  • Marine pollution prevention manager system has been operated for the purpose of preventing marine pollution from ships and marine facilities in Korea. As a new "marine environment management act" replacing an old "marine pollution prevention low" had entered into force from January 20, 2008, the education system for marine pollution prevention manager is to change in some ways. Major changes in education/training institutions, education/training courses, trainees, marine pollution prevention manager's works and business, marine facilities and educational subjects are summarized, comparing between old "marine pollution prevention act" and new "marine environment management act".

  • Marine pollution prevention manager system has been operated for the purpose of preventing marine pollution from ships and marine facilities in Korea. As a new "marine environment management act" replacing an old "marine pollution prevention act" had entered into force from January 20. 2008. the works and business of the education and training courses for marine pollution prevention manager are scheduled to transfer from KIMFT(Korea Institute of Maritime and Fisheries Technology) and FHRDI(Fisheries Human Resource Development Institute) to KOEM(Korea Marine Environment Management Corporation) on January 1. 2011. The present state of the education and training for marine pollution prevention managers of marine facilities was surveyed and analyzed in order to prospect trainee demands for the education and training and to provide KOEM with basic data for establishing a new system for the education and training. The existing education and training courses of FHRDI for marine pollution prevention manager of marine facilities have been conducted as a regular course of 21 classes for 3 days. The average annual number of trainees in FHRDI for 6 years from 2003 to 2008 was 187 persons and the annual number of trainee was 202 persons in 2008. The trained demands for the education and training are expected to increase sooner or later, depending major factors such as the extension of fields and ranges for marine facilities and marine environment management business due to the enforcement of new "marine environment management act".

As a new "marine environment management act" replacing an old "marine pollution prevention act" had entered into force from January 20, 2008, the works and business of the education and training courses for marine pollution prevention manager are scheduled to transfer from KIMFT(Korea Institute of Maritime and Fisheries Technology) and FHRDI(Fisheries Human Resource Development Institute) to KOEM(Korea Marine Environment Management Corporation) on January 1, 2011. The present state of the education and training for marine pollution prevention managers on board ships was surveyed and analyzed In order to prospect trainee demands for the education and training and to provide KOEM with basic data for establishing a new system for the education and training. The existing education and training courses of KIMFT for marine pollution prevention manager on board ships are classified into a regular course of 21 classes for 3 days, a reeducation course of 18 classes for 2 days and a NLS course of 17 classes for 2days. The annual numbers of trainees in 2008 were 516 persons for regular course, 1085 persons for reeducation course and 135 persons for NLS course in KIMFT. The trainee demands for the education and training were attempted to be predicted on a basis on annual increase rate of ships. The predicted demands for the education and training are changeable depending on the major factors such shipping market, naval architecture industry, etc.

A Study on the Regional Cooperation for the Prevention of Marine Pollution in the Yellow Sea (황해에 있어서의 해양오염방지를 위한 지역적 협력에 관한 연구)

  • It is, as everyone knows, very important for human beings to protect and conserve marine environment. We has believed the ocean is so wide and deep that it cannot be polluted. But it has begun to doubt the capacity of self-purification of the ocean due to pollution arising from marine casualities. It has proved that semi-enclosed sea is likely to be polluted and cannot be restored easily once pollution occurs. Therefore, first of all it is important to take preventive measures for prevention of marine pollution in the semi-enclosed sea like the Yellow Sea. Many of regional conventions for prevention of marine pollution have come into existence. this dissertation was set out for the fact that the Yellow Sea is semi-enclosed sea which is vulnerable to marine pollution. It is desirable not to deal with marine preservation of the Yellow Sea by a single exclusively but to deal with it by cooperation of all coastal states under the present circumstances. I proposed a program of regional cooperation to protect and conserve the Yellow Sea. This program must be progressed with gradual arrangements. First, they must establist a basic cooperation committee to work basic affairs on the protection of marine environment within the Yellow Sea. The Committee Mainly play parts of study and research concerned with pollution of the Yellow Sea in the non-governmental side and consist of legal and scientific experts. Second, they must establish the control Committee to prevent marine pollution of the Yellow Sea substantially. There is a reason that regional cooperation cannot be directly concluded with the regional tready. Because there is a problem of Recognition of States left. In principle, a subject of tready must be a state in the International Law. But they have not made Recognition of State which is demanded by International Law between North and South Koreas. Therefore, the Control committee must play a substantial part of prevention from pollution instead of the treaty. Finally, we concluded tentatively named $\ulcorner$Convention on Regional Cooperation for Protection of Marine Environment of the Yellow Sea from Pollution$\lrcorner$ if the matter is settled which is related to Recognition of States in the International Law.

