Mongolian government enacted the Foreign Trade Arbitration Law to modernize the practice of commercial arbitration. Nevertheless, the Foreign Trade Arbitration Trade Law fell short on a number of fronts and arbitration itself remained a distant second option to litigation within Mongolia. Law on Arbitration of 2003 aimed to modernize the Mongolian arbitration framework so that it would mirror the UNCITRAL Model Law on International Commercial Arbitration. At the same time, the Law on Arbitration 2003 made a conscious decision to deviate from international norms with respect to certain aspects in order to accommodate for the unique circumstances and characteristics of Mongolia. For example, unlike its UNCITRAL counterpart, the Law on Arbitration of 2003 did not include an exhaustive list of grounds for refusing the recognition and enforcement of arbitral awards. In that sense, the Law on Arbitration of 2003 was a resounding success and a drastic improvement on the Foreign Trade Arbitration Law. These factors convinced the Mongolian government to once again revise its arbitration law. This process, which started in 2008 with the help of foreign law firms and institutions, ultimately culminated in the Law of Arbitration of 2017. The chief objective of the Law of Arbitration of 2017 was to more closely adhere to preexisting international norms on arbitration such as the Model Law on International Commercial Arbitration, and there is no question that Mongolia has succeeded in doing so. This article thus concludes by explaining some of the noteworthy improvements made by the 2017 revisions, and by noting that Mongolia is now equipped with a truly international legal framework for arbitration.

In order to establish order in fishing industry by cracking down on illegal fishing vessels effectively, it is an essential requirement to identify marking such as the name of fishing vessel and a port of register more easily. Accordingly, it is quite natural that markings on fishing vessels should be marked clearly in an appropriate size on an appropriate site in order for them to be distinguished on the air such as from planes as well as on the sea. Actually, when examining marks such as the name of a vessel which are operating in the country, marks of most fishing vessels are too small as they cannot be distinguished with the naked eye even very closely. There is no coastal fishing vessel which marks the name of fishing vessel on the upper part in order to distinguish it from planes. Fishing vessel law generally which regulates the basic laws about shipbuilding regulates marks on fishing vessel, and fisheries law only regulates sign boards of fishing vessels. Problems and improvement of the marking system on fishing vessels suggested by this paper are as follows. First, in order to contribute to establish order in fishing industry, it would be desirable to tighten standards in fisheries law besides the fishing vessel law. Second, it is difficult to distinguish marks such as the name of a vessel as relevant laws allow fishers to make such marks too small. It is necessary to set the standard for marks larger than those regulated by the international treaty. Third, the relevant laws do not regulate a letter form of marks. Therefore, it becomes a factor to make small marks hard to be distinguished more. It is necessary to decide a clear letter form. Fourth, there is insufficient detailed international standards about the marking system. It is necessary to regulate a detailed standard.
In this paper, we look at the relationship between international trade and the rule of law, using the World Justice Project Rule of Law Index, which include index figures on human rights, limits on government powers, transparency and regulatory efficiency. Based on regression analyses using the rule of law index figures and international trade figures (merchandise trade, service trade, exports and imports as percentage of GDP,) international trade and basic human rights seem to have little relationship; but trade has a close positive relationship with strong order and security. Somewhat surprisingly, regulatory transparency and effective implementation seems to have little or no effect on international trade and vice versa. International trade shows a clear positive relationship with the country's criminal justice system, but the relationship with the civil justice system is not as clear as such. For regulatory implementation and civil justice, services trade positively affect these institutions, but these institutions in turn affect exports more strongly than services trade. Finally, the effect of trade on rule of law is stronger on a medium to long term (10-20 year) time horizon.
This study is a thesis of the relationship between mother-in-law and daughter-in-law in a family based on the Korean family system. This is done by analysing how the traditional social system and the style of living are reflected in korean folk songs. This I believe is a necessity in order to understand the emotions and ideas of the word 'family' of Korea and to improve the state of the relations between mother-in-law and her daughter-in-law. I have divided this into 4 essential study points. First the family system illustrated in korean folk songs are mainly father centered family system. It caused a male-oriented society and women's subordination. Second, the relationship between mother-in-law and her daughter-in-law illustrated in folk songs are mostly vertical subordinate. This is easily described as a lord and servant relationship. Third the state of relationship reflected in the folk songs from a daughter-in-law's point of view is obedience to her husband's family nostal ia to her family desperation and opposition. Lastly the state of relationship from mother in law's point of view are discord cruel treatment the rule and power which herself carry.

The Maritime Traffic Safety Law of P. R. China has not the legal nature of navigation rule which regulates the vessel traffic directly but has the legal nature of management to ensure the safety and good order of the whale marine traffic. For that reason, the legal status of this Law is a general basic norm for the marine safety regulations rather than a definite enforcement regulation. This Law does not have any clear statements on adaptation of the steering and sailing rules of the International Regulations for Preventing Collisions at Sea, but it can be presumed the Convention would be applied on the viewpoint of the international practice. The subject matter of this Law is easily understandable, because the IMO and shipping countries have already made similar legislation. Since the maritime traffic condition of the P. R. China also has a direct effect upon the Korean coastal waters, it is essential to observe closely the process of enforcement and development of the P. R. China's Maritime Traffic Safety Law.
