FTA하에서의 사적 상사분쟁의 해결 (Settlement of Private Commercial Disputes under the FTA)

  • This age is called the age of global trade, and the World Trade Organization is a forerunner in promoting the global free trade through multilateral negotiations as the global level. On the other hand, regional economic cooperation such as North American Free Trade Agreement(NAFTA) is appearing, saying that promotion by WTO takes too much time. As is known to everybody, Europe is on the way of integrating member states through EU not to mention economic cooperation. Even in Asia such tendency is shown through ASEAN, Korea, China and Japan in Northeast Asia share geographical proximity, many common historical experiences, and similar cultural norms and values although they have disparities in stages of development, trade and economic policies, and financial and legal frameworks. Under the situation, efforts have been made between three countries of Korea, China and Japan for the conclusion of investment agreements including FTA. If the conclusion of the FTA between the three countries would be realized, it would promote regional trade and investment, contributing to economic growth in the Northeast Asian region. The writer in this paper reviewed the settlement of private commercial dispute including investment dispute arising from the FTA and investment agreements. The investment dispute is quite different from an ordinary commercial dispute arising from commercial transactions in view of disputing parties, applicable laws and rules, etc. Therefore it is a problem of vital importance that the parties interested in investment under the FTA as well as the relevant investment agreement should understand and cope with the settlement mechanism of investment disputes arising therefrom. The ICSID Convention provides facilities for the conciliation and arbitration of disputes between member countries and investors who qualify as nationals of other member countries. All contracting states of the ICSID Convention are required by the Convention to recognize and enforce the ICSID arbitral awards. The New York Convention(formally called "United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards") is also applicable for the enforcement of arbitral awards to be rendered under the FTA. As to applicable rules, the UNCITRAL Arbitration Rules may be required for the settlement of investment disputes under the FTA. This Rules has adopted by the internationally recognized arbitral organizations although it was developed primarily for use in ad hoc arbitration. The promotion of arbitral cooperation may be realized through agreements between arbitral institutions. Especially under the NAPTA system, a central common system was established to resolve jointly private commercial disputes arising from such free trades by the initiative of arbitral organizations among the member countries. It is called Commercial Arbitration and Mediation Center for the Americas(CAMCA), which may be a good example for the settlement promotion of the private commercial disputes between Korea and other relevant countries.

Long-run Effects of the Korea-China Free-Trade Agreement

  • This paper uses a 53-country 15-industry computable general equilibrium model of trade to analyze the effects of the Korea-China free trade agreement on the Korean economy, the manufacturing sector in particular. The model is based on Yaylaci and Shikher (2014) which uses the Eaton-Kortum methodology to explain intra-industry trade. The model predicts that the Korea-China FTA will increase Korea-China manufacturing trade by 56%, manufacturing employment in Korea by 5.7% and China by 0.55%. The model also predicts significant reallocation of employment across industries with the Food industry in Korea losing jobs and other industries there gaining jobs, with the Medical equipment industry gaining the most. There will be some trade diversion from the ASEAN countries, as well as Japan and the United States.

열차훼리를 중심으로 한 한.중.일 물류협력체계 구축방안 (An Alternative for Establishing a Logistics Cooperation System among Korea, China and Japan Focused on Rail-ferry System)

  • 한중, 한일, 중일간의 FTA에 대한 관심과 노력은 보다 효율적이고 합리적인 운송서비스의 개설을 요구하고 있다. 따라서 이러한 추세에 부응하며 운송 서비스의 고효율화를 위해 제시하고자 하는 방안이 열차페리이다. 특히 서해안지역항만과 중국의 주요항만을 연계하고 아울러 한일간의 열차페리 운영을 통해 한중일간의 통합물류체계의 구축이 가능하다. 본 연구는 동 서비스에 대한 기초 연구로써 그 의미를 지니고 있으나 지속적이고 구체적인 후속연구가 필요하다. 특히 한중일 간의 열차페리는 TAR의 노선 연계의 방안으로 TKR이 북측노선을 우회하여 나머지 아시안 및 유럽항만들과 연계가 가능하며 중국과 일본, 한국의 국내 물류비용에 관한 경쟁력의 제고도 가능할 것이다. 특히 한중일은 열차노선의 궤도가 동일하며 FTA 추진이나 2, 3차 산업제품중심의 교역구조로의 전환에 따른 운임 부담력이 높은 화물의 교역량의 증대 등으로 실현 가능성이 더욱 증대되고 있다. 특히 기존의 해상 운송 중심의 복합운송을 철도와 해상운송이 연계된 효율적인 복합운송체계의 구축을 통해 한반도의 동북아 물류중심국가 발전에 공헌 할 수 있는 방안으로 활용해야 할 것이다.

