This thesis introduces the trends of korean courts' ruling on damages in medical malpractice cases for past 10 years. First of all, Korean courts' ruling have had a tendency to pay only non-economic damages for not taking the informed consent. If a doctor cannot get the informed consent from a patient, he compensate only non-economic damages for the infringement of self-determination rights of patient. It's enough for the plaintiff to prove the infringement of self-determination rights, if the plaintiff just want to get non-economic damages. The Korean Supreme court have ruled that if plaintiffs want to get economic damages for the infringement of self-determination rights or informed consent, plaintiffs must prove that the infringement of self-determination rights is the proximate cause of the economic damages of patient. There is another tendency for the Korean Supreme court to limit the damages in medical malpractice cases on the ground of patient's diseases' dangerousness or patient's idiosyncrasy. In the past courts often limit the damages only to 70~80% of total damages, but now a days courts mostly limit the damages to 20~30%. This thesis also introduce the Korean courts' trends about Valuing damages in personal injury actions awarded for gratuitously rendered nursing and medical care.
In recent years, Korean population aged 65 and over has grown faster(7.2% in 2000, 14.4% projected in 2018 and 20.0% in 2026) than the other age groups and average life expectancy has increased from 65.8 years in 1980 to 75.9 years in 2000. The Aging Simulation Center(ASC) was built for people to give educational chance for further understanding of the elderly and the environment for the aged. People are able to recognize the changes including hearing loss, vision changes, and changes in the ability to touch and move after experiencing the simulated daily life of older persons. In general, ASC is composed of residential setting area and exhibition area of daily commodities for the elderly and care person. Currently, there are four ASCs in Korea. The purpose of this study is to evaluate the characteristics of space design and design elements of ASCs and to suggest design implementation for better residential environment for the elderly. For the research purpose, design characteristics such as floor plans and spatial design elements of three ASCs were analyzed and compared. As a whole, space design of three ASCs was almost same without distinguished characteristics. The major finding of this study indicates that the ASC is considerably helpful environment to understand aging. However, some of design elements such as lighting should be supplemented for safety issue. It is recommended for future design of ASC to include exterior space including outdoor stairs, paths and roads and so on. In addition, reception and preparation area should be arranged with universally designed furniture.

Estimating the emission rate of VOCs from a gasoline industry at national level can be a challenging take even though the estimation is mean-based. However, using the procedures in the US EPA AP-42 guidelines, it is possible to approximate the mean industry emission rate once enough data are available. However, this estimate can be misled in the sense that there exist many stochastic factors in the EPA\\`s estimation procedures and also throughout the marketing channels of gasoline industry. Addressing the stochasticity problem in EPA\\`s procedure is hard to tackle because the detailed data needed to execute the estimation are not usually available even from refiners. Instead, this research tries to stay focused on the second type of stochasticity issue, raised from the mean0based metrological and marketing practice data collected from the 4 major refiners. To do so emission raters from each marketing channels (8 marketing points by 3 transportation types and by storage facilities of 4 refiners) are estimated monthly, following AP-42 procedures and using Tank 4.0. Once these estimates are acquired, the distribution of VOC emission rate for each marketing channel of all 4 refiners is estimated through simulation method using @Risk. The mean-based emission rates are weighted by company quantities to estimate the emission rate from the whole gasoline industry. Simple economic implication is provided, based on the result. This study found that, on the mean-bases, about 0.66% of gasoline marketed are evaporated into air. Considering the stochasticity in the estimation, about 90% of simulation results fell into the range of 0.65 to 0.68%. For 90% chance, the estimated economic loss is $54.65 million to $57.17 million, not counting the cost caused by air quality degradation and associated health impact.

