The paper reviewed and analyzed Korea's Paperless trade system and distinctive characteristics of the 'e-B/L Korea Service. Parts of the fOWld distinctive characteristics of the Korea's e-B/L service are as follows; It is well equiped with IT and legal system. • Since July 7 mutual declaration in 1988 which is a landmark for South-North Korean relations, Inter-Korean Trade has been set out. During the period, the Inter-Korean Trade has been ups and downs depending on the Inter-Korean relations and economic situation of both countries. South Korea became one of the major three trading countries of North Korea's trading partners in 2000, when the sum of annual trade volume reached the record 425million US dollars. A rapidly increasing number of countries including North Korea are developing national policies and strategies to promote the digital economy, recognizing the potential benefits of e-business as an engine of growth and development. However, the trade structure of South-North Korea remains very simple in terms of its contents. Furthermore trade procedure many limitations especially electronic commerce in North Korea has many obstacles to working properly. The information in Inter-Korean trade cannot be shared in common. South Korean firms have suffered repeatedly trial and error and excessive competition took place among South Korean firms. Institutional inertia related to mutual trade, political and military Impacts on Inter-Korean economic relations, abnormal industrial structure of North Korea and insufficiency of SOC could be mentioned as major problems in Inter-Korean trade as well. Several measures should be taken in order to cope with those problems. First of all, South Korean government should provide valuable information to business firms about North Korean economy and business environments. It is suggested that forums related to inter-Korean trade hold in regular base between South and North Koreas and establish the system of business information sharing. Second, the government should improve various laws and regulations to respond to the realistic needs of inter-Korean trade. That is, detailed measures should be taken to guarantee investment in electronic commerce. Third, it is desirable to start with the mutual agreement between South and North Korea.

  • The purpose of this study is to identify key obstacles to the adoption of electronic bill of lading and to suggest an effective way to promote the utilization of electronic bill of lading in international trade field. This study finds that all the respondants have not used 'true' electronic bill of lading that is issued and distributed electronically, and most of them agreed the needs of e-B/L adoption, but their intentions to adopt e-B/L remain very low in the present situation. Five obstacles to the adoption of e-B/L were derived from an explanatory factor analysis: 'integration' factor, 'law institution' factor, 'usability' factor, 'economic efficiency' factor, and 'security' factor. Solutions to promote the utilization of e-B/L in international trade field are as follows; Firstly, to endow e-B/L with the legal force through amending relevant laws including the commercial law. Secondly, to conclude the relevant international agreement, and to carry out joint projects between nations are needed. Thirdly, to conduct publicity campaigns is required to increase the understanding of the concepts and benefits of e-B/L to all concerned parties. Fourthly, stable and reliable system must be constructed with high level security. Fifthly, to readjust the service fee of e-B/L system to a realistic level is to be needed in order for user companies to use e-B/L service.

  • The objective of this study has two folds. The first is to investigate current global certification system and the second is to suggest some possible solutions for expanding global e-trade networks. Both research and industrial communities recognize the importance of global certification problems in connection with global e-trade payment because global e-trade volume continue to grow. But not many research results have been reported to the communities in identifying some barriers against active global certification systems. This paper intents to suggest some possible solutions for improved global certification system and the results are summarized as follows: First, strict certification structure has to be relaxed by considering diverse mutual certification methods in global e-trade practice. This paper provides some comparative results about mutual certification methods among different nations. Second, numerous business models have to be derived such that they can be applied to other global certification applications than global e-trade. Third, global certified networks have to be expanded beyond mutual certification level. Once the certified structure among different nations have been established then diverse certified authority channels have to be implemented. Finally, since Korea has already established very good public certification infrastructure within the nation this platform has to be positioned in the center of global e-trade networks. This paper has of course to accept a critique such as this study provided limited results to generalized global e-trade certification model, and therefore empirical study for assessing robust model should be pursued in the future.

  • The electronic trade(e-Trade) revolution is changing the international trade processes dramatically. It permits new kinds of interactions among exporting and importing firms as well as internally within the firms. Ever since the Internet became a popular communications medium in the 1990s, lawmakers have struggled to develop rules for determining which courts can hear disputes involving parties in different choice of law and jurisdictions. In conclusion, I suggest an ongoing research agenda for further refining and developing a more comprehensive cosmopolitan approach. Certainly, as these cases make clear, reconceptualizing the principles underlying court to-court relations is essential in a world where the idea of a transnational community of courts is fast becoming one of the dominant realities of twenty-first century law.

  • Trade rules in service and digital sectors mainly focus on reducing regulatory uncertainties by improving transparency and minimizing unnecessary requirements. Recognizing the importance of digital trade rules and trade in information and communication technology (ICT) sectors, governments worldwide have rapidly adopted and expanded rules on free flow of data, personal data protection, electronic authentication, and cybersecurity. On the other hand, advances in technology have led governments to face multiple threats related to cybersecurity, intellectual property (including that related to source code and algorithms), and unauthorized access to proprietary information of their suppliers. This study presents digital trade rules related to digital security emphasizing cybersecurity, source code, and ICT products that use cryptography in different trade agreements. Additionally, it introduces various approaches that major countries are taking to both address digital security issues and seek balance between security enhancement and trade liberalization.

  • In this paper, I examined the trends of standardization and electronization of trade documents and SWIFT network. Also, I reviewed on emerging electronic documentary credit for electronic payment and electronic presentation of documents. New international trade customs and practices are being established and changed as a result of the growth of the Internet and other on-line networks. At the same time there is increasing pressure to move from existing paper-based documentary credit to electronic documentary credit. Several projects devoted to development of an electronic letter of credit infrastructure have recently been proposed such as Bolero, SWIFTNet, UNeDocs and eUCP, etc. Yet, little can be done until the presentation process is electrified between traders and banks. Also, interbank communication of letters of credit has long been electronic, mainly through the SWIFT. However, it is not functioned between applicant and beneficiary, although the solution of SWIFTNet has recently been developed. The Banking Commission of International Chamber of Commerce established a working group consisting of experts in the related fields to prepare the appropriate rules as a Supplement to UCP 500 for Electronic Presentation: eUCP. The eUCP will provide the necessary rules for the presentation of the electronic equivalents of paper documents under letters of credit. Some problems of electronic presentation under the eUCP, exist such as format, presentation of electronic records and the way of beneficiary's notice for completeness under the Article e5 if more than one record is to be presented electronically by third parties. Therefore, it is encouraged to provide more detailed guide for eUCP Article e5.
