작업환경측정 보고제도 개선 방안 도출을 위한 조사 연구 (An investigation on the Improvement of the Working Environment Measurement Reporting Policy)

  • Objectives: In order to reduce the burden on employers and increase the reliability of measurement results, improvements to the provisions related to the work environment measurement reporting system, such as the current Occupational Safety and Health Act and its Enforcement Rules, are planned. This study aimed to suggest improvements for the work environment measurement reporting system through a survey and Delphi investigation. Method: This survey included workplaces (health managers), national institutions (the Ministry of Employment and Labor) that use the results of the work environment measurement reporting system for policy and supervision purposes, and work environment measurement institutions that enter the results were included. In addition to the survey, we tried to derive results through meetings with stakeholders and expert advisory meetings. Results: It is difficult to abolish or partially improve the reporting system under the Enforcement Regulations of the Occupational Safety and Health Act at this point because the opinions of workplaces, supervisory agencies, and measuring agencies differ in terms of its intended purpose and use. In the case of high-exposure harmful factors (over 50% on the basis of exposure) in the "comprehensive opinion" described in the work environment measurement results table, it is necessary to insert unit of work with exposed harmful factors, exposure factors, and current conditions in checklists or tables so that they can be reflected in government policies. In the case of workplaces that are feared to be highly exposed to substances subject to measurement, it seems desirable to improve them so that industrial health instructors registered with the Korea Safety and Health Agency or local labor offices can provide technical guidance. As an improvement plan to increase the reliability of data and the use of big data, it is necessary to improve the input method for processes and jobs. Conclusion: The laws and regulations of the work environment measurement reporting system are difficult to revise due to a lack of consensus among current stakeholders, but improvements can be achieved by improving the Ministry of Employment and Labor's notifications and other means. In addition, in order to effectively utilize the data from the K2B system, it is necessary to improve the input method for processes and jobs.

Comparative Study on Themes of Research Papers on the Research Trends of Parks and Green Spaces in Japan and Korea

  • The objective of our research was an international comparison focusing on studies conducted on parks and green spaces undertaken in Japan and Korea. We also aim to clarify the similarities and differences between the two countries and consider the key features of the researches on the field of landscape architecture. We compared the recent trends of Japanese institute with Korean observed in the theme of research papers adopt title of them. The research period spanned approximately twenty years, from 1980 to 2003. We employed the Table of Contents information search system to research academic journal articles and to select the journals that included articles with the key words [park(s)] or [green space(s)] in their title. We chronologically arranged the journals for each country, based on the total number of journals and classification categories. We then conducted a comparative examination among the two countries. We also contributed information on the circumstances behind the formulation or amendment of some policies and laws and we checked the results against the research trend. Among the selected journals, the number of papers was the highest by the Institute of Landscape Architecture. But the reason for increase of the number of papers on green spaces in Japanese journals was not published by the Institute of Landscape Architecture but by the City Planning Institute and the Architecture Institute. In Japan, the papers on parks categorized under historical study were the highest among all categories. On the other hand, in Korean journals, papers on parks categorized under historical study were few. A similar trend was recognized in papers on green spaces. Every society is concerned with the study of function and effect. However, some exact differences have been observed by category classification. In Japan, the percentage of function and effect papers on parks was less than those on green spaces. In Korea, both percentages for these groups were high. The category of system and policy accounted for $17\%$ of the papers on green spaces in Korea. This result was higher than the number of papers on green spaces and parks in Japan and parks in Korea. Recently, the number of papers focusing on large-scale green space system has decreased in Japan. The trend in the study of parks and green spaces on a regional scale or at an individual level will be closely monitored. Systems and modeling studies have been focusing in Korea. The understanding between the administration and the citizens was peculiar to each country.

사막화방지(沙漠化防止) 및 방사기술개발(防沙技術開發)에 관한 연구(硏究)(I) - 중국(中國)의 사막화현황(沙漠化現況) 및 방지대책(防止對策) - (Studies on the Desertification Combating and Sand Industry Development(I) - Present Status and Countermeasures for the Combating Desertification in China -)

