미국과 캐나다 노인밀집도시의 노인주거관련 사회적지원에 관한 연구 : 농촌지역 소도시를 중심으로 (A Study on Social Supports for the Elderly Housing in Senior Concentrated Cities in the United States and Canada : Focused on Small Cities along Rural Counties)

  • The purpose of this study is to explore social supports for elderly housing and their residential lives in small cities along rural counties of the United States and Canada, and suggest future implications for age-concentrated rural villages in Korea. In this study, five small and medium cities in non-metropolitan counties of California and Ontario province were visited and elderly residents and service experts were interviewed about their perceptions of community integrated social support networks for senior residences. The senior housing complexes were built due to influx of both metropolitan and rural residents seeking warm localities, traffic connections, business purposes in active production areas. and leisure attractions. There are five main social support networks for senior housing issues in these areas. First, the areas are claimed for senior zones and accordingly health industries are encouraged by local authorities. Second, the community is homogeneously constructed as a senior friendly environment and include features such as an RV park and mobile cottages. Third, senior-helping seniors are offered active work through golf-cluster active retirement communities. Fourth, traditional theme production camps are mobilized by the elderly workers. Lastly, an information system is maintained for screening volunteers and for senior abuse prevention. On the other hand, residential lives are occasionally negatively influenced by unbalanced concentrations of elderly facilities such as nursing stations and funeral homes. For the future of Korean rural elderly policies, suggestions are made as follows: first, an integrated urban and rural township that contains attractive places for early retiring people who seek a warm atmosphere in later life needs to be constructed. Second, an integrated model retirement village of urban and rural retirement life needs to be initiated as a measure of evaluating the adaptation process of movers in senior concentrated zones. Third, a cooperation system among governmental ministries needs to be formed with the long- term goal of establishing a traditional rural town of independent housing districts and medical facilities in rural areas. Fourth, productive and active lifestyles need to be maintained as the local community and government develop successful retirement rural villages, by limiting the expansion of nursing related facilities. Finally, generation integrated visiting welfare programs and services need to be further developed for the housing areas especially in the winter, when social integration and activity are relatively low.

말기암 환자와 가족의 의료 및 간호 서비스 요구 (The Study on the Medical and Nursing Service Needs of the Terminal Cancer Patients and Their Caregivers)

  • In this study, we attempted to investigate the needs and problems of the terminal cancer patients and their family caregivers to provide them with nursing information to improve their quality of life and prepare for a peaceful death. Data was collected from August 1, 1995 to July 31, 1996 at the internal medicine unit of S hospital in Seoul area with the two groups of participants who were family members of terminal cancer patients seventy four of them were in-patients and 34 were out-patients who were discharged from the same hospital for home care. The research tool used in this study has been developed by selecting the questionnaires from various references, modifying them for our purpose and refining them based on the results of preliminary study. While general background information about the patients was obtained by reviewing their medical records, all other information was collected by interviewing the primary family caregivers of the patients using the questionnaire. The data collected were analyzed with the SPSS PC/sup +/ program. The results of this study are summarized as follows ; 1) Most frequently complained symptoms of the terminal cancer patients were in the order of pain(87%), weakness(86.1%), anorexia(83.3%) and fatigue (80.6%). 2) Main therapies for the terminal cancer patients were pain control (58.3%), hyperalimentation(47.2%) and antibiotics(21.3%). 3) Special medical devices that terminal cancer patients used most were oxygen device (11.1%), and feeding tube(5.6%). Other devices were used by less than 5% of the patients. 4) The mobility of 70.4% of the patients was worse than ECOG 3 level, they had to stay in bed more than 50% of a day. 5) Patients wanted their medical staffs to help relieve pain(45.4%), various physical symptoms(29.6%), and problems associated with their emotion(11.1%). 6) 16.7% of the family caregivers hoped for full recovery of the patients, refusing to admit the status of the patients. Also, 37% wished for the extension of the patient's life at least for 6 months. 7) Only 38.9% of the family members was preparing for the patient's funeral. 8) 45.4% of family caregivers prefer hospital as the place for the patient's death, 39.8% their own home, and 14.8% undetermined. 9) Caregivers of the patients were mostly close family members, i.e., spouse(62%), and sons and daughters or daughter-in-laws(21.3%). 10) 43.5% of the family caregivers were aware of hospice care. 46.8% of them learned about the hospice care from the mass media, 27.7% from health professionals, and the rest from books and other sources. 11) Caregivers were asked about the most difficult problems they encounter in home care, 41 of them pointed out the lack of health professionals they can contact, counsel and get help from in case of emergency, 17 identified the difficulty of finding appropriate transportation to hospital, and 13 stated the difficulty of admission in hospital as needed. 12) 93.6% of family caregivers demanded 24-hour hot line, 80% the visiting nurses and doctors, and 69.4% the volunteer's help. The above results indicate that terminal patients and their family caregivers demand help from qualified health professionals whenever necessary. Hospice care system led by well-trained medical and nursing staffs is one of the viable answers for such demands.

