Purpose: This study sought to analyze perceptions and attitudes regarding patient personal information protection according to the general characteristics of paramedic students and their clinical practice experience. Methods: A total of 215 paramedic students from G university in I metropolitan city and D university in G do were surveyed. Frequency analysis, percentage analysis, and one-way distribution analysis were conducted using the software SPSS version 23.0. Results: First, recognition regarding the operation of laws and systems related to medical law and personal information protection was high among students who had no clinical practice experience, and there were no differences with regard to students' general characteristics. Second, the level of recognition regarding patient personal information protection and exposure did not differ depending on students' general characteristics and clinical practice experience. Conclusion: Based on the results of this study, students' recognition and attitude should be improved by carrying out continuous education on patient personal information protection. Furthermore, more specialized and systematic training related to patient personal information protection should be conducted to nurture appropriately trained paramedic students.

Legal accountability is no limited to nurses in advanced practice: it is a recognized fact of life for every practicing nurse. whether she is an RN employed as a staff nurse in a hospital, a Certified Nurse-Midwife in independent practice or a patient's home. Therefore, it is essential for nurses to be as familiar as possible with the legal guidelines that govern their patient care responsibilities. However there are only a few studies focused on nursing negligence. To define nurse's civil liability in medical malpractice, it is necessary to indentify both legal nursing behaviors and nurse's due care in those nursing behaviors. So this paper focused on nurse's due care, especially in nursing malpractice. To clarify nurses' due care. chapter II has focused on nursing behavior and the scope of nursing practice based on the medical law and health care related study results. Chapter III deals with the content and scope of nurse's due care. Generally. negligence is defined as not doing something which a resonable person. guided by those ordinary considerations which or dinarily regulate human affairs. would do. or doing something which a resonable and prudent man would not do. Next. it describes how we can set the standard of due care in nursing practice. There is objective factors and subjective factors. And we also discuss about the limitation of due care in nursing practice. Finally. chapter IV deals with the case studies related to nursing negligence in the situation of determination. First. there are several cases dealing with nurse's negligence in nursing practice. however, those cases didn't judge nurse's due care based on individual -specific standard but general-objective standard. Second, there is a tendency to put an emphasis on the principal of belief to distinguish who has the liability in the case of medical malpractice among medical care team. So nurses shoud practice nursing care more actively to protect themselves and patients because there is an effort to form professional nurse system and the scope of nursing practice will be deeper and broader. Third, standard of care is a necessary element in establishing negligence. If a nurse is able to meet the standard of care, no breach will be found.
Herein, we describe the case of a 67-year-old female patient who presented with cough and haemoptysis. Chest computed tomography revealed destruction of the left lower lobe and multiple fungus balls in a bronchiectatic cavity. A left lower lobectomy was performed via thoracotomy. Histopathological examination of the lung showed a concomitant aspergilloma and multiple tumourlets in the large bronchiectatic cavity. Pulmonary intracavitary aspergilloma and concomitant tumourlets are quite rare. Our report presents this interesting case that manifested with haemoptysis.
Objective : This study was aimed to reassess the scope of practice for medical personnel based on laws. Method : The law specifying the scope of practice for medical personnel has been selected searching Korean Law Information Center(https://www.law.gov.kr). The result was categorized as 'examination, diagnosis, treatment, procedure, prescription, and others'. Results : The laws related to medical procedures were divided into three categories: diagnosis, treatments, and public health and others. In the field of diagnosis, traditional Korean medicine practitioners are generally allowed to play a role. However, some laws specify that only medical doctors can be the primary authorities for diagnosing infectious diseases. In the area of treatments, particularly in emergency medical situations, only medical doctors or nurses are typically mentioned. There are debates in the field of public health and other areas concerning issues such as vaccination, disability diagnosis, and the qualifications for health center directors. A reevaluation is also needed for the Occupational Safety and Health Act, where only medical doctors are set as the personnel standard for workers' health examinations. Conclusion : To safeguard and promote the health of the citizens, there is a need for a clear definition of the licensure and scope of practice for healthcare professionals. Consistent interpretation of conflicting provisions among various laws and clear criteria for the term 'physician' in legal contexts are essential.