상사분쟁 해결촉진을 위한 한-중 중재기관간 협력의 과제 (Cooperation for Development of Commercial Dispute Settlement between Korea and China Arbitral Institutions)

  • It is well recognized that the availability of prompt, effective and economical means of dispute resolution is an important element in the orderly growth and encouragement of international trade and investment. Increasingly, ADR(Alternative Dispute Resolution) including arbitration and mediation, instead of litigation in national courts, has become the preferred means of resolving private international commercial disputes. Under the situation, efforts for settlement of trade and investment disputes by ADR have been made between Korea and China through trade and investment agreements and arbitration agreement. Judging from the importance of economic exchange between Korea and Qingdao including Shandong Province, The Korean Commercial Arbitration Board(KCAB) and The Qingdao Arbitration Commission(QAC) should strengthen mutual cooperation to develop efficient methods of resolving commercial disputes arising between the two countries and to assist parties in solving those disputes through conclusion of arbitral agreement. Recently, efforts for conclusion of a Korea-China-Japan Free Trade Agreement(FTA) received strong support at Korea-Japan and Korea-China Summit Meeting held on June and July, 2003 respectively. If the conclusion of FTA among the three countries would be realized, it would promote regional trade and investment, contributing to economic growth in the Northeast Asian region. Under the circumstances, the key arbitral institutions including KCAB and QAC should consider to take the initiative in setting up tentatively called ${\ulcorner}$Joint Arbitration Center for Northeast Asia${\lrcorner}$ for which the CAMCA of NAFTA will be the good example.

한/중 무역구조에 대한 실증분석 (A Empirical Study on the International Trade Structure between Korea & China)

  • This Paper will use various analysis tools that have not been used a lot by the existing researches, and also use the statistics of trade until August 2007 to measure and analyze the trade relationship between China and Korea. This study, which is basic study to studies to be conducted later, has been performed to establish effective economic cooperative relations between Korea and China by examining trade structure of the two countries through trade-related indexes. Therefore, this study has academic values as a theoretical study which can explain economic effects of the Korea-China FTA. However, as data used for this study was based on the data of the National Statistics Office in general, this study was executed with realistic limitations owing to lack of local data. I will supplement this later and do my best to conduct a precise study.

한ㆍ싱가포르 FTA 체결에 따른 수산부문의 영향분석 (Economic Effects of Korea-Singapore Free Trade Agreement on the Fisheries Sector)

  • According to this study, overall economic impacts of the FTA between Korea and Singapore upon fish and fishery products of our country were likely to be very small and insignificant. When the tariff on fish and fishery products between the two borders were completely eliminated, if no roundabout exports from other ASEAN countries were practicing, then this study calculated that the increase of imports from Singapore in the 12 chief items was estimated to be only about 250,000kg, which comes to the amount of 1.1 billion won. The 12 items used here account for over 90% imports of fish and fishery products from Singapore. This study also revealed that imports of fish and fishery products from Singapore would be substituted for domestic products more than 100,000kg in the 7 items produced domestically. The substitution effect represents fishermen's demage by replacing domestic products by imports in terms of income which comes to the amount of 438 million won. As the results of the study shows, establishing an FTA between the two countries will not exert so much adverse effects on our fisheries because relative importance of fish and fishery products in both countries are very small. But the contents of the agreement on fish and fishery products between the two countries are very important, as concluding the negotiation and signing the agreement between Korea and Singapore would be a precedent in future negotiations with other asian countries, especially with China and ASEAN countries.

