진료기록감정 및 그 판단에 대한 법적 고찰 - 의료민사책임을 중심으로 - (A Legal Study On Expert Opinion of Medical Records and the Judgment - Focus on Medical Civil Liability -)

  • 의료사고에 대한 분쟁의 해결을 위해, 법원은 통상 진료기록에 대하여 의학전문가에게 그의 의학에 관한 전문적 지식이나 그 지식을 이용한 판단을 보고하게 하는 감정(鑑定) 절차를 진행하고 있다. 의료사고에 대한 감정의 결과는 전문가에 대한 참고 의견으로 증거방법의 하나에 불과하다. 그러므로 원칙적으로 법원이 그 결과에 대하여 기속되어야 하는 것은 아니지만, 법원이 의료사고의 구체적 경위를 비롯하여 의료과실과 인과관계가 존재하는지 여부에 관하여 의학적 판단인 감정결과를 온전히 배제할 수는 없다. 따라서 의료사고에 대한 분쟁에서 진료기록감정이 차지하는 비중은 높고 법원 등의 심증 형성에 중요한 영향을 미치고 있다. 본고에서는 의료사고에서 감정의 의의와 기능을 살펴본 뒤, 현행법상 진료기록감정의 양상으로 이루어지고 있는 법원에서의 진료기록감정절차와 한국의료분쟁조정중재원의 의료사고에 대한 감정절차를 각각 유형별로 고찰한다. 또한 우리나라 판례에서 진료기록감정회신에 대하여 어떠한 태도를 취하고 있는지, 외국의 제도로 일본의 경우를 살펴보아 우리나라에의 시사점을 알아보고자 한다. 특히 우리나라의 진료기록감정절차가 지니고 있는 진료기록감정회신의 공정성에 관한 문제, 진료기록감정절차의 지연으로 인한 소송의 지연에 관한 문제 등에 대한 개선점을 제시하고자 한다.

교통사고 후 발생한 이상근 증후군 치험 1례 (Clinical Case Study on Piriformis Syndrome after Traffic Accident)

  • This study is performed to report that oriental medical treatment was effective to the patient with piriformis syndrome after traffic accident. The patient was diagnosed as piriformis syndrome by considering clinical symptom, clinical history, physical examination, radiologic study and NCV EMG study. We applied acupuncture, herbal medicine, cupping, Chuna manipulation and exercise to the patient. After treatment, VAS decreased, and physical examination sign was disappeared. This result suggest that oriental medical treatment can be effective to piriformis syndrome.

정면충돌 시 고령운전자 상해 특성에 관한 실사고 연구 (Real-world Accident Study on Injury Characteristics of Elderly Driver in Car-to-Car Frontal Crashes)

  • Real-world accident cases were investigated to understand injury characteristics of the elderly driver. A total 10 cases of car-to-car frontal crash accidents from passenger car including SUV claimed to domestic car insurance company were reviewed. The injury characteristics of the elderly were analyzed from personal information (gender, age), medical treatment record (medical certificate, curative days), vehicle information (model, air-bag, seatbelt) and damage information. This study showed that elderly driver has higher possibility of thorax injury than non-elderly's. Moreover, Injury type and severity were more severe than non-elderly driver at similar type accident conditions. Also, elderly driver's medical treatment period needs 3 times more than non-elderly driver's.

교통사고 환자 39예에 대한 한방치료 기대도 조사 (Survey on Expectation of Korean Medicine Treatment in 39 Cases by Traffic Accident)

  • Objectives The purpose of this study was to measure the expectation of patients visiting the Korean medical hospital for treatment from traffic accident (TA). Methods The data were collected with a questionnaire for about 1 year. The subjects were 39 patients who hospitalized in Korean Medical Hospital after TA. All data were analyzed using SPSS (Statistical Package for the Social Science) program to analyze. Results Acupuncture (8.36) had the highest expectation degree which was followed by Herbalmedicine (8.32), Pharmocoacupuncture (8.14). There were no significant differences in the expectation degree with sex, age, education, occupation. The patients who had experienced Korean medicine treatment had high expectation degree in Pharmocoacupuncture and Herbalmedicine. And the expectation was different significantly (p<0.05). Conclusions The expectation of TA patients was high in Acupucture and Herbalmedicine. The group experienced korean medical treatment before had high degree of expectation in Palmacoacupuncture and Herbalmedicine.

교통사고 소아환자 121례를 통한 임상적 고찰 (The Clinical Study on 121 Traffic Accident Child Patients)

  • Objectives The purpose of this study was to find out the characteristics of children patients who had been treated in the Oriental Medical Hospital due to traffic accidents. Methods The study was carried out with 121 children patients who visited the Oriental Medical Hospital from April 2011 to March 2012 and was analyzed by reviewing the patients' charts. Results In the distribution of sex the ratio between boys and girls were similar, but regarding the age, 0~6 year-old group was more than that of 7~15 year-old group. In the traffic accident patterns, 87.6% of the entire children patients were injured by car crash. The highest type in the collision between cars was rear-ending impact. The most patients (48.8%) visited our hospital for oriental medical treatment in less than 3 days after the traffic accident. The number of the first visitors in the Oriental Medical Hospital were 77 (63.6%) and those who visited other western hospitals before and were 44 (36.4%). The most frequent duration of admission and treatment in OPD was less than 7 days. Sleeping disorders (37.1%) were diagnosed the highest in 0~6 year-old group and C-spine sprain (49.0%) was diagnosed the highest at 0~7 years-old group. Herb medications were prescribed to relieve anxiety for 0~6 year-old group and for 7~15 year-old group, those were prescribed to activate blood eliminating phlegm and to normalize Qi flow. The highest effective treatment period was less than 7 days. Conclusions This data suggested that the oriental medical care could be more effective in treating children victims of traffic accidents by confirming many different symptoms depending on the age.

