The Liability for Damage and Dispute Settlement Mechanism under the Space Law (우주법상 손해배상책임과 분쟁해결제도)

  • The purpose of this paper is to research on the liability for the space damage and the settlement of the dispute with reference to the space activity under the international space treaty and national space law of Korea. The United Nations has adopted five treaties relating to the space activity as follows: The Outer Space Treaty of 1967, the Rescue and Return Agreement of 1968, the Liability Convention of 1972, the Registration Convention of 1974, and the Moon Treaty of 1979. All five treaties have come into force. Korea has ratified above four treaties except the Moon Treaty. Korea has enacted three national legislations relating to space development as follows: Aerospace Industry Development Promotion Act of 1987, Outer Space Development Promotion Act of 2005, Outer Space Damage Compensation Act of 2008. The Outer Space Treaty of 1967 regulates the international responsibility for national activities in outer space, the national tort liability for damage by space launching object, the national measures for dispute prevention and international consultation in the exploration and use of outer space, the joint resolution of practical questions by international inter-governmental organizations in the exploration and use of outer space. The Liability Convention of 1972 regulates the absolute liability by a launching state, the faulty liability by a launching state, the joint and several liability by a launching state, the person claiming for compensation, the claim method for compensation, the claim period of compensation, the claim for compensation and local remedy, the compensation amount for damage by a launching state, the establishment of the Claims Commission. The Outer Space Damage Compensation Act of 2008 in Korea regulates the definition of space damage, the relation of the Outer Space Damage Compensation Act and the international treaty, the non-faulty liability for damage by a launching person, the concentration of liability and recourse by a launching person, the exclusion of application of the Product Liability Act, the limit amount of the liability for damage by a launching person, the cover of the liability insurance by a launching person, the measures and assistance by the government in case of occurring the space damage, the exercise period of the claim right of compensation for damage. The Liability Convention of 1972 should be improved as follows: the problem in respect of the claimer of compensation for damage, the problem in respect of the efficiency of decision by the Claims Commission. The Outer Space Damage Compensation Act of 2008 in Korea should be improved as follows: the inclusion of indirect damage into the definition of space damage, the change of currency unit of the limit amount of liability for damage, the establishment of joint and several liability and recourse right for damage by space joint launching person, the establishment of the Space Damage Compensation Review Commission. The 1998 Final Draft Convention on the Settlement of Disputes Related to Space Activities of 1998 by ILA regulates the binding procedure and non-binding settlement procedure for the disputes in respect of space activity. The non-binding procedure regulates the negotiation or the peaceful means and compromise for dispute settlement. The binding procedure regulates the choice of a means among the following means: International Space Law Court if it will be established, International Court of Justice, and Arbitration Court. The above final Draft Convention by ILA will be a model for the innovative development in respect of the peaceful settlement of disputes with reference to space activity and will be useful for establishing the frame of practicable dispute settlement. Korea has built the space center at Oinarodo, Goheung Province in June 2009. Korea has launched the first small launch vehicle KSLV-1 at the Naro Space Center in August 2009 and June 2010. In Korea, it will be the possibility to be occurred the problems relating to the international responsibility and dispute settlement, and the liability for space damage in the course of space activity. Accordingly the Korean government and launching organization should make the legal and systematic policy to cope with such problems.

Geometrical Interpretation on the Development Sequence and the Movement Sense of Fractures in the Cheongsong Granite, Gilan-myeon Area, Uiseong Block of Gyeongsang Basin, Korea (경상분지 의성지괴 길안면지역에서 청송화강암의 단열 발달사 및 운동성에 대한 기하학적 해석)

  • The Gilan area in the central-northern part of Uiseong Block of Cretaceous Gyeongsang Basin is composed of Precambrian metamorphic rocks, Triassic Cheongsong granite, Early Cretaceous Hayans Group, and Late Cretaceous-Paleocene igneous rocks. In this area, the faults of various directions are developed: Oksan fault of $NS{\sim}NNW$ trend, Gilan fault of NW trend, Hwanghaksan fault of WNW trend, and Imbongsan fault of EW trend. Several fracture sets with various geometric indicators, which determine their relative timing (sequence and coexistence relationships) and shear sense, we well observed in the Cheongsong granite, the basement of Gyeongsang Basin. The aim of this study is to determine the development sequence of extension fractures and the movement sense of shear fractures in the Gitan area on the basis of detailed analysis of their geometric indicators (connection, termination, intersection patterns, and cross-cutting relations). This study suggests that the fracture system of the Gilan area was formed at least through seven different fracturing events, named as Pre-Dn to Dn +5 phases. The orientations of fracture sets show (W) NW, NNW, NNE, EW, NE in descending order of frequency. The orientation and frequency patterns are concordant with those of faults around and in the Gilan area on a geological map scale. The development sequence and movement sense of fracture sets are summarized as follows. (1) Pre-Dn phase: extension fracturing event of $NS{\sim}NNW$ and/or $WNW{\sim}ENE$ trend. The joint sets of $NS{\sim}NNW$ trend and of $WNW{\sim}ENE$ trend underwent the reactivation histories of sinistral ${\rightarrow}$dextral${\rightarrow}$sinistral shearing and of (dextral${\rightarrow}$) sinistral shearing with the change of stress field afterward, respectively. (2) Dn phase: that of NW trend. The joint set experienced the reactivations of sinistral${\rightarrow}$dextral shearing. (3) Dn + 1 phase: that of $NNE{\sim}NE$ trend. The joint set was reactivated as a sinistral shear fracture afterward. (4) Dn +2 phase: that of $ENE{\sim}EW$ trend. (5) Dn +3 phase: that of $WNW{\sim}NW$ trend. (6) Dn+4 phase: that of NNW trend. The joint set underwent a dextral shearing after this. (7) The last Dn +5 phase: that of NNE trend.

