우리나라 해양사고 조사매뉴얼은 국제적인 해양사고 조사지침과 코드 등을 수용하지 못하여 국제 기준과 절차 및 흐름에 뒤떨어져 있고, 새로운 시대와 여건에 맞는 독자적인 조사매뉴얼이 없는 실정이다. 이 연구에서는 한국과 일본 및 미국 해양사고 조사기관의 조사 매뉴얼을 비교ㆍ분석하여 우리나라 조사매뉴얼의 문제점을 도출하고, 우리 실정에 맞는 새로운 조사매뉴얼의 제정 방안을 제시하고자 한다.

우리나라의 해양안전심판원은 지난 40년동안 많은 업적을 남겼지만, 아직도 해양사고의 조사에 대한 법과 제도 및 매뉴얼 등에서 미흡한 점이 있다. 조사매뉴얼은 국제해사기구의 해양사고조사지침 등의 국제규정과 기준을 수용하지 못하고 심판지침과 함께 작성되어 있을 뿐만아니라 그 구성과 내용 및 조사기법 등이 매우 부실하다. 그리고, 조사제도는 심판원이 독립성을 가지지 못하고 재발방지를 위한 권고기능이 크게 위축되어 있는 실정이다. 또한, 해양사고의 원인판단지침이 없어 조사관이 항법적용을 혼동하거나 오류를 범하는 경우가 종종 발생하고 있고 초임 조사관 등의 사고원인판단의 기준으로 활용할 수 있는 교재도 없다. 이 연구에서는 영국, 미국, 네덜란드 및 일본의 조사매뉴얼과 조사제도를 비교ㆍ분석하여 개선안을 제안하고, 사고 종류별 질문조사기법을 제안한다.

This paper presented a literature review and investigation analysis results of total 19 present guide book and provisions of maintenance and management system in existing railway bridges to development of urban maglev track structures inspection manual. This research carried out a cooperated research subject 3-1, development a design code and maintenance and management inspection manual for urban maglev track structures, of the Center for Urban Maglev Program. Three types of track structures were includes as a major analytical parameter together with railroad, high speed railroad, subway and light rail transit. Bridges were analyzed a general rules, investigation, evaluation, repair and strengthen method as a key aspect. And rail were analyzed examination and maintenance also. This analysis results show that the track structures evaluation are based on the test and examination results, and repaired or strengthened consideration of deterioration, track irregularity and materials according to provision requirements.

흠흠신서(欽欽新書)에 관해 법률서로서의 그 가치에 대한 연구는 많이 이루어져 왔으나, 수사실무 및 법과학 서적으로서의 가치에 대한 연구는 거의 전무한 것이 사실이다. 따라서 이 연구에서는 다산의 흠흠신서(欽欽新書)가 가지는 법과학적, 수사 실무서로서의 가치를 탐구하고 재발견 해보고자 한다. 범죄수사 및 처벌에 관해 다산은 인도주의에 입각한 정의 관념과 합리주의를 기본이념으로 삼고, 무죄추정의 원리, 신속한 수사의 원리, 자백의 증거능력의 제한 등을 통해 현대 민주적 형법사상에 접근하였다고 평가받고 있다. 또 수사기법에 있어서는 진술을 청취함에 있어서 언어적 단서 뿐 아니라 비언어적 단서의 중요성 역시 강조하고 있으며, 당대의 과학 수준에서 가장 합리적이고 과학적인 수사기법들을 소개하고 있다. 이 연구를 통해 흠흠신서가 현대를 살아가는 우리에게도 여전히 "실용적"가치를 지니고 있음을 재발견하고 "온고지신(溫故知新)"의 의미를 다시 한 번 되새기는 계기가 되기를 기대한다.

최근 IT 첨단기술의 발전과 더불어 국민들의 정보화 수준이 지속적으로 향상되고 있는 가운데 교통 분야에 IT기술의 최신분야인 유비쿼터스 기술 및 모바일 기술 등 첨단기술을 접목하려는 시도가 늘어나고 있는 추세이다. 이러한 경향에 발맞춰 교통사고 조사를 신속하고 효율적으로 실시할 수 있는 PDA 조사 장치가 개발되었다. 본 논문에서는 교통사고 조사를 위해 개발된 PDA에 대해 평가방법론을 설정하고, 정성적 및 정량적 평가를 실시하였다. 평가 결과, PDA를 활용한 교통사고 조사는 수기조사에 비해 자료의 정확성 및 편리성, 그리고 조사시간 측면에서 비교 우위에 있는 것으로 평가되었다. 그리고 사고데이터를 입력하는 형식에 관한 일부 개선이 필요한 면도 파악되었다. 향후 이러한 문제점을 개선한다면 사고조사 분야에 큰 기여를 할 것으로 판단된다.

