우리나라 생활안전영역의 비의도적 손상 발생률 및 발생 양상 (The Incidence and Patterns of Unintentional Injuries in Daily Life in Korea: A Nationwide Study)

  • Objectives: This study was conducted to estimate the cumulative incidence rate (CIR) of unintentional injuries in Korean daily life and to describe the pattern of unintentional injuries. Methods: The study population was the people who used the National Health Insurance because of injuries (ICD code: S00$\sim$T98) during 2006. The stratified sample according to gender, age and the severity of injury (NISS, New Injury Severity Score) was randomly selected. The questions on the questionnaire were developed as a reference for an international classification tool (ICECI, International Classification of External Causes of Injury). The questions included the locations of injury, the mechanisms of injury and the results of injury. Moreover, we used age, gender, region and income variables for analysis. Results: The CIR of unintentional injuries that occurred in daily life for 1 year per 100,000 persons was 17,606, and the CIR of severe injuries was 286. Many injuries were occurred at home (29.6%), public places (19.0%), school (13.7%) and near home (12.0%). The major mechanisms of injuries were slipping (48.8%), contact (14.0%), physical over-exertion (13.8%), and fall (6.6%). Infants and old aged people were vulnerable to injuries, and those who lived rural area and who were in a low income level were vulnerable too. Conclusions: We signified the risk groups and risk settings of unintentional injuries in Korean daily life. These results could contribute to establishing strategies for injury prevention and implementing these strategies.

LS-DYNA 코드의 유체-구조 연성해석 기법을 이용한 자유낙하식 구명정의 가속도 응답 추정 (Estimation of Acceleration Response of Freefall Lifeboat using FSI Analysis Technique of LS-DYNA Code)

  • During certification of freefall lifeboats, it is necessary to estimate the injury potential of the impact loads exerted on the occupants during water entry. This paper focused on the numerical simulation to predict the acceleration response during the impact of freefall lifeboats on the water using FSI(Fluid-Structure Interaction) analysis technique of LS-DYNA code. FSI problems could be conveniently simulated by the overlapping capability using Arbitrary Lagrangian Eulerian(ALE) formulation and Euler-Lagrange coupling algorithm of LS-DYNA code. Through this study, it could be found that simulation results were in relatively good agreement with experimental ones in the acceleration peak values, and that the loading conditions were very sensitive to the acceleration responses by the experimental and simulation results.

UCC상 Warranty 위반의 구제에 관한 연구 (A Study on the Remedy for Breach of Warranty under the Uniform Commercial Code)

  • The seller may take a warranty with respect to the goods. If they are not as warranted, they may be held liable for the breach of warranty. Even when they has not made a warranty, the law will in some instances hold them responsible as though they had made a warranty. An express warranty is a part the basis for the sale. That is, the buyer has purchased the goods on the reasonable assumption that they were as stated by the seller. When the buyer intends to use the goods for a particular or usual purpose, as contrasted with the ordinary use for which they are customarily sold, the seller makes an implied warranty that the goods will be fit for the purpose when the buyer relies on the seller's skill or judgment to select or furnish suitable goods, and when the seller at the time of contracting knows or has reason to know the buyer's particular purpose and his reliance on the seller's judgment. A merchant seller who makes a sale of goods in which he customarily deals makes an implied warranty of merchantability. The Uniform Commercial Code expressly abolishes the requirement a privies to a limited extent by permitting a suit for breach of warranty to be brought against the seller by members of the buyer's family, his household, and his guests, with respect to personal injury sustained by them. Apart from the express provision made by the Code, there is a conflict of authority as to whether privies of contract is required in other cases, with the trend being toward the abolition of that requirement. At common law the rule was that only the parties to a transaction had my rights relating to it. Accordingly, the buyer could sue his immediate seller for breach of warranties. The rule was stated in the terms that there could be no suit for breach of warranty unless there was a privies of contract. The code expressly abolishes the requirement of privies to a limited extent by permitting a suit for breach of warranty to be bought against the seller by members of the buyer. Apart from the express provision made by the Code, there is a conflict of authority as to whether privies of contract is required in other cases, with the trend being toward the abolition of that requirement.

