A Study on the Adoption of Convention on the Use of Electronic Communications in International Contracts and its Application to the Arbitration Agreement (국제계약에서 전자통신의 이용에 관한 협약의 채택과 중재합의에의 적용에 관한 연구)

  • The purpose of this paper is to make research on the method of arbitration agreement, the adoption and contents of the Convention on the Use of Electronic Communications in International Contracts, and the standpoint and problem with reference to the new Convention's application to the method of arbitration agreement in New York Convention. Last year the UN General Assembly and UNCITRAL adopted a new Convention on the Use of Electronic Communications in International Contracts that makes agreements by electronic communications enforceable, including arbitration agreements under the Convention on the Recognition and Enforcement of Foreign Arbitral A wards (New York Convention). Aimed at enhancing legal certainty and commercial predictability where electronic communications are used in relation to international contracts, the provisions of the Convention deal with, among other things, determining a party's location in an electronic environment; the time and place of dispatch and receipt of electronic communications; and the use of automated message systems for contract formation. Under the New York Convention, arbitration agreements in international contracts must be reduced to writing before they can be enforced. But under the new Convention, an arbitration agreement made entirely in electronic form would be enforceable. The working group expressed overall support in favor of the inclusion of a reference to the New York Convention in the new Convention. However, one proposal was that the exclusions provided under article 2 of the new Convention might be too broadly worded to adequately accommodate the New York Convention. In conclusion, Korea's government authorities should take prompt measures to sign and ratify the new Convention, and declare on the scope of its application. Also Korea's arbitration institute should make preparation for the amendment of the arbitration act and arbitration rules in accordance with the new Convention.

  • IT Service Management (ITSM) achieves consolidated management for the IT services supporting the acquisition system, and no outside connections can be established with such ITSM. Issues pertaining to the D2B can be addressed to System Q&A or a Call Center for problem-solving. In other words, internal staff can take the necessary measures for problems by directly connecting with ITSM. Currently, diverse innovative technologies are being used in electronics and ubiquitous computing environments. This allows us to create a better world by providing the backbone for remarkable development in our human society in the fields of electronics, devices, computer science, and engineering. Following the expansion of IT services in the military acquisition sector such as Defense Electronic Procurement, military export/import support system, etc., customers' dependence on IT for conducting business with the military or related companies is increasing, including the military's dependence on the same technology for services to the public. Nonetheless, issues pertaining to the simplified/integrated management of complex IT service management systems, including slow system recovery, lack of integrated customer service window, and insufficient information sharing, have become the priority problems that IT managers are required to solve. Therefore, this study conducted research on the integrated management of IT services provided by Korea's national defense acquisition system, which was developed based on the existing system IT Infrastructure Library (ITIL) v2, and investigated the level of satisfaction with services with focus on ensuring that it can be used for understanding the necessity of the system and its advancement in the future.

An Empirical Study on the Determinants of Supply Chain Management Systems Success from Vendor's Perspective (참여자관점에서 공급사슬관리 시스템의 성공에 영향을 미치는 요인에 관한 실증연구)