To collection of field data for development of maintenance manual of Han-ok, we investigated defects which occurred in members of Han-ok by field investigation. The noticeable defects were wood cracks, gaps that developed between wood pillar and wall or wood window frame and tenon joints. The most common biological defect was blue stain which was created in log. The mold generation was observed on exterior wood and wall which get wet by precipitation. The gaps between members of Han-ok pointed out as defect that is urgently improved by residents of Han-ok. The reason is mainly due to poor of insulation in winter by bad confidentiality. The maintenance work of defect such as gap was conducted personally. As a result, the repair parts were ugly for unfamiliar repair work.

Engagement is an important factor in the field of rehabilitation as it is a known factor that have a positive influence on functional gaining in people who receive rehabilitation therapy. Although a number of measurements for engagement have been recently developed, investigation of possible factors that may have influence on engagement is not well established. Currently available evidence suggests that engagement is affected by mood and it is hypothesized that a personal factor may contribute to engagement. Therefore, this study aims to test the hypothetical relationship between mood and engagement while performing a manual dexterity task through an experiment in healthy participants prior to investigation on people with medical condition who requires rehabilitation therapy. After inducing target mood (positive or negative mood) for study participants by asking them to recall autobiographical memories, change in muscle activity, which was operationalized as an indicator of engagement, was investigated. Electromyogram (EMG) was recorded from four muscle areas in non-dominant hand side to quantify muscle activity. The results show that the target moods were appropriately induced with the method. Although there were subtle differences in the level of engagement between different moods, certain variables derived from muscle activity were significantly different; mean amplitude for wrist extensor EMG showed significant difference between different moods (Z = -2.023, p < .05) indicating that muscle activities in the wrist extensor are greater for positive mood than negative mood region during manual dexterity task. Meanwhile, performance outcomes of Minnesota Manual Dexterity Test (MMDT), such as mean completion time and number of errors, between moods showed no significant difference in two different moods, resulting in MMDT administration may not be useful task in distinguishing the level of rehabilitation engagement.

공판중심주의 강화와 법률시장 개방 등 사법제도의 변화로 인해 화재현장의 해석은 과학적인 증거를 통해 철저한 실체적 진실의 구현을 지향하고 있다. 화재에 대한 실체적 진실 규명의 근거가 되는 물적 증거물에 대한 적정한 수집이 선행되지 않으면 법정에서 증거능력 부정 또는 증명력이 배척되어 조사결과에 대한 신뢰도는 추락하게 된다. 엄정하게 관리된 현장에서 물리적, 화학적으로 변형 우려가 높은 화재 증거물의 특성상 최대한 원형을 보존하도록 채취되어야 하고 채취부터 분석 감정에 이르는 모든 과정이 사진 및 기록으로 유지되어야 하며 이런 과정들에 대한 세부적인 매뉴얼 또는 지침이 규정화 될 필요가 있다. 이런 절차들이 정립되고 조사 기관간 협업 관계가 구축된다면 신뢰도 높은 화재감식 체계가 될 것이다.

The research will be essential that the method for strengthening safety are safe installations in a hardware portion, a safe running ceremony of the vehicle employee (an engine driver) and the estimate of the situation which is accurate. In railway car the window wiper which is auxiliary equipment for safe operation is changed the existing manual control method with automatic correspondence precipitation used raindrops censor which can assure the vision of driving. It can be easy to safe driving as might have expected the object. We carried out studies technical review investigation which can accomplish the best suited wiping speed in maintaining an introduction existing system in the manual control system applied the existing train and corresponding to precipitation. The observation fact in the studies can be possible to ensure safety operation. That is, Manual operation method (of the driver) to add the automatic speed adjust function can operate improved window wiper drive system when it rains and, as was expected, it is able to ensure the range of a good railroad driver's vision and to concentrate in working at rainfall.