Methods to determine the volume of infrapatellar fat pad as an indicator of anterior cruciate ligament tear

  • Anterior knee pain is a major problem among adolescents and young adults especially those who participates in sports. The most common pathogenesis of anterior knee pain can arise from compression and shear forces in the patellofemoral joint. It is also caused by impingement of infrapatellar fat pad. Fat pad impingement can occur when the fat pad becomes swollen and inflamed due to a direct blow or chronic irritation. As a result, the bottom tip (or inferior pole) of the patella can pinch the fat pad. One of the many causes of swollen fat pad can be secondary to anterior cruciate ligament (ACL) injury. The aim of this study was to compare the infrapatellar fat pad volume in patients with acute ACL injury and a group of age-, gender-, and activity- matched controls with intact ligament. Axial magnetic resonance (MR) images have been performed on 32 patients with torn ACL and 40 control patients. The volume of the fat pad was measured digitally from MR image by using a 3d Reconstruction software, ellipsoidal approximation, and a MATLAB code. The results were compared between patients with torn ACL and control group. Patients with a torn ACL had a significantly larger fat pad than the controls (P=0.01). There was no significant difference between the methods used to measure the infrapatellar fat pad volume (P=0.83-0.87). Thus, lesions of the infrapatellar fat pad is often associated with ACL injury.

정면충돌 시 차량 탑승자의 하지 손상기전에 대한 분석 (Analysis of Lower Extremity Injury Mechanism Centered on Frontal Collision in Occupant Motor Vehicle Crashes)

  • Injury mechanisms of lower extremity injuries in motor vehicle accidents are focused on fractures, sprains, and contusions. The purpose of this study is to evaluate the analysis of lower extremity injury mechanism in occupant motor vehicle accident by using Hospital Information System (HIS) and reconstruction program, based on the materials related to motor vehicle accidents. Among patients who visited the emergency department of Wonju Severance Christian Hospital due to motor vehicle accidents from August 2012 to February 2014, we collected data on patients with agreement for taking the damaged vehicle's photos. After obtaining the verbal consent from the patient, we asked about the cause of the accident, information on vehicle involved in the accident, and the location of car repair shop. The photos of the damaged vehicle were taken on the basis of front, rear, left side and right side. Damage to the vehicle was presented using the CDC code by analytical study of photo-images of the damaged vehicle, and a trauma score was used for medical examination of the severity of the patient's injury. Among the 1,699 patients due to motor vehicle crashes, 88 (5.2%) received a diagnosis of lower extremity fracture and 141 (8.3%) were the severe who had ISS over 15. Nevertheless during 19 months for research, it was difficult to build up in-depth database about motor vehicle crashes. It has a limitation on collecting data because not only the system for constructing database about motor vehicle crash is not organized but also the process for demanding materials is not available due to prevention of personal information. For accurate analysis of the relationship between occupant injury and vehicle damage in motor vehicle crashes, build-up of an in-depth database through carrying out various policies for motor vehicle crashes is necessary for sure.

건강보험 청구 질병코드와 퇴원손상환자심층조사 질병코드 비교 연구 (A Comparative Study of the Disease Codes between Korean National Health Insurance Claims and Korean National Hospital Discharge In-Depth Injury Survey)