  • Domestic laws such as Korea Marine Pollution Prevention Law which has been made and amended according to the conclusions and amendments of various international conventions, especially by MARPOL 73/78, were reviewed and compared with major contents of international conventions, and several alternative measures for legislating new laws or amending existing laws such as Korea Marine Pollution Prevention Law in accordance with new contents and recent amendments of existing and new international conventions were proposed. Annex VI of MARPOL 73/78 has been recently accepted in Korea Marine Pollution Prevention Law which should be applied to ships which are the moving point sources of air pollution at Sea rather than in Korea Air Environment Conservation Law which should be applied to automobiles and industrial installations which are the line and/or point sources of air pollution in land. International Convention for Ship's Ballast Water/Sediment Management should be accepted in Korea Marine Pollution Prevention Law or by a new law in order to prevent domes marine ecosystem and costal environment from the invasion of harmful exotic species through the discharge of ship's ballast water. International Convention for the Control of Harmful Anti-Fouling Systems on the Ships should be accepted in Korea Marine Pollution Prevention Law which should be applied to ships which are navigating in open sea and coastal waters rather than in Korea Noxious Chemicals Management Law. Basel Convention which shall regulate and prohibit inter-nations movements of noxious chemical substances should be accepted in Korea Marine Pollution Prevention Law in order to prevent the movement and transfer of scrap-purpose tanker ships containing bilge water of oil/water mixtures and chemicals remained on board from advanced countries to developing and/or underdeveloped countries and to conserve global marine environment after all.

  • Through the revision of the Framework Act on Administrative Regulations (July 17, 2019), the government minimized regulations and applied the comprehensive negative regulation principle to enhance economic vitality. However, a legally mandatory certification system has been applied to marine pollution prevention materials and chemicals, and inspection is conducted every time a product is sold, suppressing the autonomy of manufacturers. In addition, the majority of manufacturers of marine pollution prevention materials and chemicals are small businesses; therefore, they take the approach of producing small quantities of products whenever a buyer requests an order. Consequently, the need for deregulation was raised to ensure autonomy of the market and industry, and improve efficiency in accordance with the current trend of approval, performance test, and inspection systems for marine pollution prevention materials and chemicals. In this study, problems within the current system were identified and improvement plans are proposed through comparison and analysis of domestic and foreign systems.

  • The quantitative increase in maritime transport for domestic and foreign trade is one of the main reasons for the increase in marine pollution accidents. Despite the implementation of relevant laws in each country to prevent and mitigate marine pollution accidents caused by ships, human negligence (carelessness, intention, etc.) by ship workers has been reported as the biggest cause of marine pollution accidents. One of the most effective ways to reduce marine pollution accidents caused by ships is to reduce human negligence through systematic education and training of ship workers. Therefore, this study aimed to review the appropriateness of the statutory education and training curriculum for ship marine pollution prevention managers in accordance with domestic laws and regulations such as the 「Marine Environment Management Act」 and suggest improvement measures. To this end, we compared and analyzed the legal training·general education courses related to the prevention of marine pollution and marine disasters in Japan, where the laws and systems are similar to Korea, and investigated the cases of legal training for experts in land pollution prevention in Korea.

How to Improve Self-Check System for Marin Pollution Prevention in Korea (해양오염예방을 위한 자율점검제도 개선방안)

  • For marine pollution prevention, Korea Coast Guard has enforced the self-check system on excellent workplace of marine facilities and ships since 2007 as part of the government policy for deregulation of administrative inspection. The self-check system had much effect amid interest from the workplaces and with their participation and cooperation. But the system has become stagnant because KCG has missed the proper timing to reflect the social and environmental change, marine workers' consciousness changes and the transformation of its relevant inner organization in the operation of the system for several years. To accommodate the changes of internal and external environments, this study surveyed 332 workers of ships and marine facilities through questionnaire about the self-check system for marine pollution prevention, reflected on the system, and focused on how to improve the existing system effectively. To increase the effect of self-check system, the enhancement of public relations efforts and improvements in marine pollution control system for ships of 5 gross tons and above are necessary. In addition, for relieving the burdens of business activity and visit inspection by KCG on excellent workplaces of ships and marine facilities, Marine Environment Management Act is needed to be amended so that the self-check system can be reflected in its amendment.