Purpose: The purpose of this study was to provide an appropriate direction for effective field practice program by analyzing the influencing factors on satisfaction in ambulance ride practice of paramedic students in Korea. Methods: This study analyzed of 180 paramedic students from 20th to 30th september, 2019. The collected data were analyzed with MedCalc 18.1.0 program. Results: The results of the satisfaction of ambulance riding practice according to the degree of procedure practice are as follows. Satisfaction was high in all groups except the practice time. The lowest satisfaction rate was seen in the category of'There were many cases of applying theories learned at college'within the variable of practice environment(2.82±0.82). The factors affecting the satisfaction of ambulance riding practice were the nurse (β=-0.1472, p=.024) and emergency medical technician(β=-0.3318, p=.002) according to the ambulance worker qualification paramedic, and the practice score (β=0.0048, p<.001). Conclusions: For effective ambulance riding practice, it is necessary to be able to select the practice place where many cases can be experienced, the appropriate selection of the practice leader, and the degree of procedure practice.
Considering the existence of asymmetric information between doctor and patient, the doctor's reimbursement method has been considered as a desirable policy device of improving efficiency of patient's use of medical care in terms of its affecting doctor's practice pattern by determining doctor's practice revenue. By using the Community Tracking Study (CTS) physician data set, which includes not only various information on doctors practice arrangements and sources of practice revenue, but also vignettes of various clinical presentations, this paper investigates doctor's reaction to the financial incentive under the control of patient's specific medical situation. Under the econometric model for exploring the effect of doctor's reimbursement method on his/her practice patterns; referring patients, recommend doctor-visit or medical tests, the Hausman's specification test was used for checking out the possibility of the doctor's reimbursement method being endogeneized explanatory variable. In the case where the endogeneity problem of doctor's reimbursement method exists, the 2SLS method was used for correcting that problem, and the multiple regression method was used in the case where the problem is found to be nonexistent. Based on the empirical results, this paper finds that doctors do appear to respond to financial incentive. The empirical results show that the doctor's reimbursement method statistically significantly affects doctor's practice pattern and are coincident with the theoretical result proposed by previous researches, This results suggest, as doctor's practice revenues are mainly determined by prospective method, such as capitation, doctors would more refer their patients to specialists, and hesitate in recommending doctor-visit or medical exam.
Purpose: The aim of this study is to present the basic data for qualitative improvement of emergency care for emergency patient by paramedic in fire station by understanding the level of awareness and practice in prehospital and transfer step, and understanding the level of emergency care and improvement of clinical knowledge through hospital clinical training. Methods: The researchers explained the objective for 143 persons who completed hospital clinical training from June 2nd, 2006 to October 23rd, 2009 among paramedic in fire station. The questionnaire in this research consisted of 80 questions. In the reliability for the awareness of emergency patient assessment, cronbach's $\alpha$ was 0.95, and in the reliability for emergency care fulfillment, cronbach's $\alpha$ was 0.93. reliability for clinical knowledge improvement is cronbach's $\alpha=.95$, and reliability for emergency care fulfillment is cronbach's $\alpha=.82$. Collected data was analyzed through SPSS 18.0 statistics program for frequency, percentage, average, standard deviation, Paired t-test, t-test, Correlation Coefficient, and internal consistency reliability was analyzed by cronbach's $\alpha$. Results: 1) The paramedic awareness and practice difference for emergency patient is statistically signification for general patient assessment(t=14.159, p=.000), trauma patient assessment(t=11.288, p=.000), internal medicine patient assessment(t=10.898, p=.000), and it shows the level of practice is lower than the level of awareness. 2) The paramedic difference between the level of awareness and practice according to whether or not they have clinical career is not signification on awareness(t=3.119, p=.125), and is high on practice(t=3.119, p=.002). 3) The correlation between paramedic awareness and the level of practice shows positive correlation(r=.61, p=.000). The higher the awareness of emergency patient assessment is, the higher the level of practice is. 4) The difference between paramedic clinical knowledge improvement and the level of emergency care practice is statistically significant(t=3.351, p=.001). 5) 89.6%(128 persons) of paramedic replied hospital clinical training experiences are helpful for field activity. 92.3%(133 persons) replied they apply well for clinical knowledge learned during hospital clinical training and emergency care skills in the field. Conclusion: Paramedic in fire station must evaluate the patient's initial assessment and activate the transfer system to the emergency department. It is necessary to develop and implement the effective education program continuously. The education program should systemize currently operated hospital clinical training. emergency disease and symptoms emergency care method, and practice mainly skill education should be progressed. In the prehospital and transfer management, high quality of medical assessment is required to the emergency medical service system. Medical direction from the doctors can feedback the paramedic continuously and continuing education must be provided to the paramedic in fire station.