  • Background: As most of people in Korea are covered by National Health Insurance (NHI), the disease information collected in NHI provides high availability for health policy. Nevertheless, the validity of disease codes in NHI data has been controversial till now. So we tried to evaluate the validity of them by comparing the NHI claims data with Korean National Hospital Discharge In-depth Injury Survey (KNHDIIS) data. Methods: We compared the NHI patients sample data (2009) with the KNHDIIS data (2009). We selected the inpatient data of KNHDIIS and NHI patients sample. The weighted number of patients from NHI patients sample was 5,551,210 and the number of patients from KNHDIIS was 5,559,874. We classified the disease codes into principal diagnoses and other diagnoses, and we compared as one, two, three unit level. Also we calculated the agreement rate of each of them. Results: In the comparison of principal diagnoses, NHI claims data had more C code than KNHDIIS data did, whereas KNHDIIS data had more Z code than NHI claims data did. In the comparison of other diagnoses, NHI claims data had 2, 3 more codes than KNHDIIS data did. The overall agreement rate at three unit level was 76.5% in principal diagnoses and 46.8% in other diagnoses. Conclusion: Considering the large difference between the two data, the validity of disease codes in NHI Claims data seems to be low. To increase the validity of them, the definite detail coding indicator, the reinforcement of coding education, and the reform of system are needed.

100마리의 야생 멧돼지 사냥견에서 응급 외상성 질환의 분류 (Prevalence of Emergency Traumatic Injuries in 100 Wild Boar Hunting Dogs)

  • 전북지역에서 야생 멧돼지 사냥 시 발생한 응급 외상성 질환을 치료하기 위하여 내원한 사냥견 100마리를 외상의 정도에 따라 분류 하였다. 분류는 응급 외상성 질환의 경향과 정도를 부상의 원인, 부상 부위의 숫자와 위치, 부상의 중등도, 치사율과 같은 의료 기록들을 통하여 정보를 수집하였고 이를 토대로 후향성 조사를 실시 하였다. 사냥견 100마리의 환자에서 136개 (71마리의 단일 응급 외상성 질환과 29마리에서 복합 응급 외상성 질환)의 응급 외상성 질환이 발견되었다. 응급 외상성 질환의 원인으로는 야생 멧돼지 공격에 의한 응급 외상이 92마리, 오발로 인한 응급 외상이 7마리 그리고 덫에 의한 응급 외상이 1마리로 조사 되었다. 흉부는 응급 외상 질환이 가장 잘 발생하는 부위이며, 부상심각점수(ISS)는 2단계로 판단되었다. 치사율은 9% 였으며 사망에 이르게 된 증례는 모두 흉강에 외상을 입고 있었다. 야생 멧돼지 사냥 시에 발생하는 응급 외상성 질환은 사냥물을 공격할 때 대부분 발생하는 것으로 특히 가장 흔한 부위는 흉부였으며 이것은 임상 수의사가 흔히 접하는 일반적인 응급 질환들과는 매우 다른 특징을 나타내고 있었다. 본 연구를 통하여 야생 멧돼지 사냥견에서 응급 외상성 질환의 치료 경과, 발생 형태, 예후, 치사율 등 임상 응급 진료에 필요한 정보들을 알 수 있었다.

국내 하지손상의 발생현황에 대한 분석 (Incidences of Lower Extremity Injuries in Korea)

  • Purpose: We conducted this retrospective epidemiological study to assess the incidence and severity of lower extremity injuries in Korea Methods: For this study, we retrospectively reviewed nationwide lower-extremity injury data compiled from 2001 to 2003 based on the National Injury Database, what included National Health Insurance Corporation (NHIC), Car Insurance, and Industry Insurance data. Data were standardized in terms of demographic characteristics, region, and socioeconomic status by using NHIC data. To assess the degree of the injuries, we used the Modified Abbreviated Injury Scale (MoAIS), what has been changed from the International Classification of Disease-10 (ICD-10) code. By using the Excess Mortality Ratio-adjusted Injury Severity Score (EMR-ISS), we classified the degree of severity into four categories: mild, moderate, severe and critical. Results: From 2001 to 2003, lower extremity injuries increased slightly, with a yearly average of 2,437,335. Insurance data should that lower-extremity injuries were the most common, followed by upper-extremity injuries. Significant difference were seen in the numbers of lower extremity injuries based on gender and age. As for provinces, Seoul and Gyeongi provinces had the highest numbers of cases. Junlabukdo had the highest rate of 55,282 cases per 1 million people for standardized gender and population. The annual incidence of the insured patients with lower extrimity injuries was higher than the employer's medical insurance contributions to the medical insurance program. Daily cases occur most often in May and June, with the lowest occurrences being in January and February. Conclusion: The result of this study shows that lower extremity injuries comprised common cause of all injuries. In addition, differences associated with gender, location and socioeconomic status were observed. Further studies are needed to find reasons and then this knowledge will allow strategies to prevent the lower extremity injuries.

