An Analysis of WTO Disputes in Aircraft Manufacturing Industry (항공기 제조산업 관련 WTO 분쟁사례 분석)

  • In order to promote the domestic aircraft manufacturing industry, this study analyzed the limitations of the preceding study on the WTO dispute concerning civil aircraft by summarizing the latest developments and issues in the mid-range aircraft dispute between Brazil and Canada and the large civil aircraft dispute between the United States and the EU. Based on the results of the study, we should look closely at WTO regulations and existing cases of disputes to find maximum support measures, and we believe that in order to stimulate the domestic aircraft manufacturing industry, we should refrain from publicly specifying support measures in the data, such as laws and policies, utilize the WTO SCM Agreement exceptions, and strengthen links with international cooperation and other industries.

Current Status for Resources Recycling in Korea (자원리싸이클링의 현황과 전망)

  • In order to prospect current recycling status in Korea, legislative system and policies relating to recycling, wastes generation and recycling rate were reviewed. Approximately 260,400 ton/day of wastes was generated in 2001. 48,400 ton/day of household waste and 212,000 ton/day of industrial waste. During the last ten years, waste management laws such as waste disposal law, recycling law and environment friendly industry law were prepared. In this article, concerning over waste generation and recycling, recycling law, Extended Producer Responsibility System and the problems and technological developments associated with recycling were summarized.

Theoretical Overview of Housing Welfare and Future Policy Issues (주거복지에 대한 이론적 개관 및 향후 정책과제)

  • The purposes of this study are to define 'housing welfare' which constitutes an important theme of discussion today and to present some future policy issues. Recently, the expression 'housing welfare' is widely used in our daily life and written in some laws, but its concept is still ambiguous. Housing welfare can be defined as 'the situation in which citizens gain access to a decent housing and adapt themselves well to the community life. In this context, the goals of housing welfare policy should be as follows: reduction of the number of households living below the minimum standard in housing, promotion of the right to housing, housing provision and management based on housing needs, linkage of housing and other welfare measures, realization of social integration and social justice. But, there are still some controversies on such questions as target group, moral hazard of beneficiaries, social equity, etc. To get all the policy alternatives more effective, efforts should be made to improve the general infrastructure of welfare policies, to prevent NIMBY phenomenon of local actors, and so on.

  • A cultural classification and a culture contents industrial classification are the basic tools for cultural policies, cultural supporting, cultural statistics, and evaluations and there is a cyclic processes among them. This study finds out the varieties and short time changes of cultural categorization in laws, statistics, indexes, evaluations, research reports. As a result, colon style new cultural classification is suggested which used networks, media, genre, and cultural comparts as principles.

  • This paper presents the system dynamics methodology for modeling and control the production/inventory system. Under system dynamics point of view, we can apply some production/inventory policies as if we use the control laws for dynamics systems, then the behavior of system is analyzed and evaluated to improve the performance of production/inventory system. We also utilize the hybrid modeling method for the dynamic of production system with the combination of Matlab/Simulink and Matlab/Sateflow. Finally, the numerical simulation results are carried out in Matlab/Simulink environment and compare with the results from other works. It is shown that our approach can obtain some good performances (such as operational cost, stability of inventory, customer service level).

  • Apartments, which are typical residential spaces, are reconstructed or remodeled according to aging. However, reconstruction or remodeling of apartment complexes or an individual building requires following relevant laws and policies and requires a lot of time. Therefore, there are cases where apartment residents choose remodeling that improves the living environment by renovating only the interior of their household. In order to improve the interior space of an apartment, various materials such as windows, toilets, walls, and floors are replaced, and lots of matters must be considered in this process. Several problems arise in the process of selecting a remodeling company and carrying out construction, and the problem must be resolved through owner's decision-making. This study analyzes the problems through the case of apartment interior remodeling and suggests ways to improve them.

  • The present study aims to develop an agenda consisted of strategies for long-term preservation of electronic records with enduring values. To do this, it has collected 19 cases of agenda reports generated from the digital preservation community at large, including those working on electronic publications and research data as well as electronic records. The study draws its conclusion by proposing an agenda encompassing 4 areas: laws and policies; research; technologies; and partnership.

  • As growth engines such as cloud, social networks, big data that can affect the security market have been grown, the information security industry has has also rapidly evolved. Reviewing information security policies carried out in USA, UK and Japan, this paper examines trends on the IoT-related information protection law and regulations that are at issue around the major developed countries. Through this research, we can get the implication that measures be taken as soon as possible to apply the existing data protection laws in the Internet of Things.

  • The revision of domestic laws is in progress according to the UN Convention on the Law of the Coastal Zone Management . Along with it, the governmental policies related to maritime environmental preservation, especially around coastal zones and public works have been promoted based on enviornment, swiftly changed from the old function-based style. Therefore, this report will point out the important aspects which should be considered whenever there is any project on the coastal zones, suggest and classify projects of reviving the nationwide coastal zones, and show how to planning , check and evaluate the necessary technologies for reviving the coastal zones. This research will track down the coastal zone management method based on the natural enviornment as one of the necessary process to check the coastal zone enviornment for effective operating of the coastal zone management equipment method, starting on August 9, 1999, and report the technologies related with it.

The Disputes of FTA Preferential Duty Treatment : The Implications of the U.S Customs Case Laws (한·미FTA 특혜관세분쟁을 대비한 미국판례의 동향과 함의)

  • Papers in FTA research have mostly focused on the legal interpretation of the FTA treaties. In this research, more focus was put on the customs laws and related cases delivered in the U.S. federal courts, by which we can analyze the Korea-U.S. FTA in more practical manner to derive the enterprises' solutions to cope with the disputes of FTA preferential duty. The Tariff Act of 1930 is the U.S. customs law to govern FTA preferential duties. The administrative practices with customs duties are coordinated with the FTA rules. The most controversial issue in the U.S. customs law lies in the classification of imported goods for imposition of the customs duties, based on Harmonized Tariff Schedule of the United States. It was found that the U.S. federal courts had been quite favorable to the CBP(U.S. Customs and Border Protections) in litigation with the private importers and exporters. The reason seems to be that the CBP has been dealing with the customs cases so many times, accumulating much experience in execution of the U.S. customs laws, which is likely to make their decisions on customs duties almost free of errors. Therefore, the Korean exporters need to collect the CBP's past cases on the denial of preferential treatment on imported goods and be fully informed of the CBP's policies on the FTA preferential duty treatment.