  • The purposes of this study were to investigate and understand the present status of various types of "deserts", such as sand desert, gravel desert, rock desert, earth desert, salt desert, desert, rocky desert, gobi desert, sandy desert, clay desert, etc., and the general countermeasures for the combating "desertification" "desertization", and to develop the technologies on the revegetation and restoration for the combating desertification in China. The methods of this study were mainly composed of field surveys on the several experimental sites and research institutes related to combating desertification in China, and examinations on the various technologies for the combating desertification at the Daxing Experimental Station of Beijing Forestry University. The conclusion from this study may be summarized as follows; 1. Status and tendency of desertification in China : China is one of the countries seriously threatened by desertification. Desertification affected areas in China are mainly distributed in arid, semi-arid and dry sub-humid areas in China, covering the most regions of the Northeast China (eastern region of Inner-Mongolia), the northern part of the North China (middle and western region of Inner-Mongolia, Shaanxi, Ningsha, Gansu) and the western part of the Northwest China (Xinzang, Qinghai, Xizang). The total area affected by desertification in China is approximately 2.622 million $km^2$. It covers 27.3% of the total territory of China. Until recently, it is estimated that the annual spreading ratio of desertification in China is 2,460 $km^2$. Therefore, desertification is mostly serious problems facing to the Chinese people. 2. The causes and environmental effect of desertification : The desertification in China is mainly caused by compound factors, including natural condition and human activities. In China, the desertification is started by the decrease of precipitation, continuous dry and drought, strong wind, wind and water erosion, land degradation and loss of natural vegetation caused by climate variation, and accelerated by the human activities, such as over-cultivating, over-grazing, over-cutting of woods, irrational use of water resources. Because desertification has affected the geographical features, soil nutrients contents, salinity, vegetation coverage and the functions of ecosystem, the environmental deteriorations in the desertification affected areas are very seriously. 3. The fundamental strategies of combating desertification in China are the increase of education and awareness of people through various mass media, the revision of laws to guarantee operation of Desertification Combating Law and to improve many relating laws and regulations, the application of advanced technologies and training of experts, the establishment of discriminative policies, and increasing arrangement of budget-investment, and so on. China, as a signed country in UNCCD, has made efforts for the combating desertification. Korea is also signed country in UNCCD, so we should play an important role in the desertification combating projects of China for the northest asia and global environmental conservation as well as environmental conservation of Korea.

FTA하에서의 사적 상사분쟁의 해결 (Settlement of Private Commercial Disputes under the FTA)

  • This age is called the age of global trade, and the World Trade Organization is a forerunner in promoting the global free trade through multilateral negotiations as the global level. On the other hand, regional economic cooperation such as North American Free Trade Agreement(NAFTA) is appearing, saying that promotion by WTO takes too much time. As is known to everybody, Europe is on the way of integrating member states through EU not to mention economic cooperation. Even in Asia such tendency is shown through ASEAN, Korea, China and Japan in Northeast Asia share geographical proximity, many common historical experiences, and similar cultural norms and values although they have disparities in stages of development, trade and economic policies, and financial and legal frameworks. Under the situation, efforts have been made between three countries of Korea, China and Japan for the conclusion of investment agreements including FTA. If the conclusion of the FTA between the three countries would be realized, it would promote regional trade and investment, contributing to economic growth in the Northeast Asian region. The writer in this paper reviewed the settlement of private commercial dispute including investment dispute arising from the FTA and investment agreements. The investment dispute is quite different from an ordinary commercial dispute arising from commercial transactions in view of disputing parties, applicable laws and rules, etc. Therefore it is a problem of vital importance that the parties interested in investment under the FTA as well as the relevant investment agreement should understand and cope with the settlement mechanism of investment disputes arising therefrom. The ICSID Convention provides facilities for the conciliation and arbitration of disputes between member countries and investors who qualify as nationals of other member countries. All contracting states of the ICSID Convention are required by the Convention to recognize and enforce the ICSID arbitral awards. The New York Convention(formally called "United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards") is also applicable for the enforcement of arbitral awards to be rendered under the FTA. As to applicable rules, the UNCITRAL Arbitration Rules may be required for the settlement of investment disputes under the FTA. This Rules has adopted by the internationally recognized arbitral organizations although it was developed primarily for use in ad hoc arbitration. The promotion of arbitral cooperation may be realized through agreements between arbitral institutions. Especially under the NAPTA system, a central common system was established to resolve jointly private commercial disputes arising from such free trades by the initiative of arbitral organizations among the member countries. It is called Commercial Arbitration and Mediation Center for the Americas(CAMCA), which may be a good example for the settlement promotion of the private commercial disputes between Korea and other relevant countries.