Interim measures by an arbitral tribunal aim to protect the parties' rights before or during arbitral proceedings for avoiding frustration of the final award in international commercial disputes. Even though decisions of the interim measure are expected to be performed by parties directly during the arbitral processing, it is not easy to be provided by the arbitral tribunals cause of lack the power to enforce their decisions directly against the parties. Particular court supports mechanism for enforcement directly to assistance to arbitral tribunal's decisions. Decisions on interim measures are provisional. Even though the arbitration is ongoing to request interim measure directly to the arbitral tribunal, relevant courts are able to ensure effective relief cause by the difficulty of limited rights of the arbitral tribunal. In this time both revised Korean Arbitration Act in 2016 and UNCITRAL 2006 revised Model Law are complemented to attach articles for recognition and enforcement of interim measures by arbitral tribunal during the arbitration processing. It could be possible to enforcement of decisions of interim measures by arbitral tribunal on the revised arbitration law. In this paper it is considered the problems and alternatives on related applicable articles and articles of recognition and enforcement for the interim measures by arbitral tribunal under the revised UNCITRAL Model law and Korean Arbitration Act.
This essay aims to explore Herman Melville's recognition and resolution of the vicious link between law and violence in his posthumous Billy Budd, Sailor (1924). In order to investigate the issues, this essay refers to Freud, Benjamin, Derrida, Lacan, and Žižek, all perceptive to the uncanny affinity of law and violence. Especially, Žižek's arguments of "superego" as an embodiment of cruel and destructive violence supplementing the official law and of "love" as an ethical possibility beyond the limit of the problematic law are introduced in this study to make Melville's reflection of the inseparableness between law and violence much clearer. John Claggart and Captain Vere embody the legal (superegoic) violence. Claggart even procurs secret enjoyment, in the name of maintaining positive law. Billy Budd discloses another violence defending his justness according to natural law. However, Melville suggests the possibility of suspending the problematic tie of law/violence through "love," as portrayed at the last part of the story. The two final words from Billy and Vere, as a sort of delayed dialogue between them after the event of their secret interview before Billy's hanging, suggest that they finally distance from the obscene nightly law of superego-respectively from outward punitiveness toward Vere and from inward punishment for Vere's excessive enforcement of Billy's hanging-and identify each other's lack as their own. Their love implicated in the last words is for the real other-in Lacan's sense-who discloses the constitutive lack or incompleteness of beings and aporia of the law. This essay's examination of Melville's representations about the superegoic violence as the (im-)possible condition of law and the possibility of withdrawing from it would help us recognize Billy Budd, Sailor as the author's own last word for the possible vision of love cutting the vicious knot of law/violence.
In this study, the fuzzy approximator and sliding mode control (SMC) scheme are considered. An adaptive sliding mode control is proposed based on the SMC theory. This proposed control scheme is that a adaptive law is utilized to approximate the unknown function f by fuzzy logic system in designing the sliding mode controller for the nonlinear system. In order to reduce the approximation errors, the differences of nonlinear function and fuzzy approximator, an adaptive law is also intoduced and the stability of proposed control scheme are proven with simple adaptive law and roburst adaptive law. This proposed control scheme is applied to a single link robot arm.
The in-law relationship traditionally plays a major role in Korean marriages and families because parents-in-law prefer to stay with their son under the same roof. The recent spike in the number of intercultural matches in South Korea may be provoking changes in the traditional family experience. The object of this qualitative study was to explore the contextual factors causing conflicts between mothers-in-law and their daughters-in-law in multicultural families. Six mother and daughter in-law dyads from rural areas of South Korea were recruited and interviewed. We found that the mothers-in-law and daughters-in-law had had different motives for the marriage at first. Five major themes emerged from the analysis of the dyadic interviews: the conflicts of the participants were embedded in the alternative family formation, in financial strains and the power structure, barriers in communication, cultural insensitivity and conflicts between value systems, as well as in role conflicts due to differing role expectations and hegemony. In conclusion, the authors of this study suggest that increasing cultural sensitivity and communication skills in immigrant daughter-in-law an Korean mother-in-law relationships will be crucial for a healthy in-law relationship. The need for the availability of Multicultural Family Centers' services in the community was highlighted. In order for mothers-in-law and daughters-in-law to form positive relationships, it is important to facilitate a variety of easily accessible educational programs in the community focusing on fostering the mother-in-law's understanding of the daughter-in-law's perspective.
From the field survey of the main ethnic minority areas in the south China, it is found that political, economic, cultural and natural environmental changes are the main reasons leading to the change of customary law. The power mechanism of the customary law change include the three aspects, such as the promotion of country elite, the dominance of grassroots government, and the daily demands of the villagers, which promote the change of customary law alone or together. Through the application of customary law, the country elites can adjust and refine the rules of customary law in order to make out the new customary law and promote its development. In the current pattern of rural governance, grassroots self-government is actually the "official supervision of people's autonomy". The executive power of the grassroots government often intervene the practice of customary law and other informal rules. This is another mechanism of customary law change. Customary law arises from the practice of the daily life of the villagers. If the villagers think that the norms of customary law cannot meet the actual needs of daily life practice, the customary law will be promoted in the form of collective consultation. This is the most important dynamic practice mechanism of customary law change. Transformation and abandonment are the two ways to change customary law. No matter what kind of change does not lead to the demise of the customary law system, the demise of the customary law is only an outdated result, which is made by the universality, nature and objectivity of customary law. The procedure of customary law change is the process of continuation and rebirth about customary law. The result of the change is to produce the new customary law of keeping pace with the times, and the customary law will be presented with new content and form after the change. The continuation of customary law means the inheritance of traditional customary law, but it is based on the transformation of traditional customary law. The rebirth of customary law means that the traditional customary law is completely discarded. But it will produce new customary law rules and be based on the needs of social life practice. Customary law occupies a pivotal position in the normative system and the national law cannot be replaced. The purpose of customary law change will let the customary rules better adapt to the development of modern society, adjust the social relations more reasonably and better meet people's needs of production and life, which is decided by the character of customary law.