한-중-일 수출입의 대체·보완성에 관한 실증분석 (Empirical Analysis on the Substitutability or Complementary Nature of Export and Import among Korea, China, and Japan)

  • 한-중-일 3국간 무역형태는 각국의 산업구조 변화를 반영하여 무역수지가 고착화되고 또한 상호간 수출입 품목의 우선순위도 조정되어 왔다. 따라서 이와 같은 무역환경을 감안하여 새로운 형태의 무역정책을 수립 및 시행하는 것이 중요한 경제현안으로 부상하게 되었다. 본 연구는 공적분추정과 오차수정모형을 활용하여 한국, 중국, 및 일본간 수출입의 대체 보완성을 실증적으로 분석하려는 시도이다. 실증분석결과에 의하면 한-중-일 3국간 수출입의 경우 단기적으로는 보완관계를 유지하면서 상호간의 수출증대에 기여하는 측면이 있지만, 장기적으로는 한-중-일 3국 모두 대체관계를 형성하고 있어서 상호간의 수출을 감소시키는 것으로 나타났다. 따라서 향후 우리나라 무역정책의 경우 단기적으로는 시장에 의존하는 수출입 정책을 채택해도 무리가 없겠지만 장기적으로는 중국이나 일본과의 무역에서 대체관계에 따른 수출 감소에 대비할 수 있는 정책을 수행하여야 할 것이다. 즉, 한-중-일 3국간 무역에서 단기적으로는 기존의 산업구조를 바탕으로 시장에 영향을 미치는 환율정책이나 무역정책을 중심으로 운용해도 무리가 없겠지만 중장기적으로 무역구조에 영향을 미치는 산업구조의 개편이나 한-중-일 3국간 FTA 체결 등은 대체관계를 고려해서 추진하여야 할 것이다.

FTA가 유가공업에 미치는 영향과 원유 수급 전망 (The Effect on Dairy Industry of FTA and the Raw Milk Demand and Supply Outlook)

  • The FTA(Free Trade Agreements) are loading the world trade liberalization. Entering into FTA with Chile on 1 Apr 2004, Korea is trying to tie with Singapore and Japan in FTA. It also has a long-term plan for free-trading with China, USA, ASEAN, Canada and India. The portion of the dairy products imported from Chile, Japan and Singapore is under 1% of total dairy product imports. However, in the long run the conclusion of FTA with dairy product exporting countries such as USA, Australia, New Zealand and Netherlands will give a big impact on the dairy industry with abrupt increment in dairy product imports. Especially, whole and skim milk powder imports which are imported on the high tariff rate expect to increase. Furthermore mixed milk powder(Food preparations of goods and other whey powders) imports which domestic price is higher than world market also will dramatically increase. The milk powder stocks have increased since 2002. That made the government carry out some policies. Those include slaughtering milking cow(2002) and terminating the dairy farm enterprise and decreasing in milk production(2003). Also the case of artificial insemination by a Hanwoo fertilized egg has increased with the rise of Hanwoo farm price in 2003. By those reason, it is forecasted that the downward trend in the number of cow will be continued in 2004. It is also forecasted that the raw milk production in 2004 will decrease 4.4% compared to last year due to decreasing in the number of milking cow and raw milk collecting quota.

동아시아 지역협력강화와 경제공동체 추진에 관한 고찰: 중-일 관계를 중심으로 (Discussion on East Asian Economic Community)

  • 현재 동아시아에서는 경제통합을 둘러싼 논의가 활발히 진행되고 있다. 1997년 발생한 동아시아 통화위기는 역내에서 제도적인 협력체 형성을 위한 논의를 본격화 시키는 계기를 마련하였다. 이후 ASEAN+3 정상회의가 정례화 됨으로써 지역경제협력 및 경제통합 논의가 시작되었다. 또한, 동아시아에서는 역내외 다국적기업이 직접투자를 통해 생산공정을 역내 산업집적지에 분산(fragmentation)시키는 공정간 분업체제가 국제적 생산·유통네트워크를 구축함으로서 경제통합을 가속화시키는 역할을 하고 있다. 이러한 역내 네트워크는 각국·지역간 FTA체결을 통해 강화되었고 경제관계의 심화로 연결되고 있다. 그러나 동아시아는 지역 내 경제격차, 문화의 다양성과 사회·정치제도의 차이, 역사적 화해 등 산적한 문제를 가지고 있어 경제공동체 구성의 앞날이 순탄하지 못할 것이 예상되고 있다. 본 연구에서는 동아시아 지역협력강화 현황을 살펴보고 EU의 경제통합 성공사례의 시사점을 통해 동아시아 경제공동체 형성의 가능성과 구성의 논점을 고찰한다.