국내·외 라돈 관련 제도 비교를 통한 산업안전보건법 개선방안 (Improvement of the Occupational Safety and Health Act by the Comparison of the Domestic and Foreign Radon-related Policies)

  • Objectives: Concerns have been raised about the possible health effects of radon on both workers and consumers with the spread of social attention to the impact of radon exposure. Thus, an entire raw material handling workshop was investigated, and standards for radon levels in the workplace were newly established at 600 Bq/m3. However, regulations on the management of workers exposed to radon are still insufficiently developed. Therefore, by comparative analysis of overseas and domestic radon-related regulations for workplaces, this study aims to suggest improvement plans of protection regulations under the Occupational Safety and Health Act (OSH Act) for the prevention of health disorders of radon-exposed workers. Methods: For overseas case studies, we consulted radon-related laws and reports officially published on the websites of the European Union (EU), the United States (U.S.) and the United Kingdom (UK) government agencies. Domestic law studies were conducted mainly on the Act on Protective Action Guidelines against Radiation in the Natural Environment and the OSH Act. Results: In Europe, the basic safety standards for protection against risks arising from radon (Council Directive 2013/59/EURATOM of 5 December 2013) was established by the EU. They recommend that the Member States manage radon level in workplaces based on this criterion. In the U.S., the standards for workplaces are controlled by the Occupational Safety and Health Administration (OSHA) and the Mine Safety and Health Administration (MSHA). Action on radon in the UK is specified in "Radon in the workplace" published by the Health and Safety Executive (HSE). Conclusions: The Act on Protective Action Guidelines against Radiation in the Natural Environment mainly refers to the management of workplaces that use or handle raw materials but does not have any provisions in terms of protecting naturally exposed workers. In the OSH Act, it is necessary to define whether radon is included in radiation for that reason that its current regulations have limitations in ensuring the safety workers who may be exposed to naturally occurring radon. The management standards are needed for workplaces that do not directly deal with radon but are likely to be exposed to radon. We propose that this could be specified in the regulations for the prevention of health damage caused by radiation, not in Article 125 of the OSH Act.

Post-2020 국가 보호지역 시스템 관리를 위한 기타 효과적인 지역 기반 보전 수단(OECMs) 후보지역 유형 검토 (Reviewing the Candidate Types for Other Effective Area-based Conservation Measures for Post-2020 Management Related to National Protected Areas System)

  • This study aims to systematically review the candidate types for OECMs suitable for domestic conditions in areas related to the Korea Forest Service in order to achieve the goal of establishing the protected areas and OECMs system required by Post-2020 GBF, and to provide basic data for the establishment of the national protected areas system. As a result of the study, the selection criteria for OECMs were presented, and it was found that arboretums·botanical gardens, Natural Recreation Forests, and air holes may correspond to the Candidate Types for OECMs. As a result of evaluating the possible areas for OECMs based on the OECMs selection criteria, in the case of arboretums·botanical gardens, it is judged that only conservation areas can be designated as OECMs, except for areas mainly used by visitors of arboretums·botanical gardens that fall under the BGCI conservation type among national and public arboretums·botanical gardens. However, private and school arboretums·botanical gardens have personal property ownership, so it was judged to have no effective measures to control activities that may adversely affect biodiversity, which showed limitations in designation of OECMs. Natural Recreation Forests was found to meet the OECMs selection criteria. However, private forests have personal property ownership, which limits the designation of OECMs. Therefore, it is necessary to strengthen the function of in-situ conservation in order to meet the OECMs for private and school arboretums·botanical gardens, and private forests that have personal property ownership. To this end, effective measures are needed to achieve biodiversity conservation outcomes, and it is judged that legal control and corresponding support policies (incentives) are needed. In the case of air holes, for sustainable conservation, the management boundary of air holes should be clearly defined based on the preparation of laws and guidelines related to air holes. In addition, it is judged that it is desirable to designate the competent local forest office as the management authority and conduct periodic detailed surveys of air holes, establish and implement the conservation plans based on those.

  • 프랜차이징은 창업 촉진, 고용 창출 및 경제발전 측면에서 매우 효과적인 전략으로 세계 각국은 관련 법규 마련 및 발전 계획 수립을 통해 프랜차이즈 산업을 육성, 지원하고 있다. 베트남은 2005년 6월 프랜차이즈 관련 법규를 마련하고, 2009년 WTO 가입으로 프랜차이즈 분야 100% 외국인 단독투자를 허용하여 프랜차이즈 산업 활성화 기반을 확대하였다. 아울러 베트남은 경제발전에 따른 소득증가, 서구식 생활패턴의 확산 등으로 프랜차이즈 산업이 급속히 발전되고 있고, 많은 글로벌 프랜차이즈 기업들이 앞 다투어 진출하고 있는 유망시장이나, 지금까지 베트남 프랜차이즈 시장 진출과 관련된 국내의 연구는 전무한 실정이다. 따라서 본 연구에서는 베트남에 성공적으로 진출한 국내외 기업들의 사례 분석을 통해 베트남에 진출하려는 우리의 후발 기업들에게 효과적 진출 전략과 성공 요인을 제시하고자 한다. 연구결과, 베트남 시장에 성공적으로 정착한 기업들은 각자의 기업 특성과 강점에 맞는 마케팅 전략을 전개하였으며, 공통적인 핵심 성공 요인들은 1) 선발주자이점의 최대한 활용, 2) 과학적 시장조사를 통한 현지화, 3) 철저한 위생 안전 관리, 4) 선직영, 후가맹 전략, 5) 타국에서의 성공, 실패 경험 벤치마킹 등으로 나타났다.

