  • This research intends to analyze the implications of current adult guidance system from an angle of people with developmental disabilities in an sudden changed information age. Through it, this research intends to seek improvement of adult guardian system for people with developmental disabilities, a main group of the system, from an angle different from the aged. It focuses on significance and improvement for the significance of adult guardian system for people with developmental disabilities, which are weak for self-decision. Furthermore, for the improvements, this system should be able to be information exchange and communities through the using internet in the cyber space.

  • The right to self-determination in regard to one's body is a key element of human dignity, privacy and freedom. It is constitutionally enshrined in the guarantee of human dignity, in the general right of personality and, most concretely of all, in the right to physical integrity. In principle No-one may trespass another person's body against his will, whether this act improves his physical condition or not. This right of self-determination applies equally to healthy and to sick people. Hence everyone has the right either to permit or to refuse a medical treatment, unless he can not make a rational decision. If the person does not consent himself, for whatever reason, another one must do for him as guardian. Representation in consent to medical treatment is therefore the exception of self-determination rule. This article explored, 1. who can consent to the medical treatment in the case of the mentally incapacitated adult and the infant, 2. what kind of consent to the medical treatment can the deputy determinate for the mentally incapacitated adult and the infant, 3. when the deputy can not determinate without permission of the court, and 4. what can the doctor do in the case of conflict between minors and guardians.

  • First of all, this study shows the legal issues of hospice and palliative care, and the legal basis for lifelong medical practice is generally derived from medical, civil and criminal law regulations, and is applied to patients who are severely ill and dying in principle. In addition, those what is particularly meaningful about hospice and palliative care in terms of legal aspects are discussed the determination of the purpose of care and the provision of medical adaptability and adult guardianship, in particular the legal criteria for the work and status of patient representatives. As such, the purpose of care is to form part of the contract of care and to be agreed between the patient and the physician. In addition, the patient may not write to his/her agent in advance, and the patient may admit discretionary powers to his/her agent, but the patient's will is to be considered. In conclusion, the medical institutional ethics committee should play an active role, especially in the case of no-agents/family or no intention of the patient.

Self-Efficacy effects on Job Burnout of Workers of Independent living support centers for the disabled: Focusing on Mediating Effects of Empowerment (장애인자립생활센터 종사자의 자기효능감이 직무소진에 미치는 영향: 임파워먼트의 매개효과를 중심으로)

  • The purpose of this study is to examine whether empowerment mediates the association between self-efficacy and job burnout of workers of independent living support centers for the disabled. The data were collected through a survey of workers in 108 centers. Findings of the research is as followed. First, we found that self-efficacy as well as empowerment had negative effect on job burnout of workers in centers. Second, we found that empowerment had negative effect on job burnout of workers in centers. And finally, we found a partially mediating effect of empowerment between self-efficacy and job burnout of workers in centers. Based on the findings of this study, specific suggestions were presented to reduce job burnout of workers in independent living support centers for the disabled.

  • In this article, 「Act on the hospice and palliative care and decisions on life-sustaining treatment for patients at the end of life」, 「Act On The Improvement Of Mental Health And The Support For Welfare Services For Mental Patients」, 「Organs Transplant Act」, 「Safety And Management Of Human Tissue Act」, 「Pharmaceutical Affairs Act」, 「Prevention Of Acquired Immunodeficiency Syndrome Act」, 「Tuberculosis Prevention Act」, 「Infectious Disease Control And Prevention Act」 were reviewed. Patients' right to self-determination and consent in these laws are related to civil law. even though they are closely related to the civil law in relation to patients' right to self-determination and consent. In order to consistently operate medical administration, it is necessary to understand the principles of civil law decision-making.

Nurturing Experience of Mothers of Children with Disabilities Admitted to a Group-Home (장애아동을 그룹홈에 입소시킨 어머니의 양육경험)

  • The research subject is 8 mothers who put their physical/mentally impaired children in a group home, as the research method, this study conducted an in-depth interview survey. The participants of this study collected data from the in-depth interview on 8 mothers who put their disabled children to the group home. In the result of open coding, total 34 concepts, 28 subcategories and 13 categories were derived. The core category in the selective coding was 'establishing restorative relationship through entering a group home after encountering the limit of nurture.' Practical Strategies include the following; first, it's necessary to provide psychology counselling consequent on a mother's nurturing phase, and this study proposes a program for a father having a child with disability; in addition, there is the necessity of having to arrange the differentiated facility for physically/mentally impaired people, which meets the needs of the relevant people. At a level of policy, this study suggested the necessity of having to take into account the minimization of poverty problem facing a family having a disable child through the caring card, necessity of the use of good-natured card, and medical-social-welfare-based intervention, expansion of facility-touring class installation, and use of adult guardianship system, and differential payment of disabled child nurturing allowance consequent on income quantile, etc.