떡의 이용실태(利用實態) 및 시판제품(市販製品)에 대(對)한 평가(評價) (A Survey on the Utilization of Korean Rice-Cakes and the Evaluation about Their Commercial Products by Housewives)

  • 본 조사는 서울시, 충남 대전시, 경북 영주시, 충남 서천군에 거주하는 530명의 주부를 대상으로 1987. 11. $16{\sim}11$. 28 사이에 떡의 이용실태와 시판제품의 품질특성에 대한 주부들의 평가도를 조사했던 바 여기에서 얻어진 결과를 요약하면 다음과 같다. (1) 조사대상자의 가정에서 이용하는 떡의 종류는 총 37종 이었고 그중 인절미(67.9%), 송편(66.6%), 흰떡 (51.4%), 개피떡(43.4%) 등 일부 도병류의 이용율이 높았고 전병류, 단자류 및 일부 증병류의 이용율은 아주 낮았다. (2) 의례시 떡의 이용율은 혼례때 가장 높았고 상례때 가장 낮았으며 돐, 혼례, 회갑때는 백일, 어른과 아이의 생일, 제사, 상례때보다 떡의 이용율이 높은 경향이었다. (3) 의례시 가장 많이 이용하는 떡은 백일, 돐, 아이의 생일에는 백설기로 어른의 생일, 혼례, 제사, 회갑에는 인절미로 나타났다. (4) 어른과 아이의 생일에는 케이크의 이용율이 (36%내외) 떡보다 높은 경향이었다. (5) 절식시 떡의 이용율은 설날에 가장 높았고 그 다음이 추석으로 나타났으며 그밖의 절식은 조사대상자의 가정에서 거의 지켜지지 않고 있었다. (6) 전체조사대상주부들중 61.7%가 앞으로도 계속 가정에서 떡을 만들겠다고 응답했던 바 아직까지 대부분의 주부들은 의뢰 또는 구입하기보다는 가정에서 직접 만들고 싶어하는 경향임을 알 수 있었다. (7) 조사대상주부들이 시판제품을 구입하는 이유는 간편해서가(65.8%) 가장 많았고 또한 시판제품을 구입하지 않는 이유는 내 손으로 직접 만들고 싶어서가(44.3%) 가장 많았던 바 두가지 이유가 상반되는 경향이었다. (8) 조사대상주부들은 시판되는 떡의 품질특성중 맛과 색 등 관능적인 면은 비교적 좋게 평가하는 경향이었고 가격, 위생성, 포장 및 저장성 등을 나쁘게 평가하는 경향이었다. 시판제품의 색은 주부의 거주지에 따라 농어촌에 거주하는 주부가 도시에 거주하는 주부보다 더 좋게 평가하는 경향이었다. (p<0.05) 위생성은 주부의 학력과 거주지에 따라 주부의 학력이 높을수록, 농어촌지역보다는 도시에 거주하는 주부일수록 시판제품이 더 비위생적이라고 평가하는 경향이었고(p<0.01) 포장에 대해서는 주택형태에 따라 농가나 아파트에 거주하는 주부가 단독주택이나 연립주택에 거주하는 주부보다 더 나쁘게 평가하는 경향이었다. (p<0.05) (9) 조사대상주부들은 시판제품의 가장 개선해야 할 점으로 위생성(37.0%), 가격(23.8%), 포장(15.6%), 맛(11.1%), 저장성(10.1%) 및 색(2.4%) 등의 순으로 지적하였고 주부의 거주지에 따라 대도시에 거주할수록 위생성을, 농어촌에 거주할수록 가격을 가장 개선해야 할 점으로 보는 경향이었다. (p<0.05)

떡류(類)의 문헌적(文獻的) 고찰(考察) -(1670년${\sim}1943$년의 우리말 조리서를 중심으로)- (A Bibliographical Study of Dock(Korean rice cake))