드론 기반 스마트 방재 방안 연구 (Drone-based smart quarantine performance research)

  • 본 연구의 목적은 드론 기반 스마트 방역 연구로서 드론을 방재 분야에 활용을 통한 대응방안과 기대효과를 연구하는 것이다. 현행 방재업무의 문제점에 대한 검토와 이에 따른 대응안을 환경적, 시장적, 기술적 접근으로 살펴보면 다음과 같다. 첫째로 환경적 측면에서 드론 기반 관제를 활용한 방재업무의 활용 효과는 산림, 조류인플루엔자, 가축, 시설지역, 모기 유충, 해충 등 광범위한 활용과 AI 및 콜레라 등 각종 방역업무 단순화 및 효과적 방역체계 제공 할 수 있다. 둘째, 시장적 측면에서 방역방법의 신기술 도입을 통한 국내 표준화 드론을 활용한 소독방역 임무 활용에 따른 축산·가축 방역 관련 법령, 행정규칙의 기준마련, 관련 산업의 동반성장과 신시장 발굴, 가축 질병 방역에 투입되는 연간 예산 절감의 효과를 가져온다. 셋째, 기술적 측면은 (1) 새로운 가축 질병 방역형태인 다중드론 활용 소독 방역의 현장적용, (2) 드론 산업 소프트웨어 분야의 혁신, (3) 다양한 시장에 적용 가능한 드론 관제/제어 통합시스템으로 산업 다변화, (4) 빅데이터 드론 이동로 3차원 공간정보 분석 정밀 드론 교통정보제공으로 안전성 높은 비행 보장, (5) 다수의 드론 동시 자동 임무 비행이 가능하여 저비용 고효율 시스템 보급 실현, (6) 고도의 정밀 비행기술 불필요에 따른 분야별 드론 이용자 증가로 고찰되었다. 본 연구는 문헌 조사와 전문가의 의견을 기반으로 작성되어 향후 연구 분야는 드론 기반 서비스에 대한 실증적 자료를 기반으로 그 효과에 대해 입증하는 작업이 필요하다. 본 연구의 기대효과는 드론을 방재업무에 적극적 활용 지원 또는 이와 관련된 정책을 수립하는데 이바지 한다.

세계유산 황산의 보호관리 특성 및 보전방안 (A Protection Management Characteristic and Preservation Plan of World Heritage Mt. Huangshan)

  • 본 연구는 국내 자연 및 복합유산의 지속적인 보호관리 정책 마련을 위한 기초자료 구축에 목적이 있으며, 세계복합유산으로 등재된 황산을 대상으로 세계유산협약에 따른 보호관리 현황 및 그 특성을 살펴보고 지속적 보전 가운데 활용 방안을 모색해 보고자 하였다. 이에 황산 관련 보호관리 법령 및 제도, 경계 설정, 정책의 변화와 특성을 살펴본 결과는 다음과 같다. 첫째, 황산은 1933년 황산 건설 위원회 성립을 시작으로 보호관리가 시작되었으며, 1982년 국가급 풍경명승구 지정 이후 중앙부처에서의 법률 제정, 지방정부의 조례를 통해 보호관리의 근거가 마련되면서 보호관리 및 활용과 관련한 다양한 사업들이 시행되었다. 둘째, 보호를 위한 경계의 설정은 행정구역 계획을 통해 황산의 경계를 재정비 하는 등 중앙정부의 적극적 개입이 이루어졌으며, 황산 일대 생태적, 경관적 가치뿐만 아니라 문화적 요소의 보호를 위해 풍경명승구 및 세계유산 지정구역 선정 등 보호구역을 설정하였다. 셋째, 황산의 보호관리 양상은 크게 네 가지 시기로 구분되었다. 제1기는 황산의 보호관리를 위한 행정조치가 시작된 시기로 구분하였으며, 제2기는 황산이 국가급 풍경명승구로 지정되면서 법령 및 관리계획이 시행되었다. 3기는 세계유산 등재 이후 국제기구의 권고사항에 따른 보호 중심의 사업이 이루어진 시기였으며, 제4기는 황산시의 지속적 보호 가운데 활용을 위한 관광산업 확대 이후 오늘날까지 유산을 중심으로 한 지역 활성화 정책과 지정구역 내 보전사업이 시행되고 있었다. 넷째, 황산의 보호관리 주체는 중앙정부와 성시정부로 이원화되어 있으며, 복합유산인 황산은 문화유산 관리부처와 자연유산 관리부처가 공동으로 관리하고 있다. 황산의 보호관리는 행정단위별 관리체계 구축을 통해 유산 관련 업무의 효율성과 전문성을 도모하였으며, 현단위 이상 지방정부가 지역 특성에 맞는 보호관리 정책을 시행하도록 권한을 위임받았다. 다섯째, 오늘날 황산은 산정을 중심으로 하는 개발정책으로 보호구역이 파괴되었다. 또한 난립하는 숙박시설 운영에 따라 오수와 쓰레기 방류, 관광객에 의한 환경오염이 문제점으로 제기되고 있으며, 주변지역에 식재된 인공림에서 발생하는 병충해 피해와 케이블카 조성에 따른 생태계의 변화가 나타났다. 여섯째, 황산의 지속적 보호를 위해서는 숙박시설에 대한 신축 증축, 관리에 대한 엄격한 규제가 요구되며, 관람객 수용인원 제한 및 통제를 위한 시설물의 설치가 필요하다.