In bluetooth system, there are two kinds of interference. One is the frequency static interference, for example 802.11 direct sequence, the interferer uses fixed frequency band. Another is frequency dynamic interference, for example other piconets or 802.11 frequency hopping, the interferer uses dynamic frequency channel and cant be estimated. In this paper we introduce a novel solution of hybrid method of Listen-Before-Talk (LBT) and Adaptive Frequency Hopping (AFH) to address the coexistence of bluetooth and Direct Sequence of wireless local area network (WLAN). Before any bluetooth packet transmission, in the turn around time of the current slot, both the sender and receiver sense the channel whether there is any transmission going on or not. If the channel is busy, packet transmission is withdrawn until another chance. This is the LBT in Bluetooth. Because of asymmetry sense ability of WLAN and bluetooth, AFH is introduced to combat the left front-edge packet collisions. In monitor period of AFH, LBT is performed to label the channels with static interference. Then, all the labeled noisy channels are not used in the followed bluetooth frequency hopping. In this way, both the frequency dynamic and frequency static interference are effectively mitigated. We evaluate the solution through packet collision analysis and a detail realistic simulation with IP traffic. It turns out that the hybrid method can combat both the frequency dynamic and frequency static interference. The packet collision analysis shows it almost doubles the maximal system aggregate throughput. The realistic simulation shows it has the least packet loss.
Early, mid, and late maturing soybean varieties were artificially infested with larvae of Delia platura at seeding, and then later development and productivity of soybeans were studied. In addition, in hope to utilize as possible tactics in the management of D. platura in soybeans, cultural factors such as contents of organic matter in soil, soil types, and the use of plastic mulching on the degree of damage to soybean plants by D. platura were examined. Primary leaf damage by the larva delayed the forthcoming vegetative growth but not the blooming which is initiated by the change in day length. Degree of delay in growth was more severe where leaf damage was induced by insect infestation than where artificially excised, apparently owing to simultaneous damage in stems and roots besides primary leaves. Productivity of soybeans also dropped significantly in plants with 25 % or more loss in the primary leaf area by the larva. Both transparent and black plastic mulchings shortened the period from seeding to emergence of soybean thus reducing the chance of possible attack by the larva. Soybean seedlings grown in clay loam or clay were attacked less by the larva than those in other types of soil. High organic matter content in the soil enhanced speed of emergence resulting in less larval damage to the seedling.
Between September 1988 and December 1993, 32 cases of benign esophageal stricture, of which 12 males and 20 females, were managed in Seoul National University Hospital hospital. Their age ranged from 2 to 61 years, and the mean age was 33.9 years. The ingestion of caustic agent was the most common cause, and the caustic material was acid in 16 patients [58% and alkali in 11patients [39% . Nearly all of the patients complained of dysphagia, and some of chest pain, epigastric pain, weight loss, vomiting, general malaise, and dyspnea. The most frequent site of stricture was found in the upper thoracic esophagus with 34% incidence followed by the lower thoracic esophagus[28% , whole esophagus[19% , and the mid esophagus[16% . The operations performed were 17[53% ECG[esophagocologastrostomy , 5[16% PCG[pharyngocologastrostomy , 5[16% EG[esophagogastrostomy , 2 EJG [esophagojejunogastrostormy by free jejunal graft , and 1 case each of EJ [esophagojejunostomy , esophageal end to end anastomosis, jejunostomy only, and gastrostomy only. In 23 patients [72% , diseased esophaguses were resected, using transhiatal total esophagectomy in 15 [47% and transthoracic partial esophagectomy in 8 [25% . Of those 23 patients, 3 patients [9.4% were diagnosed as esophageal carsinoma on microscopic examination. The postoperative most common complications were unilateral vocal cord palsy in 6 patients [19% , followed by cervical anastomosis leakage in 4 patients [12.5% , wound infection in 2 patients [6% , and pneumothorax in 2 patients [6% . Late death occurred 8 months after the operation in one patient, which was associated with infection due to anastomotic leakage. Our experience shows that the rate of mortality and the morbidity were low in patients receiving surgical management for esophageal stricture and that the cancer transformation rate was high. We recommend esophageal reconstruction surgery with esophagectomy [transhiatal or transthoracic for the esophageal stricture because it can avoid a chance of prevent cancer transformation.