측면충돌시 승객의 거동에 대한 연구 (A study of occupant responses in side impact collision)

  • With the recent issuance of a dynamic side impact test regulation in the Federal Motor Vehicle Safety Standard in the United States of America, many aspects of occupant protection in side impact crashes have been under investigation. Many investigations of real world accidents, crash test results and simulation studies have established that in side impact crashes of passenger cars, thoracic and pelvic injuries of occupant are, large part, caused by occupants' impact against the interior side of the vehicle, primarily the door. This paper is concerned with the development of a lumped mass computer model, which simulates the interaction of a struck car door and an adjacent seated occupant in side impacr, based CTP code which has been successfully used in vehicle and occupant simulation. New model developments include elimination of influence of vehicle side structure stiffness in the occupant injury responses. The model was used to investigated the effect of various door padding characteristics on occupant responses to improve vehicle safety performance. The evaluation of different crush properties of door padding have also focused to understand of behavior of impacted occupant. Results from simulations, The effects of both material coefficients $C_{f}$ and p were illustrated in terms of occupant injury criteria TTI and pelvis.

항공운송인의 손해배상책임 원인에 관한 법적 고찰 - 여객 손해배상책임을 중심으로 - (A Legal Study on liability for damages cause of the air carrier : With an emphasis upon liability of passenger)

