Overview of Alternate Dispute Resolution with Special Reference to Arbitration Laws in Pakistan

  • Arbitration is one of the prominent and widely practiced forms of Alternate Dispute Resolution. Different countries are strengthening their alternate dispute resolution mechanism, and focusing on arbitrations is a very important edge. Pakistan is in the phase of developing effective laws and policies to strengthen the process of arbitration. The Pakistan Arbitration Act of 1940 is very important to discuss and along with domestic laws the applicability of the international conventions must be discussed. This paper analyzed the situation of arbitration laws in Pakistan with respect to both the domestic laws and international laws applicable in the country.

A Comparative Analysis of Accommodation Sharing Legislation of Platform Businesses in South Korea and OECD Countries

  • Purpose: This study investigated the legal issues and policies on accommodation sharing based on qualitative research and examined how OECD societies establish laws and regulations to legalize accommodation sharing and prevent adverse effects. The purpose of this study is to contribute to the understanding of the different laws and regulations at both the country and city levels and to help better manage accommodation sharing in our society. The ultimate goal of this study is to enhance citizen understanding of platform businesses to minimize unnecessary conflicts. Research design, data and methodology: This study conducted a qualitative research by exploring laws and regulations in OECD countries. This study performed comparative analysis of accommodation sharing business' legislation, legal definitions, and operational policies that citizens should necessarily understand for better usage. Results: Local ordinances and regulations developed differently based on the situations of local markets and communities, so they are established and improved at the city or country level. Conclusions: Each government should consider preparing better policy on accommodation sharing by considering how to secure the housing market for residents with better establishment of new platform businesses and relationships with citizens. This study suggests policy reactions to government as policymakers, guests, hosts, platforms, and communities.

A Study on the Policies and Projects for the Creation of Areas for Close Contact with Nature in Japan (자연과의 접촉공간 조성에 관련된 일본의 시책.사업에 관한 연구)

  • Nowaday special attention is being paid to the conservation of all species or ecosystmes of sites for public projects. Many environmental conservation policies and projects in Japan emphasize the coexistence of man with nature and close contact with nature. The objectives of this study was to investigate policies and projects for the creation of areas for the close contact with nature in Japan, to characterize change of techniques for the space creation over times, and to classify those policies and projects implemented by many government agencies. This study was mainly carried out by literature survey of laws, policies and projects related to environmental conservation pertinent to national scale. Major findings of this study can be summarized as follows: First, two most significant turning points for the environmental conservation in Japan were the establishment of the Office of Environmental in 1971 and the enactment of many laws influenced by the awareness of global environmental problems since 1990. Second, polices and projects for the creation of areas for the close contact with nature started in 1960s by the Office of Forestry, and focused on planting and development of simple facilities in forests. And the conservation of natural environment, ecological restoration and the expansion of urban green spaces, and the creation of biotopes and other areas for the close contact with nature in urban areas were the major characteristics of environmental conservation in Japan during 1970s, 1980s, and 1990s, respectively.

Examining China's Internet Policies through a Bibliometric Approach

  • In order to understand China's internet governance, this paper examined 1,931 Internet policies of China by bibliometric techniques. Specifically, the bibliometric techniques include simple document counting, co-word analysis, collaboration network analysis and citation analysis. The findings include: (1) China's Internet legislations mainly emphasized e-commerce and Internet governance, and, to some extent, neglected personal data protection; (2) China's Internet is under intensive multiple regulatory controls by central government. A large number of government agencies are involved in Internet policy-making. The Propaganda Department of the Central Committee of the Communist Party of China and the State Information Leading Group of the State Council, enforced fewer policy documents, but occupy higher positions in the Internet governance hierarchy; (3) China's Internet legislation system is primarily composed of industry-specific administrative rules, rather than laws or administrative regulations. Nevertheless, laws and administrative regulations received significantly more citations owing to their superior force. This paper also discussed current gaps in China's internet governance and how the country's internet policies are situated in the broader global context.