  • $D{\acute{o}}ck$ (Korean rice cake) is a peculiar food of Korea made of grain. By means of cooking from, it is defined as 'Pulvberzed food of grain' $D{\acute{o}}ck$ was one of the daily food, but development of boild rice had narrowed it's use to the food of festive days and ceremonies. $D{\acute{o}}ck$ is used as a main food of all Kinds of ceremonies from one's birth to death, such as the Three seven day(a baby's twenty-first day of life), one hunderdth day, birthday, wedding, both brithday, funeral and sacrifical rites, vocational ceremonies, such as a sacrifice to spirits and a srevics for a big catch of fish. It is also used as a present and seasonal food. A large variety of $D{\acute{o}}ck$ is available and its recipe is scientific and reasonable. In this treatise, the Kinds of $D{\acute{o}}ck$ and the frequency of them, the material, the recipe, the measuring unit of material, cooking kitchen utensils and the cooking terms are studied from the books published in Korea from 1670 to 1943. 1. $D{\acute{o}}ck$ was classified as Tcbin $D{\acute{o}}ck$(steamed), Chin $D{\acute{o}}ck$(strikn), Chijin $D{\acute{o}}ck$(fried) and Salmun $D{\acute{o}}ck$(boiled), according to its way of cooking. 2. There were 122 Kinds of $D{\acute{o}}ck$, 57 were Tchin $D{\acute{o}}ck$, 35 Chin $D{\acute{o}}ck$, 20 Chijin $D{\acute{o}}ck$, and 10 Salmun $D{\acute{o}}ck$. 3. There were 34 Kinds of measuring units. Of them, 13 for volume, 4 for weight, 9 for quantity, 4 for length and 4 for the rest. 4. There were 55 Kinds of cooking Kitchen utensils but now many of them are not used because of mechanization or automation of tools of living. 5. There were 143 Kinds of cooking terms. Of them 49 for the preparing process, 25 for the mixing process, 27 for well-forming process 10 for process of getting ready to cook, 14 for heating process, 10 for cutting process, 5 for dishin process and 3 for process of soaking in sugar or honey.

우리나라 옷에 대한 현대인(現代人)의 의식(意識)과 춘용실태(春用實態)에 관(關)한 연구(硏究) - 서울 지역(地域)을 중심(中心)으로 - (A Study on Modern People's Consciousness and Wearing Practice of Korean Costumes)

  • It is significant for developing the future for us to know our present age. In order to preserve our Korean costume as a fola clothes retaining our distinguished independent characterisitics and to help design the tomorrow of our Korean costume playing a role as a racial to develop the world clothing culture, a survey was conducted to investigate modern people's conscious-ness and wearing practumes of Korean costume by questionaire and interviewing methods. The results of the survey were analyzed as follows: (1) At present, Korean costumes were purchased as customtailored(64.0%) and as ready-made(17.8%) and most of them were not made at individual homes. The laundry and ironing of them were carried out at laundry shops(68.8%). Considering our present economic, social and cultural aspects, sowing, laundryand ironing will not be carried out at homes again in the future and ready made costumes seen to be produced in a large scale in the future. Garment makers and laundry shop operators should be trained how to make our Korean costumes retain our traditional beauty in the course of their production and laundry and the makers of ready-made costumes must make research how to efficiently produce ideal ready-made costumes by adopting the synchro system in their wrk odisivion. (2) The age group wearing Korean costumes most frequently was the aged people over 60 (their wearing rate; 45%-50%) and the group wearing them most frequently next io the aged people over 60, was housewives(their wearing rate; 15%-20%). Excludign aged people and housewives, other respondentsdid not wear Korean costumes very frequently. Men's wearing rate was lower their wearing rate was the younger their ages were and the less their monthly incomes were. Korean costumes were used for holiday and festival(60%), wedding and funeral ceremonies (52%), visiting and working(22%), casual wear(12.8%) and home wear(9.2%). The use of Korean costumes as casual and home wears, was lower than the use for holday, festival, visiting and working, Under our present circumstances in which our Korean people use both Western style clothes and Korean costumer, our Korean costume has lostits position as a basic and necessary requiement in Korean people's daily life and become a ceremonical and fancy costume. It is natural that the times and life change everything in our daily life. Our costume has to be made as good ceremonial and fancy clothes satisfying modern sensibility according to its new role. In order for us to get close with our clothes, a keen study must be carried out to cleat the color, material, style, function and harmony of the Korean costume matching the of the times. (3) The 47.8% of the respondents answered that they were proud of our Korean costume as our folk clothes, 47.6% replied that thought them just common and 1.1% responded that they were ashamed of it. Most of them were affirmative in feeling pride with our Korean costume. (4) Considering the functional aspect of Korean costumes, their strong points were symetric beauty, rhythmical beauty, unity feeling, harmonical beauty and detailed decorations. Their common shortcomings were lack of individuality and inadequateness for active life. The shortcomings of woman costumes were suppressing breast, making resperation difficult and in adequnteness in summer time. The main reason not to wear our Korean costumes, was due to the fact that they are incomvenient for active life. As a measure to eliminate such shortcomings, 1) the suspension system of skirt to remove the suppression of breast should be generally adopted. 2) they should be simplified in their structure to make them convenient for active life and adepuate in wearing them in hot weather in an extent to which the traditional beauty of the costume may not be lostand 3) a new technique must be explored for showing individuality by wearing method and new arrangment of colors and decorations. (5) The reasons desiring to wear Korean costumes were classifide as follows: A. Korean costumes are our traditional clothes(43.4%). B. Korean costumes are noble and beautiful(26.8%). C. They are accustomed to wear Korean costumes by habit(19.5%). D. Korean costumes are necessary for attending ceremoneis(9.5%). E. Miscellaneous reasons(0.8%). Classifying these reasons into age groups, the high age group over 40 wore them because they were easy to wear by habit and the low age group of 10-30 never thought that they were east to wear by habit. Considering that even those who were accustomed to wear Korean costumes showed a low wearing rate and that the young generation were accustomed to wear Western style clothes rather than Korean costumes, the wearing rate of Korean costumes will be reduced in the future if such trend continues. It is urgent for us to make our best efforts in order to enhance the interest of young generation in Korean costumes and not to make them lose the strong points of Korean costume in the future. (6) Conicering the plan of the respondents on what kind of clothes they were going to wear in the future, among the age group over 50, those who wanted to wear only Korean costumes were 24.8%(men) and 35.1%(women), those who wanted to wear 49.7%(men) and 47.4(women), those who wanted to wear chiefly Western style clothes were 20.7% (men) and 14.4%(women) and those who wanted to wear only Western style clothes, were 2.4% (men) and 2.1%(women). This shows that the general tendency to wear only or chiefly Korean costumes is more prevalent than that to wear only Western style. Among the age group under 50, the tendency to wear Western style clothes was conspicuous and most of the respondent answered that they would wear chiefly Western style clothes and Korean costumes occasionally. Only 5.4% of the respondent answered that they would wear only Western style clothes and this shows that meny respondents still wonted to wear Korean costumes. Those who wanted their descendants to wear what they desire, were 50.1%(men) and 68.8% (women) and those who wanted their descendants to wear Koran costumes occasionally, were 85.8%(men) and 86.3%(women). This shows that most of respondents wanted their descendants to wear Korean costumes. In order to realize, it is necessory for us to make ourdescendants recognize the preciousness of our traditional culture and modify our Korean costumes according to their taste so that they may like wearing them.