Recent studies have evaluated the association between specific beverage intake and metabolic risks in adults. However, more evidence is needed to examine the association between the Healthy Beverage Index (HBI) and metabolic factors. Therefore, this study investigated the relationship between HBI and metabolic factors in adults. In this cross-sectional study, 338 overweight and obese individuals living in Tabriz, Iran were selected. Data on beverage consumption, demographics, physical activity, and anthropometric characteristics were evaluated using validated standard protocols. The predefined HBI was calculated based on previous studies. The mean value of HBI index among all of the participants was 59.76 ± 6.51. Those at the higher HBI scores had significantly lower waist circumference, waist-to-hip ratio, fat mass, and weight (p < 0.05). HBI and triglyceride scores also had a significant relationship. It has been shown that at higher HBI scores compared to lower scores, high-density lipoprotein cholesterol levels increase while homeostatic model assessment for insulin resistance, low-density lipoprotein cholesterol, total cholesterol, and blood pressure decrease. HBI scores higher among Iranian adults were associated with a better chance of losing weight and weight loss and a better lipid profile, and lower blood pressure. Therefore, HBI can be a useful and helpful tool for assessing the overall quality of beverages adults consume. However, further studies are warranted to confirm the possible health effects of healthy beverage index.

Early implantation before sufficient ossification has taken place usually results in osseointegartion failure due to reduced bone-fixture interface area. However, various studies have shown successful osseointegration results following immediate implants concurrently with GTR. The clinical trends have been to shorten the patients' edentulous state by immediate implantation, and reduce the alveolar bone resorption. However, it may be difficult to attain the complete soft tissue coverage of the sites, increasing the chance of infection. Furthermore, there may be more studies needed on the clinical behaviors of e-PTFE membranes, various modofications in the membrane materials and bone graft materials. Various animal and clinical studies have been reported on the successful osseointagration following immediate implantation, but the long-term follow-up studies are limited. The present study investigated 16 immediately-implanted implants with GTR therapy with or without calcium carbonate grafting on 11 patients 3 years after installation and 24-30 months after functional loading. Based on the clinical, radiographic and histologic findings, the following results have been attained. 1. Clinically, stability has been shown on all 16 implants throughout the investigated periods. 2. Radiologically, the alveolar bone loss has progressed up to the polished neck portion but not beyond it, suggesting the progressive osseointegration from the GTR therapy. 3. The GTR method used in the present study is easy to use clinically, and may be appied in the regeneration of ossoeous defects around implants and in the immediate implantation. 4. The difficulty in complete tissue coverage may be avoided by delaying the installation for 2 to 3 weeks after the extraction allowing certain degree of soft tissue healing.

Background: The abrupt rise of colorectal cancer in developing countries is raising concern in healthcare settings. Studies on assessing relationships with modifiable and non-modifiable risk factors in the Pakistani population have been limited. The present investigation was designed to examine associations of dietary practices, addictive behavior and bowel habits in developing colorectal cancer (CRC) among patients in a low-resource setup. Materials and Methods: An age-gender matched case control study was conducted from October 2011 to July 2015 in Karachi, Pakistan. Cases were from the surgical oncology department of a public sector tertiary care hospital, while their two pair-matched controls were recruited from the general population. A structured questionnaire was used which included questions related to demographic characteristics, family history, dietary patterns, addictive behavior and bowel habits. Results: A family history of cancer was associated with a 2.2 fold higher chance of developing CRC. Weight loss reduced the likelihood 7.6 times. Refraining from a high fat diet and consuming more vegetables showed protective effects for CRC. The risk of CRC was more than twice among smokers and those who consumed Asian specific addictive products as compared to those who avoid using these addictions (ORsmoking: 2.12, 95% CI: 1.08 - 4.17, ORpan: 2.92, 95% CI: 1.6 - 5.33, ORgutka: 2.13, 95% CI: 1.14 - 3.97). Use of NSAID attenuated risk of CRC up to 86% (OR: 0.14, 95% CI: 0.07 - 0.31). Conclusions: Most of the findings showed concordance with the literature elucidating protective effects of consuming vegetables and low fat diet while documenting adverse associations with family history, weight loss, constipation and hematochezia. Moreover, this study highlighted Asian specific indigenous addictive products as important factors. Further studies are needed to validate the findings produced by this research.
