무료심판변론제도의 도입에 관한 연구 (A Study on the Introduction of Free Counsel System for the Maritime Safety Tribunal in Korea)

  • 해양안전심판에는 징계와 권고 또는 명령 등 개인의 권익에 대한 제한이 뒤따르며, 또한 그 결과는 해양사고 관련 민사재판에도 지대한 영향을 미치게 된다. 우리의 해양안전심판제도에는 해양사고관련자가 심판변론인의 도움을 받을 수 있도록 되어 있지만 그 비용이 만만치 아니한 관계로 경제적인 사정에 따라 제약을 받게 되어 있다. 본고에서는 경제적인 사유로 심판변론인의 도움을 받지 못하여 불이익을 당하는 해양사고관련자들을 위하여 사법제도 등의 유사제도를 검토$\cdot$ 연구한 결과 다음과 같은 방법에 의한 무료 심판변론제도의 도입을 제안한다. 1. 심판법령에 "강제변론주의"와 "국선변론인제도"를 도입하고 그 비용을 국가가 부담 2. 위 제도를 도입하되, 국선변론인을 해사관련단체 소속 임직원 중에 선임하고 비용은 소속단체에서 부담 3. 심판원 산하단체로서 금융지원 등 구조활동을 수행할 "해양안전심판협회" 설립

IMO 해양사고조사코드의 도입과 해양사고조사제도에 관한 고찰 (A Study on the Introduction of IMO Casualty Investigation Code and Marine Safety Investigation System in Korea)

  • 해양사고조사는 해양에서 발생한 사고 및 준사고에 대해 조사하여 원인을 규명히고, 이를 통해 미래의 유사사고 재발을 방지하는 것을 목적으로 한다. 따라서 국제해사기구(IMO)를 비롯하여 대부분의 국가들은 해양사고의 조사결과를 바탕으로 해사안전관련 협약 및 관련 국내 법규를 채택하고 개정한다. 특히, 최근 국제해사기구는 해양사고의 조사에 있어 각국이 협조하여 정확한 원인을 규명하고, 이를 일정한 양식에 따라 보고하며, 동 보고에 근거하여 새로운 국제적 안전기준을 마련하여 사고의 재발방지에 도움이 되도록 규정한 IMO 해양사고조사코드를 채택하였다. 우리나라의 경우는 "해양사고의 조사 및 심판에 관한 법률"에 근거한 해양안전성심판제도를 통해 해양에서의 사고 원인을 규명함으로써 해양안전의 확보에 이바지하는데, 본 연구에서는 IMO 해양사고조사코드를 분석하고 해양안전심판제도와 비교 분석하여 코드 도입에 따라 우리나라 해양사고조사제도인 해양안전심판제도에 있어서 반영되고 개정되어야 할 몇 가지 사항에 대해 논의하며 이를 향후 제도 개선에 참고할 수 있는 기초자료로서 제공한다. 이에는 특히, 조사기관의 독립과 조사의 공정성 확보를 위한 국선심판변론제도 몇 선원인권보장 등이 포함된다.

공과대학 교수의 교육업적평가 지표 개발 연구 (A Study on the Development of Teaching Evaluation Indicators for Faculty in Engineering College)

  • The purpose of this study is to analyze the current evaluation methods on faculty performance at Korean engineering colleges and develop teaching evaluation indicators for faculty performance. We investigated the faculty performance cases in engineering colleges inside and outside of the Korea, the engineering faculty's awareness of evaluation factors for their educational performance, and the appropriate ratios by indicating factors. Also we developed evaluation indicators for educational achievements to improve the current faculty performance system. 227 engineering faculty members answered our survey questionnaire. The result in the case study on faculty performance evaluation is as follows. First, most items of faculty performance evaluation are about quantitative indicators that can easily conduct objective evaluation. Second, evaluation items of faculty performance are mostly focused on instruction in a classroom. Third, the evaluation by students and administrative managers is more dominant than that by professors or their colleagues, document evaluation than on site evaluation, general evaluation than formative evaluation, and static evaluation than dynamic evaluation. Lastly, Some universities tend to substitute outstanding articles for underperforming instruction. The evaluation indicators that we have developed can be implemented by four types of subjects, such as students, professors, their colleagues, and deans. Also, based on the evaluation indicators, faculties can freely select their evaluation domains depending on the their tracks, such as a teaching track, a research track, or an industry-university cooperation track. The mandatory evaluation fields include teaching, student counselling, teaching portfolio evaluation by mentors or colleagues, class management evaluation by deans, and self-evaluation. The other areas are optional and professors can choose their evaluation factors.

의학적 충고에 반한 퇴원의 특성과 퇴원결정 요인에 관한 연구 - 사회사업가의 개입사례와 역할을 중심으로 - (A Study on the Characteristics of DAMA(Discharge Against Medical Advice) Case and Causal Factors of DAMA - Perspective of Medical Social Worker's Role and Intervention -)

  • Objectives : DAMA cases were analyzed to examine what the main casual factors of DAMA were and how to deal with these cases effectively in hospital with the DAMA interdisciplinary team including medical social worker whose role is to perform psycho-social assessment, family counsel, to evaluate family's DAMA need. Patients and Methods : The content analysis of medical record and social work record were reviewed in 37 cases referred by medical doctor to DAMA team. These cases were reported by patients' self discharge request or family's request for discharge from September 1998 to February 2000. The DAMA team consists of Assistant Director of Hospital as team leader, medical staff in-charge, social worker, QI nurse, other staff members who are not involved in direct treatment for patient, and administrative clerk. Results : The results of content analysis are as follows : 1) The most causal factors of DAMA consist of combination of more than 2 factors. 2) The major decision-maker is revealed to be son and daughter of patient. 3) In 59.4% of cases, family was not informed of patients' prognosis, alternatives, the consequence of DAMA at all. 4) In cases of DAMA report, the rapid intervention of social worker is carried out. Conclusion : In this study, we propose the interdisciplinary team approach to make decision legitimately and ethically for DAMA. The suggestions from this study are as follows : 1) To deal with DAMA case properly, the interdisciplinary team approach should be considered. 2) The criteria for DAMA case should be formed carefully. For the explicit selection of DAMA case, preliminary system for high-risk patient screening is recommended. 3) The medical social worker is available for the psycho-social problems of the patient once family members. For the effective family counselling, discharge planning and nursing home placement, the participation of medical social worker should be mandatory.