실전 판소리의 재탄생 연구 - 창극 <변강쇠 점 찍고 옹녀>를 중심으로 - (The study on the rebirth from a lost pansori : An aspect of a changgeuk )

  • 본 논문은 국내 뿐 아니라 해외에서도 <마담 옹(Madame Ong)>이라는 제목으로 그 작품성을 인정받은 국립창극단의 창극 <변강쇠 점 찍고 옹녀>를 통해 실전판소리가 어떻게 새롭게 재탄생되었는지, 그 과정에 주목하여 이 작품의 텍스트와 음악적 특징을 분석해보았다. 창극 <변강쇠 점 찍고 옹녀>는 현재에는 실전된 판소리 <변강쇠가>를 각색하여 창극으로 만든 작품이다. 이 과정에서 변강쇠의 치상부분인 후반부의 내용을 삭제하고, 옹녀가 변강쇠를 되찾아오기 위해 장승들과 전쟁을 벌이는 내용을 새롭게 삽입하여 텍스트의 변화를 주었다. 또한 <변강쇠 점찍고 옹녀>라는 제목에서도 드러나듯, 원작과는 다른 관점으로 변강쇠가 아닌 옹녀를 주인공으로 삼아 그동안 음녀로만 여겨졌던 옹녀를 자신의 운명에 맞서 싸우는 주체적이고 독립적인 여인으로 변모시켰다. 창극 <변강쇠 점 찍고 옹녀>는 모든 소리가 작창으로 만들어졌는데, 극과 가장 부합되는 소리, 즉 이면에 맞는 소리를 표현하기 위해 창자간의 화음을 넣는 등, 여러 가지 시도가 이루어졌다. 또한 소리를 하는 인물 혹은 등장인물의 심경 변화에 따라 그 소리의 조와 성음이 달리 사용되었음을 알 수 있다. 창극 <변강쇠 점 찍고 옹녀>는 특히 반주음악에서 다양한 시도가 이루어졌는데, 소리북을 여러 개 사용하거나 대중가요에서 왈츠, 클래식, 각도민요에 이르기까지 다양한 장르의 음악을 사용하는 등 도전적인 시도를 했다. 이러한 시도들은 극을 더욱 풍성하게 만들었고 사실감 있는 극적표현을 도와주었다. 이렇듯, 창극 <변강쇠 점 찍고 옹녀>는 내용적인 측면에서는 고전서사를 차용했지만, 음악적인 측면에서는 기존의 창극에서 벗어난 다양한 변화와 시도들을 통해, 온고지신의 면모를 갖춘 새로운 창극의 모습을 보여주었고, 현대 사회에서 창극이 나아가야 할 방향과 가능성을 제시해 준 작품이다.

