Explaining One Less Nuclear Energy Policy from Governance Perspective: Energy Transition and Effectiveness of Urban Energy Policy (대안적 에너지 정책에 대한 탐색: 서울시 원전하나 줄이기 정책과 거버넌스의 역할)

  • Seoul's One Less Nuclear Power Plant is the major urban energy policy launched in April 2012. Its effort to respond to climate change and energy crisis in the aftermath of the Fukushima nuclear accident turned out very successful, considering huge decrease of energy consumption. However, the question of how the cut of energy consumption was possible remains unanswered. This paper introduces the concept of urban governance capacity as the cause of the success. It is the managing and governing capability to maintain the logical consistency policy system, comprising of policy perception, goals, policy tools and evaluation. Without this logical correspondence between the policy factors, any system including energy regime easily falls apart during the systemic transitional period. Governance capacity provides the integrating framework, so that the system as a whole maintains the internal homeostasis.

  • This paper deals with the future role of Korean National Assembly in regulatory policy making, Implementation, and evaluation. For this purpose, the author developed the logic for NA's intervention to the regulatory policy making by the executive branch and presidency. Five models of regulatory initiative between National Assembly and the executive branch are also developed by the author. Lastly, new organizational alternatives for the National Assembly to initiate, to participate and to evaluate national regulatory reform policies.

  • A seismic change is under way in diplomatic topography surrounding the Korean Peninsula. A new dynamic is being generated that could lead to a breakthrough in the nuclear stalemate and to an end of hostility between the two Koreas. Moon Administration's bold and creative foreign policy, which is alleged to place South Korea in the "driver's seat", is probably responsible for what is happening on the Korean Peninsula. However, on the other hand, Moon Administration's foreign policy shows a lot of continuity with foreign policy of previous conservative governments. In particular, the Moon government's emphasis on the vitality of the ROK-US alliance and its commitment to close coordination with the US in dealing with nuclear issues of North Korea is the hallmark of the continuity in South Korea's foreign policy. Emphasizing and sharing the notion of the continuities in foreign policy could contribute to social integration by garnering bi-partisan support. It could also spawn sense of stability, predictability, and confidence to diplomatic counterparts in other countries. And it could help avoid the negative effects of expectation-reality gap in the event that the outcome of all the diplomatic endeavor falls short of expectation held by citizens.

The Political Environment and the President's Influence for Policy toward North Korea: Focusing on the process of 'Special Zone of Peace and Cooperation in the West Sea' policy making (대북정책 결정의 정치적 환경과 대통령의 영향력 : '서해평화협력특별지대' 정책결정 과정을 중심으로)

  • The purpose of this study is to analyze the institutional factors and the political environment in which the influence of the president is limited in South Korea's decision making process of the policy toward North Korea. Although the president has the highest decision-making power over policy toward North Korea as a head of state, the president's influence is not always absolute. Many reasons, such as bureaucratic government through the separation of power, the political environment such as divided government or the remaining term of the president,and the specificity of policy act as factors limiting the president's influence on policy toward North Korea. This study analyzed the dynamics of the decision making process of the 'Special Zone for Peace and Cooperation in the West Sea' which was planned by the agreement between the two Koreas in 2007, and examined the influence of the president, limited by the institutional environment and political conditions in the process.

  • US Northeast Asia Policy will show the following changes and continuities with the transition from the Trump administration to the Biden administration. As the Biden administration adheres to traditional principles and norms of US foreign policy, there will be more stability and predictability. The US-China confrontation is likely to become more serious, as President Biden will continue the hawkish China policy Trump initiated. Regarding North Korea, the Biden administration is expected to adopt a more conservative 'bottom-up' approach rather than a 'grand bargain' that Trump pursued. Due to many policymakers holding deep suspicions about the North Korean regime, any diplomatic breakthrough with North Korea is unlikely to occur soon. As for South Korea and Japan, Biden will show more respect to these key allies but may also demand them to contribute more to US-led initiatives countering China.

A Comparative Study on the Legislation of Homeschooling in the United States and South Korea (미국과 한국의 홈스쿨링 법제화 비교연구)

  • The purpose of this study is to compare and analyze legislation of homeschooling in the United State and South Korea and to seek a measure to legislate homeschooling in South Korea. To fulfill its goal, related literature and materials were reviewed to derive a criterion of analysis, and also state laws on homeschooling in the United States and homeschooling legislative bill in South Korea were compared and analyzed. The major findings of analyses are as follows. First, regards to declaration of intention in the procedure for homeschooling permission, legislative bill and law of both countries include related regulations. Second, regards to requirement for homeschooling, homeschooling legislative bill in South Korea nearly does not include related regulations while state laws on homeschooling in the United States mostly do include them. Third, regards to public school access policy, both parties do not include related regulations. Fourth, regards to education support service, homeschooling legislative bill in South Korea includes all of related regulations while state laws on homeschooling in the United States nearly do not include them. Fifth, homeschooling legislative bill in South Korea can be affiliated to low on degree of regulation in comparison to the degree of regulation of state laws on homeschooling in the United States. Based on these analysis results, conclusion and discussion have been proposed.

