processed by SPSS WIN 10.0 Program was used. The research selected 3 major body measurements, such as stature, bust girth, waist girth and 7 secondary measurements to investigate the body features of the Chinese adult women. The data throughout the study were analyzed by using SPSS WIN version 10.0 S/W. The result were as follows: The clothes dimensions for upper and lower body and the coverage rate of body size that had the highest appearance ratio from the selected age group in 20's were: Y-type 160-84 155-64(5.9%) and the section 160cm 22.6%, A-type 160-80 160-62(39%) and the section 160cm 27.9%, B-type 155-80 155-66(6.2%) and the section 160cm 24.7%. The representative size codes of the Chinese adult women aged in their 20's were set for representing certain body dimensions such as 150-76A 150-60A(0.0%), 155-80A 155-64A(2.4%), 160-84A 160-68A(3.9%), 165-88A 165-72A(0.3%), 170-92A 170-76A(0.0%). The production coverage rates for the each representative size codes were S size the section 150cm 1.5%, M size the section 155cm 15.3%, L size the section 160cm 36.0%, XL size the section 165cm 29.7%, XXL size the section 170cm 11.4% that covered 93.9%.