Development of Community Health Nursing Service Model: - Based on the Visiting Nurses Project in Seoul, Kyonggi, and Kang-won Area- (지역사회 간호 서비스 전달 체계 모형 개발 -가정방문서비스를 중심으로-)

  • This study was done to identify a status of home visiting project as a community health nursing system, that was the organization. personal who have age, educational background, marital status, position, experience of the home visiting in the public sectors in part of Seoul. Kyonggi, Kang-won area, It was done to provide basis data for the development of effective visiting nurses project in the health sectors, where was Health Centers in urban and rural. Branch of Health Center in rural and Health posts. The question airs were distributed 352 public health workers who working place was 118 health workers in 12 health centers in Seoul. 56 public health workers among 39 health center and other public health sectors in Kyonggi and 178 public health workers among health center and health care sectors. Data collected from October to December. 2000. The analysis by SAS system with F test, percentage and frequency. The major result were as follows. The general characteristics of the respondent show that most of them were graduates from community college and RN-BS with broadcast that they had not completed CPHN course but only two health workers have trained for the visiting nurses project. As for their grade in the position, the most of health workers have seventh level and the other CHP were above sixth level in the health care post that in the government structure. This indicates that workers do not have great authority in decision making, the most period of works in the position was one and two years indicating that they change jobs frequently. On an average their clinical experience was 4.11 years which is ideal for the total service. As for preparation of staff for home visiting workers education on visiting nurses program have to receive short term or longer term training course for strong emphasis. The analysis showed that public health visiting workers responds about active job performance that based on an area, approach of acting by districts, education and position are shown statistically significant difference between acceptance of the visiting nursing job show the same as well as visiting nurses project. Special concerns for visiting Nursing care spread came to burden, many of activity carry out main solution is covered the health problem connective support system needs of quality and quantity which out health problem. As 71.1% of visiting health service held on the poor population was under the guardianship of the law, but people who health insurance wide application under law shown a tendency to increase gradually. The general characteristics of the patients showed 56.2% of female on average of age was 66.1 years old, they have health problem was the most of 47.6% of high blood pressure and stroke, the other and as a problem that economics, which is complex welfare with out health problem. Community health care service should be combined health and social work program. The form of delivery of visiting health care given the most guide and education with counselling and support. (33.6%) Among the six category of visiting care service shown statistically significant difference and next is fundamental care, remedy care with priority.

Study on the Process and Roles of Sibling Caregiving for People with Chronically Mentally Illness (만성정신질환자 형제자매의 보호자 됨의 과정과 그 역할유형에 관한 연구)

  • Under the Korean mental health circumstances where familistic culture is predominant and social resources are limited, siblings are an important presence that effect chronically mentally ill people's lives. Despite this fact, our society in some aspect overlooks their importance. Therefore, this study is focused on the role of siblings as caregivers of chronically mentally ill adults and is conducted to understand the relevant process and types of how siblings fulfill the role of caregivers. In order to achieve this goal, data was collected from nine study participants through individual interviews and focus group interviews and its contents were analyzed according to Grounded Theory. The results revealed that the siblings' experiences as caregivers of chronically mentally ill people were mainly categorized as 'carrying painful memory, responsibility, and concern about the obscure future of the mentally ill sibling and finding a caring role different from those of parents.' Moreover three types of sibling caregivers were recognized: 'reality-adapting, obligation fulfilling' type, 'sacrificial self-responsibility fulfilling' type, and 'growing guardianship creator' type. This research aimed to vividly deliver the voices of research participants and proposed social support and permanent planning services based on the experiences and desires unique to siblings.

Experiences of Korean Homestay Guardians of Early Study Abroad Students in the U.S. (미국 한인 조기유학생 홈스테이 가디언의 경험)

  • The aim of this study was to determine key experiences of homestay guardians of unaccompanied minor Korean adolescents studying abroad in the United States through qualitative research method of grounded theory methodology. This study identified guardianship experiences and the process of adjustment to life with homestay students through in-depth interviews with 12 subjects who are Korean guardians in the United States. The results of this study classified "started with concern" as a category that leads guardians to start providing homestay accommodation, and "other's recommendation," "need for financial support," and "unexpectedly" as subcategories. This study identified "act as a mediator to resolve differences" as a key experience of guardians, and classified subcategories are "parental role" and "calculation of gains and losses" on a personal level; and "feel sorry for own children," "limited leeway of the family," and "formation of relationship between own children and homestay students" on a family level. Developed subcategories are "thirsty for attention," "vulnerability," "task on freedom and control," and "regrettable feeling in the absence of communication" with respect to relationship with students; "grade expectations," "one-way communication," "trapped between parents' and students' demands" in regard to relationship with parents; and "advice from school" in the aspect of school. "Cultural difference," "preparedness of students and parents," "age differences between guardian's children and students," "family support," "similar personalities," "guardian's motivation," and "parent's attitude" are subcategories that affect central phenomenon of guardians.

  • This study compared policies of elderly abuse of long-term care facilities on WHO, Main countries for improvement of Korean policy. So, This study reviewed policies of elderly abuse of long-term care facilities on WHO, Main countries. So, This study reviewed risk factors that may increase the potential for abuse of an older person can be identified at individual level, care-woker levels, socio-cultural levels and facilities levels. The results of the study were as follows: First, The openness of long-term care facilities are emphasized on many countries. There are a need for a policy considerations such as policies of Ombudsman, Adult guardianship for visiting facilities, external monitoring. Second, There was a difference of facilities infrastructure and workers of treatment condition long-term care facilities each other countries. So It is important to improve facilities infrastructure and workers of treatment condition. Third, It is necessary to consider traits of elderly in long-term care facilities. Especially, it is required to manage dementia elderly and elderly on night time in long-term care facilities. Finally, implications and future directions of policies of elderly abuse of long-term care facilities were discussed based on the finding of the study.