HYBRID POWER FLOW ANALYSIS USING SEA PARAMETERS

  • This paper proposes a hybrid analytic method for the prediction of vibrational and acoustic responses of reverberant system in the medium-to-high frequency ranges by using the PFA(Power Flow Analysis) algorithm and SEA(Statistical Energy Analysis) coupling concepts. The main part of this method is the application of the coupling loss factor(CLF) of SEA to the boundary condition of PFA in reverberant system. The hybrid method developed shows much more promising results than the conventional SEA and equivalent results to the classical PFA for various damping loss factors in a wide range of frequencies. Additionally, this paper presents applied results of hybrid power flow finite element method(hybrid PFFEM) by formulating the new joint element matrix with CLF to analyze the vibrational responses of built-up structures. Finally, the analytic results of coupled plate structures and an automobile-shaped structure using hybrid PFFEM were predicted successively.

  • The emission of microwave sulfur lamp is mainly composed of visible light. This lamp producing little infrared radiation, has high light efficiency, long lifespan and less power consumption. In comparison with xenon lamp, growing under sulfur lamp apparently postponed jointing, increased the number of tillers, accelerated root growth of wheat. Relatively, xenon lamp evidently promoted heading and grain maturation. The development characteristics of wheat plant under sulfur lamp were more similar with that in natural condition.

  • There are many analysis formulas for determining the resultant shear force in welds. However, there is no general procedure which is applicable to a joint with all six possible loadings exerted simultaneously. A numerical methodology and computer program for such a problem were developed, and they are capable of analyzing a weld of any shape composed of straight or circular line segments. The computer program developed in this study can also display the design procedures and results using computer graphics. The development of such a design procedure and an interactive computer program for weldments analysis will lead to lower cost.

  • The lack of close working relationship between agricultural research, extension organizations and farmers, is one of the most difficult problems confronting agricultural technology system. Systems approach is an effective method to use in indentifying lingkage problems in agricultural technology system, and it is a problem-solving methodology. There are two basic types of linkage mechanisms; organizational and managerial. Organizational mechanisms involve the structural modification of the research and extension organizations involved in an agricultural technology system. The other major type of lingkage mechanisms involves a range of managerial interventions such as joint planning and review activities, collaborative program activities, and resource allocation procedures, etc.

  • The East Asian Observatory (EAO) was established in 2014 by the East Asian Core Observatories Association (EACOA). The goal of the EAO is to build and operate world-class facilities on behalf of the East Asian regions, as a counterpart to the European Southern Observatory (ESO). Leading astronomical facilities such as ALMA, TMT, GMT, and SKA are mega projects which require enormous economic resources. It is difficult for any observatory or any country to fund such facilities on its own. EAO intends to combine the resources and manpower in our East Asian regions, in order to play a leading role in the next generation frontier instruments. The EACOA institutes: NAOC, NAOJ, KASI, and ASIAA, have authorized the EAO to take on the operations of the James Clerk Maxwell Telescope (JCMT) on Mauna Kea as their first joint venture. In this talk, we will report on the development of EAO, our current operations of JCMT, and our future aspirations.

  • This paper deals with the development of biomechanical model on a seat with backrest support in the vertical direction. Four kinds of biomechanical models are discussed to depict human motion. One DOF model mainly describes z-axis motion of hip, two and three DOF models describe z-axis of hip and head, and while nine DOF model suggested in this study represents more motion than the otehr model. Three kinds of experiments were executed to validate these models. The first one was to measure the acceleration of the floor and hip surface in z-axis, the back surface in x-axis, and the head in z-axis under exciter. From this measurement, the transmissiblities of each subject were obtained. The second one was the measurement of the joint position by the device having pointer and the measurement of contact position between the human body and the seat by body pressure distribution. The third one was the measurement of the seat and back cushion by dummy. The biomechanical model parameters were obtained by matching the simulated to the experimental transmissiblities at the hip, back, and head.

  • Human dummies are essential tools in the development of such products as vehicle have been actively used not only in reach and view field tests. but also in impact perception evaluations. This study attempted to obtain geometric and dynamic model body segments from Korean anthropometric data. The investigation focused on the de both human and dummy for the geometric and inertial properties. The dynamic modeli being suggested is based on rigid body dynamics using fifteen individual body segments by joins. The segments are connected at the locations representing the physical joint body so that each segment has its mass and moment of inertia. For visual three-dimensional graphic was used for easier implementation of the dumn applications. For applications, proposed Korean dummies Were used in dynamic crash and driver's view and reach test modules were developed in virtual environment.

  • The finishing method of concrete floor using automatic surface finisher is one of new technologies in concrete floor construction. The development of high technologies in construction will increase in order to satisfy the demand to construct high quality building. Using this method, it is possible to increase the quality of building as well as to reduce the labor work in site. In this paper, a system which can be used to finish the concrete floor using automatic surface finisher, is presented and its structural capacities are evaluated. The system is composed of rail which guides the surface vibrator and absorbs the volume change of concrete, and a device supporting the rail. From the experimental work for these devices, it was shown that the support and rail had suitable strength to resist the automatic surface finisher. For design purpose, also, effective span of supports was tabulated.