A Network Analysis of the Library Bill Cosponsorship in the Legislative Process of the 19th National Assembly of Korea (도서관법안에 관한 19대 국회 입법과정의 공동발의 네트워크 분석)

  • The legislative cosponsorship network shows the legislative process of the National Assembly through the relationship between the members of the National Assembly formed by cosponsorship. This study focused on the library bill proposed during the 19th National Assembly term, and conducted the cosponsorship network analysis, the centrality analysis of actors of the National Assembly, and a subgroup analysis of keyword-centric networks. As the result of the study, the library bill's cosponsorship network was segmented according to political parties, and lawmakers who played an intermediary role in close proximity to other political party members had an important influence on the network. When restructured into a keyword-oriented network, the network structure segmented into political parties improved as members of different parties shared the same keywords and formed subgroups. Based on the results, it was suggested that a strategy for spreading and sharing policy issues based on core keywords rather than library legislation, centered on lawmakers who play a mediating role between parties, is needed to activate library legislation.

  • Considering Republic of Korea that is known as the worlds one of the most compact airspace, together with development of technology of aerospace and ever-strengthening weapon systems of aircraft, is, in its reality, in a dire need for more practical infrastructure against any intrusion, of course also being mindful of the situation with the North Korea, to its national airspace or other controlled airspace. Republic of Koreas current legislative regime is unable to effectively respond to such crisis on any legal ground, and responsible government members are relying heavily on relevant military laws and regulations. Naturally, there exists strong possibility of various problems when there occurs an actual intrusion to Koreas airspace and lawful and legal resolution of the aftereffect is demanded. This article categorizes Korean peninsula and its national airspace into various kinds of airspaces; KADIZ; FIR; airspace above EEZ; airspace above contiguous zone; airspace above the high sea, and attempted to research and study these respective categories, given the unique nature of airspace and the current responsive measure. Furthermore, this article will review some of the relevant legislative actions and their sense of direction as solution to the discussed problems.

Improvement Plans of the Parliamentary Inspection System in the Information Society

  • Today, in the information society, since the government administration of all countries places importance on clarity and efficiency, the authority concentration of the administration is inevitable. Therefore, the Parliament, which is a legislative body, is at a time when the policy control function to check and monitor it is becoming more important. In particular, due to the emergence of parliamentary democracy, in the reality that the people must elect representatives and represent their own opinions, the parliamentary inspection system is very valuable in that it satisfies the right of the people to know and ultimately enables the people to democratically control the administration. The role of the Parliament moves from the inherent legislative function to the information collection and disclosure of government administration, discussion and resolution of political issues, and observation and supervision of the administration. And it can be seen as the global trend. As a result of this trend, status and role of the National Assembly is being strengthened from the legislative body to the control agency of government administration. Thus, the most substantive authority of Article 61 of the Constitution can be deemed the parliamentary inspection system. The parliamentary inspection system is a system that let exercise the legislation, budget, and authority to control of state administration by identify the challenges and policy implementation of each country's institutions through the audit of the executive administration's overall government administration performance outside the National Assembly. However, due to the amendment of Constitution in 1988, the parliamentary inspection right and investigation of state administration right had reinstated and the parliamentary inspection system, which is being implemented annually, is the 31st year of the year in 2019. However, the general evaluation of the public is negative and insufficient time for inspections, lack of sanctions on nonattendance witnesses, excessive data submission, and refusal to submit materials by the administration were pointed out as the problem. Therefore, in this paper, the researcher tries to point out the overall problems of the parliamentary inspection system and to summarize the effective improvement plans.

  • This research focuses on accomplishing analysis problems and issues by examining the policies and systems related to geo-spatial big data which have recently arisen, and suggests political and systemic improvement plan for service activation. To do this, problems and probable issues concerning geo-spatial big data service activation should be analyzed through the examination of precedent studies, policies and planning, pilot projects, the current legislative situation regarding geo-spatial big data, both domestic and abroad. Therefore, eight political and systematical improvement plan proposals are suggested for geo-spatial big data service activation: legislative-related issues regarding geo-spatial big data, establishing an exclusive organization in charge of geospatial big data, setting up systems for cooperative governance, establishing subsequent systems, preparing non-identifying standards for personal information, providing measures for activating civil information, data standardization on geo-spatial big data analysis, developing analysis techniques for geo-spatial big data, etc. Consistent governmental problem-solving approaches should be required to make these suggestions effectively proceed.