  • The supply chain management (SCM) systems have emerged as strong managerial tools for manufacturing firms in enhancing competitive strength. Despite of large investments in the SCM systems, many companies are not fully realizing the promised benefits from the systems. A review of literature on adoption, implementation and success factor of IOS (inter-organization systems), EDI (electronic data interchange) systems, shows that this issue has been examined from multiple theoretic perspectives. And many researchers have attempted to identify the factors which influence the success of system implementation. However, the existing studies have two drawbacks in revealing the determinants of systems implementation success. First, previous researches raise questions as to the appropriateness of research subjects selected. Most SCM systems are operating in the form of private industrial networks, where the participants of the systems consist of two distinct groups: focus companies and vendors. The focus companies are the primary actors in developing and operating the systems, while vendors are passive participants which are connected to the system in order to supply raw materials and parts to the focus companies. Under the circumstance, there are three ways in selecting the research subjects; focus companies only, vendors only, or two parties grouped together. It is hard to find researches that use the focus companies exclusively as the subjects probably due to the insufficient sample size for statistic analysis. Most researches have been conducted using the data collected from both groups. We argue that the SCM success factors cannot be correctly indentified in this case. The focus companies and the vendors are in different positions in many areas regarding the system implementation: firm size, managerial resources, bargaining power, organizational maturity, and etc. There are no obvious reasons to believe that the success factors of the two groups are identical. Grouping the two groups also raises questions on measuring the system success. The benefits from utilizing the systems may not be commonly distributed to the two groups. One group's benefits might be realized at the expenses of the other group considering the situation where vendors participating in SCM systems are under continuous pressures from the focus companies with respect to prices, quality, and delivery time. Therefore, by combining the system outcomes of both groups we cannot measure the system benefits obtained by each group correctly. Second, the measures of system success adopted in the previous researches have shortcoming in measuring the SCM success. User satisfaction, system utilization, and user attitudes toward the systems are most commonly used success measures in the existing studies. These measures have been developed as proxy variables in the studies of decision support systems (DSS) where the contribution of the systems to the organization performance is very difficult to measure. Unlike the DSS, the SCM systems have more specific goals, such as cost saving, inventory reduction, quality improvement, rapid time, and higher customer service. We maintain that more specific measures can be developed instead of proxy variables in order to measure the system benefits correctly. The purpose of this study is to find the determinants of SCM systems success in the perspective of vendor companies. In developing the research model, we have focused on selecting the success factors appropriate for the vendors through reviewing past researches and on developing more accurate success measures. The variables can be classified into following: technological, organizational, and environmental factors on the basis of TOE (Technology-Organization-Environment) framework. The model consists of three independent variables (competition intensity, top management support, and information system maturity), one mediating variable (collaboration), one moderating variable (government support), and a dependent variable (system success). The systems success measures have been developed to reflect the operational benefits of the SCM systems; improvement in planning and analysis capabilities, faster throughput, cost reduction, task integration, and improved product and customer service. The model has been validated using the survey data collected from 122 vendors participating in the SCM systems in Korea. To test for mediation, one should estimate the hierarchical regression analysis on the collaboration. And moderating effect analysis should estimate the moderated multiple regression, examines the effect of the government support. The result shows that information system maturity and top management support are the most important determinants of SCM system success. Supply chain technologies that standardize data formats and enhance information sharing may be adopted by supply chain leader organization because of the influence of focal company in the private industrial networks in order to streamline transactions and improve inter-organization communication. Specially, the need to develop and sustain an information system maturity will provide the focus and purpose to successfully overcome information system obstacles and resistance to innovation diffusion within the supply chain network organization. The support of top management will help focus efforts toward the realization of inter-organizational benefits and lend credibility to functional managers responsible for its implementation. The active involvement, vision, and direction of high level executives provide the impetus needed to sustain the implementation of SCM. The quality of collaboration relationships also is positively related to outcome variable. Collaboration variable is found to have a mediation effect between on influencing factors and implementation success. Higher levels of inter-organizational collaboration behaviors such as shared planning and flexibility in coordinating activities were found to be strongly linked to the vendors trust in the supply chain network. Government support moderates the effect of the IS maturity, competitive intensity, top management support on collaboration and implementation success of SCM. In general, the vendor companies face substantially greater risks in SCM implementation than the larger companies do because of severe constraints on financial and human resources and limited education on SCM systems. Besides resources, Vendors generally lack computer experience and do not have sufficient internal SCM expertise. For these reasons, government supports may establish requirements for firms doing business with the government or provide incentives to adopt, implementation SCM or practices. Government support provides significant improvements in implementation success of SCM when IS maturity, competitive intensity, top management support and collaboration are low. The environmental characteristic of competition intensity has no direct effect on vendor perspective of SCM system success. But, vendors facing above average competition intensity will have a greater need for changing technology. This suggests that companies trying to implement SCM systems should set up compatible supply chain networks and a high-quality collaboration relationship for implementation and performance.

  • This article examines the features of improving the public management of the market of medical and social services using information technology to improve the efficiency of public activity in modern conditions. The interpretation of the essence of the categories "information technologies" and "information support" is analyzed. The importance of the organization of information support of public authorities in the insurance of the state apparatus of information management for the adoption and solution of state issues of the market of medical and social services has been studied. Issues and system of information support of public management of the market of medical and social services are considered. The stages of the ICT implementation process in the market of medical and social services are described. The tools of state regulation in the market of medical and social services and the introduction of targeted programs for the development of the social sphere and health care are highlighted. Recommendations for improvement are formulated public management of the market of medical services and social way introduction of ICT tools, which provide for the implementation of a set of measures aimed at intellectualizing the entire system public data management spheres. The necessity of development of innovative tools of public management of the market of medical and social services of Ukraine for the purpose of working out of strategies of increase of quality of medical and social services in the XXI century is substantiated. A number of benefits from the implementation of an effective process of application of information support of public management of the market of medical and social services to ensure the efficiency of public authorities of Ukraine. It is proposed to create a "Department of information support of self-government" and electronic health care system (e-Health) to improve the management decision-making process, which will provide an opportunity to accumulate, process, analyze, and as a result, get the expected effect in the form of balanced management decisions by public authorities of Ukraine.