국제항공운송 승무원이 항공기내에서 사상(死傷)을 당한 경우 법률관계 - 국내외 판례의 분석을 중심으로 - (Legal Issue in Case of Death or Injury of an International Crew While on Board)

  • 여객이 1999년 몬트리올 협약 제17조상 사고로 인정되는 범위 내에서 사상을 당하였을 때 항공운송인은 위 협약을 근거로 손해배상을 받을 수 있다. 항공기에 탑승한 승무원이 같은 사고로 인하여 사상을 당한 경우 몬트리올협약을 배타적으로 적용받는 여객과는 달리 항공사와 체결한 근로 계약상 준거법인 노동법에 의하여 보상받게 된다. 승무원이 근로제공을 위하여 항공기에 탑승하는 것은 근로계약을 근거로 한 것이지 항공여객운송계약을 근거로 하는 것이 아니다. 그러므로 사고로 인하여 항공기에 탑승한 승무원이 사상을 당한 경우, 사용자인 항공사에 대하여 근로계약에 기한 채무불이행 책임을 묻는 경우에는 노동법이, 근로자 또는 유족이 사용자를 상대로 불법행위에 기한 손해배상을 청구하는 경우에는 민법이 적용된다. 이와 관련하여 중국항공사에 근무하는 중국승무원이 대한민국에서 사고를 당하여 사망한 경우 유족이 중국 항공사를 상대로 손해배상을 청구하는 사건에서 불법행위지인 대한민국에서 국제재판관할이 있는지 여부, 이때의 준거법은 법정지법인 대한민국법이 되는지 근로계약의 준거법인 중국법이 적용되는지 대법원 2010. 7. 15. 선고 2010다18355 판결을 통하여 살펴보았다. 또한 서울지방법원 1995.5.18. 선고 94가단14412판결은 비행근무 중 상해를 입은 승무원이 근로기준법상 재해보상, 산업재해보상보험법상 보험급여에 만족하지 않고, 사고에 관하여 책임이 있는 사용자나 제3자를 상대로 불법행위나 채무불이행을 원인으로 한 민사상 손해배상을 청구할 수 있다는 것을 보여준다. 출근 중 기존의 질병으로 인하여 사망한 사건에서는 근로복지공단에서 망인의 사망을 업무상 재해로 인정하지 아니하여 망인의 부모가 유족급여 및 장의비 부지급 처분을 취소하는 소송에서 1심(서울행정법원 2017.8.31. 선고 2016구합 81642 판결)에서는 업무상 재해로 인정되었지만, 항소심(서울고등법원 2018.7.19. 선고 2017누74186 판결)에서 패소하여 고인의 질병 및 업무량에 관한 분석을 통하여 항소심의 판결을 비판하였다. 승무원의 근무 형태는 타 직종과는 다르게 항공기에 탑승하여 이루어지는 것이므로 다른 근무지로 이동하거나 비행근무 종료 후 모기지 또는 체류지로 돌아오기 위하여 비행임무는 수행하지 않으나 비행근무시간의 50%만 인정받는 형태로 항공기에 탑승하는 경우도 발생한다. 여객과 동일하게 간주할 수는 없지만 비행임무를 하지 않는 승무원이 사고로 사상을 당한 경우 근로계약에 기인한 손해배상 청구를 할 것인지 국제항공운송에서 사고발생시 여객에게 적용되는 몬트리올협약이 배타적으로 적용될 지에 관한 논의와 함께 그와 관련된 판례인 In re Mexico City Aircrash of October 31, 1979, 708 F.2d 400 (9th Cir. 1983), Demanes v. United Airlines, 348 F.Supp. 13 (C.D.Cal. 1972), Sulewski v. Federal Express Corp., 749 F.Supp. 506 (S.D.N.Y. 1990)을 검토해 보고 유럽사법재판소(CJEU)에서 Wucher Helicopter GmbH and Euro-Aviation Versicherungs AG v. Fridolin Santer를 통하여 정의한 '여객'의 개념을 명확하게 이해해 보도록 한다.