  • 오늘날 항공운송은 국가 간 인적 물적 교류를 위한 최적화된 운송 수단이다. 우리나라는 물론 세계 각국은 효율적인 항공운송을 이용하기 위해 국제항공협정을 체결하여 항공사 노선확장과 운항횟수의 증가 등을 이룩하였지만 동전의 양면처럼 항공운송 사고의 발생가능성도 높아졌다. 항공운송 사고의 발생 빈도는 타교통수단 사고와 비교하였을 때 높지는 않아도 항공사고가 발생하면 대형 참사로 이어진다. 항공운송 사고는 국내 운송사고보다 국제 운송사고가 많으며, 사고가 발생하였을 경우에 항공운송인과 여객 또는 송하인 등의 법적 책임에 대한 분석이 필요하다. 항공운송 사고의 법적 규율에 대한 선순위 판단은 항공운송계약의 종류의 구분이다. 항공운송계약은 객체에 따라 항공여객운송계약과 항공물건운송계약으로 분별된다. 특히 항공여객운송 사고는 인명 피해를 발생시키기 때문에 이에 대한 법적 규율에 대한 논의가 더욱 필요하다. 개정 "상법" 항공운송편은 국제항공운송에서 세계적으로 활용되는 조약들의 내용을 우리 실정에 맞게 반영하여 국제적 기준에 맞으면서 체계상으로도 육상 해상 항공 운송을 포괄하는 특징을 갖고 있다. 그러나 "상법"은 운송계약상 항공운송인의 손해배상책임 문제를 규율하는 몬트리올협약을 주로 반영하면서 동 협약이 가지고 있던 문제로 인하여 국내 상황에 맞게 변형 및 생략을 통해 동 협약의 규정을 수용함으로 인해 발생하는 문제들도 생겨나게 되었다. 특히 여객 손해에 대한 손해배상책임의 발생 원인으로서 사고의 개념은 판례의 해석이 반영된 관련 조약과 "상법"에서 어느 정도 명확한 개념 정의가 필요하다고 할 것이다. "상법" 항공운송편의 모법인 몬트리올 협약은 여객의 사망 또는 신체상해의 원인이 된 사고가 '항공기상에서' 또는 '승강을 위한 작업 중' 발생한 경우에 항공운송인의 손해배상책임에 대하여 규정하고 있으며 이는 바르샤바 협약부터 이를 개정한 전 협약에 걸쳐 동일하게 규정되었고 '사고'의 개념 및 '승강을 위한 작업 중'의 범위와 관련하여 지금까지 논란이 계속되고 있는 중이다. 또한 손해배상의 대상 범주인 여객 손해 중 '신체상해'에 여객이 항공운송 중에 입은 정신적 손해를 포함시킬 수 있는지 여부를 두고 논쟁 중이다. 현행법상 신체적 상해의 경우 특정 상황에서 정신적 손해에 대한 배상이 가능하고 항공사고로 인한 발생한 정신적 손해는 중대한 신체적 상해와 같이 피해자로 하여금 정상적인 생활을 할 수 없게 할 만큼 심각한 피해이다. 그래서 여객의 정신적 손해는 관련 조약이나 "상법"상 신체적 상해에 포함하는 것으로 해석할 필요가 있으며 항공운송인의 합리적인 보호와 남소의 예방 측면에서 명백히 증명될 수 있는 정신적 손해만을 배상하여야 할 것이다. 연착 손해의 배상은 바르샤바 협약, 몬트리올 협약, "상법"은 여객 수하물 및 운송물의 연착으로 인한 항공운송인의 손해배상책임 규정은 있지만 연착에 대한 언급을 하고 있지 않기 때문에 연착에 대한 개념 정리가 필요하다. 연착의 개념에 대한 엄격한 해석은 항공운송인의 안전한 운항을 저해할 소지가 있으므로 여객 수하물 또는 운송물이 항공운송계약에 명시된 도착 예정인 공항에 합의된 시간 내에 또는 이러한 합의가 없을 경우 당해 상황을 고려해 선의의 운송인에게 요구할 수 있는 합리적인 시간 내에 도착 또는 인도되지 아니한 경우를 말한다와 같이 정의하는 것이 옳다고 생각한다. 항공사 약관의 손해는 여객 손해는 대한항공의 국제여객운송약관에 의하면 협약이나 기타 법령에서 정하는 경우 이외에 해당하는 항공운송이나 대한항공이 행하는 서비스로부터 여객에게 발생한 손해는 대한항공이 원칙적으로 책임을 부담하지 않고 대한 항공의 태만 또는 고의적인 과실에 기인하여 발생하였다는 사실이 증명되고 동 손해에 여객의 과실이 개재되지 않았다는 점이 판명된 경우에만 책임을 부담한다. 협약 또는 법령에서 정하지 않은 손해의 경우에는 항공사 측의 과실이 증명된 경우에만 책임을 부담한다는 조항인데 대한항공 약관상 '태만' 또는 '고의적인 과실'이라는 용어의 적합성에 대한 판단이 필요하며 중과실이라고 함이 타당하다고 생각된다. 수하물 손해는 대한항공 국제여객운송약관은 여객의 위탁수하물에 포함되어 있는 전자제품 등의 손상 또는 인도의 지연에 대하여 대한항공은 사실을 알고 있는지 여부에 관계없이 책임을 부담하지 않지만 미국을 출발 또는 도착하는 국제선 운송의 경우에는 그렇지 않다. 따라서 미국을 출발 또는 도착하는 국제선 여객을 다른 나라에 출발 또는 도착하는 국제선 여객을 불합리하게 차별하는 것으로 조약의 내용과 동일하게 물품에 대하여 항공사가 책임을 부담하는 방향으로 개정되어야 할 것이다.