중국과 베트남의 문화유산 특성 비교 연구 (A Comparative Study on the Characteristics of Cultural Heritage in China and Vietnam)

  • 본 연구는 역사상 상호 지정학적·문화적 영향관계 속에서 발전해 온 중국과 베트남의 문화유산 특성을 비교한 결과 다음과 같은 결론을 얻었다. 첫째, 중국과 베트남의 문화유산 정의는 양국이 유사한 의미를 지닌다. 문화유산 분류의 경우 양국 모두 무형문화유산의 법적 개념을 유네스코를 통해 본격적으로 도입하게 되면서, 무형문화유산 진흥정책 측면에서 유사성을 지니고 있다. 둘째, 중국은 유형문화유산과 무형문화유산을 관리하는 법이 각각 따로 존재하는 반면, 베트남은 두 유형의 문화유산을 단일 법령에 의해 통합적으로 관리하고 있다. 베트남은 중국에 비해 문화유산 개념의 도입은 늦은 면이 있지만, 체계적인 측면에서는 높은 통합성을 보이고 있다. 셋째, 중국과 베트남의 유산은 모두 등급화가 나타나며, 이는 유산의 유형에 따라 다르게 적용된다. 지정방식은 양국이 수직적 구조를 가지고 단계를 높여가는 유사성을 지니고 있다. 이러한 단계적 검토를 통한 유산의 가치 복원 및 완전성의 보완으로 관광을 통한 유산 향유, 경제적 효과 창출을 통한 전국의 균형적 발전을 꾀하고 있다. 넷째, 문화유산 관리기구는 양국 모두 중앙정부의 관리기관이 존재하지만, 중국의 경우 베트남에 비해 지방정부의 권한이 높은 것으로 확인되었다. 또한, 유형문화유산과 무형문화유산을 통합적인 기관에서 관리하는 베트남과 달리 중국은 무형문화유산을 관장하는 기관이 별도로 존재하였다. 다섯째, 중국은 유산의 보호와 활용을 조화롭게 한 지속가능성에 초점을 맞추어 보존관리 정책을 수립하고 있다. 베트남은 협약의 내용과 정신을 문화유산, 특히 무형문화유산과 경제·사회 전반에 관련된 법률, 프로그램, 프로젝트에 통합하고 이를 발전시키기 위해 노력을 기울이고 있다. 그러나 아직은 선진국의 원조와 국제기구의 영향에 의존하고 있는 실정이다. 여섯째, 중국과 베트남은 유형문화유산 중심의 문화유산 보호정책에서 벗어나 현재는 근래 도입한 무형문화유산에 관심을 기울이고 있다. 또한, 문화유산을 통해 국민을 결집시키고 국가의 통일된 정책 목표를 달성하고자 한다. 양국은 무형문화유산을 지역 공동체나 지역을 보존하는 효율적 보존 수단으로 활용할 필요가 있다. 무형문화유산의 구성요소를 하나의 단위로 통합할 수 있는 각 주체별 문화유산 보존 네트워크를 구축하여 국민들의 향유 기반을 마련하여야 한다. 본 연구는 중국과 베트남의 문화유산 체제와 보존관리 현황에 주목해 비교한 연구의 단계로 한계를 지니며 유형별 문화유산 정책의 특성비교는 차후 연구과제로 남긴다.