The characteristics and clinical outcomes of trauma patients transferred by a physician-staffed helicopter emergency medical service in Korea: a retrospective study

  • Purpose: Helicopter transport with medical teams has been proven to be effective, with improvements in patient survival rates. This study compared and analyzed the clinical characteristics and treatment outcomes of trauma patients transported by doctor helicopters according to whether patients were transferred after a clinical evaluation or without a clinical evaluation. Methods: This study retrospectively reviewed data from the Korean Trauma Data Bank of trauma patients who arrived at a regional trauma center through doctor helicopters from January 1, 2014, to December 31, 2022. The patients were divided into two groups: doctor helicopter transport before evaluation (DHTBE) and doctor helicopter transport after evaluation (DHTAE). These groups were compared. Results: The study population included 351 cases. At the time of arrival at the trauma center, the systolic blood pressure was significantly lower in the DHTAE group than in the DHTBE group (P=0.018). The Injury Severity Score was significantly higher in the DHTAE group (P<0.001), and the accident to trauma center arrival time was significantly shorter in the DHTBE group (P<0.001). Mortality did not show a statistically significant between-group difference (P=0.094). Surgical cases in the DHTAE group had a longer time from the accident scene to trauma center arrival (P=0.002). The time from the accident to the operation room or from the accident to angioembolization showed no statistically significant differences. Conclusions: DHTAE was associated with significantly longer transport times to the trauma center, as well as nonstatistically significant trends for delays in receiving surgery and procedures, as well as higher mortality. If severe trauma is suspected, air transport to a trauma center should be requested immediately after a simple screening test (e.g., mechanism of injury, Glasgow Coma Scale, or Focused Assessment with Sonography in Trauma), which may help reduce the time to definitive treatment.

서울시 개원치과의사의 의료사고 유형 및 대책에 관한 조사연구 (A Study on the Types of the Medical Accidents and the Counterplan of the Dentists in Seoul)

  • The subjects chosen for the study were 2,941 dentists who have been registered in the Seoul Dental Association in 1997. Questionnaires were delivered to the dentists, and 1,133 questionnaires of these were returned. The basic dental of repliers, medical accident experiences, and general thoughts on the dental care and medical accident had been reviewed. Many dentists had appeared to be exposed to the medical accidents and disputes, and the rate of the experience of these cases was also high. In the dental practice, the execution degree of the duties as a dentist was lower than the perception of the duties as a dentist, while the perception was good. However, in spite of carefully following the duties as a dentist, it seemed to be impossible to fundamentally prevent the medical accidents. Thus, dentists should always predict the possibilities of the medical accidents, and it is necessary to establish the impartial dental institutions and organizations through which dentists can settle the medical disputes.

  • Tele-medicine and emergency medical system are necessary for moving from an accidental point or far distance to a hospital and emergency treatment or home treatment before a hospital. Emergency treatment is extremely important in the case of death before arriving a hospital and deformed or disabled by medical treatment delay. A necessary element for this medical system is the emergency communication system. This system is on preparing for an ability of furnishing patient status to a corresponding health service by monitoring the patient at an ambulance of the accident place. This is the transportation of basic biological information of a patient to a medical center by wireless communication system and the corresponding hospital or medical center examine the patient by monitoring, then they can send emergency medical order to the patient for emergency treatment. The TRS is most efficient way of emergency medical communication system, which is currently used with popularity. In this paper studied simultaneously a way of detecting and transporting bio-logical signals, and monitoring of transporting data with communication of voice in the accident place or ambulance.

교통사고로 내원한 환자의 한방치료 전후의 삶의 질과 주관적 스트레스 변화 (Changes of quality of life and subjective stress after the oriental medicine treatment, among the patinets who had visited hospital due to traffic accidents)

  • Objectives : This study is to evaluate the quality of life and amount of stress after the treatment among the patients who visited hospital due to traffic accident. Methods : We evaluated 40 patients who have been treated by western medicine for 3 months but showed no improvements. We surveyed VNRS, SF-36 and IES-R-K scores before treatment began and treated patients twice a week for 4 weeks with acupuncture, chuna theraphy, herbal medicine. After 4 weeks of treatment, we surveyed VNRS, SF-36 and IES-R-K scores again and compared with the scores of before treatment. Results : VNRS score and SF-36 scale and IES-R-K scale showed significant improvement after the treatment, compared to the treatment before. Conclusions : The amount of pain and stress, physical condition, all showed improvement among the patients who came to Oriental medicine hospital due to traffic accident.

교통사고로 발생한 외상성 대퇴부 피하혈종의 한의학 치료 효과 (A Clinical Case of Oriental Medical Treatments for Traumatic Thigh Subcutaneous Hematoma by Traffic Accident)

  • Objectives : This study was performed to report the effect of oriental medical treatments in one patient with traumatic thigh subcutaneous hematoma by traffic accident. Methods : The patient was treated by acupuncture, herbal medicine, pharmacopuncture and cupping for 3 months. Results : After treatments, VAS(visual analog scale) score changed from 10 to 0. MR Imaging showed that the size of subcutaneous hematoma has decreased from $5{\times}11{\times}5.8cm$ to $2.4{\times}3.2{\times}2.6cm$. And the palpation results also showed that the size of subcutaneous hematoma has gotten smaller. Conclusions : Our study suggests that oriental medical treatments such as acupuncture, herbal medicine, pharmacopuncture and cupping may be effective in traumatic subcutaneous hematoma. More cases of controlled treatments are needed to define the effect of oriental medical treatments for traumatic subcutaneous hematoma.