The purpose of this study is to assess individual decisive factors for distribution of medical specialists in Korea. A data set was constructed using several published data sources. including the Korean Medical Association's physician master file as a principal source for physician information. Linear logistic regression analysis was performed to assess the relationship between the location of private specialist clinic for practice with six variables related with individual characteristics: age. sex. location of postgraduate training hospital. location of medical school graduated, size of hospital for training, and specialty. Analysis showed that location of practice. classified into urban and rural areas, was significantly associated with the variables of sex. location of postgraduate training hospital. location of medical school. In addition, significant association was found between the location of practice which was categorized into "near-Seoul area" and others, and sex, location of postgraduate training hospital. and location of medical school. We could conclude that to improve area maldistribution of physicians locations of hospitals for training and medical schools have to have the highest priority in the policymaking.icymaking.
Purpose: This study was conducted to identify the impact of human rights sensitivity and patient rights awareness of first-year students in clinical practice on clinical practice adaptation and to prepare practical and systematic personality development program education alternatives to foster high-quality medical personnel. Method: As for the research method, an online survey of 155 medical and nursing students from two universities in G-do (76 medical students and 79 nursing students) was conducted, and the collected data were T-test, ANOVA, Scheffe test, Pearson's correlation coefficient and step-by-step multiple regression analysis using SPSS WIN/25.0. Findings: The results of the study are as follows. First, as a result of analyzing the differences in each variable according to general characteristics, human rights sensitivity had a significant impact on gender, patient rights recognition on personality type, and clinical practice adaptation had a significant impact on major selection motivation. Second, the factors affecting the adaptation of first-year college students to clinical practice had a significant impact on extroverted personality and patient rights perception among personality types (regression model results F=6.38 (p<).001), 24.2% explanatory power). Conclusion: This study suggests that education and policy efforts are needed to foster accurate awareness of human rights issues by developing flexible and flexible extracurricular activity programs in the operation of the curriculum to strengthen medical and nursing students' ability to adapt to clinical practice and improve awareness of human rights issues.
대법원 2022. 12. 22. 선고 2016도21314 전원합의체 판결은 한의사가 진단용 초음파기기를 사용하여 자궁내막증식증을 진단한 것이 무면허의료행위가 아니라고 판단하였다. 이 판결은 서양의학에 속하는 영상의학적 방법을 사용한 특정 의료행위가 무면허의료행위가 아니라고 판단한 것이 아니라 진단용 초음파기기 사용만으로 서양의학에 속하는 영상의학적 진단행위가 있었다고 단정할 수 없고 그러한 사정은 검사가 구체적으로 특정하여 기소하고 증명하여야 함을 분명히 하는 취지라고 할 수 있고, 그러한 한 타당하다. 한의학계에서 주장해온 바와 같이 특정 기기 사용 자체를 금지하는 규정은 없는 것이다. 그러나 당해 사안에서 실제로 서양의학에 속하는 영상의학적 진단방법을 사용하였을 가능성이 상당하고 그러한 경우 무면허의료행위임 또한 분명하다. 지금까지 의료와 한방의료의 경계획정이 문제된 사안 중 상당수가 시험적 성격을 띤 반면, 위 사건의 의료행위는 다수의 한의원에서 널리 행해지고 있다고 의심된다는 점에서 일정한 대응이 필요하다. 나아가 실제로 서양의학에 속하는 영상의학적 진단방법을 쓴 것이 아니라 하더라도 여전히 문제가 있다. 다수의 한의원이 전체적으로 진단에 관한 한 서양의학에 속하는 영상진단을 하는 것처럼 오인하기 쉽게 하고 있는바, 이는 부정경쟁행위이자 의료 소비자의 실질적 선택권을 침해하는 행위이기 때문이다. 현행법상 무면허의료행위만으로 이 문제에 대응하는 데는 한계가 있을 뿐 아니라 장차 무면허의료행위 규율을 개선하는 방법으로 대응하는 것도 쉽지 아니하다. 별도의 규율장치를 도입할 필요가 있다.