  • This study proposed two improved models, depending on each central axis of local library policies, to improve the management of the metropolitan library committee which should play an important role in pursing the policies. The model of draft 1 suggested that the metropolitan library committees' library policy deliberative functions be reinforced for pursuing metropolitan library policies, around the department of library policy in each central office. The model of draft 2 suggested that the metropolitan library committees play a role in the policy governance, in pursuing the metropolitan representative libraries-based local library policies. In order to efficiently pursue the proposed improvements of the management of the metropolitan library committees, the functions of the metropolitan library committees and each status of the chairmen and the vice chairmen, which are stipulated by 「Library Act」 need to be elevated, according to the draft 2. Then a local laws and regulations (draft) was proposed to stipulate matters concerning the management of metropolitan library committees by metropolitan municipalities, based on the local laws and regulations.

A Comparative Study on Laws and Policies of Advanced Countries to Prevent Fall Accident (건설현장 추락재해 방지를 위한 해외 선진국간의 법령비교연구)

  • Although accidents in the domestic construction industry have been decreased gradually, deaths in the construction sites have been occupied 49.9 percent of the total industry and deaths from fall accident have been accounted for 59.7 percent of the construction industry. In order to prevent fall accident, Occupation Safety and Health Act(OSHA) was enacted for setting management standards and detailed regulations was designed by the Ministry of Employment and Labor. Although government has been pushed for companies and workers to comply the regulations, currently, many domestic construction sites have been violated. On the other hand, in safety-advanced countries such as the United States, Japan, and the EU, industrial accidents have been decreased due to continual application of adapted safety policies according to characteristic in each country. Therefore, it is necessary to analyze laws and polices of advanced countries and apply them to domestic construction sites in order to reduce fall accidents. Therefore, the objective of this study is to compare domestic laws related fall accident with advanced countries laws. In the future, the results of this study will be utilized as a reference to reinforce Occupation Safety and Health Act(OSHA).

A Study on the Recent Change in Korean Legislative System of Marine Environment Related Laws (최근 국내 해양환경법제도의 변화에 관한 고찰)

  • Korea actively endeavors to improve the national marine environmental laws and regulations. Along with the growing global concern on the importance of marine environment, the concern is also increasing nationwide in Korea. These institutional changes in Korea have implications in that it has started to internalize the Sustainable Development Principle and the Precautionary Principle in the form of 'law' and 'policy.' The enactment efforts for conservation and sustainable use of marine environment will continue as the legal demand of public for coastal erosion prevention and climate change mitigation increases. This calls for robust revision for more logical framework and coherence of marine environment laws and regulations as well as efficient implementation of policies. In addition, it is strongly required that the systematical research and survey as well as the robust reversion of laws and policies should be taken accordingly for the effective conservation of marine environment.

A Study on the Improvement of Working Conditions and Win-Win Support for Franchisees (프랜차이즈 가맹점의 노동조건 개선 및 상생지원 방안)

  • Purpose: The Korean franchise market has undergone drastic growth in recent years. Followed by expansion of franchise business types, relevant legal matters have diversified. Compared to conventional economic laws that focused on resolving problems related to unfair transactions between franchisors and franchisees, more diverse labor laws have emerged recently due to governance and economic dependencies of franchise structure. However, it was found that the business environment of franchisees and working conditions of franchisee employees have not changed accordingly due to the unique structure of franchise business. Though franchisees are entrepreneurs independent from franchisors, they are still under franchising contract with the franchisors. For instance, employees of franchisees have been exposed to malpractices in regard to pay, time, and other working conditions. These malpractices may show the ineffectiveness of current labor laws. Labor management is an important issue for sustainability of franchise businesses. Negative publicity of franchises generated from violating relevant labor laws may have significant negative impact on overall image of franchised brands. However, franchisors should not hold franchisees fully responsible for legal violations in terms of labor management but strive to prevent relevant risks. Thus, the recent amendment in labor law related to increased minimum wage and reduced worktime have called for more attention to effectively implementing the law. Research design, data, and methodology: This study was conducted through a review of franchise-related laws and various institutions and policies. Results: It is further needed for all parties, including franchisors, franchisees, and franchisee employees, to take collaborative actions to improve working conditions of franchisees. Therefore, this study aims to propose appropriate and effective response plans toward recent changes in the Minimum Wage Act, while strengthening sustainability of franchisors, franchisees, and their employees. Conclusions: The proposal mainly contains plans regarding profit-related aids and profit sharing/cost reduction strategies for franchisees, as well as collective bargaining in the franchisor-franchisee relation. More detailed suggestions are included. Conclusions: This proposal may help franchisors and policymakers develop business plans and policies in improving business conditions of franchisees and working conditions of franchisee employees.
