MFN Restrictions in Investment Agreements for the Prevention of ISDS Forum Shopping (ISDS 포럼쇼핑 방지를 위한 투자협정상 MFN 배제조항)

  • MFN provisions in investment agreements have been a tool for equitable treatment between foreign investors with different nationalities. This non discriminatory principle has been pursued by the host states for further investment promotion. However, it may be abused to bring the situation of so called "ISDS forum shopping" which might harm the stability and predictability of investment agreements by unexpectedly extending the scope of obligations. While some investment arbitral tribunals have interpreted the scope of MFN provision very broadly to allow the ISDS forum shopping, both procedural and substantive provisions have been invoked. To prevent any chaos of unclear boundary of MFN provision, some explicit MFN restrictions which would limit the scope of MFN provision are needed. Indeed, some investment agreements have included these MFN restrictions. Specifically, MFN restrictions deal with both procedural or substantive provisions to prevent ISDS forum shopping. According to the lessons from the recent examples of MFN restrictions, there must be a careful consideration on the benefits and costs of having a certain type of MFN restriction as the parties can be the host state and the home state of their investors at the same time.

The Impact of Information Technology Investment on Cost Reduction in Korean Insurance Industry (한국 생명보험산업의 정보화투자와 비용절감)

  • Analyzing the effects of information technology(IT) in the life insurance Industry is important in establishing the direction for future information technology investment. In this research, the cost-elasticity of IT capital stock was measured by the SUR technique, using the second-order translog cost function, which was drawn out by a Taylor expansion of the multi-product joint cost function. Analysis was made based on data from 1991 to 2003 collected from 33 life insurance firms. The results show that although the effects of information technology investment vary according to individual life insurance firms, half of the life insurance firms surveyed reduced their costs by investing in information technology. The research also revealed that although large life insurance firms reduced their costs by investing in information technology medium & small life insurance firms and foreign ,life insurance firms increase their costs. Additionally, although both information capital and information labor increase as the information budget increases, the increase in information capital is larger than one in information labor. Because the price of information capital is decreased rapidly more than one of information-related labor.

An Economy Analysis on the Underground Food Storage (농수축산물저장을 위한 지하암반냉동창고의 경제성분석)

  • It is in general reported that construction cost in an underground storage facility is less than that of the same capacity and features in an aboveground facility. Since these costs have a derivative with respect to facility size and fridging unit, the cost of construction and fridging unit are sensitive to location of storage, items to store, and rock quality of storage site. In this paper, to analyse an economic investment point for the underground food storage relative to aboveground storage, we compared these two models which have equivalent annual cost with the total cost that consists of initial facility investment cost and annual operation cost. Based on comparison of the economic investment in the underground with aboveground storage. an economic initial investment cost has been suggested for storing the agricultural and fish products.

The Relationship between Intra-Industry Trade and FDI: A Case of Machinery and Transport Equipment Trade between Korea and China (산업내 무역과 해외직접투자의 관계 : 한.중간 기계 및 운수장비 산업을 중심으로)

  • This study presents the pattern and determinants of intra-industry trade in Korea's machinery and transport equipment industry focusing the influence of foreign direct investment on intra-industry trade. Using an OLS regression model the determinants of intra-industry trade are investigated. Results indicate that a statistically significant negative relationship is found between intra-industry trade and foreign direct investment, and show that intra-industry trade is positively affected by the degree of product differentiation and export structure similarity. Intra-industry trade is also positively associated with the economies of scale, the level of trade barrier, and transportation costs, although this is not statistically significant. The study found strong evidence that the propensity of foreign direct investment toward export specialized industry makes the negative relationship between intra-industry trade and foreign direct investment.

  • This paper discusses how to develop a comprehensive performance evaluation framework and measure Quantitative and Qualitative benefits of 'Small Business Networking Project' which has been supported by Korean Government since September 2001. Employing BSC framework to identify various benefits realized from the project, we suggest specific procedure and method of deriving ROI (return on investment) for analyzing the benefits against the costs associated with the project, where we restrict our attention to the government investment. From the study, we show that ROI analysis can be served as a useful means to validate government projects as well as uncover specific problem areas to handle in the course of implementing them. Moreover. the ROI analysis we present in this paper can also be applied to pre-evaluate similar government investments.

  • According to the Policy for ' e-Korea construction ' of Korean government, investment of information system during the Past decay are dramatically increasing. More than a half of this investment is cost of hardware infrastructure. So, accurate hardware sizing are essential for higher efficiency of investment. Accurate hardware sizing benefits are generally viewed in toms of the avoidance of excess equipment and lost opportunity costs by not being able to support business needs. Unfortunately, however, little research effort to make the hardware sizing methodology are doing. We propose a sizing method for information system in public sector. This method is determinated empirical study that are gathering and analyzing cases, making method and reviewing expert. Finally we are proposed calculating method for hardware components that is CPU, memory, internal and external disk according to the application system type which is OLTP, Web, WAS. Our study certainly will act as a catalyst for higher investment-efficiency of the future information programs in public sector.

Effects of Stockholders' Secondary Tax Liability on Corporate Investment

  • This study analyzes the impact of secondary tax liability borne by stockholders, an exception to the principle of limited liability, on corporate investment. The paper constructs a model of a firm to examine the effect of this secondary tax liability, finding that the violation of limited liability increases firms' expected bankruptcy costs, thereby reducing investments. By means of an empirical analysis, the paper examines whether firms with the largest shareholder stake exceeding 50%, the condition under which secondary tax liability is incurred, decrease their investments. The results show that firm investment is highly concentrated in observations of cases in which the largest shareholder stake does not exceed 50%. Investments decrease sharply in cases where the largest shareholder stake exceeds 50%. The results here provide implications pertaining to how exceptions of the limited liability principle, existing only in Korea, affect corporate investments.

  • Protection agriculture is the essential choice for human to increase the efficiency of limited crop production area under harsh and changeable weather boundary conditions, extend growing season, maximize the crop yields, and then increase the sustainable income of the grower. The investment costs far greenhouses as well as labor and energy costs are much higher than for conventional plant production systems, so these can only be balanced by better crop yields, higher labor productivity, and higher energy efficiency.   • This paper considers the cell formation in a manufacturing environment where the setup times and costs are significantly dependent on the sequence. The trade-off between saving on the setup costs and additional investment on new machines is considered for determining the economic number of cells. Accordingly, This paper develops a mixed integer program and mentions a variety of manufacturing situations where this model can be useful. This paper also includes an illustrative example.