  • The pandemic, which came unannounced, has caused people to feel the limitations of physical books and spaces, and discussions on library digital capabilities and sustainable library services are spreading. The e-book service of public libraries is at the stage of expanding to the autonomous district level and seeking to revitalize the service. In this study, a user satisfaction survey was conducted on the Gangdong district Library in Seoul to identify the current status of public library e-book services and suggest improvement measures. Based on the analysis results, improvement measures were derived in three aspects: expanding e-book content, strengthening user support services, and improving the e-book system management system.

  • This study aims to derive practical suggestions to apply application methods by auxiliary costs, especially application of logistics and customs clearance areas in order to establish EPS support system of auxiliary cost occurred from export/import. For the propose, this study has analyzed types and situation of auxiliary costs, application method by auxiliary costs, payment situation of logistics auxiliary costs and clearance auxiliary costs and suggested the relevant problems and their application methods. Especially, in case of logistics auxiliary costs through connection to the attached general documents required for negotiation by reflecting characteristics of B2B transactions. In addition, it has suggested that those services by the said system should be conveniently used commonly by the export companies and logistics companies through provision of various payment measures, support of foreign currency payment, etc. and security of reliability/system stability, etc. for the compatible payment with other systems as the prerequisite for the successful settlement of the auxiliary costs EPS. It is expected that satisfaction of the uTradeHub users such as export/import companies and logistics companies will be increased, user-oriented customized information services such as raw cost prediction service through calculation of auxiliary costs could be available in the future and efficiency of work processes related to auxiliary costs will be increased, by providing the EPS through various single window based payment measures through establishment of the export/import auxiliary costs payment system.

  • The typical missions for the current stand-off UAVs are surveillance and reconnaissance. On the other hand, the primary mission for the future UCAS will be combat mission such as SEAD under the man-made ultimately hostile environment including SAM, antiaircraft artillery, threat radar, etc. Therefore, one of the most important challenges in UCAS design is improvement of survivability. The current studies for aircraft combat survivability are focused on the improvement of susceptibility and vulnerability of manned aircraft system. Although the survivability design methodology for UCAS might be very similar to the manned combat system but there are some differences in mission environment, system configuration, performance between manned and unmanned systems. So the parameters and their sensitivities which affect aircraft combat survivability are different in qualitatively and quantitatively. The susceptibility related parameters for F-16 C/D and X-45A as an example of manned and unmanned system are identified and the susceptibility parameter sensitivities are analyzed by using Monte-Carlo Simulation in this study.

A Study on the Strategy of Resolving Impediments to Use of Digital Resources : The Case of Korean Public Libraries

  • In this study, users' perceptions and concerns about digital information resources were investigated, focusing on impediments to the use of digital resources, to devise measures for improvement by identifying factors that hinder the use of digital information resources. To achieve the purpose of the study, the research identifies the inconvenien ce factors and establishes the user inconvenience list based on prior research and the current status survey. Based on the derived list, a survey was conducted on users of public libraries. Through this study, it was found that the use of digital information resources can be enhanced by improving the internal library system. Specifically, it refers to improving search performance and accessibility of digital data, providing one-stop services for digital information resources through the operation of an integrated data management system, conducting customized user education, and establishing a digital information resource preservation system, e.g. web archiving. Also, improving the external environment and system, such as contracting with more libraries for digitized data use agreements, strengthening support, unifying the names and classifications of digital information resources, and simplifying the procedure for using digital information resources, is of great importance.

  • A smart meter is a kind of electronic meters that measures and records consumption of electric energy in intervals of an hour or less and transmits that information to the remote places. AMI provides two-way communication path between utilities and consumers and should be able to support smart grid's new functionalities such as demand-response actions and real time pricing. The main objective of this paper is to provide a new diagnosis method and system for testing of smart meters in AMI neighborhood area network.

  • A safety management system is a information system. This system finds out hazards which could occur during safety management activities, and analyze and evaluate their natures, and then plan to take measures. Therefore accidents could be prevented. To establish the information system, robust architectures are required. A purpose of this research is to derive procedure of establishment in relation to developing safety management systems, which is needed to be advanced. To accomplish it, we reviewed a movement of architectures to establish electronic information and a movement of technology development And then we led definitions of requirements and architectures development process from those that are based on review of the trends.
